SURF – SPRING HOME IMPROVEMENT COMPETITION
TERMS & CONDITIONS




    Information on how to enter and prizes form part of these Terms and Conditions. Participation in this competition is deemed acceptance of these Terms and Conditions.

COMPETITION SUMMARY

    The Surf Spring Home Improvement Competition (Competition) is a game of skill.

ELIGIBILITY

    Entry is only open to Australian residents aged 18 years or over.
    Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

HOW TO ENTER

    The promotion period begins on 19 September 2016 and entries close at 11.59pm on 23 October 2016 (Promotion Period).
    To enter, entrants must:

        Purchase any Surf laundry detergent from Woolworths branded stores during the Promotion Period;
        Visit the www.surflaundry.com.au/spring website. Enter your contact details and tell us in 25 words or less “Which laundry scent inspires you for spring and why?”;
        Submit the completed entry form (with your proof of purchase). Valid proof of purchase includes Woolworths receipt number including any Surf laundry liquid or powder pack purchased during the promotion period.

    Entrants may enter as many times as they wish, provided each new entry is accompanied by a new purchase.

PRIZES

    The Prizes consist of:

        Minor Prizes;
        One Major Prize.

    The Minor Prizes consists of:

        1 x Clover Hill flower delivery.

    The Major Prize consists of:

        1 x in-home consultation with home improvement influencers Alisa and Lysandra;
        1 year of monthly Clover Hill flower deliveries;
        1 year supply of Surf laundry liquid (being 6 litres).

    Each entry will be individually judged based on creative and literary merit. The Judging Panel consists of three representatives from the Surf brand. The Judging Panel reserves the right to select additional reserve entries, which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible entrant.
    The judging for the Minor Prizes will occur at the end of each week. At the end of each week, the Judging Panel will choose the seven (7) best entries from the entire week.
    The Minor Prizes will then be delivered to each of the seven (7) winners.
    The judging for the Major Prize will take on Tuesday, 25 October 2016.
    A member of the Judging Panel will contact the winners of the Minor Prizes and the winner of the Major Prize by email and/or telephone. If the member is unable to get in contact with the winners of the Minor Prizes within 2 days, or the winner of the Major Prize within 5 days of initial contact being made, the winner’s entry will be deemed invalid and the prize will be offered to the next best entry as judged by the Judging Panel.
    The Promoter reserves the right to substitute any component of the prizes for a component of equal value at the Promoter’s sole discretion.
    The prizes cannot be gifted to other persons in lieu of the winner not being able to redeem the Prize. Should the winner not be able to complete all aspects of the prize, the remaining items shall be forfeited without any replacement for their value.
    The prize, or any unused portion of the prize, is not transferrable or exchangeable and cannot be taken as cash.

GENERAL

    The Promoter reserve the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity and age) and reserve the right, in their sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of their rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
    Incomplete or indecipherable entries will be deemed invalid.
    If there is a dispute as to the identity of an entrant, the Promoter reserve the right, in their sole discretion, to determine the identity of the entrant.
    All entries submitted become the property of the Promoter and will not be returned. As a condition of entering into this promotion, each entrant licences the Promoter to use their entry in any media for an unlimited period for any reason including but not limited to future promotional, marketing or publicity purposes. Entrants voluntarily and irrevocably consent to any use of their entry by the Promoter in a way, which may otherwise infringe their moral rights pursuant to the Copyright Act (Cth) or any similar law in another jurisdiction. To the extent permitted by law, entrants also waive all moral rights in their entry.
    Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
    Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if any tax liability incurred by a winner or entrant; or (f) use of a prize.
    The Promoter collect personal information (PI) in order to conduct the competition and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in their Privacy Policies: Unilever Australia Limited’s privacy policy can be accessed at http://www.unilever.com.au/resource/privacypolicy/index.aspx . In addition, if you have consented to the Promoter contacting you about future promotions and new products, the Promoter may, use your PI for those purposes, including sending electronic messages to you. The privacy policies also contain information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter.
