TERMS AND CONDITIONS
PARTICIPATION
Information on how to enter the Fisherman's Friend: Win 1 of 5 Ultimate Reef Adventures Promotion (Promotion) and the prizes form part of these Terms and Conditions. By participating, Entrants (as defined below) agree to be bound by these Terms and Conditions. Promotion is not valid in conjunction with any other special, discount or promotional offer unless indicated otherwise.
Entry is only open to Australian residents aged 16 years or over (Entrants). Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion. Certain elements of the Major Prize (defined below) are subject to conditions, including weight and health restrictions (see clause 23 for further details).
Employees (and the immediate families) of the Promoter, participating retailers of Fisherman's Friend products and agencies associated with this Promotion are ineligible to enter. The promoter is Stuart Alexander & Co Pty Ltd (ABN 43 000 058 677) of Level 3, 1 Smail Street, Ultimo, NSW 2007 Australia (Promoter).
The Promotion commences on 18th April 2016 at 12:01am AEST and entries close at 11:59pm AEST on 11th July 2016 (Promotional Period).
ENTRY
To enter the Promotion, Entrants must, during the Promotional Period:
Purchase any one (1) pack of Fisherman's Friend, during the Promotional Period, at any participating retailer (Qualifying Purchase). Participating retailer means any supermarket or convenience store that stocks Fisherman's Friend products nationally, including but not limited to IGA, Supa IGA, Foodland and Foodworks but excluding all Coles, Woolworths/Safeway and Aldi branded supermarkets and/or convenience stores e.g. Coles Express and Woolworths Petrol; and then
submit a valid entry form in accordance with clause 6 below.
To submit a valid entry form, Entrants must visit the promotional entry platform at
www.winwithfishermansfriend.com.au (Promotional Entry Platform). Entrants must then fully complete the entry form on the Promotional Entry Platform as requested including but not limited to entering their details and the last four (4) digits of the eligible product barcode and follow the prompts to submit the entry form online so that it is received during the Promotional Period.
Multiple entries permitted, subject to the following: (a) only one (1) entry submission and entry permitted per Qualifying Purchase; (b) each entry form must be submitted separately and in accordance with the entry requirements; (c) unrecognised barcodes will be deemed invalid; and (d) maximum of one (1) entry per Entrant per day is permitted, regardless of the number of Fisherman's Friend products purchased by an Entrant in a single transaction or over multiple transactions on any one day.
All entries must be received by the Promoter during the Promotional Period. Entries received before the start of the Promotional Period or after the close of the Promotional Period will not count towards the Promotion and will be regarded as invalid. Records of the Promoter are final and conclusive as to time of receipt. Incomplete, illegible or indecipherable entries will be deemed invalid.
Entrants can only enter in their own name. The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant's identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
If there is a dispute as to the identity of an Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Entrant.
For each entry, Entrants must retain the original purchase receipt(s) for each Fisherman's Friend product used to enter the Promotion. The original purchase receipt(s) must clearly show each Fisherman's Friend product was purchased during the Promotional Period but before the date of entry, and the participating retail outlet where each Fisherman's Friend product was purchased. Failure to produce the original purchase receipt for an entry when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an Entrant's entries and forfeiture of any right to a prize.
PRIZES AND DRAWS
Instant Win Prizes
There are a total of thirty (30) prizes to be won instantly during the Promotional Period (Instant Win Prize). Instant Win Prizes will be awarded randomly during the Promotional Period. Entrants will be notified in writing immediately on screen, upon submitting a valid entry form, in accordance with clauses 5 and 6 above, whether they have won an Instant Win Prize and their names will be published at
www.winwithfishermansfriend.com.au from 20th July 2016.
All valid entries received will be automatically placed in the draw for the Major Prize (as defined below), irrespective of whether they are also an Instant Win Prize winner.
Each Instant Win Prize will consist of AU$50 cash, to be transferred via EFT into each Instant Win Prize winner's nominated bank account. Upon receiving the Instant Win Prize notification, Instant Win Prize winners must click on the 'Redeem Cash' button to redeem their Instant Win Prize. Instant Win Prize winners will then be directed to a secure page and instructed to provide their EFT details. If an Instant Win Prize winner does not have a bank account, the AU$50 cash will be awarded in the form of a cheque in the Instant Win Prize winner's name as it appears on the winning entry form.
Total Instant Win Prize pool value is AU$1,500.00.
The Promoter will not, to the fullest extent permitted by law, take any responsibility for any Instant Win Prizes being lost and/or transferred to an inaccurate/incorrectly provided bank account or cheque sent to an inaccurate/incorrectly provided address.
If any Instant Win Prizes are not awarded during the Promotional Period or remain unclaimed as at 11:59pm AEDST on 11th October 2016 (Remaining Instant Win Prizes) then a draw for those Remaining Instant Win Prizes will take place at 3:00pm AEDST on 12th October 2016 at Anisimoff Legal, Level 5, 492 St Kilda Road, Melbourne, VIC 3004 subject to any directions from a regulatory authority. The winner/s, if any, will be notified in writing by email within two (2) business days of the draw and their names will be published online at

The email will contain a link to a secure page where Remaining Instant Win Prize winners, if any, will be instructed to provide their EFT details. If a Remaining Instant Win Prize winner does not have a bank account, the AU$50 cash will be awarded in the form of a cheque in the Remaining Instant Win Prize winner's name as it appears on their winning entry form.
By participating in this Promotion, Entrants consent to the Promoter making a payment into their nominated bank account by EFT transfer. The Promoter, in its discretion, reserves the right to refuse the award of an Instant Win Prize if an Instant Win Prize winner declines to provide their bank account details, or the details required to enable the Promoter to deliver the Instant Win Prize by cheque.
Instant Win Prizes must be claimed prior to 11:59pm AEDST on 11th October 2016 by following the instructions referred to in clause 14, and Remaining Instant Win Prizes must be claimed prior to 11:59pm AEDST on 13th November 2016.
Major Prizes
The draw for the Major Prizes (as defined below) will take place at 10:00am AEST on 14th July 2016 at Anisimoff Legal, Level 5, 492 St Kilda Road, Melbourne, VIC 3004. Anisimoff Legal on behalf of the Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible Entrant is drawn. The winners of the Major Prizes (Major Prize Winners) will be notified by email within two (2) business days of the draw and their names will be published online at

The Major Prize Winners must follow the instructions set out in the winner notification email referred to in clause 20 and respond by 9:59am AEDST on 14th October 2016 in order to claim their prize.
Entries will be split into the following five (5) State/Territory groups (State Group) for the purpose of the Major Prize Draw:

The first valid entry drawn per State Group in the draw for the Major Prize (as defined below) will each win an Ultimate Reef Adventure for two (2) people, valued at up to AU$3,420 (Major Prize) each depending on the dates in which the prize is taken and the point of departure. Acceptance of the Major Prize is subject to the Major Prize Winner (and their companion), at all times, abiding by the conditions set out in these Terms and Conditions. Each Major Prize consists of:
return economy class airfares for two (2) people from the winner's nearest Australian capital city to Cairns, QLD (only provided if winner does not reside in or is in close vicinity of Cairns as determined by the Promoter in its absolute discretion). If the winner's closest airport from which commercial domestic flights depart is Cairns Airport, the Promoter may in its absolute discretion, award the winner with alternative travel arrangements. If alternative travel arrangements are not provided in accordance with the terms of this clause, then this component of the prize is forfeited and is not redeemable for cash;
all airline and airport taxes (if flights are awarded);
two (2) nights' accommodation in a 3.5 star hotel in either a twin share or double room in Cairns, QLD, (with exact hotel to be selected and booked by the Promoter's at its discretion);
Daily breakfast for two (2) people (exact breakfast menu to be determined by the Promoter);
return private transfers from Cairns airport to the hotel for two (2) people (only provided if return airfares to Cairns Airport are also provided to the winner); and
Winner's choice, subject to the limitations outlined below, of one (1) of the following 'Action Seeking Adventure' activities (Action Seeking Adventure), for two (2) people. The winner may select only one (1) of the following options for their Action Seeking Adventure in accordance with the individual conditions and any applicable restrictions of each Action Seeking Adventure (as outlined below):
Option 1: Full-Day White Water Rafting including BBQ Lunch. Participants in this option must be a minimum of 13 years of age at the time that this Action Seeking Adventure is taken. Rafting is not suitable for anyone who is pregnant. For safety, the winner and/or their companion will not be permitted to raft if the prize supplier detects that they are under the influence of drugs or alcohol and no refund will be given. Winner/s and/or their companion/s who have a medical condition and/or are unsure if they are physically able to participate in the rafting activity are recommended to consult with a medical practitioner prior to booking or selecting this option; or
Option 2: A 30-minute Flyboard experience. Participants in this option must be a minimum of 16 years of age at the time that this Action Seeking Adventure is taken; or
Option 3: A Rainforest Adventure Tour by Hummer: Participants in this option must be a minimum of 4 years of age. This Action Seeking Adventure is limited to twenty (20) people at a time.; or
Option 4: Great Barrier Reef Diving and Snorkelling adventure. Participants in this option must comply with the following restrictions and conditions: (a) All intending divers over the age of 65 years must provide a current Diving Medical certificate; (b) Children aged 12 years and under are not permitted to participate in onboard diving activities as per Queensland Australian Law; (c) Children under the age of 18 years must be in the immediate company of a parent or legal guardian; (d) Evidence of dive certification is required from all divers wishing to participate in a certified dive; (e) Diving within twenty-four (24) hours before a flight is not permitted; and (f) All participants will be required to complete a health/medication questionnaire prior to diving. Some pre-existing medical conditions (e.g. asthma, heart & lung conditions etc.) and prescribed medications may prevent the winner and/or their companion from diving. The winner and their companion are advised to consult a medical practitioner before selecting/booking this option; or
Option 5: The Minjin Swing experience. Participants in this option must comply with the following weight restrictions: (a) minimum solo swing weight is 120 pounds (55 kilograms); (b) maximum swing weight per person is 330 pounds (150 kilograms); and/or (c) maximum combined swing weight of 530 pounds (240 kilograms) for two (2) or three (3) people; or
Option 6: A Cairns Bungy Jump. Participants in this option must be: (a) a minimum of 10 years of age at the time that this Action Seeking Adventure is taken; and (b) a minimum weight of 100 pounds (45 kilograms) to participate in this activity; or
Option 7: A Cairns Skydive. Participants in this option must be: (a) a minimum of 12 years of age at the time that this Action Seeking Adventure is taken (if the winner or their companion is under the age of 18, then that individual must be accompanied by a parent/guardian); and (b) a maximum weight of 253 pounds (110kgs) to participate in this activity. A surcharge will apply for persons 209 pounds (95kgs) or more; payable by the Major Prize Winner or their travel companion.
If, for any reason, a Major Prize Winner does not take the Major Prize (or an element of the Major Prize) by the time stipulated by the Promoter, then the Major Prize (or that element of the Major Prize) will be forfeited and cash will not be awarded in lieu.
For the avoidance of doubt there will be a total of five (5) Major Prizes, one (1) per State Group and each for up to two (2) people, drawn as part of this Promotion.
Each Major Prize Winner and their companion must book the Major Prize a minimum of forty-five (45) days in advance of requested departure dates and by no later than 14th January 2017. Travel must be completed by no later than 11th July 2017. No exceptions permitted. All travel is subject to availability at all times and maybe dependent on additional conditions, including but not limited to select seat class with airlines or specific room category availability with accommodation partner. If the Major Prize Winner cannot travel in accordance with these Terms and Conditions, the Major Prize will be forfeited. If, for any reason, the Major Prize Winner does not take an element of the Major Prize during the stated period, and on the conditions stipulated by the Promoter or any third parties, then that element of the Major Prize will be forfeited and cash will not be awarded in lieu of that element of the Major Prize.
Spending money, excess baggage costs, meals, taxes (excluding airport and airline taxes), travel insurance, transport to and from the airport departure point in each Major Prize Winner's nearest capital city, any additional transfers other than those referred to in the Terms and Conditions, items of a personal nature, in-room charges, vaccinations and all other ancillary costs are not included in the Major Prize. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the Major Prize. The Major Prize is subject to the standard terms and conditions of individual Major Prize service providers. The Major Prize Winners may be required to present their credit card at time of accommodation check in as a security measure for any charges incurred during the stay over and above the cost of accommodation.
The Major Prize Winner acknowledges, and must ensure that each companion acknowledges, that elements of the Major Prize may be subject to additional terms and conditions imposed by third party prize suppliers, including booking conditions, fare rules including any amendment fees, baggage restrictions, conditions of carriage, codes of conduct and any standard restrictions or participation conditions in addition to those outlined above in clause 23. The Major Prize Winners and their companions must become acquainted with any such additional terms and conditions before taking the Major Prize. The Promoter does not accept any responsibility, and is not liable for, any additional conditions imposed by third party service providers on the taking of the Major Prize, or for the breach of those conditions by any person and the consequences, which may follow.
The Major Prize Winners and their companions are responsible for their own travel to and from their nominated departure point, and must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in agreement with the winner but in the event that agreement cannot be reached, the Promoter reserves the right to determine the itinerary. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers.
The Major Prize Winners and their companions are responsible for any amendment fees issued by airlines or suppliers once booking is confirmed and ticketed. The Promoter recommends that each Major Prize Winner and their companion obtain travel insurance.
To the extent permitted by law, the Promoter is not responsible for and cannot be held liable for any element of the Major Prize which is cancelled or delayed, or where the location is changed, or any other occurrence which is out of the reasonable control of the Promoter.
The Major Prize Winners of the Action Seeking Adventure ("Activity") and their companion's acknowledge that the Activity can be dangerous and could potentially result in injury or death, and participate at their own risk. The Major Prize Winners and their companions must: (a) attend, undergo and pass any appropriate training, briefings, required medical tests and other requirements of the Promoter and Activity organisers as determined by them in their absolute discretion; (b) not have any heart condition or history thereof, or other medical conditions that would make it dangerous to participate in the Activity; (c) not be under the influence of drugs or alcohol when they redeem the prize; (d) comply with all directions of the Promoter and Activity organisers at all times; and (e) wear all safety and other equipment required. The Promoter and Activity organisers, in their absolute discretion, at all times reserve the right to: (a) prevent any Major Prize Winner or their companions from participating in the Activity if, at any time, they reasonably believe that the Major Prize Winner or their companions pose a safety risk to themselves or to others or for any other reason; and/or (b) cancel the Activity if the conditions are deemed dangerous. If the Activity is varied for any reason beyond the control of the Promoter it may not be rescheduled and no compensation will be offered.
During the entire duration of the Major Prize, a nominated parent/guardian must accompany, and will be responsible for, any person under 18 years of age.
Draw(s) for any unclaimed Major Prize(s), may take place on 14th October 2016 at the same time and place as the original Major Prize draw, subject to any directions from a regulatory authority. GENERAL
The total prize pool for this Promotion is up to AU$18,600.
The Promoter's decision is final and no correspondence will be entered into.
Prizes are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
If a prize (or an element of the Major Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that element of the Major Prize) with another prize of equal value and/or specification, subject to any written directions from a regulatory authority.
If for any reason a winner does not take a prize (or an element of the Major Prize) by the time stipulated by the Promoter, then the prize (or that element of the Major Prize) will be forfeited and will not be redeemable for cash.
In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.
Entrants who win a prize consent to the Promoter using their name, likeness, image and/or voice (including photograph, film and/or recording of the same), in any media, for an unlimited period and without remuneration, for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter (including but not limited to technical difficulties, unauthorised intervention or fraud), the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
Any cost associated with entering the Promotion, or accessing the Promotional Entry Platform is the Entrant's responsibility.
Printing and other quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised total prize pool will be honoured. Any unclaimed Instant Win Prizes that are part of the advertised total prize pool which are not awarded as Instant Win Prizes will be awarded in the unclaimed prize draw set out in clause 17.
Any documentation associated with a prize, including instant win game materials, tickets and vouchers, are void if stolen, forged, mutilated or tampered with in any way.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Entrant; or (f) taking of or participation in a Major Prize or taking/use of an Instant Win Prize.
As a condition of accepting a Major Prize, the Major Prize Winner (and their companion), must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. In the event a Major Prize Winner's companion is under the age of 18, a nominated parent/legal guardian of such person will be required to sign the legal documentation required under this clause on their behalf.
The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such personal information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on Entrants providing their personal information. The Promoter will collect, store, use and disclose personal information as set out in its Privacy Policy, which can be viewed at

In addition to any use that may be outlined in the Promoter's Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the personal information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Entrant. The Privacy Policy also contains information about how Entrants may opt out, access, update or correct their personal information, how Entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant's personal information to any entity outside of Australia.
Participation in the Promotion is dependent on Entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities. These can be viewed at
