Entrants and their companion must be 18 years of age or over. However, where an entrant is under 21 years of age, that entrant must be accompanied by a parent or guardian who is 21 years of age or over whilst taking the prize (if applicable).
The Promoter may require entrants and their companion to provide proof of age in a form acceptable to the Promoter. Should an entrant or their companion be unable to satisfy this requirement, the entrant will be ineligible for the prize.
Entrants and their companion must be able to take the prize between 26th September, 2016 and 26th March, 2017.
Dates and schedules of the prizes are not under the Promoter’s control and are subject to change. The Promoter takes no responsibility for any date or schedule changes.
Entrants and their companion must be the holder of a current passport with at least 6 months validity from the travel date.
The prize winner and their companion are responsible for any visa requirements associated with the prize. If the winner and/or their companion is unable to obtain a relevant visa or travel document, and/or is refused entry into The US, the winner may forfeit the prize.
If requested by the Promoter (in its sole discretion), entrants and their companion must sign an indemnity and exclusion of liability form in order to be eligible to win and participate in the prize.
Entrants must nominate a personal contact number being either a personal mobile number or home phone number (and not a business number) to be eligible for the prize (Personal Contact Number).
By entering the Promotion, an entrant grants the Promoter the right to call that entrant on their Personal Contact Number on air.
Entrants in the Promotion must be able to receive a phone call from a representative of the Promoter (on their Personal Contact Number, as defined below) between 10:00am AEST and 10:00pm AEST between 26th September, 2016 and 30th September, 2016 and in accordance with the requirements outlined in the Entry Method to be eligible to be awarded the prize.
If the entrant does not answer their phone by the time that phone goes to a message bank, the entrant consents to the Promoter broadcasting that entrant's voicemail message including their full name and/or business name live on air.
Each entrant acknowledges and agrees that their whole voicemail message may be broadcast on-air during the Promotion Period.
Each entrant warrants that they have received all consents from third parties that may ordinarily answer their Personal Contact Number in the entrant's absence to be broadcast live on-air if that third party answers the relevant phone live on-air. If a third party answers an entrant's Personal Contact Number, that entrant will not be eligible for a prize as determined by the Promoter in its absolute and sole discretion.
An entrant who has won prizes to the value of $10,000 or more, in any promotion(s) run by the Promoter in the previous six (6) months prior to their Entry in this promotion is ineligible to enter this promotion.
The promotion begins at 5:00pm AEST on 23rd September, 2016.
Entries into the promotion close at 2:00pm AEST on 29th September, 2016.
Online Entry
During the Promotion Period entrants will be invited via Station on-air commercials to visit the Station Website and fully complete the online entry form in the manner required, including by providing their full name, mobile telephone number, current and valid email address, age and answering in 25 words or less the question “why do you want to meet Havana Brown in LA?”
Each Valid entry will be individually reviewed by representatives of the Promoter (Judges) based on the Judging Criteria.
Each day during the Promotion Period between 10:00am AEST and 10:00pm AEST the Judges (in their sole and absolute discretion) will:
a) select up to ten (10) entrants judged to have submitted the ‘best’ Online Entries based on the Judging Criteria (in the Promoter’s sole and absolute discretion) from all valid entries submitted by 2:00pm AEST that week day during the Promotion Period (each, a Selected Entrant);
b) contact up to ten (10) Selected Entrants (in the absolute and sole discretion of the Promoter) by telephone and place them on the standby list for the week day, and
c) invite the Selected Entrant who submitted the ‘best’ Online Entry (based on the Judging Criteria) to appear on air to participate in the On Air Challenge between 12:00pm AEST and 10:00pm AEST (Challenger).
On Air Challenge
a) For each On Air Challenge, the Promoter will have one (1) pre- determined location within LA, (Location) (as determined by the Promoter in its sole and absolute discretion).
b) The Challenger will be invited to correctly name the Location within Los Angeles based on the clues provided on air at the time of the On Air Challenge (as determined by the Promoter in its sole and absolute discretion)
c) The Challenger must state the correct Location (as determined by the Promoter in its sole and absolute discretion) to be awarded a place on the standby list for the Major Prize (each, a Finalist). For the avoidance of doubt, only the Challenger’s first response to the Location will be accepted.
d) Should the Selected Entrant fail to guess the location (as determined by the Promoter in its sole and absolute discretion), the Challenger will not be awarded the Prize and the Promoter (in its sole and absolute discretion) will invite the Selected Entrant who submitted the next ‘best’ Online Entry that day to appear on air to participate in the On Air Challenge as a Challenger. The Promoter will continue this process until a Challenger provides the correct Location (as determined by the Promoter in its sole and absolute discretion).
e) For the avoidance of doubt all decisions in relation to the On Air Challenges are in the Promoter’s sole and absolute discretion and no correspondence will be entered into.
On Friday 30th September, 2016 the Judges (in their sole and absolute discretion) will select one (1) winner from the five (5) Finalists on the Major Prize standby list based on their Online Entry as determined by the Judging Criteria and award them the Major Prize.
(a) contact the Finalist (on the number provided by the entrant in their entry) whose valid Online Entry is judged as the ‘best’ Online Entry based on the Judging Criteria and invite them to appear on air (Selected Finalist);
(b) if the Selected Finalist successfully appears on air will be awarded the Major Prize (as determined by the Promoter in its sole and absolute discretion), the Selected Finalist will be awarded the Prize;
(c) if the Selected Finalist declines, or is otherwise unable to appear on air, their telephone is turned off, drops out, is engaged or they are unreachable for any reason, the Promoter may (in its sole and absolute discretion) contact the Selected Finalist whose valid entry is judged as the next ‘best’ (based on the Judging Criteria) and contact that Selected Finalist by telephone (on the number provided by the entrant in their valid Online Entry) and invite them to appear on air to be awarded the Major Prize. This process will be repeated until a Selected Finalist successfully answers their telephone, appears on air, and is awarded the Major Prize (as determined by the Promoter in its sole and absolute discretion).
For the avoidance of doubt, if an entrant is spoken to by a representative of the Promoter, it does not mean they have been selected as a Selected Entrant/Challenger/Finalist or the Selected Finalist (as applicable) and they may not be invited to participate in the On-Air Game and/or be awarded a Minor Prize or Major Prize (if applicable)
For the avoidance of doubt, Selected Entrants/Challengers/Finalists or the Selected Finalist (as applicable) must appear on air during the Promotion Period to be deemed a winner and awarded a Minor Prize or Major Prize (if applicable) .
Entrants will also be asked at the time of entry if they would like to receive further information from Universal Music Australia, and if an entrant selects “yes” (via opt in tick box) when completing the online entry form their contact details will be passed on to Universal Music Australia (including for the purposes of direct marketing). Entrants may at any time unsubscribe from communications from Universal Music Australia by following the unsubscribe procedure contained in Universal Music Australia communications sent to subscribers.
Entrants may submit as many entries as they wish however each entry must be submitted via a separate online entry form and must independently comply with these Terms of Entry.
For the avoidance of doubt, entrants may only win one (1) Minor Prize and Major Prize each.
All valid entries will be individually judged by representatives of the Promoter by Friday 16th September 2016 at the Promoter’s premises to determine one (1) Major Prize winner. All valid entries will be judged based on the Judging Criteria. The winner will be notified in accordance with the Notification of Winners information set out below.
Each valid entry will be individually judged (by representatives of the Promoter) based on enthusiasm and creativity of the entrant’s Online Entry.
There is up to (1) Major Prizes to be won, as follows:
Prize
One (1) x trip to LA for the Prize winner and their companion.
Winners who’s ordinary state of residence is NOT NSW will be awarded one (1) travel prize for the winner and up to one (1) companion (companion must be aged 18 years or older,or where the winner is under 21, a parent or guardian aged 21 years or over to be determined by the prize winner and approved by the Promoter in its absolute and sole discretion) from the prize winner’s closest capital city to Sydney for their connecting flight to LA (inclusive). The travel prize comprises of the following components:
Two (2) adult return airfares from Sydney to LA (inclusive of airfare related taxes and charges); and
Five (5) nights minimum three (3) star accommodation (as determined by the Promoter in its sole and absolute discretion) in LA, twin share, to be shared by the winner and their companion; and
Lunch with Havana Brown at The Ivy, LA; and
Two (2) entries into a Universal Music Studios tour; and
Two (2) entries into Six Flags Magic Mountain theme park Valued at up to $4,500 (incl GST).
Tickets are valid for the date or period as indicated on the tickets. Tickets are subject to the conditions stipulated by the provider of the tickets.
For the avoidance of doubt, If Havana Brown is unable to or declines to attend the Meet and Greet for any reason, no replacement will be given for this portion of the Prize.
Travel Prize Terms and Conditions
The winner and their companion (if any) may be required to sign a code of conduct and/or a legal release or releases in the form determined by the Promoter in its sole discretion prior to participating in the prize. Failure to do so as determined by the Promoter (in the Promoter’s absolute and sole discretion) will result in the prize winner forfeiting their prize.
