TERMS AND CONDITIONS OF ENTRY
Information on how to enter and prizes form part of these Terms and Conditions of Entry. Entry into this competition is deemed acceptance of these Terms and Conditions. The Promoter reserves the right to modify the content of these Terms & Conditions with retroactive effect should modification be required to ensure the good execution of the competition.
The Promoter is Ug Manufacturing Co Pty Ltd of 27 Baines Crescent, Torquay Victoria 3228 Australia, ABN 63 005 047 941, Telephone 03 5261 6000 (‘ Promoter’ ).
Entry is open to Australian and New Zealand residents aged 13 years or older as at the start date of the competition. Employees of the Promoter and their immediate family members are ineligible to enter. Entrants under 18 years old must have parental/guardian consent to enter and the parent/guardian of the entrant must read and consent to all terms and conditions.
The competition commences on 21/07/2016 at 12.01am (AEST) and closes on 31/08/2016 at 11.59pm (AEST) (“Competition Period”). To be eligible, all entries must be received by the Promoter prior to the end of the Promotion Period.
To qualify for entry, customers must during the Competition Period, sign up to the ROXY database ( roxyaustralia.com.au /
www.roxy-newzealand.co.nz ) and refer at least one (1) friend to the competition. Entrants may refer up to three (3) friends and each referral increases their chances of winning. No responsibility is accepted for late, lost or misdirected entries. Incomplete, indecipherable, or illegible entries will be deemed invalid.
The draw will take place at 10am (AEST) on 01.09.2016 at 27 Baines, Crescent, Torquay, Victoria 3228 Australia. The first valid Entry selected by random electronic drawn (“Winner”) will win a trip to the #ROXY fitness event in Queenstown, as outlined below:
Prize:
The prize comprises:
2 return economy airfares to Queenstown from the Winner’s closest major city;
2 nights’ standard twin-share accommodation for 2 people at the Novotel, Queenstown;
Entry into the #ROXY fitness event in Queenstown, New Zealand on 25.09. 2016; and
2 Roxy Fitness clothing packs valued at $150 each.
Total maximum value of Grand Prize: AU$1,200 (depending on Winner’s departure point). The Promoter takes no responsibility for any variation in the Prize value. Prize does not include any ancillary costs associated with redeeming the Prize. These are the responsibility of the Winner.
Prize Conditions:
If the event that the Winner is under eighteen (18) years of age, the Prize will be awarded to the Winner’s parent/s or legal guardian and the person accompanying the Winner must be their parent or guardian.
The Prize must be taken to coincide with the #ROXY fitness event in Queenstown on 25.09.2016 (“Event”). In the event that the Winner is unable to travel during the stipulated period then they forfeit the Prize and the Winner will be awarded a $500 voucher valid for redemption from roxyaustralia.com.au /
www.roxy-newzealand.co.nz in lieu of the Prize.
The Winner and their travel companion must depart from and return to the same departure point and travel together. Travel arrangements to and from the Winner’s home and the departure point do not form part of the Prize and are the responsibility of the Winner.
The Promoter is not responsible for any cancellation, delay or rescheduling of flights and any costs incurred as a result (including, without limitation, accommodation costs) will be the sole responsibility of the winner.
The winner is responsible for the payment of any applicable airline excess baggage fees or other fees, taxes and surcharges.
The Winner (and their travel companion) must satisfy the Promoter as to their health and fitness for travel. As a condition of accepting Prize, Winner (and their travelling companion) may be required to sign legal documentation as and in the form required by the Promoter in their absolute discretion, including but not limited to a legal release and indemnity form.
In accepting the Prize, the Winner and their travel companion agree, upon the reasonable request of the Promoter and without remuneration, to participate in all promotional activities relating to the competition including but not limited to being interviewed or photographed and consent to the Promoter and its related bodies corporate using their name and image in promotional material.
Flights are subject to the fare rules and General Conditions of Carriage of the relevant carrier. The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination.
Air carrier selection and routing is at the sole discretion of the Promoter, and may include en route flight connections, overnight air travel, or require en route overnight hotel accommodations due to airline schedules and/or availability. If en route overnight hotel accommodations are required, this expense is the responsibility of the Promoter.
The Prize does not include travel insurance, spending money, meals and beverages (unless specified), medical expenses, laundry, telephone calls, taxes not included in the price of the ticket, transfers, ground transportation and any other costs of a personal nature not stated. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances. Any extension to the duration of the Prize is at the Winner’s sole expense and subject to availability at the time of booking. For the removal of doubt, taxes for domestic travel are included in the Prize winning domestic airfares provided by the Promoter.
The Promoter shall not be liable for any loss or damage whatsoever which is suffered in the event that the Event is cancelled, postponed, rescheduled or relocated for any reason whatsoever.
A credit card imprint or cash deposit will be required from the Winner at check-in in order to check into the hotel, for all incidental charges.
The Winner and their travel companion must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the Promotion or the winning of the Prize, free of charge, and they consent to the Promoter and its related bodies corporate using their name and image in promotional material.
The Winner will be notified where possible by email on the day of the draw and the name of the Winner will be published on roxyaystralia.com.au and
www.roxy-newzealand.co.nz within 48 hours of the end of the Promotion for a period of 28 days. All reasonable efforts will be taken to contact the Winner. If the Winner cannot be contacted and the Prize remains unclaimed, a redraw will take place at 27 Baines Crescent, Torquay VIC at 10am (AEST) on 07.09.2016 (subject to any directions from a regulatory authority). The draw result is final and no correspondence will be entered into. The Promoter accepts no responsibility for unread, undelivered or incorrectly provided email information.
The Prize is not transferable or exchangeable and cannot be taken as cash. The Promoter reserves the right to alter the Terms and Conditions or cancel, terminate, or suspend the promotion and, subject to any directions from a regulatory authority, select a winner from among all valid Entries received up to such time of cancellation, termination or suspension. If for any reason any element of the Prize becomes unavailable for any reason beyond the Promoter’s control then a similar prize element of equal or greater value may be awarded to the Winner in lieu, in the absolute discretion of the Promoter. For the avoidance of doubt, the Promoter is not obliged to offer an alternative prize if the Event is postponed or cancelled.
If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation.
Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents), excludes all liability (including negligence), for any personal injury or any loss or damage (including, without limitation, indirect, special or consequential loss or loss of profits), which is suffered or sustained in connection with this competition or accepting or using the Prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law.
By entering this competition, entrants automatically consent to receive communications from the Promoter and the information submitted with their Entry being entered into the Roxy database. Any information entrants provide will be held in accordance with the Promoter’s privacy policy which can be viewed at roxyaustralia.com.au/privacy-policy /
