“AYAM CHINESE NEW YEAR 2017” PROMOTION - TERMS AND CONDITIONS

Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Entry is only open to Australian residents. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.
Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Entry period commences 16/01/2017 and closes 17:00 hrs AEST on 9/04/2017 (“Promotional Period”). All times referenced throughout these Terms and Conditions will be based Australian Eastern Daylight Savings Time (“AEDST”) or Australian Eastern Standard Time (“AEST”), as and when applicable in NSW.
To enter, the individual must:
purchase any 2 or more AYAM products in one transaction from an Australian retailer (“Qualifying Purchase”);
vist www.winwithayam.com, follow the prompts to the competition entry page, input the requested details and submit the fully completed online entry form during the Promotional Period.
Once they submit their entry the entrant will be notified online whether they are a provisional instant winner.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
Incomplete, indecipherable, or illegible entries will be deemed invalid.
Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per Qualifying Purchase (i.e. any two (2) or more AYAM products in the one (1) transaction); and (b) each entry must be submitted separately and in accordance with entry requirements. For clarity, if the entrant purchases: (a) four (4) AYAM products in the one (1) transaction they will receive two entries; and (b) six (6) AYAM products in the one (1) transaction they will receive three entries.
Entrants must retain their original purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made prior to entry.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
There will be three (3) major draws with one for each four week period of the Promotional Period (“Major Draws”). Entries received during the first four (4) weeks of the Promotional Period (16/01/2017 – 12/02/2017), based on NSW local time, will be entered into Major Draw 1. Entries received during the second four (4) week period of the Promotional Period (13/02/2017 – 12/03/2017), based on NSW local time, and non-winning entries from Major Draw 1, will be entered into Major Draw 2. Entries received during the third four (4) week period of the Promotional Period (13/03/2017- 9/04/2017), based on NSW local time, and non-winning entries from Major Draw 1 & 2, will be entered into Major Draw 3.
All draws will take place at Handling Matters, 1/3 Green Street, Brookvale NSW 2100. Each Daily Draw will take place at 11am on 15/02/2017 (Major Draw 1), 15/03/2017 (Major Draw 2), 18/04/2017 (Major Draw 3). Major Draw winners will be notified by email within two (2) business days of the draw. The major prize winners be published on the Website on 28/02/2017, 28/03/2017, 28/04/2017. Any ACT instant winners will be published on the Website within 5 days of being selected.
The Promoter’s decision is final and no correspondence will be entered into.
Instant prizes

There will be one (1) instant prize awarded for each day of the Promotional Period. There will be a total of 84 x $100 instant win prizes to be awarded. Instant prizes will be awarded in the form of bank account deposit. The Promoter accepts no responsibility if the instant winner provides incorrect bank account details.
Quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured. Any instant win prizes that are part of the advertised total prize pool will be awarded in the unclaimed prize draw. Instant win game materials void if stolen, forged, mutilated or tampered with in any way. There will be a total of 84 instant win prizes distributed in this promotion.
Major Draw prizes

The first valid entry drawn in Major Draw 1 is a trip for 2 adults and 2 children (aged 2-11) to Penang Malaysia valued at up to AU$12,547 depending on date and point of departure. Prize includes:
4 x return economy airfares from winner's nearest capital city via Kuala Lumpur to Penang;
5 nights family room accommodation at Park Royal Penang Resort;

The first valid entry drawn in Major Draw 2 is a trip for 2 adults and 2 children (aged 2-11) to Kota Kinabalu Malaysia valued at up to AU$13,484 depending on date and point of departure. Prize includes:
4 x return economy airfares from winner's nearest capital city via Kuala Lumpur to Kota Kinabalu International Airport;
3 nights family room accommodation at Grandis Hotel, Kota Kinabalu;
1 night family room accommodation at Manukan Island Resort with BBQ lunch and snorkelling;

The first valid entry drawn in Major Draw 3 is a trip for 2 adults and 2 children (aged 2-11) to Kuching Malaysia valued at up to AU$15,140 depending on date and point of departure. Prize includes:
4 x return economy airfares from winner's nearest capital city to Kuching Airport via Kuala Lumpur;
5 nights family room accommodation at the Grand Margherita Hotel Kuching;
return transfers from airport to accommodation; and
set activities on day 2, 3, and 4 as determined by the Promoter.
The following conditions apply to the Major Prizes: All travel is subject to availability at all times and maybe dependent on select seat class with airlines or specific room category availability with accommodation partner. Travel is valid until 31 March 2018. Block out periods include 19 June 2017 until 9 August 2017 and from 9 December 2017 until 24 January 2018 along with all other special event periods. All bookings must be made a minimum of 45 days in advance of requested departure dates. All bookings and documentation regarding the prize must be made via Free-2-Travel Holidays Pty Ltd or their agents. Redeeming the prize is conditional on acceptance of the terms and conditions of travel as detailed by Free-2-Travel Holidays Pty Ltd and Air Asia in accordance with normal travel practices. No portion of the prize is redeemable for cash. Air Asia’s prize conditions will be given to each winner by the Promoter. The prize is not refundable or transferable. During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years of age. Each winner and his/her companions must be in possession of a valid passport with a minimum of 6 months validity on it prior to departure. Winner is responsible for any amendments fees issued by airlines or suppliers once booking is confirmed and ticketed. Visas, valid passports, additional spending money, meals (other than those included), additional transfers, items of a personal nature, and any other ancillary costs, including but not limited to insurance and any applicable insurance excesses, not listed in the travel prize package descriptions above are the responsibility of the each travel prize winner and his/her nominated traveling companions as incurred. It is the each winner's responsibility to organise transport to/from the airport departure/return point. Prize winners and travel companions must have valid travel insurance for their period of travel. Itinerary to be determined by the Promoter in agreement with each winner but in the event that agreement cannot be reached, the Promoter reserves the right to determine the itinerary. Winners and their companions must depart from and return to the same departure point and travel together. Frequent flyer points will not form part of the prize. Prizes are subject to the standard terms and conditions of individual Prize and service providers. Winners may be required to present their credit card at time of accommodation check in. Each winner and his/her companions are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation.
General

Limit of one (1) Instant and Major prize per person, except in the case of residents of S.A.
If for any reason a winner does not take the prize (or an element of the prize) at the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.
In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.
If a winner of prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on the winner’s behalf.
If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Total prize pool value is up to AUD$49,571.
Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
A draw for any unclaimed prizes may take place on 18/07/2017 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners will be notified by email within two (2) business days of the draw. Winners of the major prize, if any, will be published on the Website on 28/07/2017.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking the prize.
As a condition of accepting a major prize, a winner (and his/her companion/s) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. In the event a winner or winner’s companion is under the age of 18, a nominated parent/legal guardian of such person will be required to sign the legal documentation required under this clause on their behalf.
The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter.
