Who can enter? Entry is only open to Australian residents over the age of 18, who buy Davey Pool & Spa products during the competition period.
When is the competition period? Competition starts 1/9/16 and closes 30/11/16.
How do you qualify to enter the competition? Valid entries must spend $400 inc. GST on Davey Pool & Spa products at any participating Davey Dealer, in one transaction. Multiple entries accepted. Purchases relating to spare parts are not included. Proof of purchase must be retained to validate entry.

When, where & what time will the competition be drawn? The competition winners will be drawn on 5/12/16 at: Davey Water Products, 6 Lakeview Drive, Scoresby VIC, at 10am (AEST).

On entering the Cruise Through Summer with Davey Competition you are agreeing to the following terms and conditions:
STANDARD TERMS
Information on how to enter forms part of the terms of entry. Entry into the promotion is deemed acceptance of these terms and conditions.
This is a Game of Chance where skill plays no part in the outcome and the winners will be selected randomly.
WHO CAN ENTER?
Subject to clause 2.2, entry is open to all Australian residents only who are over the age of 18 years at the time of the commencement of the competition.
Employees and their immediate families of Davey Water Products, Davey Dealers or agencies involved in the planning & running of the competition are not eligible to enter.
HOW TO ENTER
To receive one (1) entry into the draw, the entrant must spend $400 inc GST on a Davey product at a participating Davey Dealer and then register their purchase online. The list of Davey dealers participating in this promotion are listed on our website at
www.davey.com.au/cruise-through-summer-with-davey. The registration address is
www.davey.com.au and entrants must fill out all fields required to be eligible for entry.
Entrants will receive one (1) entry into the draw every time they spend $400 (inc GST) on one purchase as above and register their purchase as above.
To be eligible for entry you must retain your original receipt of purchase. Photocopies or facsimiles of any kind will not be accepted as an original receipt and the entrants entry into the competition will be declared null and void.
THE PRIZES
There are eight (
prizes to be won to the value of $2000 each inc GST.
The total prize value is AU$16000 inc GST.
The first eight (
winners drawn in a random draw will receive a prize of a South Pacific cruise travelling on Royal Caribbean Cruises for two (2) adults for ten (10) nights.
The cruise departs from Sydney and the winners will be required to make their own way to the point of departure at their own expense and for all expenses incurred in travelling to the point of departure.
Breakfast, lunch and dinner are included in the prize and served at the discretion of Royal Carribbean Cruises with their exclusion clauses in place.
The prize winners must have current Australian passports to participate in the prize.
Travel insurance is not included and Davey Water Products strongly recommend that travel insurance is taken out by the prize winners.
Proof of identity will be required before the prize is awarded and prize winners will be required to give credit card or bank details when participating in the prize. These include, but are not limited to, expenses on the ship, expenses on shore and all sundries not included in the prize.
The prize cruise must be taken before the 18th of December 2017.
CRITICAL DATES
The competition commences at 12 midnight (AEST) on 1st September 2016 and closes at 12 midnight on Tuesday the 30th of November 2016 (AEDST).
The prize draw will take place at 10am on the 5th of December 2016 (AESDT) at the offices of Davey Water Products, 6 Lakeview Drive, Scoresby, Victoria.
Winners will be notified by phone and email by the 7th of January 2017.
If any prizes are unclaimed a redraw will take place at 11 am on the 30th of March, 2017 (AEDST) at the offices of Davey Water Products at the address listed above.
In the case of a redraw, winners will be notified by phone and email by the 3rd of April 2017.
CONDITIONS REGARDING WINNING THE PRIZE(S)
The winners of the prizes should seek independent financial advice about any tax implications that may arise from the prize winnings.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.
In participating in the competition, the winner agrees to participate and co-operate as required in all editorial activities relating to the Competition , including but not limited to being interviewed, filmed for broadcast and photographed. The winners agree to grant the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winners (and their companion) will not be entitled to any fee for such use.
The Promoter may, for an indefinite period, unless otherwise advised, use the Information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
The Promoter’s decision is final and no correspondence will be entered into.
Royal Caribbean prize conditions Cruise:

- Bookings shall be accepted subject to cruise availability and the Company reserves the right to offer alternative dates and/or itineraries. The prize is not available during blackout dates, school holidays, embargo periods, high season and is subject to availability.
- Once booked, cancellation and change fees may apply if date changes are made;
- Travel insurance is not included and we recommend you take out travel insurance prior to travel;
- No other items are included in the package (including any transport between a traveller’s residence and the departure airport, any overnight accommodation while travelling to the departure airport or destination, any other travel or accommodation, any incidental hotel charges (such as mini-bar charges, telephone calls, in house movies, food and beverages), any vaccinations or other medical or health related services, any other ancillary costs which may be incurred by those travelling).
- Total estimated value of this prize may fluctuate due to time of year trip is taken, in relation to high and low seasons. The value of this prize, itinerary and inclusions are correct at time of printing and subject to change at any time. Any change to the prize between the publishing date and the date the prize is claimed, is not the responsibility of the Promoter.
CONDITIONS REGARDING WINNING THE PRIZE(S)
In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to government legislation.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right , in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantee, the Promoter (including its respective officers, employees and agents) and Prize Promoter are not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity) ; whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by the winner or entrant; or (f) use of the prize.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (‘Non-Excludable Guarantees’). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
