SHAPES FOOTY SHOW COMPETITION
CONDITIONS OF ENTRY
1) By entering Shapes Footy Show Competition (the “Competition”), you are agreeing to the following terms and conditions.
2) Information on how to enter forms part of the terms and conditions. Entry into this Competition is deemed acceptance of these terms and conditions of entry. WHO CAN ENTER
3) The Competition is open to all residents of Australia aged 15 years or over who are able to travel to Sydney for three (3) days and two (2) nights between 30/08/16 and 01/09/16, except for employees of the Promoter and their immediate families, and all companies and agencies associated with this Competition.
4) Entrants under 18 years of age must have the consent of their parent or legal guardian to enter the Competition and provide personal information about themselves. In the event that the winner is under 18 years of age, the Promoter may, in its sole discretion, award the prize on behalf of the winner to the parent or legal guardian who consented to the winner entering the Competition.
HOW TO ENTER
5) The Competition commences Wednesday 13th July 2016 at 12:00 AEST and closes Sunday 14th August 2016 at 23:59 AEST (the “Competition Period”).
6) To enter, entrants must, during the Competition Period:
a) go online to
www.9jumpin.com.au/show/nrlfootyshow/win/arnottsshapes/ (the “Competition Website”); and
b) fully and correctly complete the Competition entry form with their details, including their full name, postcode, current and valid email address and contact telephone number (mobile); and
c) agree to the Competition terms and conditions; and
d) submit their fully completed Competition entry form.
7) Entries must be received within the Competition Period.
All entries are deemed to be received at the time of receipt by the Promoter and NOT at the time of transmission by the entrant.
9) Multiple entries permitted.
10) All entries become the property of the Promoter.
11) The Promoter reserves the right to verify the validity of entries at any time during or after the Competition Period, and reserves the right to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these terms and conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
12) The Promoter is neither responsible nor liable for any late, lost or misdirected entries, or entries not received by the Promoter for any reason whatsoever.
13) Entry via the Competition Website is free. However, any costs associated with accessing the Competition Website are the entrant’s responsibility and are dependent on the internet service provider used.
DRAW
14) There will be one (1) winner drawn from all valid entries received during the Competition Period. The winner will be the first valid entry randomly drawn by the Promoter. The Competition is a game of chance and skill plays no part in determining the winner.
15) The draw will take place at Nine Digital Pty Ltd, ABN 33 077 753 461, Level 7, Tower Building, Australia Square, 264-278 George Street, Sydney, NSW 2000 on Tuesday 16th August 2016 at 12:00 AEST.
16) The Promoter’s decisions are final and no correspondence will be entered into.
17) The winner will be notified by phone and in writing and their name published on the Competition Website on Friday 19th August 2016.
PRIZE
18) The winner will receive the prize package stipulated below:
a) Return economy flights for the winner and one (1) guest from the winner’s nearest Australian capital city airport to Sydney Airport (the “Airport”), valued at a maximum of $2,000.00; and
b) Two (2) nights’ hotel accommodation (twin/double share) for the winner and one (1) guest (hotel to be determined by the Promoter in its sole discretion) including breakfast daily (the “Hotel”), valued at a maximum of $700.00; and
c) Return private car transfers for the Winner and one (1) guest between the Airport and the Hotel, valued at a maximum of $300.00; and
d) Return private car transfers for the Winner and one (1) guest between the Hotel and the NRL Footy Show venue, valued at a maximum of $400.00; and
e) $250 spending money for the winner only, to be paid into an account in the winner’s name by cheque or EFT; and
f) Two (2) tickets to the NRL Footy Show for Wednesday, 31st August 2016; and
g) One (1) voucher for the winner only to the value of $18,200 to be redeemed at the winner’s closest Harvey Norman or David Jones furniture and/or electronics store
(subject to winner’s place of residence). Voucher will be awarded to the winner during the NRL Footy Show on Wednesday, 31st August 2016.
THE TOTAL PRIZE POOL FOR THIS COMPETITION IS VALUED AT A MAXIMUM OF $21,850.00
19) The voucher can be used towards purchase of furniture and electricals and can be used towards delivery fees, installation costs (organised through the retailer) and extended warranty/s. Exact store for the winner to redeem voucher at to be determined by the Promoter in its sole discretion.
20) The prize must be redeemed in full to travel to Sydney between 31/08/16 and 01/09/16. The winner must return prize acceptance paperwork to the Promoter within 48 hours of receiving paperwork otherwise the winner will forfeit the prize and no compensation or substitute will be offered. The prize will be awarded to another entrant in an unclaimed prize draw to be held in accordance with clause 37 of these terms and conditions.
21) The prize must be taken as offered. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be redeemed as cash (unless otherwise indicated). The prize is not valid in conjunction with any other offer.
22) The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize values.
23) The winner is advised that tax implications may arise from them winning the prize and they should seek independent financial advice prior to accepting the prize.
24) In the event that a portion of the prize is awarded to the winner in the form of a voucher / ticket / pass/ online, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass/ online. The Promoter will not be liable for any voucher / ticket / pass that has been lost, stolen, forged, damaged or tampered with in any way.
25) Flights are economy class and may be indirect. The airline’s Conditions of Carriage apply to all flights. The winner and guest must travel at the same time. The winner and their guest must depart from and return to the same capital city airport in Australia, being the capital city airport that is closest to the winner’s place of residence. The winner and their guest will be responsible for making their own way to and from their residence to their departing Australian airport. These conditions apply for all flights.
26) All components of the prize must be taken together as a package and cannot be separated into separate trips or components. The winner and their guest must travel together. All flights for each route must be utilized at the same time, for the same travel dates, to and from the same destination. The air tickets are available on regular scheduled services of each airline and subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airline’s departure city and their current flight schedule. All travel is subject to availability at all times. The winner and their guest are responsible for any amendment fees issued by airlines or suppliers once booking is confirmed and ticketed. Travel suppliers/airlines and booking time of flights to be chosen at Promoter’s discretion. Blackout periods may apply. Frequent flyer points are not available from any airline.
27) It is a condition of accepting the prize that the winner may be requested to present their credit card or a cash deposit upon arrival at any accommodation to cover all incidentals they may incur during their stay.
28) It is the responsibility of the winner and their guest to ensure they are checked in for their flights, and arrive at the airport, on the correct date and at the time specified by the relevant airline carrier. The Promoter is not responsible for any costs associated with the winners and/or their guest missing any of their flights.
29) Unless specified otherwise, the winner and their guest are responsible for all expenses including, without limitation, transport to and from departure point including but not limited to additional domestic airfares if required, any additional meals or beverages, any extra sightseeing or activities, any additional accommodation, any additional transfers, travel insurance, any additional personal spending money, and all other ancillary costs, as well as obtaining any of these. Prize also excludes medical expenses, items of a personal nature, alcoholic beverages, optional tours not outlined, laundry, telephone calls, additional nights, room or flight upgrades, incidentals, energy surcharges, gratuities, service charges, in-room charges or other ancillary costs associated with redeeming the prize other than those specified. These costs and expenses are the responsibility of the winner and their guest. Any extension to the duration of the prize is at the winner’s sole expense and subject to availability at the time of booking. For the removal of doubt, taxes for domestic travel are included in the prize winning domestic airfares provided by the Promoter.
30) In the event that for any reason whatsoever the winner does not take the prize or an element of the prize at the time stipulated by the Promoter, the prize or that element of the prize will be forfeited by the Winner and no compensation or substitute will be offered.
31) In the event that the prize, or part of the prize, is unavailable, the Promoter reserves the right to substitute the prize or that part of the prize in its discretion with an alternative prize or part of the prize to the same and equal or greater recommended retail value and/or specification subject to any written directions from the various Lottery Departments.
32) Individual supplier terms and conditions apply. It is a condition of accepting the prize that the winner and their travelling companions must comply with all the conditions of use of the prize and the prize supplier’s requirements.
33) It is a condition of accepting the prize that the winner and their guest may be required to sign a legal release or releases in a form determined by the Promoter and/or any prize supplier in its or their absolute discretion.
34) The Promoter and any prize supplier(s) reserve the right to request the winner and their travel companions to provide proof of age and identity. Identification considered suitable for verification is at the discretion of the Promoter and/or the relevant prize supplier(s).
35) If the winner is under the age of 18, the winner must be accompanied on the prize at all times by his/her parent or legal guardian.
36) It is a condition of accepting the prize that the winner and their guest agree: a) to be interviewed, photographed and filmed at any time in connection with the Competition; b) the Promoter and the agencies and companies that are associated with the Promoter or the Competition may use their name, image, comments, photographs or audio-visual clips (the “Materials”) for editorial, publicity and promotional purposes in any form of media, without reference or compensation to the winner and their guest or any other person; c) the Promoter may use, reproduce, edit and communicate to the public the Materials at any time in any form of media in its sole discretion; d) the Promoter may license, authorise or otherwise transfer the rights in the Materials to others to do the same; and
e) the winner and their guest unconditionally and irrevocably consent to any act or omission that would otherwise infringe any of their moral rights in the Materials and waive all moral rights in the Materials that arise outside Australia.
GENERAL
37) As this is an event based prize, the Promoter may conduct such further draws at the same place as the original draw as are necessary on Friday 19th August 2016 at 09:00 AEST in order to distribute any prize that remains unclaimed by that date, subject however to all reference to any relevant state and territory regulations. In the event of a winner in the unclaimed prize draw, the winner will be notified in writing and by telephone and published on Monday 22nd August 2016. The winner must return prize acceptance paperwork within 48 hours of receiving paperwork.
38) The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this Competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this Competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
SPECIAL CONDITIONS OF ENTRY
39) If a winner is under the age of 15 years, their entry will be deemed invalid and the prize will be forfeited and subject to the unclaimed prize draw.
40) If the winner is 15 years or over but under the age of 18 years, the prize will be awarded to the winner’s parent or legal guardian on behalf of the winner. It is the responsibility of the winner’s parent/legal guardian to prove their parental status/ legal guardianship at the time of winner notification. In the event that for any reason whatsoever a person/s mistakenly represents themselves to be a winner’s parent and/or legal guardian, then that person will be liable for all costs associated with relocating and/or re-awarding the prize (including but not limited to any administrative fees incurred by the Promoter). Where relevant, the Promoter is only responsible for ensuring that the prize is awarded to a person who is either a parent or legal guardian of the winner. The Promoter is not responsible for determining any other delivery details or taking direction that relates to any ongoing family law negotiations and/or determinations. These are the responsibility of the winner and their respective parent/s and/or legal guardian/s.
41) If, for any reason, this Competition is not capable of running as planned, including, without limitation, due to unforeseen circumstances, war, terrorism, state of emergency or disaster, technical failures, unauthorised intervention, fraud or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and, subject to any written directions given by the various Lottery Departments, to cancel, terminate, modify or suspend the Competition.
LIABILITY AND RELEASE
42) Except for any liability that cannot be excluded by law, the Promoter and each of their related entities (including their officers, employees and agents) and affiliates (including broadcasting affiliates) exclude all liability (including negligence) for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential,
arising in any way out of the Competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under their control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond their reasonable control; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; (f) participation in the Competition; and/or (g) redemption and/or use of a prize.
43) The Promoter and each of their related entities (including their officers, employees and agents) and affiliates (including broadcasting affiliates) will take no responsibility for defective prizes or prizes damaged or lost in transit, or late, lost or misdirected mail.

44) The Promoter will collect entrants’ personal information in connection with this Competition and will use and handle the personal information in accordance with these Terms and Conditions and the Promoter’s Privacy Policy at
