Instructions and information about how to enter form part of the Terms and Conditions of this Promotion. Participation in this Promotion is deemed to be acceptance of these Terms and Conditions. The Promoter is Boost Juice Pty Ltd ACN 092 165 681 (“Boost Juice”) with its principal place of business at Level 1, Tower 2, Chadstone Place, 1341 Dandenong Road, Chadstone, Victoria, 3148.
The Promotion will commence at 4:00am A.E.S.T. on 20 June 2016 and conclude by the close of business of participating stores on 24 July 2016 (“Promotional Period”). All entries must be submitted before 11:59 pm A.E.S.T. on 24 July 2016 (“Closing Date”).
Entry is open to Australian residents. Any entrant who is under the age of 18 years at the date of entry must obtain consent and prior permission from their parent or legal guardian to participate in this Promotion.
Employees, and the Immediate Families, of Boost Juice, its related entities, its suppliers, franchisees or other agencies or businesses associated with this Promotion (including Permitz Group Pty Ltd), are ineligible to enter the Promotion or to claim or redeem any Prize. “Immediate Family” means any of the following: spouse, ex-spouse, defacto spouse, and whether natural or by adoption: child or step child, parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
To the extent of any inconsistency between these Terms and Conditions and any other reference to this Promotion, these Terms and Conditions shall prevail.
HOW TO ENTER
To participate in this Promotion for the chance to win a Prize, a customer must:
during the Promotional Period, purchase a Finding Dory kids cup with a drink from any participating Boost Juice store (“Eligible Product”);
submit an entry online by following the links at boostjuicekids.com.au prior to the Closing Date of this Promotion, completing the mandatory fields on the entry form and submitting the unique code found underneath the Eligible Product;
notify the Boost Juice if the customer’s contact information changes before the date of the Second Chance Draw if the customer is eligible to participate in the Second Chance Draw; and
comply with all of the other requirements set out in these Terms and Conditions.
A customer may submit more than one entry, provided that only one entry is submitted for each purchase of an Eligible Product and that each entry is submitted separately and in accordance with these Terms and Conditions. Eligible Products only available while stocks last.
Every Eligible Entrant who submits an entry in accordance with clause 6 will receive a bonus gift of Kids Go Free Voucher to Sea Life.
Boost Juice shall not accept liability or responsibility for any entries that have not been received by Boost Juice before the Closing Date of the Promotion, or that are otherwise incomplete or incorrect in any way.
Entries which are partially or wholly incomplete, inaccurate, erroneous, ineligible or incomprehensible will automatically be deemed invalid.
NOTIFICATION OF WINNERS
All entries will have an equal chance of winning a Prize.
When a customer submits an entry online, they will be notified instantly if they win a Prize. The Prize (or where applicable, confirmation of voucher) will be posted to the address nominated by the Winner (or otherwise provided to the Winner) within 28 days.
Any winners of prizes of over $250 will be published online at boostjuice.com.au from 28 July 2016 for 28 days.
If a customer does not win a Prize, their entry will be included in the Second Chance Draw used to distribute Prizes awarded but unclaimed other than discount vouchers in accordance with clauses 14 – 16 below.
SECOND CHANCE DRAW
In the event that any Prize other than a discount voucher is not claimed before the Closing Date of this Promotion, Boost Juice will conduct a Second Chance Draw.
The Second Chance Draw will take place on 18 August 2016 at 11:00am A.E.S.T. at Boost Juice’s Head Office: Level 1, Tower 2, Chadstone Place, 1341 Dandenong Road, Chadstone, Victoria, 3148.
Boost Juice will use an electronic draw system licensed for use by Permitz Group Pty Ltd to conduct the Second Chance Draw from the remaining non-winning entries as the original promotion registered in accordance with clause 6. Boost Juice will use reasonable endeavours to notify the Prize Winners personally by telephone and in writing by email within 2 business days of the second chance draw. Winners of any prizes valued at more than $250 will have their names published online at boostjuice.com.au from 20 August 2016 for 28 days. Prizes will be posted to the address nominated by the Winner within 28 days of the Second Chance Draw.
PROOF OF ELIGIBILITY
Provision of a Prize will be subject to Boost Juice being satisfied that these Terms and Conditions have been complied with. Boost Juice reserves the right to request documentation to verify that the purchase of the Eligible Product was made within the Promotional Period.
If a customer is awarded a Prize and is then found to have breached these Terms and Conditions, they must immediately return the Prize, at their cost.
PRIZES ON OFFER
The Prizes on offer are those set out in the Schedule.
The total prize pool valued at up to $45,344.00 (incl. GST). All Prize values are in Australian dollars and correct at the time of printing. Any change in value of Prizes occurring between the publishing date and date the Prize is claimed is not the responsibility of Boost Juice.
Prizes must be taken as stated and in accordance with any terms specified by the Prize suppliers. Vouchers are subject to prevailing terms and conditions of use, including additional prize conditions set out in the Schedule. All winners of movie tickets are advised that the allocated classification guidelines for each film must be adhered to as per usual standards set out by the Australian Classification Board and any relevant laws.
Prizes are subject to availability, cannot be exchanged and are not redeemable for cash. If a Prize is unavailable, for whatever reason, Boost Juice reserves the right to substitute the Prize for a Prize of equal or greater value, subject to State and Territory legislation.
Prizes may be subject to expiry or use by dates. Winners must ensure they use any such prize in full by the date indicated.
GENERAL
Boost Juice is not responsible for Prizes damaged or lost in transit.
A Prize Winner may transfer a Prize to another person, provided that the person to whom the Prize is transferred consents to these Terms and Conditions being binding upon them.
Prizes cannot and must not be sold, scalped, auctioned, raffled, pledged or promoted as an incentive or reward by any third party as an inducement for any person or other entity to enter into any commercial or other arrangements with that third party. If any Prizes are obtained through any of these methods, those Prizes will not be honoured by Boost Juice or any Prize supplier.
Boost Juice’s decisions in relation to all aspects of the Promotion and matters pertaining to it are final and binding on each customer and no correspondence shall be entered into. A failure by Boost Juice to enforce its rights in any instance will not give rise to any claim or right of action by any other person.
Printing and other quality-control errors will not invalidate an otherwise valid Prize claim.
Boost Juice shall not be liable (including without limitation, in negligence) for any loss or claim, action, demand, liability, cost, expense or personal injury whatsoever (including but not limited to any direct, indirect or consequential loss) incurred, suffered or sustained by any person or entity (without limitation) in connection with, or arising from, the Promotion or the acceptance of the Prize, except that which cannot be excluded by law (in which case liability is limited to the maximum extent allowable by law).
Nothing in these Terms and Conditions limit, exclude or modify or purport to limit, exclude or modify the statutory consumer guarantees provided under the Competition and Consumer Act 2010 (Cth) where to do so would contravene that statute or cause any part of these Terms or Conditions to be void.
Boost Juice does not warrant that the participating stores will be open at all times during the Promotional Period. Access to boostjuicekids.com.au during the Promotional Period is dependent on the internet service provider. Boost Juice accepts no responsibility for any technical hardware or software failures of any kind resulting in an entry not being received.
Prize Winners agree to participate and co-operate in all editorial activities related to the Promotion where required, including but not limited to being interviewed and photographed. Prize Winners (and their companions) agree to granting Boost Juice a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide, including online social networking sites, and the Prize Winners (and their companions) will not be entitled to any fee for such use.
Boost Juice reserves the right to amend, cancel or suspend this Promotion if an event beyond the control of Boost Juice corrupts or affects the administration, security, fairness, integrity or proper conduct of the Promotion. Boost Juice will disqualify any individual who has tampered with the entry process or any other aspect of this Promotion. In particular, computer generated entries and the use “scripting” is not permitted and will not be accepted.
The personal information submitted by each customer on the online entry form will be used for this Promotion and for the purpose of informing that customer about the Boost Juice’s products, services and other promotions. Boost Juice may also give personal information to related companies, franchisees and contractors engaged to act on Boost Juice’s behalf. By entering this Promotion, each customer consents to having their personal information used in this way.
