CHANCE TO WIN EASTPOINT FOOD FAIR GIFT CARDS (“Promotion”) TERMS AND CONDITIONS OF ENTRY
1. Information on how to enter the Promotion forms part of these terms and conditions of entry. Participation in this Promotion is deemed acceptance of these terms and conditions of entry. 2. The Promotion is only open to Australian residents 18 years and over. 3. Directors, officers, management, employees (and their immediate families) of the Promoter, their respective related bodies corporate, contractors and associated companies of the Promoter, retailers at the Centre and any other agencies associated with the Promotion are ineligible to enter. 4. The Promotion commences at 9:00am on Monday, 8 August 2016 and concludes at 8:30am on Monday, 3 October 2016 (“Promotion Period”). 5. This Promotion is being run at Eastpoint Food Fair, 237-287 New South Head Road, Edgecliff NSW 2027 (“Centre”) during the Promotion Period. 6. The promoter of this Promotion is Tanert Pty Ltd (ABN 28 000 634 024) care of JLL, Level 25, 420 George Street, Sydney, NSW 2000. Telephone 02 9220 8500 (“Promoter”). Trade Promotion 7. To enter the Promotion entrants must, during the Promotion Period: a. shop at 2 or more separate retailers of the Centre and spend a combined total of at least $25.00 at those retailers in a single day; and b. complete the entry form supplied by retailers of the Centre and/or located at the Promotion entry boxes and place the completed entry form in the Promotion entry boxes. 8. To be a valid entry, each entry in the Promotion must be on a fully completed entry form and contain the entrants first name, surname, email address and a valid contact phone number and be placed in the Promotion entry boxes provided by the Promoter on Level 4 of the Centre near the entrance to Coles. 9. Entrants can enter in the Promotion more than once during the Promotion Period. Entrants must attach their receipts to their completed entry form to validate their purchases before placing their entry in the Promotion entry boxes. 10. No responsibility is accepted for late, lost or misdirected entry forms. Entry forms for each weekly prize that are received after the closing dates and times for that particular weekly prize as specified in clause 16 below will not be considered. 11. Partial lay-by receipts, bill payments such as the payment of credit card bills, bank transactions, bank fees and charges and service bills (such as gas, electricity, rates or water) are not valid purchases for the purpose of this Promotion. 12. The Promoter reserves the right to verify the validity of entries, prize claims and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry or prize claim that is not in accordance with these terms and conditions or who tampers with the entry process. 13. An entry that is incomplete, indecipherable, illegible or non-compliant with these terms and conditions is invalid and will not be accepted or considered. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 14. The prize or any unused portion of the prize is not redeemable for cash and not transferable or exchangeable and must be taken as offered. No compensation will be payable if a winner is unable to use the prize as stated. The prize is not valid with any other promotional offer or discount being offered by the Promoter at the Centre. 15. The prize consists of 8 Eastpoint Food Fair Gift Cards each with a value of $2,500 (Eastpoint Food Fair Gift Card). Each Eastpoint Food Fair Gift Card will be valid for use for 12 months from the date of issue. During the Promotion Period, 1 entrant will be drawn each week at the Centre and win an Eastpoint Food Fair Gift Card as follows: a. Prize 1: 9:00am on Monday, 15 August 2016; b. Prize 2: 9:00am on Monday, 22 August 2016; c. Prize 3: 9:00am on Monday, 29 August 2016; d. Prize 4: 9:00am on Monday, 5 September 2016; e. Prize 5: 9:00am on Monday, 12 September 2016; f. Prize 6: 9:00am on Monday, 19 September 2016; g. Prize 7: 9:00am on Monday, 26 September 2016; and h. Prize 8: 9:00am on Monday, 3 October 2016. 16. The Promotion entry boxes provided by the Promoter at the Centre will close for entries for each weekly prize as follows: a. Prize 1: 8:30am on Monday, 15 August 2016; b. Prize 2: 8:30am on Monday, 22 August 2016; c. Prize 3: 8:30am on Monday, 29 August 2016; d. Prize 4: 8:30am on Monday, 5 September 2016; e. Prize 5: 8:30am on Monday, 12 September 2016; f. Prize 6: 8:30am on Monday, 19 September 2016; g. Prize 7: 8:30am on Monday, 26 September 2016; and h. Prize 8: 8:30am on Monday, 3 October 2016. 17. Once a winner has been selected to win the Eastpoint Food Fair Gift Card for that week as set out above at clause 15, the Promotion entry boxes will be emptied of entry forms by the Promoter, and will re-open for entry in the Promotion for the remaining weekly prizes as follows: a. Prize 2: 9:30am on Monday, 15 August 2016; b. Prize 3: 9:30am on Monday, 22 August 2016; c. Prize 4: 9:30am on Monday, 29 August 2016; d. Prize 5: 9:30am on Monday, 5 September 2016; e. Prize 6: 9:30am on Monday, 12 September 2016; f. Prize 7: 9:30am on Monday, 19 September 2016; and g. Prize 8: 9:30am on Monday, 26 September 2016. 18. The winner of each of the prizes in the Promotion will be the first drawn eligible entry from each draw. The winner need not be present at each draw. 19. The Promoter’s decision is final and no other correspondence will be entered into. The Promoter reserves the right to draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. 20. The winner of each of the prizes will be notified by email and phone within 2 business days of being selected. The name and address of the winner will also be published in the Wentworth Courier within 10 business days of being selected. 21. Each of the prizes must be collected within 5 business days from the date of the winner being selected. Failure to collect a prize within this time will result in it being forfeited and the Promoter may draw/select another winner for the prize, subject to any approval or directions of a relevant regulatory authority. The winner of any redraw will be notified by email and phone within 2 business days of being selected. The name and address of the winner of any redraw will also be published in the Wentworth Courier within 10 business days of being selected. 22. If this Promotion is interfered with in any way or is not capable of being conducted as reasonable anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its absolute discretion, to modify, suspend, terminate or cancel the Promotion to the full extent permitted by law and subject to any approval or directions from a regulatory authority. 23. It is a condition of entry that the entrant consents to the Promoter using the entrant’s name, likeness, image and/or voice in the event they are a winner of a prize (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of the Promotion (including any outcome), and promoting any products and services, distributed and/or supplied by the Promoter in the Centre or otherwise. 24. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings or the use thereof. It is the responsibility of each entrant to seek independent advice on the possible implications this may have on their own financial situation. 25. The Promoter will not be held responsible for any lost or stolen Eastpoint Food Fair Gift Cards. 26. All Eastpoint Food Fair Gift Cards in the Promotion are being supplied by the company GiVV Technologies Pty Ltd for a fee paid by the Promoter. If for any reason GiVV Technologies Pty is wound up, deregistered, placed into administration or liquidation or becomes insolvent (insolvency event), the Promoter, the Centre, and/or retailers of the Centre, will not be required to honour a purchase using any remaining value a winner may have on an Eastpoint Food Fair Gift Card. The Promoter will not be held responsible for any loss or damage, including the loss of any value on an Eastpoint Food Fair Gift Card, suffered or sustained by a winner of the Promotion as a result of GiVV Technologies Pty Ltd suffering an insolvency event. 27. By entering the Promotion, an entrant releases and indemnifies the Promoter (including its related bodies corporate and officers, employees and agents) from and against all actions, liabilities, penalties, claims or demands the entrant may have against the Promoter or that the Promoter may incur for any loss or damage which is or may be suffered or sustained as a direct or indirect result of an entrant entering or participating in the Promotion or winning or failing to win a prize, or using or permitting any other person to use the prize, except for any liability which cannot be excluded by law or which would cause any part of this clause to be void or unenforceable. 28. If all or part of any term or condition contained in these terms and conditions shall be declared or become unenforceable, invalid or illegal for any reason, such term or condition (or part thereof) shall be deemed severed from these terms and conditions and the other terms and conditions hereof shall remain in full force. 29. Authorised under permit number: LTPS/16/05480.  Privacy The Promoter collects the entrants’ personal information to assist it in promoting the Centre and the retailers of the Centre and to process the Promotion entries. By entering the Promotion, unless otherwise advised, each entrant also expressly consents to: a. the Promoter (or any of its related companies) contacting an entrant by any means (including electronic message or by telephone) to let the entrant know about goods, services or promotions which the Promoter considers may be of interest to the entrant; b. use that information, in any media, for their own marketing, promotional or publicity purposes (and expressly entrant expressly consents to such persons or entities contacting the entrant by electronic message or by telephone in relation to goods or services), without any further reference, payment or other compensation to the entrant. The express consent referred to in this clause continues until the withdrawal of that consent is effective (as set out under applicable law). All personal details of the entrant will be stored at the Centre. A request to access, update or correct any information should be directed to the Centre.
