General
Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this competition (including by accepting a prize) is deemed acceptance of these Terms and Conditions. Entries must comply with these Terms and Conditions to be valid.
Entry is only open to Australian residents aged 18 years and over. Employees (and their immediate families) and contractors of the Promoter and its related bodies corporate or eBay Inc. and its related bodies corporate (“eBay”) are ineligible to enter.
Only those who are new to
www.eBay.com.au, or who have not made a purchase on
www.ebay.com.au during the preceding twelve (12) months are eligible to receive a prize. Existing
www.ebay.com.au members who have made a purchase on
www.ebay.com.au during the preceding twelve (12) months are ineligible to receive a prize.
The competition commences at 10.00 (AEST) on 16 January 2017 and ends at 5.00pm (AEST) on 31 January 2017 (“Competition Period”).
No responsibility is accepted for any entries that are late, lost, incomplete, misdirected or not received by the Promoter by 5.00pm (AEST) on 31 January 2017.
In order to enter the competition and be eligible to win one of the available prizes, entrants must enter their email address where indicated.
Only one entry per person is permitted. You cannot submit multiple email addresses, create multiple eBay.com.au accounts or use other any other methods in order to obtain more than one prize.
By entering the competition and providing their email address, entrants agree to join eBay’s mailing list and consent to receiving marketing communications from eBay.
Each eligible entrant will be eligible to receive a prize if selected by the Promoter in accordance with these Terms and Conditions, as a winner.
The prizes on offer as part of this competition are eBay vouchers. Limited voucher redemption codes are available. There are 9,600 eBay vouchers to be won in the following denominations and quantities during the Competition Period;
9,350 x AUD $10 eBay Vouchers to be won. Total value of AUD $93,500
200 x AUD $20 eBay Vouchers to be won. Total value of AUD $4,000
50 x AUD $50 eBay Vouchers to be won. Total value of AUD $2,500
Total maximum value of all prizes to be won is AUD$100,000.
Prizes, or any unused portion of a prize are not transferable or exchangeable and cannot be taken as cash.
The Promoter and eBay accept no responsibility for any variation in the value of any prize.
The Promoter or eBay’s decision regarding the eligibility of entrants and the prizes allocated to them is final, and no correspondence will be entered into regarding the outcome.
If a prize winner selected forfeits the prize or cannot be contacted by the Promoter, the Promoter or eBay may select a new winner in their discretion, subject to any written directions issued by any regulatory authority.
eBay and the Promoter reserve the right, at any time, to verify the validity of entries, entrants and winners (including an entrant’s or winner’s identity, age and place of residence) and reserve the right, in their sole discretion, to disqualify any individual who they have reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct. The Promoter reserves the right to request winners to provide proof of age, identity and residency prior to awarding a prize. Identification considered suitable for verification is at the discretion of the Promoter. Failure by eBay or the Promoter to enforce any of their rights at any stage does not constitute a waiver of those rights. eBay and the Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
Entries may be invalid or the Promoter may reject entries if the Promoter reasonably forms the opinion that an entry is made using automated entry means or by use of a computer entry service; late; incomplete; incorrect, including if an entrant provides the wrong details; breaches the Promoter or eBay’s User Agreement; incomprehensible; unlawful; offensive; capable of encouraging conduct that would be considered a criminal offence; capable of giving rise to civil liability; and/or made on behalf of an entrant by a third party or otherwise by proxy.
eBay and the Promoter shall not be liable for any loss or damage whatsoever which is suffered or sustained (including but not limited to indirect or consequential loss or for any personal injury or property damage) in connection with this competition or an entrant redeeming or attempting to use a voucher redemption code, except for any liability which cannot be excluded by law.
To the maximum extent permitted by law, entrants release eBay and the Promoter from all or any claims that may arise in connection with this competition.
eBay and the Promoter assume no responsibility for any technical error, omission, interruption, deletion, defect, delay, loss or damage in the operation of the eBay website, Facebook and/or participation in the competition.
If for any reason this competition is not capable of running as planned (including but not limited to) technical failures, unauthorised intervention, fraud or any other causes beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and, subject to any written directions given by applicable State Regulatory bodies, to cancel, terminate, modify or suspend the competition.
At the request of eBay or the Promoter, entrants agree (without charge) to participate in any promotional activities planned and consent to their name being used in eBay or the Promoter’s marketing materials. By participating in this competition, entrants consent to the use of their personal information as set out in these Terms and Conditions. eBay or the Promoter may collect and use personal information submitted with each entry for the purpose of running the competition, contacting winners, and sending prizes. Personal information may be provided to third party organisations that assist in maintaining the eBay.com.au Website and/or running the competition. If entrants do not provide the required personal information they will not be eligible to participate in the competition.
This competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this competition must be directed to the Promoter and not to Facebook. Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained by an entrant, as a result of participating in the competition (including taking/use of a prize), except for any liability which cannot be excluded by law. Entry and continued participation in the competition is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at

These Terms and Conditions are governed by the laws of Australia and entrants submit to the exclusive jurisdiction of the courts in relation to any disputes arising under these Terms and Conditions or in relation to the competition.
The Promoter and eBay reserve the right to vary these Terms and Conditions at their reasonable discretion by publishing revised terms on ebay.com.au, subject to approval by applicable State Regulatory bodies.
Any costs associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
Quality control errors will not invalidate an otherwise valid prize claim.
The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.

Issue and use of the prize (voucher)
Eligible winners will be notified in writing and emailed their prize (an eBay voucher) to the email address included in their entry by 1 February 2017. The voucher will entitle the recipient to the dollar value set out in email off the total purchase price (including postage) for one transaction on eBay.com.au.
The eBay voucher must be redeemed before 23:59 PM AEST on the date shown on the voucher on
www.ebay.com.au, after which time it will expire and no longer be valid.
Each voucher is can be used for only one transaction per person. Multiple items can be purchased in one transaction (up to a maximum of 10 items per transaction).
To redeem the voucher, recipients will have to enter the voucher redemption code specified in the email into the redemption code box during the checkout process.
The voucher redemption code will require payment with an Australian PayPal account in order to take effect. Each recipient’s PayPal account must be active at the time of redemption (not suspended or made inactive).
eBay reserves the right to disallow or reverse a discount in circumstances where it believes a sale or purchase of any item as part of this offer has not been made in good faith. This includes any collusive conduct by buyers or sellers, or any other conduct which eBay considers unfair, untoward or not in good faith.
Gift cards/certificates/vouchers are excluded from the use of the voucher redemption code.
Vouchers are not to be used in conjunction with any other eBay or PayPal coupon/voucher.
Sellers are responsible for their own stock and eBay does not guarantee the availability of stock.
In the event a recipient of a voucher returns or seeks a refund on any item purchased using the voucher redemption code, the value of the redemption code will not be refunded.
