1. STANDARD TERMS
Information on how to enter forms part of the terms of entry. Entry into the promotion is deemed acceptance of these conditions of entry.
This is a Game of Chance where skill plays no part in the outcome and the winners will be selected randomly.
2. WHO CAN ENTER?
Subject to clause 2.3, entry is open to South Australian residents only.
Entrants under 18 years old must have parental/guardian approval to enter and the parent/guardian must read and consent to these terms and conditions. Parents/Guardians may also be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.
Employees and their immediate families of Friendly Society Medical Association Limited, National Pharmacies and Blackmores and all associated agents and suppliers associated with this competition are not eligible to enter.
3. HOW TO ENTER
3.1 To receive one (1) entry intro the draw retain your original receipt for any Blackmores product purchased valued at $40 or more before member benefit at any participating National Pharmacies outlet. Visit Promoplace.com.au/Blackmores and follow the instructions and complete all of the required fields.
3.2 Multiple entries are acceptable but every entry must be accompanied by an original receipt from the pharmacy for each purchase to qualify for each individual entry.
3.3 Any photocopy, scan or copy of the receipt in any form will make the entry ineligible to enter the competition.
3.4 To accept the prize the entrant must provide to the competition promoter the original receipt or will forfeit the prize.
3.5 Entrants who do not fill out all the required fields will be ineligible to enter the competition and their entries made null and void.
4. THE PRIZE(S)
4.1 The first two (2) valid entries drawn will each win a $1000 Coles Myer Gift Card.
4.2 The total prize value is $2000.
5. CRITICAL DATES
5.1 The competition commences at 12 midnight (AEST) on Wednesday the 7th of September 2016 and closes at 12 midnight on Tuesday the 4th of October 2016 (AEDST).
5.2 The prize draw will take place on Friday the 18th of October 2016 (AEST) at 11am at the offices of Prime Focus, Level 1, 500 Chapel Street, South Yarra VIC 3141
5.3 Winners will be notified by mail and email by Wednesday the 2nd of November 2016.
5.3 If any prizes are unclaimed a redraw will take place at 11 am on the 28th of January 2017 (AEDST) at the offices of the Friendly Society Medical Association at 52 Gawler Place, Adelaide South Australia.
5.4 In the case of a redraw, winners will be notified by mail and email by the 3rd of February 2017.
6. CONDITIONS REGARDING WINNING THE PRIZE(S)
6.1 If the winner of the major prize draw is under the age of 18 years, the prize will be awarded to the winner’s nominated parent or guardian on behalf of the winner.
6.2 The prizes are not transferable (except where the winner is under 18 years of age).
6.3 The winners of the prizes should seek independent financial advice about any tax implications that may arise from the prize winnings.
6.4 The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.
6.5 In participating in the competition, the winner agrees to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed, filmed for broadcast and photographed. The winners agree to grant the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winners (and their companion) will not be entitled to any fee for such use.
6.6 The Promoter may, for an indefinite period, unless otherwise advised, use the Information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
The Promoter’s decision is final and no correspondence will be entered into.
7. NO LIABILITY
This competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Eligible persons understand that they are providing their information to the Promoter and not to Facebook. The information an Eligible Person provides will only be used for the purposes outlined in these Conditions. Any questions, comments or complaints about this Competition must be directed to the Promoter and not to Facebook
7.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to government legislation.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right , in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantee, the Promoter (including its respective officers, employees and agents) and Prize Promoter are not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity) ; whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by the winner or entrant; or (f) use of the prize.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (‘Non-Excludable Guarantees’). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
8. THE PROMOTER AND PRIVACY POLICY
8.1 The Promoter may use any personal information entrants provide in connection with this Promotion for the purpose of the Promotion, and also in advertisements, publications, media statements and other promotional material associated with the Promotion. The Promoter may disclose the information for those purposes to its related bodies corporate and contractors. If entrants do not provide the information requested, they will not be able to enter the Promotion. The Promoter is bound by the Australian Privacy Principles contained in the Privacy Act 1988 (Cth).
