Information on the Sanitair March Madness Giveaway and how to enter form part of these Terms and Conditions. Participation in this competition is deemed acceptance of these Terms and Conditions.
The Promoter is Sanitair Australia (“SA”) of Unit 2 / 54-60 Industry Drive, Tweed Heads South NSW 2486 ABN 97 114 277 468 and its agents in the promotion, including their officers, employees and agents (collectively called the “Promoter”). No correspondence received concerning this promotion will be entered into. Please refer to the mailing address nominated on the redemption site.
The promotion commences on Wednesday 1st March 2017 at 09.00am AEDST and closes at 11.59pm AEST on Friday 31st March 2017 (“Promotional Period”). The winners will be drawn by randompicker.org at 8.30am AEST on Monday 3rd April 2017 and published on the sanitair.com.au and the company’s Facebook page.
The Prize on offer is one of fifty (50) Sanitair Premium Cleans on a split system air conditioner (“Prize”). The prize on offer in the ACT – Australian Capital Territory is one (1) Sanitair Premium clean on a split system air conditioner to the value of $145.
This promotion is only open to Australian residents 18 years or over, who reside in a post code that is within a 40km radius from their closest Sanitair technician (“Serviceable Location”). This promotion is not open to SA – South Australian residents.
The Promoter does not guarantee that all residents will be available for service if they are in a regional area or where a service technician is not located.
The Promoter recommends that prior to entering the competition, the customer verifies that there is a Sanitair technician that services their post code / suburb to qualify for this offer by entering their post code in the search bar on the sanitair.com.au
Only one entry per person, per household in accordance with the offer requirements.
To participate in the competition, the entrant must complete the online registration form including their first name, last name, contact phone number, email address, post code. Entries must be received by 11.49pm AEST on Friday 31st March 2017 (end of redemption period). No entries will be processed after this date. If a claimant is not located within a post code / suburb serviced by a Sanitair technician the offer is unavailable.
Incomplete, indecipherable or illegible claim forms will be deemed invalid.
The Promoter’s decision is final and no correspondence will be entered into.
The offer is not transferable and can only be used on a Split System Air Conditioner, mounted no higher than 2.4m.
The Promoter accepts no responsibility or liability in relation to any delay in satisfying any offer.
Any cost associated with accessing the Promoter’s service technician for the purpose of redeeming the offer is the claimant’s.
The Promoter makes no guarantee of the availability of its service and will not be held responsible if the offer is unavailable at the location.
The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.
The Promoter reserves the right to reclaim the offer from any claimant, if the customer resides outside a serviceable region. This clause does not limit or affect the claimant’s rights with regards to warranties on the air conditioners either from the manufacturer or implied by legislation.
If for any reason this offer is not capable of running as planned because of any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this offer, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, subject to any written directions from a regulatory authority made under applicable State or Territory legislation.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify any provision of relevant legislation including the Competition and Consumer Act and the Australian Consumer Law in the Commonwealth, State and Territories of Australia (“Non-Excludable Guarantees”).
Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including for negligence) for any personal injury or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim or offer that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in offer value to that stated in these Terms and Conditions; (e) any tax liability incurred by a claimant; or (f) use of a offer.
All claims and any copyright subsisting in the claims become and remain the property of the Promoter. The Promoter collects personal information about claimants to include claimants in the promotion. If the personal information requested is not provided, the claimant may not participate in the promotion. By participating in the promotion and opting in at the point of product registration, each claimant also acknowledges that a further primary purpose for collection of claimants’ personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact claimants in the future with information on special offers or provide claimants with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future.
