Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

Entry is only open to Australian residents aged 18 years or over.
Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st
Promotion commences on 14/07/2016 and ends at 11:59pm on 30/08/2016 (“Promotional Period”). All times indicated in these Terms and Conditions are in AEST.

www.nbl.com.au/thanksyou, follow the prompts to the promotion entry page, input the requested details (including their full name, telephone number, and a valid email address), and submit the fully completed entry for so it is received during the Promotional Period (“Initial Entry”). Only one (1) Initial Entry permitted per person.
Once an Initial Entry has been submitted, individuals will be eligible to receive additional entries (each an “Additional Entry”) by completing either of the following:
Friend Referral: to receive one (1) Additional Entry, entrants must refer a friend/family member by providing their full name and a valid email address as prompted on the promotion entry page after submitting an Initial Entry. Each validly referred friend will then receive a promotional email from the entrant inviting them to enter. Entrants agree and warrant that: (a) they can only refer individuals who are an Australian residents aged 18 years or over and who consent to receiving these types of emails from them; and (b) the friend’s name and unique email address provided is valid. Entrants can only nominate friends, family, colleagues and other individuals who they have a direct relationship with, and who consent to receiving these types of messages. A maximum of five (5) Friend Referral Additional Entries permitted per person.
Promotion Sharing: To receive one (1) Additional Entry, entrants must complete one (1) of the following actions to share the promotion during the Promotional Period: (a) follow the prompts on the entry page after submitting an Initial Entry to share their participation in the promotion on Facebook and/or Twitter; (b) log in to their Facebook Account and ‘like’ the NBL Facebook Page (at facebook.com/TheNBL); (c) share any one (1) the NBL Facebook Page’s posts on their Facebook timeline; (d) tagging at least one (1) Facebook friend on one of the NBL social media posts on Facebook or Twitter (at @NBL) (max one (1) tag per friend). Entrants will receive one (1) Additional Entry for each action successful completed during the Promotional Period with a maximum of five (5) Promotion Sharing entries permitted per person.
Incomplete or indecipherable entries will be deemed invalid.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
There will be five (5) minor draws (each a “Minor Draw”) and one (1) major Draw (“Major Draw”) conducted for the entries received during the Promotional Period. Entries for each draw will open at 12:00am on 14/07/2016 and close at 11:59pm on the dates outlined in the table below. The draws will take place at Anisimoff Legal, Erina Plaza, 210 The Central Coast Highway, Erina, NSW 2250 at 9:00am on the dates outlined in the table below. The Promoter may draw additional reserve entries in each draw and record them in order in case an invalid entry or ineligible entrant is drawn. Major Draw 1st Prize (Major Prize) The opportunity for that entrant (“Participant”) to play a contingency game (“the Game”) for the chance to win $1,000,000. Refer to clauses 14-15 for details. Up to $1,001,200 31/08/2016
The Game will take place at Brisbane Entertainment Centre, Melaleuca Dr, Boondall 4034, Brisbane, QLD on 06/10/2016 beginning at 30pm AEDST. In order to participate in the Game, the drawn Participant will receive the following for two (2) people (i.e. the Participant and one (1) companion), valued at up to $1,200 depending on point of departure:
return economy airfares from his/her nearest capital city in Australia to Brisbane, QLD (only provided if the drawn Participant resides outside of QLD). If the drawn Participant resides in QLD, the airfare component of the prize will be forfeited and will not be awarded as cash;
one (1) night accommodation at a minimum 4-star hotel in Brisbane (exact hotel determined by the Promoter); and
return transfers from the accommodation to the Game location.
Spending money, meals, taxes (excluding airline and airport taxes), insurance, transport to and from departure point, additional transfers, items of a personal nature (including but not limited to in-room charges) and all other ancillary costs are not included. If the Participant cannot attend the Game, the Participant may appoint a proxy over 18 years of age to play the Game on his/her behalf provided the Participant gives the Promoter written, signed notice to that effect before the start of the Game. If the Promoter has not been able to contact the Participant before the start of the Game, a representative of the Promoter will play the Game on the Participant’s behalf.
The Game will be conducted as follows:
There will be ten (10) numbered envelopes on display at the start of the Game. One (1) envelope will contain a promotional message representing a $1,000,000 prize. The other nine (9) envelopes will each contain a promotional message representing a $100,000 prize. The Participant/proxy/representative (“Attendee”) must choose only one (1) envelope (“Selected Envelope”) without touching, handling or interfering in any way with any of the other envelopes on display. If the Attendee is found to have breached this condition, he/she will be disqualified. If the Attendee’s Selected Envelope contains the promotional message representing the $1,000,000 prize, then, subject to verification by the judges, the drawn Participant will have the chance to win $1,000,000. If the Attendee’s Selected Envelope contains the promotional message representing the $100,000 prize, the drawn Participant will have the chance to win $100,000.
Once the Attendee’s Selected Envelope has been selected and verified by the Promoter, the Attendee will be required to complete a mystery challenge (“Challenge”) for the chance to win the prize represented in their Selected Envelope. The Attendee will be provided with details/instructions on the Challenge at the time of the Game.
If the Attendee successfully completes the Challenge, the drawn Participant will win the prize specified in the Selected Envelope. If the Attendee does not complete the Challenge successfully, they will win the contingency prize of one (1) NBL/Chemist Warehouse Merchandise Pack valued $1,000 (exact contents of pack to be determined by the Promoter) and the prize specified in the Selected Envelope will not be awarded.
The drawn Participant’s odds of selecting the $1,000,000 prize envelope are 1 in 10. The odds of being drawn as a Participant may be significantly higher than the odds of the drawn Participant winning the $1,000,000, and will depend upon the number of entries received.
The following conditions apply to the Club Boulevard Prize:
The Club Boulevard Prize is supplied by is Ladbrokes Digital Australia Pty Ltd, ABN 25 151 956 768 of 461-473 Lutwyche Road, Lutwyche Queensland, 4030, phone 1300 523 276 (“we/us/our”).
The prize is four (4) tickets to the Club Boulevard corporate marquee including a food and premium beverage package at the 2016 Caulfield Guineas at Caulfield Racecourse in Melbourne, VIC on 8/10/16.
The prize is limited to the items listed in clause 16(b) above, and any additional costs or charges must be paid by the winner, including but not limited to travel between the prize winner’s home and the Caulfield Racecourse, etc;
The tickets are able to be used by persons who are 18 years of age or older.
Any persons who are under 18 years of age will be refused entry to the racecourse and/or Club Boulevard.
The following conditions apply to the Andre Rieu Prize:
Suite Tickets are not transferrable for another Qudos Bank Arena event.
Suite Tickets cannot be on sold. Any on-sale of the Suite Tickets is scalping and the tickets will be voided and patron not permitted entry to the venue.
Suite Tickets do not include Parking. Parking or transport to the Arena is at the winner’s expense.
Suite Tickets do not include any merchandise. Winners are welcome to purchase merchandise at the Arena’s Merchandise outlet at the winner’s expense.
The winner will be a guest in the Arena Suite so are expected to be responsible and behave in an appropriate manner. If not, the Arena reserves the right to remove the guests from the suite and the premises.
Suite Tickets include select food and beverages (on a set menu). The food and beverage option is selected by the Arena and doesn’t include spirits. The winner cannot request any food and beverage items that are not on the suite food menu or stocked in the suite fridge.
Winner is not to approach any other suite on suite level
Dress is to be smart casual. No thongs or shorts.
The following conditions apply to the Foxtel Prize:
The prize consists of 1 x Foxtel subscription to the Platinum HD pack for 12 months, valued at $1,620.00 (the “Subscription Credit”) and 1 x single standard technician install and 1 x iQ3 set top unit, valued at $225.00 (the “Install and Box Fee”) (together the “Foxtel Prize”).
The Foxtel Prize is subject to the Foxtel Residential Subscription Television Agreement.
Foxtel and some Foxtel services are not available to all homes.
In the instance that the winner’s home is not in a Foxtel serviceable area (an “Un-serviceable Winner”), then the winner may choose to:
transfer the Foxtel Prize to a nominated person who is eligible to take the Foxtel Prize; or
forfeit the Foxtel Prize, in which case the Foxtel Prize will be awarded to another entrant in the competition.
In the instance that the winner is an “Optus TV featuring Foxtel” or “Foxtel from Telstra” subscriber (an “Ineligible Winner”), the winner is not eligible to accept the Foxtel Prize as a credit to their account, but they may choose to either:
transfer the Foxtel Prize to a nominated person who is eligible to take the Foxtel Prize; or
forfeit the Foxtel Prize, in which case the Foxtel Prize will be awarded to another entrant in that Promotion.
An Ineligible Winner or Un-serviceable Winner will not receive a substitute prize or cash in lieu.
A credit will be applied to the winner’s Foxtel account in the amount equivalent to the Subscription Credit. The Subscription Credit is non-refundable and not redeemable for cash.
Installation is a single standard technician installation only. The winner is responsible for any additional installation costs that may be incurred.
In the instance that the winner is already a Foxtel subscriber with an iQ3, the Subscription Credit will be applied to the winner’s Foxtel account and they will forfeit the Install and Box Fee. No substitute will be offered. The Subscription Credit is non-refundable and not redeemable for cash.
In the instance that the winner is already a Foxtel subscriber with an iQ/iQ2/MyStar, they may choose to upgrade to an iQ3 and they will receive the Install and Box Fee.
Foxtel Store or Box Office charges, Main Event charges and other incidental charges are not included in the Foxtel Prize and are charged in addition to subscription fees, and will be subtracted from the Subscription Credit as incurred by the winner.
Once the Subscription Credit is insufficient to cover fees and charges, the winner will be responsible for all additional fees and charges.
The winner is responsible for checking the amount of credit on their account.
The winner must set up Easypay (direct debit) on their Foxtel account.
If for any reason the winner cancels their Foxtel subscription, any remaining Subscription Credit will be forfeited and cash will not be provided in lieu.
The winner must provide Foxtel with at least 31 days’ notice before the end of the subscription period (or earlier if the Subscription Credit is insufficient to cover the charges) if the winner wishes to terminate or change their subscription package, otherwise the winner will incur ongoing subscription fees reflective of the Subscription Credit.
Prizes are subject to the standard terms and conditions of individual prize and service providers. All prizes are taken at the winner’s own risk.
Any ancillary costs associated with redeeming a Gift Card/Voucher are not included. Any unused balance of the Gift Card/Voucher will not be awarded as cash. Redemption of the Gift Card/Voucher is subject to any terms and conditions of the issuer including those specified on the Gift Card/Voucher.
The event ticket prizes are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject any winner (and/or his/her companion/s) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
In regards to any prizes consisting solely of alcohol or vouchers for alcohol, NT residents will be awarded with cash in lieu of the prize. A maximum of 20L will be awarded to any NSW residents and cash will be awarded in lieu in the event this limit is reached.
The Promoter encourages consumers to enjoy responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines that are available at
www.nhmrc.gov.au.
Subject to the unclaimed prize draw clauses, if for any reason a winner does not take/redeem a prize (or an element of the prize) at/by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Total prize pool value is up to $1,036,606.
Prizes, or any unused portion of a prize, are not transferable or exchangeable for any other prize, and cannot be taken as cash, unless otherwise specified.
If the Major Prize remains unclaimed by 9:00am AEST on 19/09/2016, a re-draw for the Major Prize will take place at 9:30am AEST on 19/09/2016 at the same place as the original Major Draw, subject to any directions from a regulatory authority. The winner, if any, will be notified by telephone and email within two (2) business days of the re-draw and their name will be published online at nbl.com.au from 20/09/2016. The unclaimed prize draw winner must then claim their prize by the time specified by the Promoter.
If any Minor Prize remains unclaimed by 9:00am AEDST on 29/11/2016, a re-draw will take place at 9:30am AEDST on 29/11/2016 at the same place as the original Minor Draws, subject to any directions from a regulatory authority. Winners, if any, will be notified by telephone and email within two (2) business days of the re-draw and their names will be published online at nbl.com.au from 30/11/2016. The unclaimed prize draw winner(s) must then claim their prize by the time specified by the Promoter.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the Formula 1 Grand Prize event and/or ‘Christmas Day’ race at Mornington Racecourse is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) taking/use of and/or participation in a prize.
As a condition of accepting a prize, each winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
The Promoter collects personal information (“PI“) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers (including but not limited to Foxtel and Chemist Warehouse) and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at
www.nbl.com.au/privacy-policy/. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. Unless specified otherwise, the Promoter may disclose entrant’s personal information to any entity outside of Australia (see Promoter’s Privacy Policy for details).
