Entry is open to Australian residents aged 18 years or over only who purchase Take 5 Issue 35 during the promotional period or are subscribed to Take 5 and receive issue 35 during the promotional period. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these terms and conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. Incomplete, indecipherable or illegible entries will be deemed invalid.
The Promotion commences on 18th August 2016 and will close on 16th September 2016 at 17:00pm (AEST). The draws will take place at National Products Fulfilment Pty Ltd, 6-9 Ross Place, Wetherill Park, NSW 2164 at 9:30am (AEST) on 30th September 2016. All winners will be notified in writing within seven (7) business days of the draw using the contact details given in their entry. All winners’ names will be published in Take 5 Issue 45, on sale 27th October 2016.
For the removal of doubt, there will be six (6) individual draws for the promotional period one (1) draw for each night/question.
To enter, individuals must do the following steps:
Individuals must purchase or subscribe to Issue 35 of Take 5 magazine (on sale 18th August 2016) to receive their free Take 5 Family Feud game card. The game card is valid for each day during the period of 21 August 2016 to 26 August 2016 (inclusive).
Individuals must then watch Family Feud on Network Ten in Australia each night from 21 August 2016 to 26 August 2016 (inclusive and consecutively). Each night the show will air a special Take 5 Question of the Day. Readers must then fill in their answer to the question aired on the game card next to the corresponding day (night). For example: Wednesday night: answer to question given on Wednesday night’s show.
Individuals must then complete the official entry form on the game card and send your entry (game card) to: Take 5 Family Feud Promotion, PO Box 401, Eastern Suburbs MC NSW 2004.
For the removal of doubt entrants must have a correct answer and completed entry form on an original game card to be a valid entry. Entrants are not required to answer all questions to be a valid entry. Entrants may choose to answer a minimum of one (1) question to be a valid entry and will be valid to win that corresponding prize only.
A draw for any unclaimed prizes may take place on 9th January 2017 at the same place as the original draws, at 9:00am (AEST), subject to any directions from a regulatory authority. The Winners, if any, will be notified in writing within seven (7) business days of the draw. The Winners’ names will be published on
www.take5mag.com.au on 12th January 2017.
All entries must be submitted on the original entry form found in Issue 35 of Take 5 magazine. No copies of the official entry form will be accepted. All entries must be sent by standard Australia Post.
All entries must be received by the Promoter during the Promotional Period. The Promoter is neither responsible nor liable for late, lost or misdirected entries, or entries not received by the Promoter for any reason whatsoever. No responsibility will be taken by the Promoter in the event that the original entry is lost or damaged.
The first relevant number of valid entries drawn from all entries received from each night/question (individual entry period) will win the specified prizes as follows:
Night/question 1: One (1) x $5,000.00 – awarded in the form of a cheque made in favour of the winner.
Night/question 2: One (1) x $5,000.00 – awarded in the form of a cheque made in favour of the winner.
Night/question 3: One (1) x $5,000.00 – awarded in the form of a cheque made in favour of the winner.
Night/question 4: One (1) x $5,000.00 – awarded in the form of a cheque made in favour of the winner.
Night/question 5: One (1) x $5,000.00 – awarded in the form of a cheque made in favour of the winner.
Night/question 6: One (1) x $5,000.00 – awarded in the form of a cheque made in favour of the winner.
The total prize pool is valued at up to AUD$30,000.00 (including GST). Any ancillary costs associated with redeeming the prize are not included. These are the responsibility of the winner.
All prizes must be taken as offered. The prize, or any unused portion of the prize, is not transferable or exchangeable. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.
The prize will be delivered to the nominated address of the Prize winner. Delivery of the Prize is valid to any state and/or city in Australia.
In the event that for any reason whatsoever the Winner does not take the prize at the time stipulated by the Promoter, then the prize will be forfeited by the Winner and cash will not be awarded in lieu of the prize.
In the event that a prize, or part of a prize, is unavailable, the Promoter reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal recommended retail value and/or specification subject to any written directions from the various Lottery Departments.
The Promoter is not responsible nor liable for any prize damaged in transit in the delivery of their prize.
General terms: Unless otherwise due to fraud or ineligibility under these terms and conditions, all valid prize claims in excess of the advertised prize pool will be honoured.
Printing and other quality control errors will not invalidate an otherwise valid prize claim. In the event of a query as to the validity of an entry, the judges will determine whether or not the entry is to be deemed valid, taking into consideration all mitigating circumstances and knowledge available to them at the time of the judging. No correspondence will be entered into.
In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including but not limited to natural disaster)the Promoter reserves the right to subject to reference to all relevant state and territory rules and regulations, to cancel, terminate, modify or suspend the promotion.
Ineligible, illegible or incomplete claims and entries received will be considered null and void. Instant win game materials are rendered void if stolen, forged, mutilated, incomplete or tampered with in any way. Photocopied or faxed claims and entries will not be accepted.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to the directions of any regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia and New Zealand (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
