VISITSCOTLAND PRIZE DRAW
1. These Terms and Conditions
1.1 These are the terms and conditions for participation in the VisitScotland ‘Highland Games’ Global prize draw. If you do not wish to accept the Terms and Conditions in their entirety, please do not submit an online entry to us. By participating in the Prize Draw you will be deemed to have read and accepted all of the Terms and Conditions. Failure to comply with any of the Terms and Conditions will disqualify you from taking part in the Prize Draw.
1.2 The promoter of this Prize Draw is VisitScotland, having its principal office at Ocean Point One, 94 Ocean Drive, Edinburgh, Scotland, UK, EH6 6JH.
2. How to Enter
2.1 You must log onto
https://www.visitscotland.com/win/naasolus/ (referred to herein as "web site") and follow the directions to enter. All entries must be submitted between 09:00: AM Mean Time ("GMT") on 1 June 2016 and 12:00 PM GMT on 1 May 2017.
2.2 You must include on the entry form your complete name and email address. All entrants must have a valid email address. In case of dispute as to the identity of the entrant, the entry will be declared made by the authorised account holder of the email address submitted at time of entry. "Authorised Account Holder" is defined as the natural person who is assigned an email address by an internet access provider, online service provider, or other organisation (e.g. business, educational, institution, etc) responsible for assigning email addresses or the domain associated with the submitted email address. The potential winner may be required to provide the Promoter with proof that such winner is the authorised account holder of the email address associated with a winning entry.
2.3 Any other attempted form of entry is prohibited; no automatic, programmed, robotic or similar means of entry are permitted, and any use of such automated devices will cause disqualification. The Promoter and its affiliates, partners, agencies and any entities involved with the administration or fulfilment of this Prize Draw are not responsible for technical, hardware, software, telephone or other communication malfunctions, errors or failures of any kind, lost or unavailable network connections, web site, internet, or ISP availability, unauthorised human intervention, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one's ability to enter the Prize Draw, including, insofar as permitted by applicable law, any injury or damage to participant's or any other person's computer relating to or resulting from participating in this Prize Draw or downloading any materials in this Prize Draw. The Promoter does not warrant that the entry mechanism will be available at all times during the entry period of the Prize Draw.
2.4 There is a limit of one (1) entry per person to the Prize Draw, and the same e-mail address cannot be used to submit an entry for more than one person or on more than one occasion.
2.5 All entries become the sole property of the Promoter and receipt of entries will not be acknowledged or returned. The Promoter is not responsible for lost, late, illegible, incomplete, invalid, unintelligible, technically corrupted or misdirected entries, which will be disqualified. Only fully completed entry forms are eligible. Proof of submission will not be deemed to be proof of receipt by the Promoter.
3. Eligibility
3.1
Participation in the Prize Draw is open only to persons aged at least 18 (on the date that they submit their entry) who are a legal resident of one of the following countries:
Australia; Canada (but the Prize Draw is not open to residents of the Province of Quebec); New Zealand and the USA.
All entrants must be natural persons acting in their own personal capacity and entries submitted by or on behalf of a company, organisation or body corporate will not be valid.
3.2 Full address verification and proof of age and/or identity may be required by the Promoter.
3.3 In addition, employees, officers and directors of the Promoter, or partner companies within this promotion (including those listed in section 3.4 of these Terms and Conditions), and their respective parent companies, subsidiaries, affiliates, partners, dealers, advertising and promotion agencies, manufacturers or distributors of the Prize Draw materials, and the immediate families (parents, children, siblings, spouse) or members of the same household (whether related or not) of such employees/officers/directors, are not eligible to enter. Entries are also void where they are prohibited by local law in the entrant’s place of residence.
3.4 Partner companies within this promotion (in addition to the Promoter) include Thrifty, The Howard Hotel, East Haugh House Hotel, Raemoir House Hotel, Edinburgh Bus Tour, Braemar Gathering, Historic Environment Scotland and the Signet Library.
3.5 The Prize Draw is governed exclusively by the laws of Scotland, which shall be exclusively applicable to any and all disputes arising out of or in connection with the Prize Draw or these Terms and Conditions. The Scottish Courts shall have sole jurisdiction over any and all disputes arising out of or in connection with this Prize Draw, provided that such exclusivity does not apply to legal actions initiated or brought by the Promoter.
4. Draw
4.1 One (1) winner will be selected at random in a draw from all eligible entries received. Chances of winning depend on the number of eligible entries received.
4.2 Drawing of the Prize Draw will be conducted by an independent party, on or around the 10th May 2017.
4.3 By entering the Prize Draw, entrants fully and unconditionally agree to be bound by these Terms and Conditions and the decisions of the independent party appointed to conduct the drawing, which will be final and binding in all matters relating to the Prize Draw.
5. Prize
5.1 The Prize (as described below) will be awarded to one (1) winner. The winner will be able to choose one travel companion to accompany them on the trip.
5.2 The “Prize” comprises:
(a) Full-size automatic or manual saloon car hire for up to 7 days with Thrifty - the winner (and/or their travel companion) must have a full, clean drivers license valid for use in the UK and must adhere to the car hire company conditions of hire. Fully comprehensive car insurance is included, though please note that this does not include contents insurance, and other special conditions or restrictions may apply. The minimum driving age is 21. The hire is restricted to one driver and the hire will start and finish in Edinburgh. Winner liable for excess and fuel.
This voucher should be redeemed by 31/12/2016, May not be redeemed against rental over August Bank Holiday, Christmas Day, Boxing Day or New Year’s Day.
The basic rental includes insurance with an excess for which the driver is liable, but may be reduced on payment of an additional charge. Driver also liable for fuel. The voucher may be redeemed against rental of larger car on payment of an upgrade fee.
Renter must be over 21 years of age (surcharges apply for under 25’s). Renter must hold a full valid driving licence. Renter must have a valid credit or debit card and will be required to leave a deposit at the commencement of rental. Specific vehicle models cannot be guaranteed.
Normal rental agreement terms and conditions apply and voucher only valid at Thrifty locations in the UK.

(h) Afternoon Tea for 2 people at Colonnades, the Signet Library. Prize cannot be extended, is non-refundable and non-transferable. No change or voucher for unused differences can be issued. Photocopies will not be accepted.
5.3 If required in order for the winner to take up the Prize, the winner and their travel companion will also receive an economy class return flight to Scotland as part of the Prize, as agreed by the Promoter and subject to booking availability. The departure point, dates and airline will be chosen by the Promoter and restrictions may apply. Where the winner is a resident of Scotland, or does not require return flights to Scotland in order to take up the Prize for any other reason, no cash or other subsitution/equivalent will be provided to the winner.
5.4 The winner and their companion must travel to arrive in Scotland on specific dates in September 2017 (to be selected by the promoter). If the Prize winner and their companion are unable to travel at the specified times the Prize will be forfeited and awarded to an alternative winner in a random drawing from all remaining eligible entries. All activities, travel and accommodation are subject to availability, weather conditions and are subject to the individual operator's standard terms and conditions. Height, age and other restrictions may apply.
5.5 All travel, activities, and accommodations are taken at the winner's and their travel companion's risk. Transportation to and from departure airport, taxes, meals, gratuities, travel upgrades and any other costs, charges or expenses that are not specifically listed in the description of the Prize in sections 5.2 and 5.3 of these Terms and Conditions are the sole responsibility of the winner and their travel companion.
5.6 All travel is subject to booking availability. The winner and travel companion must travel on the same itinerary. The travel companion must be of the age of majority in their jurisdiction of residence unless the winner is their travel companion's parent or legal guardian. The Promoter is not liable for delays, cancellations or unforeseen events related to any travel.
5.7 The Winner and his/her travel companion will be solely responsible for obtaining valid identification and compliance with all travel and health requirements (i.e. passports, visas) relating to acceptance and use of the Prize and must have no impediment to entering Scotland. The Promoter will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates.
5.8 No cash equivalent to all or any part of the Prize will be provided by the Promoter in any circumstances.
5.9 The Prize is only made available for the winner’s (and their travel companion’s) personal use and neither the Prize nor any part of the Prize may be transferred or used by the winner (or their travel companion) for any business and/or promotional purposes whatsoever.
6. Notification of Winner
6.1 The selected winner will be notified by email on or around 15 May 2017.
6.2 If the selected winner does not respond within 7 days of first notification attempt, if any prize notification is returned as undeliverable, or if the selected winner is determined by the Promoter to be ineligible for the Prize or to have failed to comply with any of these Terms and Conditions, the Promoter reserves the right to withdraw prize entitlement and the prize will be forfeited and an alternative winner will be selected. Upon prize forfeiture, no compensation will be given.
6.3 You will not be notified by the Promoter if your entry is unsuccessful.
7. Conditions
7.1 Participation in the Prize Draw and acceptance of the Prize constitutes winner's permission for the Promoter to use his/her name, address (city and state/province/country), likeness, biographical information and any statements made by winner regarding the purposes without notice or additional compensation, except where prohibited by applicable law. On entering the competition entrants agree to take part in any pre and post-event competition publicity if required.
7.2 By participating, and insofar as is permitted by law, entrants, winner and travel companion agree to release and hold harmless the Promoter, and their respective advertising and promotion agencies, their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors, from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in the Prize Draw, or possession, acceptance and/or use or misuse of prize or participation in any Prize Draw related activity and claims based on publicity rights, defamation or invasion of privacy and merchandise delivery.
7.3 Insofar as is permitted by applicable law, neither the Promoter, its representatives, prize providers nor their respective employees, associated agencies and companies or anyone professionally connected with this competition, will in any circumstances be responsible or liable to any entrant and/or the winner and/or their travel companion in connection with this competition. Without prejudice to the foregoing generality, and insofar as is permitted by applicable law, neither the Promoter, its representatives, prize providers nor their respective employees, associated agencies and companies or anyone professionally connected with this Prize Draw accepts any liability for any loss, damage, personal injury or death occurring as a result of the winner taking up the prize. Your statutory rights are not affected by this section 7.3.
7.4 The Promoter is not responsible or liable to the winner or any other person if any portion of the Prize cannot be awarded due to travel cancellations, delays or interruptions due to acts of God, acts of war, natural disasters, weather, terrorism or any other events or circumstances outside of the reasonable control of the Promoter.
7.5 Entrants who do not comply with these Terms and Conditions, or attempt to interfere with this Prize Draw in any way shall be disqualified. No substitutions or cash redemptions are available, in whole or in part.
7.6 Without prejudice to section 7.4 of these Terms and Conditions, in the case of unavailability of all or any portion of the Prize, or owing to circumstances outside the reasonable control of the Promoter, the Promoter reserves the right to substitute a prize of equal or greater value.
7.7 There is no purchase or sales presentation required, or fee payable, in order to participate in the Prize Draw. A purchase does not increase your odds of winning.
7.8 The Prize is not transferable in any way (except by the Promoter in its sole discretion) and must be taken by the designated winner and his/her chosen travel companion.
7.9 The winner and their travel companion are responsible for their own travel insurance, and for having valid passports.
8. Additional Terms
8.1 The Promoter reserves the right to cancel, terminate, modify, or suspend this Prize Draw should circumstances make this unavoidable, including, but not limited to virus, bugs, non-authorised human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Prize Draw. In such case, Promoter may, at its sole discretion, decide to select a winner at random from all eligible entries received prior to and/or after (if appropriate) the action taken by the Promoter.
8.2 The Promoter reserves the right to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Prize Draw or its website.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PRIZE DRAW MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
9. Use of Entrants Data
9.1 The Promoter will be collecting personal data about participants when they enter the Prize Draw in accordance with its privacy policy. 9.2 By participating in the Prize Draw, entrants hereby agree to the Promoter's collection and usage of their personal information and acknowledge that they have read and accepted the Promoter's privacy policy. All entrants that opt-in to receiving marketing information are welcome to discontinue receiving further information from the Promoter at any time by using the unsubscribe link in any email sent by the Promoter to you.
