Network TEN #ColesBackyardLegends Competition Terms and Conditions
1. Information on how to enter forms part of the terms and conditions ("Terms and Conditions"). Entry into the #ColesBackyardLegends Competition (“Competition”) is deemed acceptance of these terms and conditions.
Eligibility to Enter
2. Entry is open to all residents of Australia. However, employees and the immediate families of Network Ten Pty Limited (the “Promoter”) and their associated agencies and companies or any organisation or individual associated with the provision of the prize(s) are not eligible to enter. Entrant must be residing in Australia at the time of entry, or their entry may be deemed invalid.
3. Entrants under 18 years of age must have the prior approval of their parent or guardian to enter.
4. Major Prize winner must be available to accept the prize as a filmed announcement on either 23, 24 or 25 January 2017 at an agreed time at the Major Prize Winners’ home or suitable location (Prize Winner Announcement).
Entry Period
5. The competition commences on Saturday 10 December 2016 at 09:00 AEDT and closes on Sunday 22
January 2017 at 12:00 noon AEDT (“Competition Period”).
6. The competition will be advertised on, but not limited to, Channel Ten and
www.tenplay.com.au.
How to Enter
7. To participate in the Competition entrants must shoot a backyard video that meets the following requirements:
not be longer than 20 seconds;
be the entrant’s own original work;
not include any third party intellectual property (such as a logo);
not include any music;
not contain material for which moral rights are not attributable to any third party;
not contain material which is defamatory, contemptuous, or obscene or infringes the rights of
any person; and
have the approval of any person featured in the work.
The entrant will then be required to:
a. Log into their Twitter account, upload their video to Twitter and tweet the link using the hashtag
#ColesBackyardLegends (“entry”) or
b. Log into their Instagram account and upload their video using the hashtag
#ColesBackyardLegends.
8. By entering into the Competition you represent the Promoter that:
If you are under the age of 18 years of age (as at the date of entry into the Competition), you
have parental/guardian permission to enter;
you are (or are authorised by) the parent or legal guardian of any person under 18 years of age
appearing in the entry (“Child”) and agree on behalf of yourself and the Child to these Terms and
Conditions;
all persons featured in the Video have authorised you to upload the Video for the purposes of the
Competition and agree on their behalf to these Terms and Conditions; and
your entry complies with these Terms and Conditions, in particular clause 6.
This is a game of skill; chance plays no part in determining the Winners. Each entry will be individually judged based on the most unique and creative entry. The judges’ decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into.
10. This promotion is in no way sponsored, endorsed, administered by or associated with Twitter and/or Instagram. You are providing your information to The Promoter and not to Twitter or Instagram. The information you provide will only be used for the purpose of this competition unless otherwise specified in these terms and conditions.
11. Entries may be broadcast on Channel Ten , Channel Eleven or Channel One during the 2016/2017 KFC Big Bash League. Entrants agree, by submitting an entry that their entry may feature on, but not limited to, the broadcast, on tenplay.com.au and Twitter and/or Instagram.
12. Incomprehensibleandincompleteentriesandentriesthatdonotcomplywithclause6oftheseTermsand Conditions will be deemed invalid.
13. There is no limit to the number of entries a person may submit, however, each entry must differ significantly from any previous entries on either Twitter or Instagram. The Promoter may, in its absolute discretion, ignore any entry which it deems not to be significantly different from another entry of the same entrant or it deems to be offensive or inappropriate, or not otherwise made in accordance with these Terms and Conditions.
14. The time of each entry will, in each case, be the time that each entry is successfully uploaded to Twitter and/or Instagram with the correct hashtag #ColesBackyardLegends. The Promoter accepts no responsibility for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason. An entry via Twitter or Instagram will not necessarily feature on tenplay.com.au.
15. All entries must be received by Sunday 22 January 2017 at 12:00 noon AEDT to be included in the Major Prize Judging. Each valid entry received over the duration of the Competition Period will be entered into the Prize judging. An entry will only be valid if the entry include the hashtag #ColesBackyardLegends. Entries must remain on the entrant's Twitter and/or Instagram account at least 28 days after the competition closes for contacting the Winners.
16. Acknowledgement of the entry will be credited to the person named in the entry. However, in a dispute, will be awarded to the account holder of the Twitter account used to submit their entry (i.e. social media account holder). By entering, the successful entrant may be contacted via their social media account with the request to contact the Promoter via email to verify their details, including age.
17. Should an entrant’s contact details change during the competition period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter. The Promoter accepts no responsibility for inability to contact an entrant because an entrant has not notified the Promoter of its change in contact details during the promotional period.
18. An entry that is made on behalf of an entrant by a third party will be invalid.
19. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Error and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
20. Asaconditionofenteringtheentrantmayberequiredtosignanylegaldocumentationasandintheform required by the Promoter in their absolute discretion, including but not limited to a consent, waiver, release and indemnity form.
21. The entry period for each minor prize commences on Sunday 10 December 2016 at 09:00 AEDT and concludes at 12:00 noon AEDT on the day of judging in the below table:

22. The method of Winner notification will be dependent on the contact information that is available for the Minor Prize Winners.
23. One (1) Major Prize Winner will be selected from the Twenty Eight (28) Minor Prize Winners and any entries received between 12.01 AEDT on Saturday 21 January, 2017 and Sunday 12:00 noon AEDT on 22nd January, 2017 by a judging panel at Network TEN at 1 Saunders Street, Pyrmont NSW 2009 on Sunday 22 January 2017 from 12:01 AEDT. The Major Prize Winner will be the entrant who, in the sole opinion of the judges, has submitted the most original, aesthetically pleasing and creative backyard video. The Major Prize Winner will be notified by email and/or in writing and/or by an Instagram and/or Twitter post submitted by the Promoter tagging the Major Prize Winner within three (3) days of the Prize Determination Date, and published on the TENPlay website at tenplay.com.au from Wednesday 25
January 2017. The method of Winner notification will be dependent on the contact information that is available for the Major Prize Winner.
24. All reasonable attempts will be made to contact the Minor Prize Winners. If the Minor Prize/s remains unclaimed by the Winner/s or unallocated or forfeited for any reason, by Friday 24 February 2017 at 09:00 AEDT, the Prize/s will be re-allocated to the entrant that has submitted the entry which best meets the judging criteria excluding the entrant that has failed to claim the prize. This Unclaimed Prize Determination will take place at Network TEN at 1 Saunders Street, Pyrmont, NSW 2009 on Friday 24 February 2017 at 10:00 AEDT. The Winner of the Minor Prize/s Unclaimed Prize Determination will be by email and/or in writing and/or by an Instagram and/or Twitter post submitted by the Promoter tagging the Winners within five (5) days of the Unclaimed Prize Determination Date, and published on the TENPlay website at tenplay.com.au from Monday 27 February 2017. The method of Winner notification will be dependent on the contact information that is available for the Winners.
25. All reasonable attempted will be made to contact the Major Prize Winner. 27. The total Prize Pool is valued at $17,812.00 (including GST). The Promoter accepts no responsibility for change in prize value between now the ultimate prize redemption date.
28. Any ancillary costs associated with redeeming the prize/s are not included. These are the responsibility of the winner.
29. All prizes are non-transferrable. No cash alternative is available for any prize. Prizes must be taken as offered. Any prize, unused portion of any prize, or portion of the prize Winner is not entitled to, are not exchangeable or cannot be redeemed as cash. Prizes cannot be used in conjunction with any other special offer. Prize values are in Australian dollars. The Promoter accepts no responsibility for any variation in the prize values. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.
30. The Major Prize must be redeemed by Tuesday 24 January, on the condition that they will be required to host a camera crew provided by the Promoter on the agreed date (either Monday 23 January, Tuesday 24 January, 2017.

31. The Major Prize Winner consents to being filmed by Network Ten for the purpose of the Big Bash League Grand Final. The Major Prize Winner will be filmed and recorded for broadcast in the Big Bash League.
32. It is a condition of entry that the Major Prize Winner is willing and able to provide a location in order for the Promoter to film the Prize Winner Announcement.
33. The Major Prize Winner can host up to a maximum of 31 (thirty one) people (including the Major Prize Winner) for the Coles Backyard BBQ (‘Guests’). The Backyard BBQ will be hosted on a date mutually agreeable by both Coles and the Major Prize Winner.
34. The Major Prize Winner, the home owner or lease of the nominated property and any Guests may be required to sign legal releases agreeing to the use of the Location for the Prize Winner Announcement.
35. The Major Prize Winner agrees that no alcohol will be consumed prior to and during the filming of the Prize Winner Announcement.
36. The Coles vouchers awarded to Major Prize Winner and Minor Prize Winners must be used in accordance with the terms and conditions applicable to the voucher as specified at

37. In acceptance of the prize, the Winners acknowledge that they may incur ongoing costs associated with the prize which are the entire responsibility of the winner.
38. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value.
39. ThePromoterisneitherresponsiblenorliableforanydamaged,delayedorlostintransitinthedeliveryof the prize.
40. If a Prize Winner is under the age of 18 years, the Promoter has the right to transfer the prize to a parent or legal guardian over the age of 18 years. The Prize Winner and/or parent/legal guardian may be required to sign a Prize Release Form to enact the transfer.
41. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.
42. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
43. Personal information about all prize winners will be shared with the prize provider, and their agents, to the extent necessary for prizes to be delivered to the prize winners.
44. If the Major Prize Winner and/or Minor Prize Winners do not provide proof of meeting the valid entry requirements, the Prize will be forfeited in full, and the Winner will have no further claim. A re-judging will be held to award the prize to a valid entrant.
45. It is a condition of accepting the prize the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
46. By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.

53. All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this promotion but no further use of this information will be made without prior consent.
54. You consent to The Promoter collecting your personal information for the purpose of conducting and promoting the Competition. Your personal information may be disclosed to third party service providers for this purpose. Your personal information may be disclosed to staff and contactors of Network TEN and published on tenplay.com.au or as required. For purposes of public statements and advertisements The Promoter may publish entrant’s full name, suburb, state and Twitter ‘name’. A request to access, update or correct any information should be directed to the Promoter. If you are not willing for this to occur you cannot participate in the promotion.

The Promoter is bound by the Australian Privacy Principles (APPs) in the Privacy Act 1988 (Cth) and by entering the Competition, you (the entrant) are taken to consent to the Promoter's privacy policy which contains information, amongst other things, about how you may access personal information that is held
