Winter Seafood Promotion - Terms & Conditions of Entry
Winter Seafood promotion (the "Promotion") is a promotion conducted under the Other Benefits component of the Woolworths Rewards Program, as set out in the Woolworths Rewards Terms and Conditions.
1. Information on how to enter the Promotion and a description of the prizes that may be won in the Promotion form part of these Terms & Conditions of Entry. Participation in the Promotion constitutes acceptance of these Terms & Conditions of Entry. Entries not complying with these Terms & Conditions of Entry are ineligible and the Promoter reserves its absolute right to disqualify any Cardholder from the Promotion if the relevant entries do not comply with these Terms & Conditions of Entry. These Terms & Conditions of Entry will be displayed at woolworthsrewards.com.au for the duration of the Promotion.

2. Definitions within this Promotion:
Card means a Registered Woolworths Rewards card issued by the Promoter as part of the Woolworths Rewards Program.
Cardholde means a person who is Registered as a Woolworths Rewards cardholder.
Eligible Shopmeans any in store or online transaction at a Participating Store, in which you spend $15 or more on product(s) from the Seafood Department. Online transactions require a $30 minimum spend per order (excluding purchases of tobacco products, flowers, liquor, delivery saver products and delivery costs).
Participating Storesmeans any Woolworths supermarket in Australia (excluding Tasmania) promoting the Woolworths Rewards program, and the Woolworths Online store
www.woolworths.com.au.
Promotermeans a Registered Woolworths Rewards Card issued by the Promoter as part of the Woolworths Rewards Program;

Promotionmeans The Woolworths Rewards Winter Seafood promotion governed by these Terms & Conditions of Entry and conducted as a promotion under the Other Benefits component of the Woolworths Rewards Program.
Promotional Periodmeans 00.01 AEST on 15 June 2016 to 23.59pm AEST to 2 August 2016.
Registeredmeans that all mandatory cardholder information in respect of the legal name of the Cardholder has been correctly completed in the Woolworths Rewards database.
Seafood Departmentmeans all fresh, chilled, frozen and thawed seafood only products sold at a Participating Store. Excludes canned seafood and ready made meals.
Woolworths Rewards Terms and Conditions means the terms and conditions governing the Woolworths Rewards Program available at woolworthsrewards.com.au.
Requirements to enter and win prizes
3. All members who have Registered for the Woolworths Rewards Program and are a resident of Australia are eligible to enter the Promotion and win prizes, provided only that directors, management and employees of Salmat Digital Pty Ltd and of any of its agencies which are directly associated with the Promotion are ineligible to enter the Promotion or to win prizes. Entrants under 18 years of age must obtain approval from their parent or guardian before entering. By providing approval, a parent or guardian accepts these terms and conditions. If a winner is aged under 18, the Promoter reserves the right to liaise with the parent or guardian in relation to the prize, in its absolute discretion.
4. For the avoidance of doubt, holders of temporary Woolworths Rewards cards are not eligible to enter or win prizes, as temporary Woolworths Rewards cards are not Registered cards.
To Enter the Promotion
5. To enter the promotion:
a. Spend $15 or more on any product(s) from the Seafood Department in one (1) transaction at a Participating Store;
b. Online transactions require a $30 minimum spend per order (excluding purchases of tobacco products, flowers, liquor, delivery saver products and delivery costs).
c. Scan your Card (if shopping in-store) or enter your Card number and the Promotional Code SEAFOODWIN (if shopping online) at the checkout prior to finalising the transaction; and
d. Registered Cardholders will receive one (1) entry into the Promotion for every Eligible Shop of $15 or more on products in the Seafood Department purchased at any Participating Store during the Promotional Period.
Description of the prizes
6. There will be a total of five (5) Major Prizes, which shall be drawn as follows:
a. one (1) draw for entries received from Woolworths Rewards members who have a registered QLD mailing address as indicated by their Woolworths Rewards account. QLD prize pool valued at $32,394.20
b. one (1) draw for entries received from Woolworths Rewards members who have a registered VIC mailing address as indicated by their Woolworths Rewards account. VIC prize pool valued at $32,394.20.
c. one (1) draw for entries received from Woolworths Rewards members who have a registered WA mailing address as indicated by their Woolworths Rewards account. WA prize pool valued at $32,394.20.
d. one (1) draw for entries received from Woolworths Rewards members who have a registered SA OR NT mailing address as indicated by their Woolworths Rewards account. SA & NT prize pool valued at $32,394.20; and
e. one (1) draw for entries received from Woolworths Rewards members who have a registered NSW OR ACT mailing address as indicated by their Woolworths Rewards account. NSW & ACT prize pool valued at $32,394.20.
Total Major Prize draw value is $161,971.
7. The winner drawn for each Draw Pool will win a Major Prize which comprises one (1) Quintrex 481 Top Ender Side Console Boat, one (1) boat trailer (Model: TA1100S13SB) and one (1) Evinrude 60HP Motor. The 12 month registration period will commence at a date agreed by both the dealer and prize winner.
8. The Major Prize winners will be determined by an automated random draw of all valid entries. The Major Prize draw will take place at 10am AEST on Wednesday 17 August 2016 at Salmat Digital Pty Ltd, Level 2, 116 Miller Street, North Sydney, NSW 2060.
9. The first 1 valid entries randomly drawn in each draw as outlined in the description of prizes above (6a) will win a Major Prize. The winners will be contacted in writing within two (2) days of the draw. All Major Prize winners will have their names and state published on the Woolworths Rewards website at woolworthsrewards.com.au and in The Australian on Monday 22 August 2016. If any winning entry is invalid, that entry will be discarded and the Prize will be awarded by randomly drawing another entry in accordance with these Terms & Conditions of Entry.
10. There will be a total of 350 Minor Prizes. Each Minor Prize consists of $100 Woolworths Dollars. Total Minor Prize draw value is $35,000. For the Minor Prizes, there will be one (1) draw conducted for the entries received each week of the Promotional Period, for a total of seven (7) weekly draws (“Weekly Minor Prize Draws”). There will be a total of 50 winners per Weekly Prize Draw. Entries into each Weekly Minor Prize Draw will open and close on the dates and times outlined in the table below:

11. The Minor Prize winners will be determined by an automated random draw of all valid entries. Each Weekly Minor Prize Draw will take place at Salmat Digital Pty Ltd, Level 2, 116 Miller Street, North Sydney NSW 2060 10am AEST as per the table above. For the removal of doubt, no draws will be conducted during the weekend or on a public holiday in NSW, Australia. There is no limit on the number of entries that may be submitted per person during the Promotional Period, however, an eligible entrant will only be eligible to win one (1) Minor Prize per Weekly Minor Prize Draw regardless of the number of entries submitted by that person.
12. The Minor Prize winners will be contacted in writing within two (2) days of the draw. All Minor Prize winners will have their names and state published on the Woolworths Rewards website at woolworthsrewards.com.au as per the table above. If any winning entry is invalid, that entry will be discarded and the Prize will be awarded by randomly drawing another entry in accordance with these Terms & Conditions of Entry.
13. Ancillary costs associated with redeeming the prizes are not included and are the responsibility of the winners. For example, but not limited to, the Major Prize winners may incur costs such as further registration on expiry of the registration provided, transfer, fuel, oil and service costs, vehicle tow ball fittings, safety gear to comply with state and territory regulations, etc which must be born by the Major Prize winners. Further, and for the avoidance of doubt, it is the responsibility of the Major Prize winners to ensure their vehicle has sufficient towing capacity.
14. The Promoter will not be responsible for any further and associated costs after acceptance of the prize. On acceptance of the prize, the winner acknowledges that they may incur initial and ongoing costs associated with the prize which are the responsibility of the winner.
15. The collection of the Major Prize is the responsibility of the winner and the winner should allow at least 28 days from the date of the Major Prize draw for the availability of their prize. Each Major Prize will be delivered to the Quintrex selling agent in the central business district of the winner’s home state in Australia. The Promoter will arrange a date and time suitable for the collection of the Major Prize and advise the winner of the location that the prize must be collected from. Prize value is correct at time of printing but no responsibility is accepted for any variation in the value of the prize after that time.
16. Prizes are not transferable or exchangeable and cannot be redeemed for cash. The prize is subject to the standard terms and conditions of individual prize elements and service providers. Subject to the approval process required by any relevant gaming or lotteries authority, in the event that any prize (or part of any prize) is unavailable despite the Promoter’s reasonable endeavours to procure within Australia, the Promoter reserves the right to substitute a different prize item of equal or greater value and/or specification.
17. The total promotion prize pool value of the Promotion is $196,971 AUD.
How an unclaimed prize must be claimed
18. If a winner does not claim their prize within 3 months from the date and time of determination of that winner, their entry will be deemed invalid and the Promoter may conduct such further draws at the same place as the original draws as are necessary, subject to regulatory authority. The unclaimed prize draw will take place at 10am AEDT on Thursday 17 November 2016 at Salmat Digital Pty Ltd, Level 2, 116 Miller Street, North Sydney NSW 2060. In the event of an unclaimed prize draw, the prize winners will be contacted in writing within two (2) days of the draw. All prize winners of any subsequent draw will have their names and state/territory published on the Woolworths Rewards website at woolworthsrewards.com.au on Tuesday 22 November 2016. Any Major Prize unclaimed winners will also have their name and state published in The Australian on Tuesday 22 November 2016.
19. At the end of the lottery all existing claims to prizes and entitlements will be met notwithstanding the advertised prize pool having been exceeded.
20. The Promoter accepts no responsibility for any tax implications that may arise from the winning of the prizes. Independent financial advice should be sought.
21. The Promoter and its agencies and companies associated with this Promotion will not be liable for any loss (including but not limited to indirect or consequential loss), damage or personal injury which is suffered or sustained (including, without limitation, that caused by any person's negligence) relating to the Promotion or the awarding or taking of the prizes, except for any liability which cannot be excluded by law (in which case liability is limited to the minimum amount allowable by law). Neither the Promoter nor Salmat Digital Pty Ltd, nor their respective associated agencies and companies, is responsible for any incorrect or inaccurate information produced by the equipment or programming associated with or utilised in this Promotion, or for any technical error that may occur in the course of the administration of this Promotion or any omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries and winners.
22. Certain legislation may imply warranties or conditions or impose other obligations including statutory consumer guarantees which cannot be excluded, restricted or modified except to a limited extent. To the extent permitted by law, the Promoter excludes all guarantees, warranties, conditions or other terms that apply under or are implied by statute, common law or trade custom or usage.
23. If in the conduct of this Promotion the Promoter is liable for a breach of any guarantee, warranty, condition or other term that applies under the Australian Consumer Law or is implied by any other commonwealth, state or territory law that cannot by law be excluded, the Promoter's liability under that legislation is limited, to the extent permitted by law, to the cost of replacement of any benefit or prize won.
24. Any exclusion of implied terms, warranties, conditions or other terms and any limitation of liability available to the Promoter under clause 21 and 22 of these Terms and Conditions of Entry will also be available to and extend to such companies as are associated with this Promotion. The Promoter holds the benefit of these clauses on behalf of such companies associated with this Promotion.
25. The Promoter reserves the right to disqualify all entries from any Cardholder who is, or who the Promoter reasonable believes is, in breach of these Terms & Conditions of Entry or the Woolworths Rewards Terms and Conditions, or who manipulates, seeks to manipulate or benefits from manipulating, the entry process or the Promotion, or who has engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
26. The Promoter shall not be liable for the failure of the Promotion to run as planned, if the cause of such failure is beyond the reasonable control of the Promoter, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Promotion, and the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the Promotion, subject to any written direction given by regulatory authorities.
27. Printing errors or other quality control matters outside the control of individual players will not be used as the sole basis for refusing to award a prize.
28. The Promoter may use any personal information that a Registered Cardholder has provided to it for the purpose of running the Promotion, and also in advertisements, publications, media statements and other promotional material associated with the Promotion. For purposes of public statements and advertisements, the Promoter will only publish the winner’s surname, first initial and state of residence. The Promoter may disclose the information for those purposes to its related bodies corporate, agencies and contractors (including call centres, advertising agencies and direct mail houses) which the Promoter engages for that purpose. The Promoter is bound by the Australian Privacy Principles contained in the Privacy Act 1988 (Cth). A copy of the Promoter's privacy policy can be viewed at
www.woolworths.com.au. To request access to, or to update, personal information the Promoter holds about them, Cardholders can contact the Promoter in writing at
privacy@woolworths.com.au.
29. In the event there is a dispute concerning the conduct of the Promotion, the decision of the Promoter is final and no correspondence will be entered into.
