Timmy Trumpet x Suzuki IGNIS Competition

1.       

Information on how to enter and the prizes form part of these terms and conditions.

2.         The Promoter is Timmy Trumpet Touring Pty Ltd as trustee for Tim Smith Family Trust (ABN 86 437 661 631) (TT)  of 801 Glenferrie Road, Hawthorn, VIC 3122 and Suzuki Australia Pty Ltd (Suzuki) (ABN 57 001 828 164) having its registered office at 97-105 Cherry Lane, Laverton North, VIC 3026 and Ministry of Sound Australia Pty Ltd (MOS) (ABN 16 106 918 601) having its registered office at 200 Crown Street, Darlinghurst, NSW 2010 (Promoter).

3.         Entry into the competition (Competition) is deemed acceptance of these terms and conditions.

 

Eligibility

4.         Entry is only open to Australian residents over 18 years of age with a valid email address.

5.         Employees, participating retailers and agents of Promoter or any company associated with the Promoter, and their immediate families are not eligible to enter the Competition. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, auntie, niece, nephew, brother, sister, step-brother, step-sister or first cousin

Entry

6.         To enter the Competition, entrants must go to the competition page at http://upvir.al/28295/TimmyTrumpet (Competition Page) to enter in accordance with these Terms and Conditions. Any entry not complying with these Terms and Conditions is invalid and will not be entered into the Draw.

7.         To be eligible the entrant must:

Enter their full name, email address and postcode;

Acknowledge acceptance of these Terms and Conditions;

Submit entry via the Competition Page;

Take full responsibility for the content of entry and for ensuring that their entry complies with these Terms and Conditions; and

Accept that incomplete and illegible entries will be deemed invalid and accept that entries will also be deemed invalid if they breach these Terms and Conditions as determined by the Promoter in its sole discretion.

Promoter is not responsible for any misdirected, late or incomprehensible entries in the Competition. Promoter is not responsible for any problems or technical malfunctions of any telephone network, computer on-line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the internet or at any web site, or any combination thereof, including any injury or damage to entrants or any other person’s computer related to or resulting from participation in in this Competition

8.         By entering the Competition, unless stated otherwise by the entrant, entrants agree that Promoter may use the entrant’s contact details in any media for future competition, marketing or publicity purposes without further reference or consent. Promoter will collect personal information about entrants for the purposes of conducting the Competition and awarding the Prize. In accordance with the National Privacy Principles in the Privacy Act 1988 (Cth), entrants have a right to access most of the information Promoter holds about them. Suzuki’s privacy policy can be found at http://www.suzuki.com.au/privacy. MOS’s Privacy Policy can be found at http://www.ministryofsound.com.au/privacy-policy.  For TT’s Privacy Policy, please contact Timmy Trumpet Pty Ltd at accounts@timmytrumpet.com.  All entries become the property of Promoter. The Promoter collects personal information from all entrants in order to conduct the Competition.  If the information requested as part of entry into the Competition is not provided, the entrant may not participate in the Competition and their entry will be discarded.  It is a condition of entry into the Competition that the Winner consents to the publication of their name and city of residence in any advertisements or articles relating to the Competition or the Prize and the Winner agrees to participate in any media releases which may include photographs of the Winner by the Promoter.  The Promoter’s treatment and storage of personal information will be handled in accordance with all applicable laws in Australia.

9.         Each entrant may make one Entry only.

Prize and Winner

10.        There will be one (1) entrant who will be deemed the winner (Winner) and will be awarded the prize which will consist of one (1) Suzuki Ignis GLX car (Prize). The Prize is inclusive of registration or any other on-road costs, but does not include any extras and/or accessories and does not include delivery to the Winner. The total Prize pool value is AU$21,000.00 (including GST) as at 04/05/2017

11.        The Promoter takes no responsibility for petrol, comprehensive insurance, health, transport, body, paint or mechanical damage, or any other costs or damages, from date of delivery. The prize value includes on-road costs. In WA, winners will be responsible for arranging and paying for an immobiliser to be fitted, as required by WA Road Traffic regulations.

12.        The Winner will be drawn at random by an independent scrutineer in accordance with the Lotteries and Art Unions Act 1901 (NSW) (the Act) and the Lotteries and Art Unions Regulation 2014 (NSW) (the Regulations). The Scrutineer will be appointed to confirm that the processes followed by the Promoter provide reasonable assurance that all entrants who are entitled to participate in the Promotion are entered and that the Promotion is fair.  In the event of a dispute that representative will act as an adjudicator and their decision will be final and no correspondence will be entered into.

13.        The Competition commences at 12:00am AEDT on Friday 19 May 2017 and concludes at 11:59pm AEDT on Friday 28 July 2017 (Competition Period). Entries must be received by 11:59pm AEDT on Friday 28 July 2017 to be included. The Winner will be drawn at 2:00pm AEDT on Friday 4 August 2017 (the Draw) and the Winner will be notified via email by 5pm AEST on Monday 7th August 2017. The Winner will have their details published in http://upvir.al/28295/TimmyTrumpet on Monday 7 August 2017. The Promoter may extend the Competition Period in its sole discretion. All entries are deemed to be received at the time of receipt NOT at the time of sending by entrants. Late entries will not be eligible.

 

 

 

Prize Conditions

14.        The Prize is not exchangeable for other goods and services and cannot be redeemed for cash.

15.        If the Prize is not claimed by the winner prior to Friday 8th September 2017 (or any later period set by the Promoter by written notice to the Winner if the Competition Period is extended by the Promoter), the Prize will be forfeited and will be awarded to an alternate winner (Unclaimed Prize Draw). The Unclaimed Prize Draw will occur on Friday 15th September 2017 at the same time and place as the original draw. If a winner is drawn from the Unclaimed Prize Draw (the Alternate Winner) the Alternate Winner will be notified by email within two (2) business days of the date of the Unclaimed Prize Draw and will have their name published in http://upvir.al/28295/TimmyTrumpet on Monday 18th September 2017. The Promoter reserves the rights to reselect such Alternate Winner the purposes of the Unclaimed Prize Draw as necessary to distribute the Prize.

           

16.        The Prize will be available for collection by the Winner from Suzuki on behalf of the Promoter at a registered Suzuki dealer within the State of residence of the Winner within four (4) weeks of the date of the Draw.  In the event that the Winner is unable to collect the Prize, the Winner will be solely liable for any transportation or other delivery costs with respect to the Prize from Suzuki to the Winner.

17.        The Promoter’s decision in relation to any aspects of the Competition is final and binding on each entrant who enters and no correspondence will be entered into.

18.        The Promoter will not be responsible for any costs associated with winning or delivery of the Prize unless specifically stated in these Terms and Conditions.

19.        If for some reason beyond Promoter’s control, it is not possible to supply the Prize as advertised, Promoter will be entitled to supply a substitute prize in Promoter’s discretion of equal or greater value. If the Competition is not capable of running as planned due to any reason out of the Promoter’s control (including, but not limited to fraud, a state of emergency, natural disaster, war, technical failures or any other causes) Promoter reserves the right without liability to the entrants to cancel, modify, terminate or suspend the Competition subject to the approval of the relevant authorities in each State and Territory.

    20.        Nothing in these Terms and Conditions is intended to exclude, restrict or modify any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by any legislation which cannot lawfully be excluded or limited.  This may include the Corporations Act 2001, the Competition and Consumer Act 2010, Australian Consumer Law or any equivalent State or Territory legislation. If any guarantee, warranty, term or conditions implied or imposed under the Australian Consumer Law or any other applicable legislation in relation to any prizes awarded under these terms and conditions cannot be excluded (Non-Excludable Provision) and the Promoter is able to limit the remedy for a breach of the Non-Excludable Provision, then the liability of the Promoter for breach of the Non-Excludable Provision is limited to one or more of the following at the Promoter's option:
    the replacement of the Prize or the supply of an equivalent prize;
    the repair of the Prize;
    the supplying of the Prize again;
    the payment of the cost of replacing the Prize or of acquiring an equivalent prize;
    the payment of the cost of having the Prize repaired; or


        the payment of the costs of having the Prize supplied again.

21.        To the maximum extent permitted by law, the Promoter expressly disclaims liability for any loss or damage whatsoever (including but not limited to indirect or consequential loss) or for any personal injury which is suffered or sustained in connection with any entrants participation in the Competition or the acceptance of the Prize. The Winner indemnifies the Promoter against any liability, injury, loss or damage which may be suffered, incurred or sustained by the Promoter arising out of, relating to, or in any way connected with, any act or omission (including negligence) by the Winner, or its use of the Prize, or its breach of these Terms and Conditions.

22.        Promoter is not responsible for any tax implications that may arise from winning the Prize and the Winner shall be solely liable for any taxes payable in connection with the Prize. Entrants should seek independent financial advice about such matters.

23.        Promoter in its absolute discretion reserves the right to verify the validity of each entry (including an entrant’s identity, age and place of residence) and to disqualify entrants if they tamper with the entry process including but not limited to submission of an entry not in accordance with these Terms and Conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. Incomplete or indecipherable entries will be deemed invalid.

24.        These Terms and Conditions constitute the entire agreement between each entrant and Promoter.

25.        These Terms and Conditions shall be governed by the laws of New South Wales, Australia.

Copyright, Statutory guarantees, Waiver and liability

 

All entries and any copyright subsisting in the entries become and remain the property of the Promoter who may publish or cause to be published any of the entries received.

Prize-winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of that prize.

The Promoter (subject to State and Territory legislation) reserves the right to amend, cancel or suspend this competition if an event beyond the control of the Promoter corrupts or affect the administration security, fairness, integrity or proper conduct of this competition. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this competition. In particular, computer generated entries and the use "scripting" is not permitted and will not be accepted.

Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.

Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ('Non-Excludable Guarantees').

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Entrant; or (f) use of a prize. The Promoter (including its' officers, employees and agents) excludes all liability for any loss (including, without limitation, indirect, special or consequential loss or loss of profits or opportunity), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence) in connection with this competition including taking or using a prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law), including the Non-Excludable guarantees. Any change in value of the prize occurring between the publishing date and date the prize is claimed is not the responsibility of the Promoter.
