TERMS AND CONDITIONS:

This competition is conducted by the State of Queensland acting through the Department of the Premier and Cabinet ABN 65 959 415 158 of 1 William Street, Brisbane, Queensland 4000 (“State”).

All competition entry instructions, requirements and prize information published by the State and publicly available at www.qld.gov.au/queenslandday form part of these terms and conditions (“Terms and Conditions”).

The Entrant accepts these Terms and Conditions by submitting the Entry.

This competition is only open to individuals who: have a permanent residential address in Queensland;
as at 25 May 2017 are aged 18 years or over; and make or have a Facebook or Instagram account (“Entrant”).
This competition commences at 9:00am AEST on 25 May 2017 and closes at 11:59pm AEST on 25 June 2017 (“Entry Period”).


An entry is either:

an original photograph showing the Entrant only with an ‘I AM’ or ‘WE ARE’ sign explaining what makes the Entrant a special part of Queensland or what the Entrant loves most about Queensland (“Individual Entry”); or
an original photograph showing the Entrant with a one or more persons with an ‘I AM’ or ‘WE ARE’ sign explaining what makes the Entrant and/or the person(s) a special part of Queensland or what the Entrant and/or the person(s) love most about Queensland (“Group Entry”);
(“Entry”).

To enter this competition the Entrant must, during the Entry Period, submit the Entry using one of the methods set out below:

(Competition Website Method) use a compatible browser to visit http://woobox.com/3xcxra (“Competition Website”) and:
complete the online entry form available on the Competition Website in accordance with its instructions, including providing the required personal information (including name, residential address, telephone number and email address);
upload the Entry;
read and agree to the Competition Rules which can also be viewed here; http://woobox.com/offers/rules/3xcxra
submit the entry form (including the Entry); and
or
(Facebook Method) use a compatible browser to visit www.facebook.com and:
upload the Entry; and
apply the hashtags “#WeAreQLD” and “#qldday”; or
(Instagram Method) use a compatible device to visit Instagram and:
upload the Entry; and
apply the hashtags “#WeAreQLD” and “#qldday”.
For the Entry to be eligible for a Prize (“Eligible Entry”), the Entry must:

not be an Entry submitted by State employees directly involved in the administration of this competition or their immediate family;
be available for public viewing on the Entrant’s Facebook or Instagram account (as appropriate) until 8:00pm AEST on 30 June 2017;
comply with the terms of use of Instagram (available here: https://help.instagram.com/478745558852511) and Facebook (available here: https://www.facebook.com/policies?ref=pf), as appropriate; and
comply with these Terms and Conditions.
The Entrant must submit the Entry manually. The State may reject the Entry if, in the State’s opinion, the Entry has been submitted in any other manner including, without limitation, by using automated entry or a competition entry service.

Each Entrant may only submit one Entry. An Entry may only be submitted by one Entrant. For the avoidance of doubt, where a person appears in a Group Entry submitted by an Entrant, that person may submit an Entry. Persons appearing in a Group Entry may not submit the same Entry.

There is no fee payable to the State to enter this competition. The Entrant acknowledges that internet connection and usage costs may be payable to the Entrant’s service provider. The Entrant is responsible for any such costs.

The State may at any time verify, to the State’s satisfaction, the eligibility of the Entrant or Entry. The Entrant must provide such documents or information as the State in its absolute discretion requests.

The State takes no responsibility for late, lost, incomplete, incorrectly submitted, illegible or misdirected Entries or for any delays or failures in telecommunications and online service or equipment. Errors and omissions may be accepted at the State's discretion.

The Entry must be an original work created by the Entrant for this competition.

The Entry must not contain unlawful, defamatory, racist or otherwise offensive or inappropriate material.

The State may, at any time and in its absolute discretion, accept, reject or remove any Entry. The State may, at any time, reject or remove any Entry that it considers, in its absolute discretion, is inappropriate; will bring the State or this competition into disrepute; is not an Eligible Entry; or is in breach of these Terms and Conditions.

The Entrant warrants that he/she is the owner of the copyright in any material submitted as part of the Entry, including but not limited to any photographs, and the submission of any material as part of the Entry does not give rise to any infringement or unauthorised use of any third party intellectual property rights. Entrants agree to indemnify the State against all costs and claims by third parties arising from a breach of this warranty.

As a condition of submitting the Entry in this competition:

all copyright, trademark, design or other proprietary rights, in relation to the material contained in the Entry (including photographs and text) will jointly vest in the State and the Entrant, with no obligation to seek consent from or to account to, the other party in relation to the proceeds; and
the Entrant consents to any acts or omissions by the State that might otherwise constitute an infringement of moral rights, including integrity of authorship and attribution, as conferred by the Copyright Act 1968 (Cth).
Photographs submitted as part of the Entry must:
only identify persons who have consented to (or where the person is under the age of 18 years, their appropriate adult has consented to) the entry of the photograph in this competition in accordance with these Terms and Conditions; and
not contain personal information such as residential and/or email addresses or phone numbers.
The Entrant acknowledges that he/she is responsible for the content of the Entry, including any photographs, and the State shall not be liable in any way for such content to the full extent permitted by law and the Entrant indemnifies the State against all costs and claims by third parties arising from such content.

The prize is a TravelOnline.com voucher to the value of $500 redeemable online (through Travelonline.com) for travel and accommodation within Queensland up to the “Expiry Date” shown on the voucher (“Prize”).

The Prize is subject to TravelOnline.com’s terms and conditions from time to time applying, including the Gift Voucher Terms of Use available here: https://www.travelonline.com/voucher-purchase-terms.html (“TravelOnline.com’s Terms”). The Prize must be used according to TravelOnline.com’s Terms.

There are four (4) Prizes to be won.

The Prize is not redeemable for cash and is not transferable or exchangeable.

If the Prize is unavailable for any reason, the State may, in its absolute discretion and without notice, substitute the Prize with another prize of equal or higher value as determined by the State to be reasonable.


WINNERS

This competition is a game of creative merit, in which chance plays no part. The State will judge each Eligible Entry on literary and creative merit and award a Prize to four (4) Entrants (“Winners”).

Each Winner will be notified by telephone, email or direct message on their Facebook account or Instagram account. It is the Entrant’s responsibility to ensure that their relevant social media profile remains active to enable the State to contact the Entrant if they win.

Each Winner must accept the Prize by 11:59pm AEST on 7 July 2017. Any Prize not accepted by this date will be forfeited, and no substitute or compensation will be provided and the Winners will not have any claim whatsoever against the State.

To accept the Prize, the Winner must produce evidence of identity, age and residency in the form of a Queensland government issued photo identification or proof of identity and residency.

If a Winner cannot be contacted, a winning Entry is found to be ineligible or in breach of these Terms and Conditions, or a Winner does not follow the State’s instructions to claim the Prize by 7 July 2017, the State will deem the Prize as unclaimed (and forfeited) and select another winner based on the same selection criteria. This process will be repeated if required.

Upon a Winner accepting the Prize, the Winner’s details will be announced no later than 10 July 2017 on the State’s Facebook and Instagram page (www.facebook.com/queenslandday/ and www.instagram.com/queenslandday/).

By accepting the Prize, the Winner agrees to:

use the Prize according to TravelOnline.com’s Terms;
participate in promotional activities (such as publicity and photography) in relation to this competition and current or future Queensland Week or Queensland Day celebrations (including promotional materials associated with such celebrations) (“Promotional Activities”), as requested by the State; and
the State publishing their name and Entry on the State’s social media accounts (including but not limited to Facebook and Instagram), online and in print.
The Entrant acknowledges and agrees that their personal information will be:

collected by the State for the purpose of:
administering this competition (including assisting the State’s contractor, Lingo PR & Digital, in administering this competition); and
notifying the Entrant of upcoming events, initiatives and programs administered by the Department of the Premier and Cabinet; and
collected by the State’s contractor, Munn Family Holdings Pty Ltd trading as Lingo PR & Digital ABN 73 158 980 057 ("Lingo PR & Digital"), for the purpose of administering this competition.

The Entrant warrants that all persons capable of being identified in the photograph have consented to (or where the person is under the age of 18 years, their appropriate adult has consented to):
the use of their image in this competition; and
the State publishing their image in connection with this competition and for Promotional Activities.
Each Winner acknowledges and agrees that the State may:
use and disclose the Entry and their personal information (such as their name and image) for Promotional Activities; and for promotional purposes on the State’s social media accounts (including but not limited to Facebook and Instagram), online, and in print; and
disclose their name and contact details to the State’s contractor, Lingo PR & Digital, and suppliers of the Prize for the purposes of facilitating the delivery of the Prize.

This competition is in no way sponsored, endorsed, administered by or associated with, Facebook, Instagram or TravelOnline.com. In conducting this competition, the State in no way sponsors, endorses or is associated with Facebook, Instagram, TravelOnline.com or any other party associated with this competition or the Prize.
The Entrant and the State will be subject to the terms and conditions of Facebook and Instagram which may allow unrestricted use and modification of the Entry including the photograph and material contained in the Entry. The State gives no warranties that it can or will seek to control how personal information contained in the Entry is subsequently used or modified by third parties.

The Entrant completely releases Facebook and Instagram from any claims, demands, liability, damages and causes of action, losses, costs or expenses, in relation to this competition including, without limitation, the supply of the Prize to the Winners.

If this competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the State, the State may, in its absolute discretion and to the fullest extent permitted by law, modify, suspend, terminate or cancel this competition.

The State may vary or amend these Terms and Conditions at any time, whether during or after the Entry Period.

To the full extent permitted by law, the State is not liable for any injury, damages, expenses or loss whatsoever (including but not limited to indirect or consequential loss) to persons or property by reason of any act or omission, deliberate or negligent, by the State, or its officers and agents in relation to this competition, including without limitation, the supply of the Prize to the Winners.

To the full extent permitted by law, the State is not liable, and will not pay compensation, for any injury, damages, expenses or loss whatsoever (including but not limited to indirect or consequential loss) to persons or property by reason of:
the Prize being lost or stolen; or
the Winner being unable to use the Prize; or
the Winner’s acceptance and/or use of the Prize including, without limitation, all transactions made by the Winner with the Prize.
No person shall be entitled to claim compensation or loss from the State in relation to this competition including, without limitation, a failure by the State to comply with these Terms and Conditions.

The State's decision in relation to any aspect of this competition is final and binding on the Entrant and no correspondence will be entered into. Failure by the State to enforce any of its rights at any time does not constitute a waiver of those rights.

These Terms and Conditions are governed by the laws of Queensland.
