TERMS AND CONDITIONS
1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in
this promotion is deemed acceptance of these Terms and Conditions.
2. The promoter is Independent Hardware Group Pty Ltd (ABN 64 004 037 049) of Level 2, 15
Corporate Drive, Heatherton, VIC 3202, telephone 1300 131 843 (“Promoter”).
3. Entry is only open to Australian residents aged 18 years or over who are business owners (or
employees including apprentices and subcontractors) in the following trades and can claim and take
the prize during the dates specified in these Terms and Conditions:
Builder;
Carpenter;
Electrician;
Landscaper; or
Plumber.4. Employees (and their immediate families) of the Promoter and agencies associated with this
promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse,
de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent,
grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or
1st cousin.
5. Promotion commences on 15/05/2017 and final entries close at 11:59pm on 30/06/2017
(“Promotional Period”). All times indicated in these Terms and Conditions are in AEST, as per local
VIC time.
6. To enter, eligible individuals must complete the following steps during the Promotional Period:
a) visit

c) input the requested details (including their full name, eligible trade, the name of the company
at which they are employed, a valid email address, mobile number, State/Territory of
residence and their preferred Home Timber & Hardware store);
d) agree to accept the terms and conditions; and
e) submit the full completed entry form.
7. Incomplete or indecipherable entries will be deemed invalid.
8. Only one (1) entry is permitted per person.9. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an
entrant’s identity, age ,place of residence and place/industry of employment) and reserves the right, in
its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached
any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or
other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors
and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any
of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to
recover damages or other compensation from such an offender are reserved.
10. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole
discretion, to determine the identity of the entrant.
11. The draw will take place at Database Consultants Australia, Level 5, 355 Spencer Street, West
Melbourne, VIC 3003 at 9:00am on 03/07/2017. Subject to clause 12, the Promoter reserves the right
to draw reserves in case of an invalid entry or invalid entrant.
12. The provisional winner will be notified immediately after the draw by telephone and in writing by email.
The provisional winner will have until 9:00am AEST on 04/07/2017 (24hours) to respond to the winner
notification and claim their prize. If the provisional winner fails to respond to the winner notification by
9:00am AEST on 04/07/2017 the Promoter will contact the next reserve entry drawn who will have
until 9:00am on 05/07/2017 (24 hours) to respond to the winner notification and claim their prize. If the
2nd reserve provisional winner fails to respond to the winner notification by 9:00am on 05/07/2017 (24
hours) a re-draw will be conducted in accordance with clause 21 below. The provisional winner will
only be deemed a winner once verified by the Promoter. The winner will have their name published
immediately after the draw online at

13. The Promoter’s decision is final and no correspondence will be entered into.
14. The first valid entry drawn, from all valid entries received during the Promotional Period, who claims
the prize as outlined in these Terms and Conditions, will win a trip for four (4) adults to QLD for Game
3 of the State Of Origin (at Brisbane’s Suncorp Stadium on 12/07/2017) valued at up to $20,000
depending on point of departure. Prize includes:
Four (4) x return economy class airfares from the winner’s nearest capital city to Brisbane,
QLD (only provided if winner resides outside of QLD). If the winner is from QLD, then the
prize does not include airfares and the airfare component of the prize is not redeemable for
cash;
Two (2) nights accommodation in a minimum 5 star hotel (on 11/07/2017 and 12/07/2017)
with four (4) single rooms being provided;
Return airport to hotel transfers;
Tickets for four (4) people to Game 3 of the 2017 State Of Origin held at Suncorp Stadium
(with Diamond category seating) on 12/07/2017, including access to the Diamond Lounge,
exclusive escorted walk on to the pitch and pre and post match function hospitality package;
Four (4) merchandise packs (one for each person) including a scarf and signed jersey (exact
size and preferred team QLD or NSW to be determined by the Promoter) and a scarf;
AUD$2,000 spending money (for the winner only); and
Travel insurance, up to the value of $65 per person.15. Additional spending money, meals, additional insurance, transport to and from departure point,
additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not
included. Prize must be taken to coincide with Game 3 of the State Of Origin event with flights
departing on 11/07/2017 and is subject to booking and flight availability. The winner and their
companion/s must depart from and return to the same departure point and travel together. Itinerary to
be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the
prize. Prize is subject to the standard terms and conditions of individual prize and service providers.
The winner may be required to present their credit card at time of accommodation check in.
16. The winner and their companion/s will each be required to fully complete a travel insurance
application form provided by the Promoter, and may also be required to undergo medical tests as
required by the Promoter’s nominated travel insurer, in order to redeem the travel insurance element
of the prize. Any person found guilty of insurance fraud or failure to honestly and accurately disclose
all relevant insurance information at the time of applying for a travel insurance policy or when making
a claim forfeits any rights or entitlements to the travel insurance element of the prize. Travel insurance
will be provided by the Promoter’s nominated travel insurer, and subject to approval by the travel
insurer. In the event that the Promoter’s nominated travel insurer refuses to issue insurance to the
winner and/or companion/s, the winner forfeits that travel insurance element of the prize. Travel
insurance is subject to the terms and conditions issued by the Promoter’s nominated travel insurer,
including but not limited to any limitations on the covered amount.
17. Subject to the unclaimed prize draw clause, if for any reason the winner does not take the prize (or an
element of the prize), at the time stipulated by the Promoter, then the prize (or that element of the
prize) will be forfeited.

18. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to
substitute the prize (or that part of the prize) with a prize to the equal value and/or specification,
subject to any written directions from a regulatory authority.
19. Total prize pool is up to the value of $20,000.
20. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be
taken as cash.
21. If the prize remains unclaimed by 9:00am AEST on 05/07/2017, a re-draw will take place for such
prize at 10:00am AEST on 05/07/2017 at the same place as the original draw, subject to any
directions from a regulatory authority. The winner, if any, will be notified immediately by telephone and
in writing by email and their name will be published online at

22. The entrants consent to the Promoter using their name, likeness, image and/or voice in the event they
are a winner (including photograph, film and/or recording of the same) in any media for an unlimited
period without remuneration for the purpose of promoting this promotion (including any outcome), and
promoting any products manufactured, distributed and/or supplied by the Promoter.
23. If this promotion is interfered with in any way or is not capable of being conducted as reasonably
anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited
to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole
discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any
written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion,
as appropriate.
24. Any cost associated with accessing the promotional website is the entrant’s responsibility and is
dependent on the Internet service provider used. The use of any automated entry software or any
other mechanical or electronic means that allows an entrant to automatically enter repeatedly is
prohibited and will render all entries submitted by that entrant invalid.
25. The Promoter will not be liable for any tax obligations arising out of participation in this promotion
(including acceptance of a prize). Entrants should seek independent financial advice in this regard.
26. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or
modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as
well as any other implied warranties under the ASIC Act or similar consumer protection laws in the
States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that
cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its
respective officers, employees and agents) excludes all liability (including negligence), for any
personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special
or consequential, arising in any way out of the promotion.
27. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the
Promoter (including its respective officers, employees and agents) is not responsible for and excludes
all liability (including negligence), for any personal injury; or any loss or damage (including loss of
opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any
technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any
theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost,
altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any
reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a prize winner,
winner’s employer or entrant; (e) if the Game 3 State of Origin event is delayed, postponed or
cancelled for any reason beyond the reasonable control of the Promoter; or (f) taking/use of the prize.
28. As a condition of accepting the prize, the winner (and their companion/s) must sign any legal
documentation as and in the form required by the Promoter and/or prize suppliers in their absolute
discretion, including but not limited to a legal release and indemnity form.

29. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this
purpose, disclose such PI to third parties, including but not limited to agents, contractors, service
providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on
providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can
be viewed at
http://www.homehardware.com.au/privacy_policy. In addition to any use that may be
outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise
advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including
sending electronic messages or telephoning the entrant. The Privacy Policy also contains information
about how entrants may opt out, access, update or correct their PI, how entrants may complain about
a breach of the Australian Privacy Principles or any other applicable law and how those complaints
will be dealt with. All entries become the property of the Promoter. The Promoter may disclose
entrant’s personal information to selected entities outside of Australia – see Privacy Policy for details.
