8 Night South Pacific Cruise Competition 2016 Details of Participation

Information on how to enter this competition forms part of these Terms and Conditions.   Entry into the competition constitutes acceptance of these Terms and Conditions.

Competition period:

The competition commences on 1 June 2016 and closes at 11:59pm on 30 April, 2017. All references to times are to New South Wales time.

How to enter:

There is no charge for entering this competition and no purchase is necessary to enter or redeem prizes.

To enter the competition, Entrants must go to the competition website via the URL supplied - https://tool.yourleadengine.com/domains/load_page/click_data/8NSPCC2-20562/8NSPCC-94886/home and follow the prompts to register their details including first name, surname, email address and telephone numbers. To enter the competition Entrants must also complete a short survey to gather demographic, lifestyle and product related information relating to a varying range of goods and services.

All Entrants who register their details and complete the survey during the competition period will receive one entry in the draw to win their choice of a 8 Night South Pacific Cruise in a balcony room for 2 with an onboard credit of $200 sailing on the Pacific Aria or a $4000 cash prize (see Prize Details below).

Entrants will have the opportunity to receive additional entries by sending information about the competition to their friends using the functionality provided on the website. For each friend Entrants refers who enters the contest the Entrant will receive one further entry in the competition.

Eligibility:

Entrants must be 18 years of age or over and an Australian resident to be eligible to enter this competition.

Entrants are not eligible to enter this competition if they are an employee, or an immediate family member of the Promoter, Marketing Tactics Pty Ltd, Sierra Marketing Pty Ltd or any Designated Promotional Partner, their affiliated companies or their related bodies corporate (as defined in the Corporations Act).  For the purpose of these Terms and Conditions a Designated Promotional Partner is the entity, contracted with the Promoter as a Promotional Partner, and provided with a unique website URL for the purpose of this competition through which the Entrant participates in this competition.

Prize details:

The Winner of the cruise prize will receive their choice of a 8 Night South Pacific Cruise with P&O Cruises Australia aboard the Pacific Aria for 2 adults in a balcony room (RRP $4,298) with a $200 onboard credit  or $4000 cash.  The cruise is for 8 nights, departing Sydney New South Wales Australia 16 November 2017 and concludes at Sydney New South Wales Australia 24 November 2017 cruising the South Pacific and stopping at Noumea, Lifou and Mare in New Caledonia.  Itinerary is subject to change without notice.

The Winner is responsible for their own transfers to and from Sydney, New South Wales. The Promoter accepts no responsibility should the Winner fail to board the cruise prior to its departure or is prevented from boarding through failure to comply with any passport or visa requirements.

Cruise inclusions: Shipboard accommodation, ocean transport, entry to all bars, pubs and nightclubs, most meals, some beverages and most onboard entertainment. Full board accommodation, on board main meals, entertainment* fitness centre, port charges and taxes.

*A charge may be made for certain entertainment/leisure facilities or activities.

Not Included: Air transport and items of a personal nature such as shore & land excursions, specialty restaurant fees, drink purchases, photographs, tips/service fees, medical services, etc. are the responsibility of the prize winner.

~ Tax and duty free shopping is not available on Australian coastal cruises except Queensland cruises featuring Willis Island.
^Due to gambling restrictions the casino does not operate on some cruises departing from Fremantle.
**Waterfront Restaurant is closed for lunch on some port days.
+The Pantry is only available on Pacific Jewel, Pacific Aria and Pacific Eden.

The cruise prize does not include flights, departure taxes or airport improvement taxes, transfers to/from the ship; shore excursions and personal expenses (for example, onboard drinks, laundry charges, health and beauty treatment, telephone calls etc), speciality dining venues on board (unless otherwise stated); transfers by any method if not travelling on the standard departure date(s); travel insurance, anything else which is not specially mentioned as being included in the prize.

Room Details: Room type is a Balcony Room (BE Room Category) with twin beds that can convert into queen-size, private balcony with outdoor furniture, Private ensuite featuring spa bath, Flat screen TV, Telephone, Wardrobe, desk with chair, Safety deposit box, Air-conditioning with personal controls.

Please note: Fridges are not available in Balcony Rooms on Pacific Aria. Smoking is not permitted inside any room on board Pacific Aria. Smoking is only permitted in designed smoking areas.

The cruise is subject to its own Terms and Conditions, set by the travel agent Our Vacation Centre and by the cruise operator.  See the end of these Terms and Conditions for Our Vacation Centre’s General Terms and Conditions for Travel Bookings (current as at May 2016).

If the Winner selects the cash prize, the money will be presented by bank account transfer to the Australian bank account nominated by the Winner within 28 days of the draw. 

The actual odds of winning will depend on the number of Entrants.

Prizes may not be redeemed for cash except for as provided in these Details of Participation.

All figures are retail estimates only and are current as at May 2016. All monetary values are in Australian currency and include GST where applicable.

The total prize pool is a minimum of $4,000 and a maximum of $4,298 (where there is a choice of prizes, the highest value is adopted).

Draw information:

The draw for the cruise/cash prize will take place on 1 May 2017 at 2pm New South Wales time at the Promoter's offices, Paramount House Upper Ground, 55 Brisbane Street, Surrey Hills, NSW 2010 via a random manual drawing process. The details of all Winners will be notified by telephone within 24 hours of the draw and in writing via email and details of all Winners will be published in The Australian newspaper on 10 May 2017. The Winner must select whether they choose the cruise or cash prize and advise the Promoter by 8 May 2017  as the Promoter is obliged to provide the Winner’s details to the cruise line by the middle of May 2017.

If the cruise/cash prize is unclaimed, an unclaimed prize draw will be conducted on 1 June 2017 at 2pm New South Wales time at the Promoter's offices, Upper Ground, 55 Brisbane Street, Surrey Hills, NSW 2010.  As the Winner’s details need to be provided to the cruise line by the middle of May 2017 if an unclaimed prize draw is needed the Winner will receive the $4000 cash prize alternative in lieu of the cruise.  The Winner of any unclaimed prize draw will be notified by telephone within 24 hours of the draw and in writing via email and details of the Winner will be published in The Australian newspaper on 15 June 2017.

General provisions:

The Promoter, in its absolute discretion, reserves the right to verify the validity of the claims and to disqualify any Entrant who tampers with the entry process, submits a claim that is not in accordance with these Terms and Conditions, or who abuses the bonus entry option by forwarding competition referrals contrary to anti-spam guidelines on the competition website.

The Promoter reserves the right to resolve any and all discrepancies, disputes or unforeseen circumstances as it deems fit subject to relevant State legislation, and State permit regulations.  The Promoters decision is final and no correspondence will be entered into.

Neither the Promoter nor any of its agents are responsible for lost, late, delayed, damaged, misdirected, incomplete, ineligible or incorrectly submitted entries.

If for any reason this promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right, in its sole discretion, to take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any direction given under the relevant State legislation, and State permit regulations.

In event that the cruise is cancelled the Promoter will give the Winner the cash prize in lieu of the cruise subject to any direction given under the relevant State legislation, and State permit regulations.

The Promoter shall not be liable for any loss or damage whatsoever that is suffered by any Entrant or Winner, including but not limited to indirect or consequential loss, or for any personal injury suffered or sustained as a result of participating in this competition or taking any prize, save where such liability cannot be excluded by law.

Privacy Statement:

The information on the entry form is being collected by the Promoter and Designated Promotional Partners for the purposes of the advertised competition and utilisation by the Promoter and Designated Promotional Partners for marketing and promotion of their respective goods and services. The Promoter and Designated Promotional Partners may also disclose information collected from entry forms to its related entities, affiliated suppliers or contracted third parties for their marketing purposes.

All Winners details will be disclosed to the parties with whom the Promoter has contracted to provide the advertised prize, for example, Winner’s details may be disclosed to the owner and/or operator of the cruise.

All Entrants give the Promoter and Designated Promotional Partners their express and indefinite consent to contact them by telephone or electronic messages for promotional purposes. Although Our Vacation Centre (OVC) takes all care in informing clients of the most up to date and correct information it remains the responsibility of clients to ensure they are familiar with all terms and conditions relating to individual travel products, visa and immigration, health and customs requirements associated with their travel.

Following is an overview of general items for you to consider in relation to your travel, however the overview may not be absolute in its content and clients must thoroughly check all details in regard to their travel plan. OVC are happy to assist you in regard to any clarifications or other information you require.

1. VISAS AND PASSPORTS ARE THE RESPONSIBILITY OF THE CLIENT

2. PASSPORTS MUST BE VALID FOR 6 MONTHS FROM RETURN DATE

3. IF YOU ARE NOT TRAVELLING ON AUSTRALIAN PASSPORT YOU MAY REQUIRE A RE ENTRY VISA.

4. ALL RESERVATIONS ARE MADE IN ACCORDANCE WITH CURRENT SCHEDULES. ANY CHANGE IN SCHEDULING OR DELAYS AND THE RESULTING IMPACT ON ARRANGEMENTS ARE NOT THE RESPONSIBILITY OF OUR VACATION CENTRE.

5. QUOTES ARE VALID FOR 7 DAYS EXCLUDING AIRFARES. AIRFARES ARE VALID AT THE TIME OF QUOTING ONLY

6. THE AMOUNTS DISPLAYED EXCLUDE ANY CREDIT CARD MERCHANT FEE SURCHARGES

7. PACKAGES, CRUISES AND FLIGHTS ARE SUBJECT TO CHANGE WITHOUT NOTICE AND SUBJECT TO AVAILABLITY

8. TERMS AND CONDITIONS APPLY TO ALL BOOKINGS. IT IS THE RESPONSIBILITY OF THE CLIENT TO REQUEST AND FAMILIARISE THEMSELVES WITH THE TERMS & CONDITIONS FOR THEIR PARTICULAR TRAVEL.

9. YOUR BOOKING MAY BE CANCELLED IF THE DEPOSIT AND/OR FINAL PAYMENT IS NOT RECEIVED BY THE REQUIRED DATE STIPULATED BY THE SUPPLIER.

10. IT IS THE RESPONSIBILITY OF THE CLIENT TO ENSURE BOOKING DETAILS ARE CORRECT AND ALL PASSENGER NAMES ARE CORRECT AND MATCH PASSPORTS. NAME CHANGES AND BOOKING CHANGES INCUR PENALTIES.

11. ALL GOVERNMENT FEES, PORT CHARGES, SURCHARGES AND TAXES ARE SUBJECT TO CHANGE WITHOUT NOTICE. THEY ARE NOT SUBJECT TO CHANGE ONLY WHEN FINAL PAYMENT IS MADE IN FULL AND TICKETS HAVE BEEN ISSUED.

12. CANCELLATION AND AMENDMENT FEES APPLY TO ALL BOOKINGS ONCE A DEPOSIT HAS BEEN RECEIVED.

13. IT IS THE RESPONSIBILITY OF THE CLIENT TO ENSURE THEY ARE AWARE OF THE LATEST TRAVEL ADVICE ISSUED BY THE AUSTRALIAN GOVERNMENT AND THE LATEST HEALTH INFORMATION FOR THE DESTINATIONS THEY ARE TRAVELLING. 14. OUR VACATION CENTRE STRONGLY RECOMMENDS THAT CLIENTS PURCHASE ADEQUATE TRAVEL INSURANCE COVER FOR THEIR DESTINATIONS
