Terms and Conditions
The following information on how to enter forms part of these Terms and
Conditions.
How to Enter:
Entry is open to real people over the age of 18 residing anywhere in Australia
except those residing in the State of NSW or in the ACT.
To enter you must:
1. Go to the Aitken Home Loans website and click the link “Register to Receive our Newsletter” The
Aitken Home Loans website can be found at
www.aitkenhomeloans.com.au2. Complete the registration details by entering the required information including your email address.
By doing so you are accepting these terms and conditions and agreeing to receive the Aitken Home
Loans email newsletter.
The Aitken Home Loans email newsletter is usually sent no more than
once each month, however special updates, such as notice that the
Reserve Bank has changed the cash rate many also be sent. There is
no cost or purchase required to enter this promotion.
Terms and Conditions
1. The above details of “How to Enter” form part of these terms and conditions.
2. Participation in this promotion is deemed acceptance of these Terms and Conditions.
3. Entry is only open to Australian residents aged 18 years or over except those in the State of NSW
and in the ACT.
4. Employees (and their immediate families) of Mainstay Business Services Pty Ltd trading as Aitken
Home Loans are ineligible to enter. Immediate family means any of the following: spouse, exspouse,
de-facto spouse, child or step-child, parent, step-parent, grandparent, step-grandparent,
uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
5. Promotion commences on 11th August 2016 and entries close at 5:00pm AEST on the Friday 9th
December 2016.
6. Multiple entries are not permitted and any person or organisation registering on the Aitken Home
loans website using multiple or false identities will be deemed to be in breach of these terms and
conditions. Should the winning entrant subsequently be found to have breached this condition,
action will be taken to recover the value of the prize along with costs and damages. Aitken home
Loans reserves the right, at any time, to verify the validity of entries and entrants (including an
entrant’s identity, age, place of residence and reserves the right, in its sole discretion, to disqualify
any entry that Aitken Home Loans suspects, with or without reasonable grounds, may have
breached any of these Terms and Conditions, tampered with the entry process or engaged in any
unlawful or other improper misconduct calculated to jeopardize the fair and proper conduct of the
promotion. Errors and omissions may be accepted at Aitken Home Loans discretion. Failure by
Aitken Home Loans to enforce any of its rights at any stage does not constitute a waiver of those
rights. Aitken Home Loans reserves all legal rights to recover damages or other compensation.
7. If there is a dispute as to the identity of an entrant, Aitken Home Loans reserves the right, at its sole
discretion, to determine the identity of the entrant.
8. The draw will take place at 62 The Boulevard, Gisborne, VIC 3437 at 11.00am AEST on Monday 12th
December 2016.
9. The winner and thus by implication all entrants agree to their details being published in the event of
them winning. Further the winner agrees to attend an award ceremony to be conducted in their
home State and of a reasonable number of photographs being taken of them being awarded the
prize which may be used for publicity by Aitken Home Loans without remuneration to the winner.
Further the winner consents to Aitken Home Loans using their name, likeness, image and/or voice,
including photograph, film and/or recording of the same in any media for an unlimited period
without remuneration.
10. The winner will be notified by email within 24 hours of the draw. Details will be published online on
the Aitken Home Loans website and on the Aitken Home Loans Facebook, Twitter and LinkedIn
pages within 24 hours of the draw.
11. Aitken Home Loans decision is final and no correspondence will be entered into.
12. Valid entrants will extracted from the Aitken Home Loans newsletter database and each entrant will
be assigned a number. A publically available random number generator will be used to select /
draw the winning entrant number. The first number generated by the random number generator
will win that entrant the $500 Christmas Hamper. This is the total prize pool. This prize may not be
redeemed for cash but maybe exchanged for $500 of supermarket vouchers. Records will be kept of
the numbers assigned to entrants, of the random number generator and of the first random
number generated.
13. Should the prize not be claimed or the entrant turn out to be invalid then subsequent draws will be
conducted every 30 days until the prize is awarded.
14. Any and all cost associated with accessing Aitken Home Loans website in order to register is the
entrant’s responsibility.
15. The winner accepts that they are responsible for any and all losses and damages which may occur as
a result of them accepting the prize.
16. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or
modify the statutory consumer guarantees as provided under the Competition and Consumer Act,
or any other warranties under similar consumer protection laws in the States and Territories of
Australia. Except for any liability that cannot by law be excluded, including the Non-Excludable
Guarantees, Aitken Home Loans (including its officers, employees and agents) excludes all liability
(including negligence), for any personal injury; or any loss or damage (including loss of opportunity);
whether direct, indirect, special or consequential, arising in any way out of the promotion.
17. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees,
Aitken Home Loans (including its officers, employees and agents) is not responsible for and excludes
all liability (including negligence), for any personal injury; or any loss or damage; whether direct,
indirect, special or consequential, arising in any way out of:
a. any technical difficulties
b. any theft, unauthorized access or third party interference
c. any tax liability incurred by an entrant or winner
d. taking or use of the prize including losses of any other nature
e. or any other factors beyond the reasonable control of Aitken Home Loans
18. As a condition of accepting the prize, the winner must sign any legal documentation as and in the
form required by Aitken Home Loans and/or prize suppliers in their absolute discretion, including
but not limited to a legal release and indemnity form.
Aitken Home Loans will by necessity collect personal information in order for people to register on
the website and to conduct this promotion and may, for such purposes, disclose personal
information to third parties, including but not limited to agents, contractors, service providers, prize
suppliers and to Australian regulatory authorities. Entry is conditional upon providing this personal
information. Aitken Home Loans may use and handle personal information as set out in its
combined Terms and Conditions and Privacy Policy, which can be viewed at
www.aitkenhomeloans.com.au but will not disclose an entrant’s personal information to any third
party except in accordance with these Terms and Conditions and the combined Terms and
Conditions and Privacy Policy available from the afore mentioned website. All entries become the
property of Aitken Home Loans.
