LORNA JANE BALI COMPETITION TERMS AND CONDITIONS
Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
The promoter is Lorna Jane Pty Ltd (ABN 91 065 384 616) of 857 Kingsford Smith Drive, Eagle Farm QLD 4009, Australia (“Promoter”), parent company of Lorna Jane USA Inc.
Entry is only open to residents of Australia and legal residents of the Forty-Nine (49) States of The United States of America and the district of Columbia (excluding Rhode Island, Puerto Rico, All US Territories and Possessions and all overseas military installations) (“USA”) aged 18 years or over.
Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Promotion commences on 23 June 2016 and final entries close at 11:59pm Australian Eastern Daylight Savings Time (“AEDST”) on 3 August 2016 for Australian Group and at 11.59pm Pacific Standard Time (“PST”) for USA group on 3 August 2016 (“Promotional Period”).
To enter, individuals must visit
www.lornajane.com during the Promotional Period, follow the prompts to the promotion entry page, input the requested details (including their full name, state, postcode/zip, and a valid email address and phone number), provide an original and creative answer to the promotional question “How would you stay active in Balii?” in 25 words or less, agree to the Terms and Conditions and the Promoter’s Privacy Policy, and also agree to receive promotional/marketing material from Lorna Jane and Chandra Villas one of the prize suppliers, and Stage & Screen, by ticking the relevant tick box, and submit the fully completed entry form. Each entrant warrants to the Promoter that their entry is an original creative work of the entrant that does not infringe the rights of any third party. All content must comply with and is subject to the provisions contained in clause 20.
Incomplete or indecipherable entries will be deemed invalid. The Promoter is not responsible for any lost, late or misdirected entries
Only one (1) entry permitted per person.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
This is a game of skill and chance plays no part in determining the winners. Entries will be divided into the following two (2) groups based on the entrant’s country of residence: (1) Australia; (2) USA (each a “Group”). The entries received in each Group will be individually judged against all other entries based on the originality, literary merit and creative merit of the answer provided to the promotional question. Entries will be judged at 5pm AEDST on 4 August 2016 at Lorna Jane Pty Ltd, 857 Kingsford-Smith Drive, Eagle Farm QLD 4009.The judges may select additional reserve entries which they determine to be the next best, and record them in order of merit, in case of an invalid entry or ineligible entrant.
The winners will be notified by email and their names will be published online at
www.lornajane.com on 10 August 2016.
The Promoter’s decision is final and no correspondence will be entered into.
The best valid entry, as determined by the judges, will win a trip for two (2) people to Bali (Indonesia), valued at up to AU$5,000 (for an Australian winner) or up to US$5,500 (for an USA winner), with the exact value depending on date and point of departure. Each Group Trip includes:
round trip economy airfares provided by Stage and Screen from winner's nearest of Brisbane or Sydney (if winner resides in Australia) or from Los Angeles in the USA (if winner resides in the USA) to Bali, Indonesia for two (2) people.
five (5) nights’ accommodation at Chandra Villas for two (2) people;
airport transfer, daily hotel breakfast for two (2) people (exact menu determined by the Promoter in its absolute discretion); and 2x 90 minute yoga sessions for 2 people.
US$500 Lorna Jane Voucher for an USA winner and AU$500 Lorna Jane Voucher for an Australian winner.
Spending money, additional meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Trip must be booked within 30 days of accepting the prize and must be taken between15 September 2016, to December 14th, 2016 and is subject to booking and flight availability. During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years of age. Each winner and his/her companion are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation. Each winner (and his/her companion) must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in agreement with a winner but in the event that agreement cannot be reached, the Promoter reserves the right to determine the itinerary. Frequent flyer points (i.e. Hawaiian Miles) will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. Winner may be required to present their credit card at time of accommodation check in.
US$500 Lorna Jane Voucher only redeemable at mainland USA Lorna Jane stores or online at
www.lornajane.com. AU$500 Lorna Jane Voucher redeemable at any Lorna Jane store in Australia or online at
www.lornajane.com.au. Any ancillary costs associated with redeeming the Lorna Jane Voucher are not included. Any unused balance of the Lorna Jane Voucher will not be awarded as cash. Redemption of the Lorna Jane Voucher is subject to any terms and conditions of the issuer including those specified on the Lorna Jane Voucher.
If for any reason a winner does not take a prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
Entrants agree that they are fully responsible for any materials they submit via the promotion including but not limited to answers to the promotional question (“Content”). The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove or decline to publish any Content without notice for any reason whatsoever. Entrants warrant and agree that:
they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; their Content shall not contain viruses or cause injury or harm to any person or entity;they will obtain prior consent from any person or from the owner(s) of any property that appears in their Content; the Content is the original work of the entrant that does not infringe the rights of any third party; they consent to any use of the Content which may otherwise infringe the Content creator’s/creators’ moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights; and they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the above terms.
As a condition of entering this promotion, each entrant licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry (which shall include Content) for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia or any statutory consumer guarantees as provided under consumer protection laws in the USA (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking/use of and/or participation in a prize.
As a condition of accepting a prize, each winner (and his/her companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. In the event a winner’s companion is under the age of 18, a nominated parent/legal guardian of such person will be required to sign the legal documentation required under this clause on their behalf.[CL1]
The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at

In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how Australian entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will disclose entrant’s personal information to Chandra Villas & Stage and Screens.
The laws of Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.
