TERMS AND CONDITIONS:
PARTICIPATION
1.Information on how to enter the Pringles Tortilla 'Mexico 2016' Promotion (Promotion) and the prizes form part of these Terms and Conditions. By participating, Entrants (as defined below) agree to be bound by these Terms and Conditions. Promotion is not valid in conjunction with any other special, discount or promotional offer unless indicated otherwise.
2.Entry is only open to Australian residents aged 15 years or over (Entrants). Entrants under 18 years old must obtain consent from their parent/guardian to enter and further, the parent/guardian of the Entrant must read and consent to these Terms and Conditions. Parents/guardians may be required to enter into a further agreement as evidence of their consent.
3.If the winner of the Major Prize (as defined below) is under the age of 18 years, the Major Prize will be awarded to the winner's nominated parent or guardian on the winner's behalf.
4.Employees (and the immediate families) of the Promoter, retailers of Pringles Tortilla products and agencies associated with this promotion are ineligible to enter. The promoter is Stuart Alexander & Co Pty Ltd (ABN 43 000 058 677) of Level 3, 1 Smail Street, Ultimo, NSW 2007, Australia (Promoter).
5.The Promotion commences on 1st August 2016 at 12:01am (AEST) and entries close at 11:59pm (AEDST) on 23rd October 2016 (Promotional Period).
ENTRY
6.To enter the Promotion, Entrants must, during the Promotional Period undertake the following steps: a.purchase any two (2) Pringles Tortilla cans, on the same day, from any participating retailer (Qualifying Purchase). Participating retailer ("Participating Retailer") means any retailer, supermarket or convenience store that stocks Pringles Tortilla products nationally including but not limited to IGA, Supa IGA, Foodland, Woolworths Petrol and Foodworks, but excluding all Coles and Woolworths/Safeway and Aldi supermarkets and Coles Express convenience stores nationally. For the avoidance of doubt, the two (2) Pringles Tortilla products do NOT have to be purchased in a single transaction, or from the same Participating Retailer but must be purchased on the same day; and
b.submit a valid entry form in accordance with clause 7 below.
7.To submit a valid entry form, Entrants must then: a.visit the promotional website at
www.winwithpringles.com.au (Promotional Website).
b.fully complete the online entry form including but not limited to entering the last four (4) digits of the product barcodes (printed on the Pringles Tortilla products), and a valid email address; and
c.submit the fully completed online entry form online during the Promotional Period.
8.Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per Qualifying Purchase; (b) each entry must be submitted separately and in accordance with the entry requirements; (c) only two (2) product barcodes per entry are permitted; (c) unrecognised barcodes will be deemed invalid; and (d) maximum of one (1) entry per Entrant per day is permitted.
9.Entrants must retain the original purchase receipt(s) for each Qualifying Purchase used to enter the Promotion. The original purchase receipt(s) must clearly show where and when each Pringles Tortilla product was purchased. Failure to produce the original purchase receipt for an entry when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an Entrant's entries and forfeiture of any right to a prize.
10.All entries must be received by the Promoter during the Promotional Period. Entries received before the start of the Promotional Period or after the close of the Promotional Period will be deemed invalid and will not be eligible to win a prize. Records of the Promoter are final and conclusive as to time of receipt. Incomplete, illegible or indecipherable entries will be deemed invalid.
11.Entrants can only enter in their own name and not on behalf of another individual. The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant's identity, age and place of residence and proof of purchase i.e. a copy of the receipt) and reserves the right, in its sole discretion, to disqualify any Entrant who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
12.If there is a dispute as to the identity of an Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Entrant.
PRIZES AND DRAWS
Instant Win Prizes
13.There are a total of two hundred and ten (210) prizes to be won instantly during the Promotional Period (Instant Win Prizes). Instant Win Prizes will be awarded randomly during the Promotional Period. Entrants will be notified upon submitting a valid online entry form, in accordance with clause 7 above, whether they have won an Instant Win Prize.
14.All valid entries received will be automatically placed in the draw for the Major Prize (as defined below), irrespective of whether they are also the winner of an Instant Win Prize.
15.Instant Win Prizes consist of: a.20 x $100 cash transferred into the respective winners' bank account via EFT;
b.40 x $50 cash transferred into the respective winners' bank account via EFT;
c.50 x $20 cash transferred into the respective winners' bank account via EFT; and
d.100 x $10 cash transferred into the respective winners' bank account via EFT.
Upon receiving the Instant Win Prize notification online, Instant Win Prize winners will be sent an email that will contain a link to a secure page where Instant Win Prize winners will be instructed to provide their EFT details. If an Instant Win Prize winner does not have a bank account, their Instant Win Prize will be awarded in the form of a cheque in the Instant Win Prize winner's name as it appears on the winning entry form. Instant Win Prizes must be claimed by 23rd January 2017. The names of Instant Win Prize winner's will be published online at

16.Total Instant Win Prize pool value is AU$6,000.
17.The Promoter will not, to the fullest extent permitted by law, take any responsibility for any Instant Win Prizes being lost and/or transferred to an inaccurate/incorrectly provided bank account or cheque sent to an inaccurate/incorrectly provided address.
18.If any Instant Win Prizes are not awarded during the Promotional Period, or are awarded but not claimed by 23rd January 2017, (Remaining Instant Win Prizes) then a draw for those Remaining Instant Win Prizes will take place at 10:00am (AEDST) on the 30th January 2017 at Anisimoff Legal, Suite 5, Erina Plaza, 210 Central Coast Highway, Erina, NSW 2250, subject to any directions from a regulatory authority. The winner/s, if any, will be notified in writing by email within two (2) business days of the draw and their names will be published online at
www.winwithpringles.com.au from 13th February 2017. The email will contain a link to a secure page where Remaining Instant Win Prize winners will be instructed to provide their EFT details. If a Remaining Instant Win Prize winner does not have a bank account, their Remaining Instant Win Prize will be awarded in the form of a cheque in the Remaining Instant Win Prize winner's name as it appears on their winning entry form. Remaining Instant Win Prizes must be claimed by 30th April 2017.
19.By participating in this Promotion, Entrants consent to the Promoter making a payment into their nominated bank account by EFT transfer. The Promoter, in its discretion, reserves the right to refuse the award of an Instant Win Prize if an Instant Win Prize winner declines to provide their bank account details, or the details required to enable the Promoter to deliver the Instant Win Prize by cheque.
Major Prizes
20.The draw for the Major Prizes (as defined below) will take place at 10:00am (AEDST) on the 7th November 2016 at Anisimoff Legal, Suite 5, Erina Plaza, 210 Central Coast Highway, Erina, NSW 2250. The Promoter may draw additional reserve entries and record them (in the order in which they were drawn) in case an invalid entry or ineligible Entrant is drawn. The winners of the Major Prizes (Major Prize Winners) will be notified by email within two (2) business days of the draw and their names will be published online at
www.winwithpringles.com.au from 21st November 2016.
21.The Major Prize Winners must follow the instructions set out in the winner notification email referred to in clause 20 and respond by 7th February 2017 in order to claim their prize.
22.Entries will be split into the following five (5) State/Territory groups for the purpose of the Major Prize Draw (according to the Entrant's residential address as indicated on their entry): a.NSW/ACT;
b.VIC/TAS;
c.QLD/NT;
d.SA; and
e.WA.
23.The first valid entry drawn in each State/Territory group, in the draw for the Major Prize (as defined below) will each win one (1) trip to Mexico for two (2) people, valued at up to AU$10,000 (Major Prize) depending on the dates in which the prize is taken and the point of departure. Acceptance of the Major Prize is subject to the Major Prize Winners (and their companions), at all times, abiding by the conditions set out in these Terms and Conditions. Each Major Prize consists of:
◦Return economy class airfares for two (2) from the Major Prize Winner's nearest Australian capital city to Mexico City (with airline to be selected and booked by the Promoter at its discretion);
All airline and airport taxes;
Return private transfers from airport to hotel in Mexico City;
Four (4) nights 4-star twin share or double room accommodation in Mexico City (with hotel to be selected and booked by the Promoter's at its discretion); and
Daily breakfast for two (2) people (on a set menu).
24.For the avoidance of doubt there will be a total of five (5) Major Prizes drawn as part of this Promotion, one (1) Major Prize per State/Territory group set out in clause 23.
25.Each Major Prize Winner and their companion must book the Major Prize a minimum of forty-five (45) days in advance of requested departure dates and by no later than 7th May 2017. Travel must be completed by no later than 17th November 2017. No exceptions permitted. All travel is subject to availability at all times and maybe dependent on additional conditions, including but not limited to select seat class with airlines or specific room category availability with accommodation partner. Availability cannot be guaranteed during Christmas, Easter, holidays and special event periods and additional blackout periods may apply. If the Major Prize Winner cannot travel in accordance with these Terms and Conditions, the Major Prize will be forfeited. If, for any reason, the Major Prize Winner does not take an element of the Major Prize during the stated period, and on the conditions stipulated by the Promoter or any third parties, then that element of the Major Prize will be forfeited and cash will not be awarded in lieu of that element of the Major Prize.
26.Spending money, excess baggage costs, meals, taxes (excluding airport and airline taxes), visa costs, custom charges, travel insurance, transport to and from the airport departure point in each Major Prize Winner's nearest Australian capital city, any additional transfers other than those referred to in the Terms and Conditions, items of a personal nature, in-room charges, vaccinations and all other ancillary costs are not included in the Major Prize. Frequent flyer points will not form part of the Major Prize. The Major Prize is subject to the standard terms and conditions of individual Major Prize service providers. The Major Prize Winners may be required to present their credit card at time of accommodation check in as a security measure for any charges incurred during the stay over and above the cost of accommodation.
27.Each Major Prize Winner acknowledges, and must ensure that each companion acknowledges, that elements of the Major Prize may be subject to additional terms and conditions imposed by third party prize suppliers, including booking conditions, fare rules including any amendment fees, baggage restrictions, conditions of carriage, codes of conduct and any standard restrictions or participation conditions in addition to those outlined above in clause 25 and 26. The Major Prize Winners and their companions must become acquainted with any such additional terms and conditions before taking the Major Prize. The Promoter does not accept any responsibility, and is not liable for, any additional conditions imposed by third party service providers on the taking of the Major Prize, or for the breach of those conditions by any person and the consequences, which may follow.
28.The Major Prize Winners and their companions are responsible for their own travel to and from their nominated departure point, and must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in agreement with the winner but in the event that agreement cannot be reached, the Promoter reserves the right to determine the itinerary. Flight schedules and accommodation arrangements are subject to change without notice.
29.The Major Prize Winners and their companions are responsible for any amendment fees issued by airlines or suppliers once booking is confirmed and ticketed. No compensation or alternative travel plans will be arranged should the Major Prize Winner and/or their companion miss their outbound or return flights or fail to meet any check in requirements for any reason. These costs will be the responsibility and expense of the Major Prize Winner and their companion. Unless expressly stated in these Terms and Conditions all other expenses become the responsibility of the Major Prize Winner.
30.The Promoter recommends that each Major Prize Winner and their companion obtain travel insurance.
31.To the extent permitted by law, the Promoter is not responsible for and cannot be held liable for any element of the Major Prize which is cancelled or delayed, or where the location is changed, or any other occurrence, which is out of the reasonable control of the Promoter.
32.The Major Prize Winners and their companions acknowledge that the Major Prize can be dangerous and could potentially result in injury or death, and participate at their own risk. The Major Prize Winners and their companions must: (a) attend, undergo and pass any appropriate training, briefings, required medical tests and other requirements as determined by the Promoter in their absolute discretion; (b) not be under the influence of drugs or alcohol when they redeem or partake in the prize; (c) comply with all directions of the Promoter at all times. The Promoter in its absolute discretion, at all times reserve the right to: (a) prevent any Major Prize Winner or their companions from participating in the Major Prize if, at any time, they reasonably believe that the Major Prize Winner or their companions pose a safety risk to themselves or to others or for any other reason; and/or (b) cancel the Major Prize if the conditions are deemed dangerous. If the Major Prize is varied for any reason beyond the control of the Promoter it may not be rescheduled and no compensation will be offered. During the entire duration of the Major Prize, a nominated parent/guardian must accompany, and will be responsible for, any person under 18 years of age.
33.The Major Prize Winners and their companions must have a valid passport with at least six (6) months validity as at the anticipated return date to be able to travel to Mexico. The Promoter cannot be held liable and won't take any responsibility if the visa or entry into Mexico is being denied to any of the Major Prize Winners or their travel companions.
34.A draw(s) for any unclaimed Major Prize(s), may take place on 21st February 2017 at the same time and place as the original Major Prize draw, subject to any directions from a regulatory authority. Winners (if any) will be notified by email within two (2) business days of the draw and their names will be published online at
www.winwithpringles.com.au from 7th March 2017.
GENERAL:
35.The total prize pool for this Promotion is up to AU$56,000.00.
36.The Promoter's decision in all matters relating to this Promotion is final and no correspondence will be entered into.
37.Prizes are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
38.If a prize (or an element of a prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that element of the prize) with another prize of equal value and/or specification, subject to any written directions from a regulatory authority.
39.If for any reason a winner does not use or take a prize (or an element of a prize) by or at the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.
40.Entrants who win a prize consent to the Promoter using their name, likeness, image and/or voice (including photograph, film and/or recording of the same), in any media, for an unlimited period and without remuneration, for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
41.If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter (including but not limited to technical difficulties, unauthorised intervention or fraud), the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
42.Any cost associated with entering the Promotion, or accessing the Promotional Website is the Entrant's responsibility and is dependent on the Internet service provider used.
43.Quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all Instant Win Prize claims in excess of the advertised prize pool will be honoured. Any unclaimed Instant Win Prizes that are part of the advertised total prize pool which are not awarded as Instant Win Prizes under clause 15 will be awarded in the unclaimed prize draw set out in clause 18. There will be a total of up to two hundred and ten (210) electronic Instant Win Prize notifications issued for this Promotion.
44.Any documentation associated with a prize, including instant win game materials, tickets and vouchers, are void if stolen, forged, mutilated or tampered with in any way.
45.Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
46.Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Entrant; or (f) use of a Major Prize or Instant Win Prize.
47.As a condition of accepting the Major Prize, the Major Prize Winner (and their companion/s), or their parent/legal guardian in the event they are under the age of 18, must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. In the event a Major Prize Winner is under the age of 18, a nominated parent/legal guardian of such person will be required to sign the legal documentation required under this clause on their behalf.
48.The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such personal information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on Entrants providing their personal information. The Promoter will collect, store, use and disclose personal information as set out in its Privacy Policy, which can be viewed at
www.winwithpringles.com.au. In addition to any use that may be outlined in the Promoter's Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the personal information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Entrant. The Privacy Policy also contains information about how Entrants may opt out, access, update or correct their personal information, how Entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter.
49.The laws in force in Australia apply to this Promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.
