Who is running the competition?
The Promoter is Coca-Cola Amatil (Aust) Pty Ltd (ABN 68 076 594
119) of Level 14, 40 Mount Street, North Sydney, New South Wales
2060 (Promoter).
When will the
competition start and end?
The competition starts at 12.01am (AEDT) on 03/10/16 and ends at
11.59pm (AEDT) on 27/02/17 (the Competition Period).
Who can enter?
Entry is open to Australian residents aged 18 years or over,
excluding:
(a) management, employees, directors and contractors of the Promoter, Energy Beverages Australia PTY LTD, their respective related bodies corporate, the participating stores and other agencies, firms or companies associated with the competition (including suppliers of prizes);
(b) a spouse, de-facto spouse, parent, guardian, child or sibling of a person referred to in paragraph (a) above;
(c) persons who have won a prize or prizes valued either individually or collectively at more than $500 (including GST) in any competition or promotion run by or on behalf of the Promoter, or any competitions or promotions promoting Mother Energy products, within the 12 months prior to the commencement of the Competition Period;
(d) persons who have used or attempted to use any more than one name in order to qualify to win a competition or promotion run by or on behalf of the Promoter (except in the case of a legal change of name); and
(e) persons who have breached the terms and conditions of any competition or promotion run by or on behalf of the Promoter.
The persons referred to in paragraph (b) above include natural and non-natural relations (in the opinion of the Promoter) and the Promoter is responsible for determining whether a person is an eligible entrant in its absolute discretion.
Do I need to buy anything to enter?
Yes. During the Competition Period, you need to buy any Mother
Energy drink product (Qualifying Purchase) from participating
Australian retailers (excluding online purchases and vending machine purchases), and retain your receipt.
Your purchase receipt must clearly identify the store of purchase, the product purchased (which must be a Qualifying Purchase) and the date of purchase (which must be during the Competition Period).
A receipt showing a Qualifying Purchase can only be used to make one entry, regardless of how many Qualifying Purchases are shown on that receipt.
Entry instructions
After you have made a Qualifying Purchase, you must during the
Competition Period visit
www.motherenergydrink.com.au (Website) and fill out and submit the online entry form including by providing the barcode number and uploading a copy of the receipt from your Qualifying Purchase, your contact details and all other requested information.
How many winners will
there be and how will they be chosen?
There will be 22 winners determined in respect of this competition.
There will be 22 draws. The draws will occur at 12pm (AEST/AEDT, as applicable) on each Monday between 03/10/16 and 06/03/17 (inclusive) (except the draw for 03/10/16 will be held on 04/10/16, and the draws for 26/12/16 and 02/01/17 will both be held on 03/01/17). Each draw will take place at Handling Matters Pty Ltd, 1/3 Green Street, Brookvale NSW 2100.
The first valid entry drawn randomly in each draw from the entries received during the Competition Period up to 11.59pm (AEST/AEDT, as applicable) on each Sunday immediately prior to the relevant draw, will win a prize. Entries received in respect of each draw will not roll over to subsequent draws.
The Promoter may draw additional reserve entries in each draw and record them in order, in case the winning entry/entrant is deemed invalid.
If, on the date of a draw, an insufficient number of entries have been received such that the prize cannot be awarded, the prize will carry over to the next draw on which the Promoter has received enough entries to award the prize.
What can I win?
There are 22 prizes available.
Each prize is $5,000 cash.
There is a limit of one prize per person/household (except for SA
residents).
Total prize pool
The total prize pool is $110,000.
How many times can I
enter?
You can enter a maximum of once per day during the Competition
Period, provided that each entry is based on a separate Qualifying Purchase and separate Qualifying Purchase transaction.. A receipt showing a Qualifying Purchase can only be used to make one entry, regardless of how many Qualifying Purchases are shown on that receipt. Each entry must be submitted separately in accordance with these Terms and Conditions.
How and when will the winners be informed?
If you are a winner, you will be informed by phone and by email within two days of the draw and your name and state/territory of
residence will be published on the Website on 5/10/16, 2/11/16,
30/11/16, 21/12/16, 18/01/17, 22/02/17 and 10/03/17 for a period of
28 days.
Must I keep anything to
verify my entry?
You must keep the original itemised purchase receipt(s) for all
entries as proof of purchase. If you don't produce the proof of purchase for all entries when asked the Promoter may disqualify all of your entries and you will lose any right to a prize. If, in the
Promoter's opinion, you have shared any receipt(s)/barcode(s) with
another person, your entries will be invalid and you will lose any right to a prize.
If I win, when must I
claim my prize?
You must claim your prize by 12pm (AEST) on 07/06/17.
What if I don't claim my
prize on time?
If a prize has not been accepted or claimed by 12pm (AEST) on
07/06/17 or if, after making all reasonable attempts, the Promoter cannot contact the drawn winner (or the drawn winner does not contact the Promoter) by the time specified above, the relevant entry will be discarded and the Promoter will re-award the relevant
prize by carrying out an unclaimed prize draw at 12pm (AEST) on
08/06/17 (Unclaimed Prize Draw) at the same location as the original draw to distribute the relevant prize/s. All entries received during the Competition Period will be combined for the purposes of this draw.
If you are a winner in the Unclaimed Prize Draw you will be informed by phone and in by email within two days of the Unclaimed Prize Draw and your name and state/territory of
residence will be published on the Website on 10/06/17 for a period of 28 days.
Payment of prizes
A prize will be paid by electronic funds transfer to the winner’s bank
account within 1 month of the later of: the date the winner accepted or claimed the prize or the date the winner provided valid bank account details.

Entry
2 Your entry must be received during the Competition Period. Your entry is deemed to be received only when received by the Promoter’s database. You will receive a return online message confirming your entry, if your entry is deemed valid by the Promoter. The Promoter is not liable for any problems with communications networks. You are responsible for your own costs associated with entering. If you enter using automatically generated entries or multiple aliases you may be disqualified.
General
3 If you are a winner, you must take part in all publicity, photography and other promotional activity as the Promoter requires, without any compensation. You consent to the Promoter using your name and image in any promotional or advertising activity.
4 If you or your entry are deemed by the Promoter to breach these Terms and Conditions, your entry (or at the Promoter's discretion, all of your entries) may be disqualified. The Promoter may, at any time, require you to produce documentation to establish to the Promoter's satisfaction the validity of your entries (including documentation establishing your identity, age, place of residence and place of employment). Failure by the Promoter to enforce any of its rights at any stage does not waive those rights.
5 You must not:
(a) tamper with the entry process;
(b) engage in any conduct that may jeopardise the fair and proper conduct of the competition;
(c) act in a disruptive, annoying, threatening, abusive or harassing manner;
(d) do anything that may diminish the good name or reputation of the Promoter or any of its related entities or of the agencies or companies associated with this competition;
(e) breach any law; or
(f) behave in a way that is otherwise inappropriate.
6 The Promoter is not liable for entries, prize claims or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible or incorrectly submitted.
7 The Promoter’s decision in connection with all aspects of this competition is final and no correspondence will be entered into.
8 Prizes cannot be transferred or exchanged. Without limiting any other term of these Terms and Conditions, all prizes must be taken as and when specified, or will be forfeited with no replacement.
9 By entering, you request that your full address not be published.
10 If this competition cannot run as planned for any reason beyond the Promoter's control, for example due to software, hardware or communications issues, unauthorised intervention, tampering, fraud or technical failure, the Promoter may end, change, suspend or cancel the competition or disqualify affected entries/entrants, subject to any necessary approval by the state/territory gaming authorities.
11 The Promoter is not responsible for any tax implications arising from you winning a prize. You should seek independent financial advice. If for GST purposes this competition results in any supply being made for non-monetary consideration, you must follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
Liability
12 Nothing in these Terms and Conditions restricts, excludes or modifies any consumer rights under any statute including the Competition and Consumer Act 2010 (Cth).
13 Subject to the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable (including in negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury, illness or death suffered in connection with this competition or any prize, except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law).
14 Without limiting the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable for any loss of, damage to or delay in delivery of prizes. Prizes will only be delivered to addresses in Australia.
15 The Promoter may communicate or advertise this competition using Facebook or Instagram. However, the competition is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram. You provide your information to the Promoter and not to Facebook or Instagram. You completely release Facebook and Instagram from any and all liability.
Collection and use of your personal information
16 The Promoter may collect your personal information directly or through its agents or contractors. The Promoter will use your personal information to conduct the competition. The Promoter may disclose your personal information to its related companies, agents and contractors to assist in conducting this competition, communicating with you or storing data. This may include disclosures to organisations outside Australia including in places such as the United States of America. By entering, you consent to the Promoter keeping your personal information on its database to use for future marketing purposes, including contacting you by electronic messaging. By
entering, you consent to receive email or SMS messages from the Promoter without any functional unsubscribe facility. The Promoter’s Privacy Policy (see
https://www.ccamatil.com/en/privacy-policy includes information about:
(i) how to seek access to the personal information the Promoter holds about you and seek correction of the information; and
(ii) how to complain about a privacy breach and how the Promoter will deal with such a complaint.
