Sponsor

The #HowIRoam contest (the "Contest") is provided by Blundstone Australia Pty Ltd (the “Sponsor”).

Eligibility

The contest is open only to legal residents of Australia who are 18 years of age or older at the time of entry. Excluded from eligibility are officers, directors, employees, agents and representatives of Blundstone Australia Pty Ltd, Sol Invictus Motorcycles Pty Ltd and Primer Pacific Pty Ltd (collectively, the "Excluded Individuals"). NO PURCHASE IS NECESSARY TO ENTER THE CONTEST. The Contest is void where prohibited by law.

Acceptance of rules

Participation in the Contest constitutes an entrant's full and unconditional agreement to these Official Contest Rules (the "Rules"), as may be amended by Blundstone Australia Pty Ltd at its sole discretion from time to time. Winning a prize is contingent upon a winning entrant also fulfilling all requirements set forth in these Rules.

Contest period

The Contest commences at 00:00 AM (EST) on August 2, 2016 and, subject to these Rules, concludes at 11:59 PM (EST) on September 30, 2016 (the "Contest Period"). Weekly giveaway dates will be selected and announced through social media by and at the discretion of the Sponsor. Additional giveaways may be announced without notice at any time during the Contest Period.

Participation and contest entiries

To participate in the Contest, entrants must have an Instagram account.  At the time of writing of these Official Rules, there are no fees known by the Sponsor to be associated with the creation of an Instagram account.
Entrants are encouraged to take Instagram photos of themselves in their element and share each image using hashtag #HowIRoam and @blundstone (each a "Photo Submission").

Only Photo Submissions which include the hashtag #HowIRoam in the description may be claimed as valid Photo Submissions to enter the Contest. Photo Submissions must be the original work of the Contest entrant, and not contain any content or subject matter that would violate or infringe upon the rights of a third party (including copyrights, trademarks, or rights of privacy or publicity). Blundstone Australia Pty Ltd retains the sole discretion to disqualify any Photo Submission that it believes contains obscene, insensitive or inappropriate content, and that does not comply with these official Rules or is not consistent with the spirit of the Contest. 

Incomplete entries or Photo Submissions received after the expiry of the applicable Contest Period will be considered null and void and ineligible to be considered for or to win any prize under this Contest. 

There is no limit to the number of Photo Submissions an entrant may provide.  Once an entrant has won a weekly prize for a Photo Submission, that Photo Submission and entrant will no longer be eligible to win a weekly prize during the Contest Period. Weekly winners, as well as those entrants whose Photo Submission, were not selected to win a weekly prize, will be eligible to win the “Grand Prize” giveaway at the conclusion of the Contest Period.

Prizes and prize value

Prizes will be provided by Blundstone Australia Pty Ltd. Prizes will be awarded by the Sponsor in accordance with these Rules. Weekly prizes are expected to include (but are not limited to): Blundstone Australia Pty Ltd boots (with each such weekly award having an estimated maximum retail value of AUD$478 and gear from Poler Stuff (with each such weekly award having an estimated retail value of between AUD$129.98 and $179.98). The total weekly prizes will have a total estimated RRP value between $607.98 and $657.98 depending on the items selected by the winner. The “Grand Prize” will include one (1) pair of boots from Blundstone Australia Pty Ltd (max RRP 239.00) and one (1) Sol Invictus Nemesis (including on road costs), one (1) Sol Invictus Riding Jacket and one (1) pair of Sol Invictus Gloves (with such Grand Prize having a combined estimated retail value of $10,478).

Selection of winners and judging criteria

Weekly winners (the “Prize Winners”) will be selected by the Sponsor from the pool of eligible Photo Submissions submitted during the Contest Period. A panel of at least three (3) Sponsor employees or nominated agents will review Photo Submissions received at any given time during the Contest Period and judge them on overall artistic merit, which may include (but not limited to): (i) creativity, (ii) composition, (iii) style, and (iv) aesthetics. In addition, when evaluating Photo Submissions for prize consideration, the Sponsor’s judging panel may consider as a factor the quantity of "likes" and comments associated with a Photo Submission, but the number of "likes" or comments will not be the ultimate determinant of any winning Photo Submission. The Entrant must be following @blundstone on Instagram to qualify.

Notification of winners

The Sponsor will attempt to notify Prize Winners via Instagram. If after exercising reasonable efforts, Blundstone Australia Pty Ltd cannot reach an entrant within two weeks from the first attempt to contact them, Blundstone Australia Pty Ltd will be free of any liability for awarding a given prize to that entrant or other entrants and such prize may be considered by the Sponsor to be forfeited for all purposes. If there is a dispute as to the identity of an entrant, the prize will be awarded to the authorized account holder of the social media account submitted when the photo was claimed.

Terms of acceptance

Each prize must be accepted as awarded. No substitution, assignment or transfer of prizes is permitted, except: (i) as otherwise explicitly provided herein; or (ii) at Blundstone Australia Pty Ltd’s sole discretion. Blundstone Australia Pty Ltd reserves the right to substitute a Prize with one (1) of comparable or greater value without liability or consent. Blundstone Australia Pty Ltd is not responsible for lost or misused prizes or promotional items. All costs and expenses not specifically included as part of any prize, including, without limitation, insurance, taxes, transportation costs, and any other expenses and any taxes thereon, are the sole responsibility of the winner.

Privacy and publicity rights

Blundstone Australia Pty Ltd, its authorized agents and/or representatives may collect, use, and disclose the personal information provided by each entrant at the time they enter the Contest for the purposes of administering the Contest and prize fulfillment. By entering this Contest, each entrant expressly consents to the use of their personal information for such purposes.

By accepting a prize, a winner hereby consents to BLUNDSTONE AUSTRALIA PTY LTD ’s use of the winner's name, city of residence, picture or other photographic image, biographical information, statements, voice and likeness in any advertising and publicity that BLUNDSTONE AUSTRALIA PTY LTD may conduct in any media or format, whether now known or hereafter developed, including but not limited to the Internet, at any time in perpetuity, without further compensation or notice to the winner.

Rights in photo submissions

Entrants agree that upon submitting a Photo Submission, Blundstone Australia Pty Ltd shall have a worldwide, unlimited, irrevocable perpetual license to use, publish, distribute, publicly perform or display, post electronically, create derivative works from, or otherwise reproduce in any manner the entrant's Photo Submission in any media or format whatsoever, whether now known or hereafter developed, including but not limited to the Internet, at any time in perpetuity, without further compensation or notice to the winner and also including, without limitation, in connection with Blundstone Australia Pty Ltd’s social media, websites, and photostreams anywhere in the world, without further payment or notice for the purposes of Blundstone Australia Pty Ltd’s advertising, marketing, promotion, and/or journalistic, archival, historical, internal and external recognition activities.  To the fullest extent permitted by applicable law, each entrant waives all moral rights in and to the Photo Submissions.

Additional terms

Blundstone Australia Pty Ltd reserves the right, at its sole discretion, to disqualify any entrant from the Contest if Blundstone Australia Pty Ltd finds or reasonably believes such individual to be tampering with the entry process or the operation of the Contest or where applicable, the Contest Page; and/or to be acting: (i) in violation of these Rules; (ii) in an unsportsmanlike or disruptive manner; or (iii) with the intent to annoy, abuse, threaten or harass Blundstone Australia Pty Ltd, or any of their respective employees, any other Contest entrants, or any other person.  Any attempt by an entrant or other individual to automate the entry process, or to otherwise undermine the legitimate administration, security or operation of the Contest is prohibited and may be a violation of applicable criminal and civil laws. Blundstone Australia Pty Ltd reserves the right to seek remedies and damages from any such person to the fullest extent permitted by law. Entrants engaging in any of the foregoing activities may be disqualified and will forfeit any prizes awarded to such entrant.

The decisions of Blundstone Australia Pty Ltd in regards to all matters of the Contest are final and binding upon entrants. In the event of any dispute regarding the interpretation of the rules of the Contest or any decision rendered by Blundstone Australia Pty Ltd, the decision or interpretation of Blundstone Australia Pty Ltd shall prevail.
All entrants must comply with all applicable laws.

Releases and limitations

Entrants acknowledge that Blundstone Australia Pty Ltd, and all involved advertising and promotional agencies, other suppliers providing Prizes or other materials or services in connection with this Contest, anyone else involved in the development or execution of this Contest (e.g., Instagram, Sol Invictus, Poler Stuff), each of their respective parent companies, subsidiaries and affiliated companies and each of their respective shareholders, directors, officers, employees, agents, representatives, successors and assigns (collectively, the "Releasees") have not made, nor are in any manner responsible, for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to, its quality, merchantability and fitness for a particular purpose or the use thereof.  Further, no responsibilities are accepted by any of the Releasees for any additional expenses, omissions, delays, re-routing, or acts of any government or authority.

BY PARTICIPATING IN THE CONTEST, EACH ENTRANT HEREBY RELEASES AND HOLDS HARMLESS ALL OF THE RELEASEES FROM ANY AND ALL LIABILITY, INJURIES, LOSS, CLAIMS OR DAMAGE OF ANY KIND WHATSOEVER (INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES) ARISING FROM OR IN CONNECTION WITH: (I) PARTICIPATING IN THE CONTEST; AND/OR (II) ACCEPTANCE, USE, MISUSE OR NONUSE OF ANY PRIZE OR PARTS THEREOF, INCLUDING, WITHOUT LIMITATION, LIABILITY FOR DEATH, PERSONAL INJURY, DAMAGE OR LOSS OF ANY KIND, LOSS INCURRED DURING TRAVEL TO/FROM, AND/OR ATTENDANCE AT, ANY OF THE EVENTS FORMING PART OF THE PRIZES AND FROM LIABILITY TO ANY OTHER PERSONS RELATING TO OR RESULTING FROM ENTERING THE CONTEST.

Without limiting the foregoing, the Releasees are not responsible for: (i) any incorrect or inaccurate information, whether caused by an entrant, Instagram, or any third parties, or by any of the equipment, hardware, software or programming associated or used with the Contest; (ii) technical errors, defects, delays or failures of any kind, including, without limitation, malfunctions, interruptions or disconnections in communications lines, Internet or website access, hardware or software; (iii) digital or electronic disruptions (e.g., security breaches); (iv) unauthorized human intervention (e.g., hacking); (v) technical or human error which may occur in connection with any aspect of the Contest; (vi) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from an entrant’s participation in the Contest, or receipt or use of any Prize; (vii) an entrant’s breach of Instagram and/’s terms of use; and (viii) lost, incomplete, illegible or garbled entries, mail or transmissions, interrupted or unavailable network, server or other connections, miscommunications, computer viruses, bugs, worms, tampering, unauthorized intervention, fraud, failed computer hardware or software or telephone transmissions, or other errors or problems of any kind whether electronic, mechanical, or human.

Governing law

The Contest and the Rules shall be governed exclusively by and construed in accordance with the laws in the State of Tasmania, Australia, without regard to conflicts of laws principles. Any dispute not otherwise determined in accordance with these Official Rules of the Contest shall be adjudicated in the courts sitting in Tasmania, Australia (or any appeals court therefrom).
