Terms & Conditions
1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in the Freedom Win a Freedom Kitchen Competition plus chance to win a $500 eGift Card every week ("Competition") is deemed acceptance of these Terms and Conditions.
Promoter
2. The Promoter is Steinhoff Asia Pacific Limited trading as Freedom, ABN 55 051 493 764, of Level 4, 1 Epping Road, North Ryde NSW 2113 (“Promoter”).
Competition Period
3. The competition commences at 12.01am (AEST) on 6 February 2017 and closes at 23:59pm (AEDT) on 5 March 2017 (“Competition Period”).
Eligibility to Enter
4. Entry is open to Australian residents over the age of 18 but only an entrant who is the registered home owner of the premises in which the Freedom Kitchen will be installed and the premises is within the delivery areas specified at www.freedomkitchens.com.au/delivery-areas in Sydney, Central Coast NSW, Canberra, Melbourne or Brisbane will be eligible to choose the Freedom Kitchen Package Prize.
5. Employees (and their immediate family members) of the Promoter, or any related body corporate of the Promoter, as well as any franchisee or any agency associated with this Competition are ineligible to enter. Immediate family members means any of the following: spouse, ex-spouse, de-facto, ex-de-facto, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin. (“Eligible Entrants”).

6. The Promoter reserves the right to verify the validity of entries and to disqualify any entrant who the Promoter believes either has tampered with the entry process or has submitted an entry that is not in accordance with these conditions of entry.
How to Enter
7. All eligible entrants who:
(1) Spend a minimum of $50 in one transaction at a Freedom store or on www.freedom.com.au; and
(2) Whose name and email address details are held by the Promoter or who provide these details at check-out for marketing purposes;
will be entered into the Competition.
8. A maximum of 1 entry per day is permitted.
Prize Draw
9. Minor Draws: All eligible entries received each week during the Competition Period will be entered into a random computerized draw for the Minor Prize (“Minor Draw”).The Minor Draw will be conducted by Mike Da Silva & Associates (Aust) P/L (“MDSA”) at Ground Floor, 15 Grosvenor Street, Neutral Bay, NSW 2089 at 2.00pm AEDT every Tuesday from 14 February 2017 until 7 March 2017. Entry periods for each Weekly Minor Draw Period will be from 12:01am – 23:59pm on the following dates;

10. The first eligible entry drawn in each Minor Draw will receive a $500 freedom eGift Card, and will be notified via email, and their full name, suburb & state will be published on www.freedom.com.au within 2 business days of the applicable Minor Draw for a minimum of 28 days.
11. Major Draw: All eligible entries received during the Competition Period will be entered into a random computerized draw for the Major Prize (“Major Draw”).The Major Draw will be conducted by Mike Da Silva & Associates (Aust) P/L (“MDSA”) at Ground Floor, 15 Grosvenor Street, Neutral Bay, NSW 2089 at 2.05pm AEDT on Tuesday 7 March 2017.
12. The first eligible entry drawn in the Major Draw will win the Major Prize and will be notified by phone & via email within 2 business days of the Major Draw and their full name, suburb and state will be published on www.freedom.com.au from 7 March 2017 for a minimum of 28 days. The winner must claim the Major Prize by 1 June 2017.
Prize
13. The first Eligible Entry drawn in the Major Draw will win their choice of either:
(a) a Freedom Kitchens Package provided by Freedom Kitchens Direct Pty Limited ABN 15 097 861 268 (“Freedom Kitchens”) valued at a maximum $20,000 (including GST) (“Freedom Kitchen Package Prize”); or
(b) a $10,000 Freedom Gift Card;
provided that the winner is the registered home owner of the premises in which the Freedom Kitchens will be installed and the premises is within the delivery areas specified at www.freedomkitchens.com.au/delivery-areas in Sydney, Central Coast NSW, Canberra, Melbourne or Brisbane.
14. The Freedom Kitchens Package Prize is comprised of:
a) Kitchen cabinets with Hettich ArciTech soft-closing drawers and a Caesarstone® Classico benchtop valued up to $13,000;
b) Stainless steel kitchen appliance package nominated by Freedom Kitchens, which includes an oven, gas cooktop, slide-out rangehood and dishwasher valued up to $2,000;
c) Design, delivery and labour for installation of the Freedom Kitchen Package valued up to $5,000;
15. The Freedom Kitchens Package Prize is valued at a maximum of $20,000.00 (including GST). The winner will have a choice of specific colours and finishes to include in the installation of the kitchen. These lists will be provided by the service provider at the time of winner notification. If the winner chooses a specific item or the design, delivery and labour for installation costs are outside of the prices and fees quoted above, the winner will be advised of the additional cost and can opt to pay the additional cost or bring the total cost within the budget quoted above
16. For the removal of doubt, the Freedom Kitchens Package Prize does not include:
a) trades works (other than kitchen cabinetry installation), glass splashbacks, appliances other than specified, ceiling lighting or flooring or other kitchen accessories including but not limited to sink and taps;
b) any gas, electricity, water or associated costs incurred in before, during or after the claiming, installing and using of the Freedom Kitchen Package Prize; 

c) any accommodation, meals or other spending money incurred in relation to or ancillary to claiming or using the Freedom Kitchens Package Prize; 

d) any other ancillary or incidental expenses incurred in connection with the Freedom Kitchen Package Prize, whether before, during or after installation; 

e) any insurances or taxes; 

f) any construction, electrical, tiling or plumbing services; 

g) any ongoing maintenance costs;
h) any costs in excess of the allocated budget per component of the Freedom Kitchen Package Prize as specified above or any other ancillary costs associated with redeeming the Freedom Kitchens Package Prize.
17. The winner is responsible for all of the trades works (other than the actual kitchen installation) such as plumbing, electrical and tiling. Much of this will need to be completed before the kitchen can be installed. The Freedom Kitchens team will make all reasonable attempts to assist the winner with contacts for these trades.
18. The Freedom Kitchen Package Prize must be redeemed in full within a year, as a package and all works must be completed by 7 March 2018. Freedom Kitchens will contact the winner after winner notification to organise redemption of the Freedom Kitchen Package Prize.
19. All materials in relation to the installation of the prize will be provided and all installation will be undertaken by suppliers and persons selected in Freedom Kitchens’ absolute discretion. Freedom Kitchens will provide contracted kitchen installers to install the Freedom Kitchens Package Prize components but are not responsible for any plumbing and/or electrical services or any structural, renovation or construction work. The Freedom Kitchen Package Prize is subject to all of Freedom Kitchens’ standard terms, conditions and warranties relating to purchase and installation.
20. If the winner of the Major Prize opts to receive the $10,000 Freedom Gift Card or is ineligible to win the Freedom Kitchens Package Prize, the $10,000 Freedom Gift Card will be posted to the winner by registered mail within 5 business days and is valid for twelve (12) months from the date of card issue. The $10,000 Freedom Gift Card is subject to its terms of issue which can be found at http://www.freedom.com.au/terms-and-conditions/gift-card-terms-and-conditions/. Any unused balance of the Freedom Gift Card at expiry will not be awarded as cash.
21. A $500 Freedom eGift Card (“Minor Prize”) will be sent to each winner of the Minor Prize via email within 2 business days of the applicable Minor Draw and is valid for twelve (12) months from the date of card issue. The $500 Freedom eGift Card is subject to its terms of issue which can be found at http://www.freedom.com.au/terms-and-conditions/gift-card-terms-and-conditions/. Any unused balance of the Freedom eGift Card at expiry will not be awarded as cash.
22. All prize items are valued in Australian dollars and are inclusive of GST. Values for the Freedom Kitchens Package Prize stipulated above are based on the recommended retail prices as at the time of writing. The Promoter accepts no responsibility for any variations in prize values between such time and the date of prize redemption. The prize is not transferable, exchangeable or redeemable for cash. In the event that the winner does not take or redeem a component of the Freedom Kitchens Package prize by 5 March 2018, that component will be forfeited by the winner and cash will not be awarded in lieu of that component. In the event that any prize item is unavailable, the Promoter reserves the right to substitute a prize item of equal or greater value. Any taxes (other than GST, if any) which may be payable as a consequence of a winner receiving the prize are the sole responsibility of the winner.
23. The Promoter makes no representation or warranty as to the quality or suitability of any of the goods or services provided as part of the prize other than those which cannot be excluded under the Competition and Consumer Act Cth (2010), or any other warranties (whether express or implied) under any state or federal legislation.
24. In acceptance of the prize, the winner acknowledges that they may incur ongoing costs associated with the prize which are the entire responsibility of the winner.
25. All entries become the property of the Promoter. The Promoter’s decision is final and no correspondence will be entered into. No responsibility is accepted for entries not received by the Promoter. Entries will be deemed void if stolen, forged, mutilated or tampered with in any way.
26. The Promoter and its associated agencies and companies accept no responsibility for any prize damaged or lost in transit.
Unclaimed Prize Draw
27. If any prize is still unclaimed after three (3) calendar months of the original prize draw, the Promoter will conduct a further draw for the prize, subject to any directions from any regulatory authority. The unclaimed prize draw will be conducted at the same time and place as the original draw on 15 June 2017. In the case of a winner in the unclaimed prize draw, they will be notified by telephone and in writing within two (2) business days of the unclaimed prize draw and their name will be published on www.freedom.com.au from 16 June 2017 for a minimum of 28 days. The unclaimed prize winner must claim the prize by 15 September 2017. Disposal of any unclaimed prize may be made subject to any written directions given by any government authority and pursuant to any relevant legislation.
General
28. The Promoter assumes no responsibility for, and the entrant releases the Promoter from responsibility for, any failure to receive an entry or for inaccurate information or for any loss, claim, damage or injury to person or property (including computer systems and servers) as a result of the entrant’s participation in this promotion or the conduct of the promotion generally or as a direct or indirect result of an entrant’s error, any technical problem of any kind including communications or network failure, unauthorised access to, transferring or theft of data, whether caused by the entrant or associated with the equipment or programming used in the conduct of this promotion. If, because of any such problem, this promotion is not able to be conducted as planned and/or the promotion’s administration, security, fairness or integrity are compromised or affected, the Promoter may (where necessary with the approval of the relevant Department) cancel, terminate, modify or suspend the promotion and/or disqualify any entrant involved in interfering or tampering with the conduct of this promotion in any way.
29. Except for any liability that cannot by law be excluded, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
30. To the fullest extent permitted by law and without limiting any other conditions of entry, the Promoter may, in its discretion, terminate, modify or suspend the promotion, subject to any directions given by any relevant authority. All entrants participating in the promotion at the point of termination, modification or suspension of the promotion will be notified by the Promoter in writing. In the event of modification or suspension of the promotion, the entrant may choose to terminate their participation in the promotion at no cost.
31. All entries will be automatically opted in to marketing communications from Freedom. Details from all entries will be collected and used for the purposes of conducting this promotion (which may include disclosure to third parties for the purpose of processing and conducting the promotion) and for publicity purposes surrounding this promotion. By entering this promotion entrants consent to the use of their information as described. Entrants may access and/or change their data by following the procedures in the Promoter’s privacy policy which is available at www.freedom.com.au/privacy.
32. The winning entrant will participate in and co-operate as required with all reasonable marketing and editorial activities relating to the Promotion, including (but not limited to) being recorded, photographed, filmed or interviewed and acknowledges that the Promoter may use any such marketing and editorial material without further reference or compensation to them.
33. This is not a game of skill. The prize winners will be selected by MDSA at random through an automatic selection process.
34. The Promoter reserves the right to verify the validity of entries and to disqualify any entrant who the Promoter believes either has tampered with the entry process or has submitted an entry that is not in accordance with these conditions of entry.
35. Incomplete entries will be deemed invalid and removed from the draw. The Promoter's decision is final and no correspondence will be entered into
36. The prize is not transferable or exchangeable and cannot be taken in any other form (including not being able to be taken as cash).
37. Subject to the unclaimed prize draw clause 27, if for any reason a winner does not take possession of their prize by the time stipulated by the Promoter, then the prize will be forfeited.
38. Except for any liability that cannot by law be excluded, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Competition.
39. The Promoter accepts no responsibility for any tax implications that may arise from winning of the prize. Independent financial advice should be sought.
