Promotion
Information on how to enter and the prize details form part of these Terms and Conditions. Entry into the “Energizer Easter Egg Hunt” promotion (“Promotion”) is deemed to be acceptance of these Terms and Conditions
The Promoter is Energizer Australia Pty Ltd of 1 Figtree Drive, Sydney Olympic Park NSW 2127, Ph: (02) 9763 6111. ABN 91 003 539 026.
The Promotion commences at 9am AEST on 22 March 2017. Purchases must be completed by 11.59pm AEST on 2 May 2017 and Entries must be received by 11.59pm AEST on 4 May 2017 (“Promotion Period”).
Eligibility and Entry
Entry in the Promotion is only available to Australian residents. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this Promotion and to the Terms and Conditions.
Management, employees, directors and contractors (and their immediate families) of the Promoter, the Promoter’s associated companies and other agencies or companies associated with the Promotion are ineligible to enter the Promotion. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter the Promotion repeatedly is prohibited and will render all entries submitted from that source and by that entrant invalid.
To be eligible to enter the Promotion, an entrant must purchase any specially marked Energizer Max® battery product (“Promotional Energizer Product”). Each Promotional Energizer Product will have a promotional Easter egg sticker attached, with a unique code appearing on the reverse side of the Easter egg sticker (“Unique Code”).
All eligible entrants who comply with these Terms and Conditions are eligible to win a prize.
How to Enter
To enter the Promotion, eligible entrants must during the Promotion Period:
a) purchase any Promotional Energizer Product from a participating retailer;
b) peel back the Easter egg sticker on the Promotional Energizer Product to reveal the Unique Code;
c) go online to
www.energizeregghunt.com.au or such other or additional website as may subsequently be nominated by the Promoter (Promotional Website); and
d) enter their full name, phone number, email address, together with the Promotional Energizer Product barcode and the Unique Code from the Easter egg sticker on the Promotional Energizer Product.
Entrants must retain the promotional Easter egg sticker(s) (with the Unique Code), Promotional Energizer Product barcode(s), and the original store receipt(s) from the Promotional Energizer Product, for all entries, as proof of purchase.
Multiple entries in the Promotion are permitted, subject to the following requirements:
a) only one entry is permitted for each Promotional Energizer Product purchased;
b) each entry must be submitted separately and in accordance with the entry requirements; and
c) a maximum of 10 entries are permitted per person/household/e-mail address.
Entries received outside of the Promotion Period will be ineligible for entry. Entries are deemed to be received at the time of receipt by the Promoter and not at the time of submission by the entrant.
Verification
The Promoter may, at any time, verify the validity of any entry into the Promotion, and any entrant (including but not limited to an entrant’s identity, age, place of residence, Promotional Energizer Product barcode, Unique Code, proof of purchase and eligibility to enter the Promotion and claim a prize).
The Promoter may request the promotional sticker(s) with Unique Code, Promotional Energizer Product barcode(s) and the original store receipt(s) from the winner’s Promotional Energizer Product, to verify the validity of an entry. The Promoter reserves the right to declare invalid any entry for which these documents cannot be provided.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
The Promoter may disqualify any entrant who submits an entry or claim that is not in accordance with these Terms and Conditions or who tampers with the entry or claim process.
Errors and omissions may be accepted at the Promoter’s discretion.
Incomplete or indecipherable entries and claims will be deemed in valid.
The Promoter will have no liability to any entrant who provides incomplete or incorrect information.
Prizes
The prizes to be won are as follows:
a) 10 x major prizes consisting of $5,000 awarded in the form of a cheque to each of the winners (Major Prizes). The total Major Prize pool is valued at AU$50,000.
b) 10,000 x minor prizes consisting of a credit to the value of up to $4.99 for a Digital HD movie rental (Minor Prizes). The total Minor Prize pool is valued at up to $49,900.
The total prize pool for Major Prizes and Minor prizes is up to $99,900.
If a prize is unavailable for any reason, the Promoter, in its discretion, reserves the right to substitute the prize with a prize of equal value and/or specification, subject to any directions from a regulatory authority and the winner will be notified accordingly.
Winners are notified instantly whether their Unique Code is a lucky Easter egg that results in a prize. Winners are selected at random.
Winners receive either a Major Prize or a Minor Prize. The nature of the prize (Major or Minor) is determined at random.
Valid for one available movie rental from eligible rentals on Google Play. Open to participants who receive a promotional code from Energizer Australia. 100% discount applied at checkout. Limit 1 code redemption per valid Google account. Google Payments account required, subject to Google Content Promotion Terms. Age restrictions apply. See Google Play Terms for more information.
Five Major Prizes will be won by entrants who purchased their Promotional Energizer Product from a Woolworths store and five Major Prizes will be won by entrants who purchased their Promotional Energizer Product from a participating retailer other than Woolworths.
The names of Major Prize winners will be published on the Promotional Website within 7 days of submission of the prize winner’s entry.
All prizes from the advertised prize pool will be distributed.
How to Claim a Prize
Upon successful submission of their entry at the Promotional Website, winners will be notified immediately if they have won a prize. Further instructions on how to claim the prize will be provided online.
Prize Conditions
In order to claim a Major Prize, the winner must present their original Promotional Energizer Product barcode, promotional sticker with original Unique Code, and the purchase receipt for their Promotional Energizer Product to the Promoter for validation prior to the end of the Promotion Period. The prize will be awarded in the form of a crossed cheque made out to the winner, or if the winner requests, in the form of an electronic funds transfer to an account nominated by the winner. It is the responsibility of the winner to advise the Promoter of their correct details for payment. The Promoter will not be responsible for any funds transmitted to an incorrectly nominated account.
Prizes, including any unused portion, are not transferable or exchange able and cannot be taken as cash unless otherwise stipulated in writing by the Promoter.
Delivery of a Major Prize may take up to 28 days.
If the prize winner is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian, on behalf of the prize winner.
No entrant may win more than one Major Prize and one Minor Prize. Once an entrant has won a Major Prize, they are ineligible to win any more prizes in the Promotion. Once an entrant has won a Minor Prize, they are ineligible to win further Minor Prizes, but remain eligible to win a Major Prize in the Promotion.
Despite anything set out in condition above, residents of South Australia may win more than one Major Prize and more than one Minor Prize.
A Minor Prize consists of a credit to the value of up to $4.99 for a Digital HD movie rental from the 20 movie titles listed at Energizer Movie Website. Winners will need to select a Digital HD movie rental. Winners will need a Google Play account to stream the selected movie. To collect the movie credit, the winner is required to create an account (for free) or log into Google Play. Once logged in to Google Play, Minor Prize winners’accounts will be credited with the movie credit. If a Minor Prize winner does not wish to claim their Minor Prize straight away or navigates away from the Energizer Movie Website, they can return at a later date. Minor Prize winners will require a device and internet connection capable of supporting Google Play in order to stream their chosen movie. Any ancillary costs incurred in streaming the movie are the responsibility of the Minor Prize winner. By claiming the movie rental, the Minor Prize winner agrees to comply with the Google Play terms and conditions, a copy of which can be found at
https://play.google.com/intl/en_au/about/play-terms.html. All subsequent use of Google Play by the Minor Prize winner will be subject to any terms and conditions applicable to the Google Play account.
Downloading, streaming, accessing and using Google Play and accessing and using mobile content including the Minor Prize will incur data charges. Data charges will be the winner’s responsibility and will vary depending on the internet service provider, usage plan or mobile carrier used (as applicable). Winners will need to refer to the terms of the contracts with their mobile carrier, usage plan or internet service provider (as applicable) for costs.
Movie credits are valid for use until 30 August 2017 and cannot be used in conjunction with any other offer or discount. Once selected, the movie is valid to be played for 30 days from the date the movie is linked to the winner’s account. Once viewing has commenced, the winner has 48 hours to complete viewing the movie. Winners will not be able to recommence playing the movie after this time.
Any or all of the movie credit that is unused will be forfeited.
At the end of the Promotion, all existing claims for prizes and valid entitlements to claims will be met notwithstanding the advertised prize pool has been exceeded.
Printing errors or other quality assurance matters outside the control of the individual player will not be used as the sole basis for refusing to award a prize.
Unclaimed Prize Draw
Subject to any written directions given by a relevant lotteries or gaming authority (as applicable), a draw will be held to award any Instant Win Prizes that have not been awarded, or any Major Prizes that have not been claimed by 5pm AEST on 7 August 2017 (“Unclaimed Prize Draw”).
The Unclaimed Prize Draw will be held at 10am on 9 August 2017 at Level 2, 608 Harris Street, Ultimo, NSW 2007.
All entrants (except entrants who have already won a Major Prize who reside in a state or territory other than South Australia) will be automatically entered into the Unclaimed Prize Draw.
The unclaimed Instant Win and Major Prize (if any) will be awarded to the first valid entry drawn in the Unclaimed Prize Draw. The Unclaimed Prize Draw will continue until all unclaimed Instant Win and Major Prizes have been distributed. Winners (if any) of the Unclaimed Prize Draw will be notified in writing within two (2) business days of the draw and winners’ names will be published on the Promotional Website on 23 August 2017.
General
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or voice recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome) and promoting any products manufactured, distributed or supplied by the Promoter.
Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
The Promoter’s decision is final and no correspondence will be entered into.
If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to:
a) disqualify any entrant; or
b) subject to any directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
The Promoter is not liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with the Promotion, including using the prize or any inability to use the prize, except for any liability which cannot be excluded by law.
Any cost associated with accessing the Promotional Website is the entrant’s responsibility and is dependent on the service provider used. Use and availability of the internet is dependent on many factors beyond the Promoter’s control and the Promoter makes no warranty that the Promotional Website will be available at any particular time.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided in the Competition and Consumer Act 2010 (Cth) or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”).
Except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury, or any loss or damage of any other kind (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of:
a) the Promotion;
b) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
c) any theft, unauthorised access or third party interference;
d) any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
e) any variation in prize value to that stated in these Terms and Conditions;
f) any tax liability incurred by a winner or entrant; or
g) use of a prize or any offer.
If the Promoter becomes liable to any person under any law which cannot be excluded, including any implied warranties or guarantees, the Promoter’s liability will be limited to one of the following, at the Promoter’s election:
a) the re-supply of any goods supplied or the cost of re-supplying the goods in question; or
b) the re-supply of any services supplied or the cost of re-supplying the services in question.
All entries become the property of the Promoter. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, reward suppliers and, as required, to Australian regulatory authorities. Entry in the Promotion is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at
http://www.energizerholdings.com/en/pages/privacypolicy.aspx. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose an entrant’s personal information to any entity outside of Australia.
Facebook may be used to advertise or promote the Promotion. By entering the Promotion, entrants agree:
a) that the Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook; and
b) to release Facebook from all liability in relation to this Promotion.
