1. Stella Artois is giving cinemagoers the chance to win the ultimate HOYTS LUX screening for the winner and their friends valued up to $3,000. 10 Runners up will also receive a Stella Artois chalice. By purchase Stella Artois at a HOYTS LUX venue, you can enter the competition. All you have to do is fill in the competition card given to you by a staff member. “In 25 words or less why Stella Artois is their favourite beer”, and include your details; including First Name, Last Name, Email Address, Phone Number and Date of Birth. This card must be placed into the ballot box


2. This is a game of skill; chance plays no part in how a winner is determined in this competition. All entries will be reviewed and judged by the Promoter (or by an appointed panel of judges) based on selected criteria such as creative merit, originality, humour and brand suitability.


3. The entry judged to be the best from all entries received will win the major prize. The next 10 best valid entries will each win a minor prize.


4. 1 major prize and 10 minor prizes to be won. The major prize is a private screening at Hoyts LUX for the winner and up to 30 adult guests, valued at $3,000 depending.


5. The winners will be contacted by phone and by email


6. The major prize can be redeemed at any HOYTS LUX cinema (in the Relevant States) of the major prize winner’s choice, on a date and time to be agreed between HOYTS and the major prize winner.


7. Each minor prize is a Stella Artois chalice, valued at $5. See Prize Conditions for further information and conditions.


8. Prize/s must be claimed by 5:00pm (AEDT) on 01/11/2017.


9. If the Promoter is unable to contact the winner (and/or the winner does not contact the Promoter) by the Prize Claim Date, the Promoter will discard that entry and either award the prize to the next best valid entry, or in its absolute discretion, withdraw the prize un-awarded.


10. Entrants must be an Australian resident aged 18 or over and have purchased Stella Artois at a HOYTS LUX venue.


11. Relevant States: This competition will run in NSW, Vic and WA only. Competition Period: 9:00am (local time) on 11/07/2017 to 11:59pm (local time) on 06/10/2017.

Venues: This competition will run at all Hoyts Lux sites.

12. In NSW, entrants are limited to 1 entry per day. Everywhere else, entrants are limited to Eligible Purchases totalling 4 standard drinks per day. Each entry submitted must be based on a separate Eligible Purchase and separate entry form as set out in the Entry Process section of the Schedule (Competition T&C’s)

 

Terms and Conditions:

1. These Conditions integrate, and must be read together, with the Schedule (the Conditions of Entry). Instructions on how to enter and information regarding prizes forms part of these Conditions of Entry.  Entry into this competition constitutes acceptance of these Conditions of Entry.

2. The Promoter’s decisions regarding all aspects of this competition are final and no correspondence will be entered into.

Treatment of Personal Information

3. All entries and any copyright subsisting in an entry will be the property of the Promoter. The information entrants provide to enter will be used by the Promoter for the purpose of conducting this competition. The information entrants’ guest/s provide will be used by the Promoter for the purpose of fulfilling the prize and otherwise running this competition. The Promoter may collect entrants’ or their guest/s’ personal information (including through its contractors or agents) or disclose entrants’ or their guest/s’ personal information to its related companies, contractors and agents to assist in conducting this competition, storing data or communicating with entrants or their guest/s. Those disclosures may include disclosures to organisations in locations such as the USA, the UK, India and Germany. By entering this competition, entrants’ consent to their personal information being stored on the Promoter’s database and the Promoter may use this information to contact the entrant with special offers, news and information about its products, including contacting the entrant via electronic messaging. By entering this competition, entrants consent to receiving SMS or email messages from the Promoter that do not contain any functional unsubscribe facility. The Promoter is bound by the Privacy Principles in the Privacy Act 1988 (Cth).  The Promoter’s Privacy Policy, located at http://cub.com.au/privacy-policy/, contains information about:

(i) how entrants or their guest/s can seek access to the personal information the Promoter holds about them and seek the correction of such information; and

(ii) how entrants or their guest/s can complain about a privacy breach and how the Promoter will deal with such a complaint.

Entry Process

4. Entries must be received during the Competition Period. Entries must be on the original entry form.

5. Entrants must only enter in their own name. Entrants who enter using multiple email/postal addresses, phone numbers, social media accounts or aliases may be disqualified.

6. All entries submitted must be the entrant’s original work. The Promoter has the right at any time to verify (or require an entrant to verify) that the entry is the entrant’s original work.  If in the Promoter’s opinion the entrant’s work has not been verified as their original work, the Promoter will deem that entry invalid.

7. All entries and any subsisting copyright become the property of the Promoter and will not be returned to entrants.  By submitting an entry, entrants:

a) agree to assign all rights in the entry to the Promoter and consent to the Promoter using the entry in any way and for any purpose as determined by the Promoter (including editing, adapting, altering the entry or publishing the entry in part or whole) in any media; and

b) undertake to the Promoter that their entry is not, and its use by the Promoter will not be, in breach of any third party intellectual property rights.

8. The Promoter is not liable for late, lost, incomplete, misdirected, incorrectly submitted delayed or illegible entries, correspondence or claims for prizes due to error, omission, tampering, theft, destruction or otherwise.

Prize/s Awarded

9. The prizes are as specified in the Prize Details and Prize Conditions sections of the Schedule and must be taken as offered and, if applicable, on the date/s specified.

10. Prize values are the recommended retail price (or an estimated value where a prize has no consumer price attributed) as provided by the prize supplier, include GST and are accurate as at the time of formulating these Conditions of Entry. The Promoter accepts no responsibility for change in prize value after that date.

11. The Promoter accepts no responsibility for any tax implications arising from prize winnings. Entrants should seek their own independent financial advice.

12. A prize will only be awarded to an entrant once the entrant has been validated and verified by the Promoter in accordance with these Conditions of Entry.

13. Prize/s not transferrable or exchangeable and cannot be redeemed for cash. Prize/s must be taken by the winner/s (and their guest/s, where applicable) at the time stipulated by the Promoter.  Failure to do so will result in the prize/s being forfeited and no cash or other compensation will be provided. If a prize or element of a prize becomes unavailable for any reason beyond the Promoter’s reasonable control, the Promoter will award a comparable prize or prize element of equal or greater value as elected by the Promoter.

14. The Promoter is not liable for and will not provide any replacement prize for tickets that are stolen, forged, damaged or tampered with any way once awarded or are not activated or used before the stated expiry date.

15. Where alcohol is available as part of a prize, it will be served in line with the responsible service of alcohol guidelines carried out by the venue staff and management.  The Promoter is not responsible for how a venue conducts and executes its responsible service of alcohol guidelines. Venue staff and management reserve the right to refuse service of alcohol to any prize winner/s or their accompanying guest/s if they are deemed to be inebriated.

16. Prizes will be delivered by post to the winners at their nominated delivery address. The Promoter and its associated agencies and companies are not liable for any damage, loss or delay in transit to prize/s. Prize delivery will only be made to Australian addresses.

17. As a condition of accepting or participating in any prize a winner’s guest/s accepts these Conditions of Entry.

18. The Promoter may in its sole discretion appoint a chaperone to accompany the winner/s and their guest/s taking the major prize.  The winner/s and their guest/s agree to the chaperone being present for the duration of the trip/event and agree to comply with all reasonable directions or guidelines specified by the Promoter and/or their chaperone.

19. As a condition of accepting the major prize, a winner is required to behave appropriately (to the Promoter’s satisfaction) at all times while taking the prize. A winner is fully responsible for the behaviour and conduct of their guest/s at all times while taking the major prize. If in the Promoter’s opinion a winner or the winner’s guest/s behaves in a way that is contrary to law, behaves inappropriately, aggressively or offensively, or behaves in a way which may damage the reputation of the Promoter or any of its related bodies corporate or the agencies or companies affiliated with this competition, the Promoter may in its absolute discretion cancel or withdraw the prize and will offer no substitute prize or compensation.

Publication & Publicity

20. Where winners’ details are published, each entrant requests that his or her full address not be published.

21. If requested by the Promoter, entrants and the winner/s (and the winner’s guest/s, if applicable) must participate in all promotional activity (for instance publicity, filming and photography) in relation this competition, free of charge and they consent to the Promoter using their name/s, image/s and/or voice/s in promotional material in any media for any length of time without notification, remuneration or compensation.

Verification

22. The Promoter (or its nominated agent) reserves the right, at any time during or after the Competition Period, to request entrants to produce suitable photo identification or other documentation (to the Promoter’s satisfaction in its sole discretion) to verify the validity of their entry/ies and to verify an entrant (including an entrant’s identity, age, place of residence, place of employment, eligibility to enter and eligibility to claim a prize). If the requested documentation is not provided in the timeframe required or an entrant has not been validated or verified to the Promoter’s satisfaction, then the entrant’s entry (and at the Promoter’ discretion all of the entrants’ entries) will be deemed invalid.

23. The Promoter reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has:

a)      submitted an entry which is not in accordance with these Conditions of Entry;

b)      breached any of these Conditions of Entry;

c)      tampered with or benefited from tampering with the entry process or the operation of the competition;

d)     engaged in any unlawful, fraudulent, deceptive or other improper misconduct intended to jeopardise the fairness and proper conduct of the competition and/or damage the goodwill or reputation of the Promoter or any of its related bodies corporate or the agencies or companies associated with this competition; or

e)     acted in a disruptive manner with the intent to annoy, abuse, threaten or harass any other person.

Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter reserves its legal rights to recover damages or other compensation from such an offender.

Liability

24. The Promoter has no control over communications networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise.  Costs associated with accessing the Internet (e.g. website or social media platform) may vary depending on the Internet service provider used, and those costs are the responsibility of the entrant. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred.

25. Except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law), the Promoter and its associated agencies and companies exclude all liability for any loss, expense, damage, personal injury, illness or death (whether or not arising from any person's negligence) that may occur from participating in this competition or as a result of accepting or using any prize. For the avoidance of doubt, this clause does not limit or affect any waiver or disclaimer signed or accepted by entrants as part of this competition.

26. These Conditions of Entry do not exclude, restrict or modify any statutory consumer rights under the Australian Consumer Law and any similar laws. However, to the extent permitted by law to do so, the Promoter makes no representations or warranties, express or implied, other than the Australian Consumer Law, regarding the quality and suitability of a prize awarded as part of this competition and will not be responsible for breach of any such implied terms.

Other

27. If this competition is unable to run as planned due to computer virus, network/technical/communications failure, tampering or any cause beyond the Promoter’s reasonable control, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition or invalidate any affected entries.

28. The Promoter may run, communicate or advertise this competition using Facebook and/or Instagram.  However, the competition is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram.  Entrants are providing their information to the Promoter and not to Facebook or Instagram.  Each entrant completely releases Facebook and Instagram from any and all liability.

29. The Promoter encourages consumers to enjoy alcohol responsibly. Legally aged consumers are advised to consider the safe drinking levels recommended in the National Health and Medical Research Council Australian Guidelines to Reduce Health Risks from Drinking Alcohol. Entry and continued participation in this competition is subject to the Venue’s liquor serving policy.

1.1  Here at Carlton & United Breweries we are committed to protecting your privacy and the confidentiality of the personal information that we collect in the course of running our business.

1.2  This policy explains how Carlton & United Breweries and its related companies (CUB, we, us and our) collects, uses and discloses personal information. Among other things, it describes:

2. Key terms within this Privacy Policy

Carlton & United Breweries means CUB Pty Ltd (ABN 76 004 056 106) of 77 Southbank Boulevard, Southbank, Victoria, 3006.

Personal information means information about an individual whose identity is apparent or can reasonably be identified (for example, a person’s name, address, phone number or date of birth).

Privacy Act means the Privacy Act 1988 (Cth).

Sensitive information includes information about race, religious beliefs, sexual orientation, health information, membership of trade unions or political associations, criminal records or philosophical beliefs.

3. What types of personal information does CUB collect?

3.1  We collect information to provide better products and services to all of our consumers and customers. The types of information we collect depends largely on the circumstances in which the information is collected, some key examples of which are set out below.

CUB may collect contact details including your name, address, email address, phone numbers and your date of birth / age. We may also collect answers you provide to questions we ask and other information in relation to your dealings with CUB (such as your personal interests and preferences). If you purchase products or services from us, we may also collect certain details to process the transaction.

When you use our websites, we may collect website usage information such as the IP address you are using, the name of your Internet service provider, your browser version, the web site that referred you to us and the next website you go to, the pages you request, the date and time of those requests and the country you are in. Similarly, when you use our mobile applications, we may collect information such as your device ID, your location and details of how you used the mobile application.

If you apply for employment with CUB, in addition to the information referred to above, we may also collect information for the purpose of considering your application including your qualifications and resume as well as reference information from your nominated referees.

If you are an individual contractor to CUB, in addition to the information referred to above, we may also collect information relevant to your engagement with CUB including qualifications, resume, reference information from your nominated referees, bank details, feedback from supervisors and training records.

3.2  CUB does not generally require you to disclose any sensitive information to us. If you do provide sensitive information to us for any reason, you consent to us collecting that information and to us using and disclosing that information for the purpose for which you disclosed it to us and as permitted by the Privacy Act and other relevant laws.

3.3  In addition to the types of personal information identified above, CUB may collect personal information as otherwise permitted or required by law.

4. How do we collect your personal information?

4.1  CUB collects personal information in a number of ways. The most common ways we collect your personal information are:

directly from you when you provide it to us or our agents or contractors;

via our websites or when you deal with us online (including through our social media pages and our mobile applications);

when you enter a competition or promotion or use one of our mobile applications;

if you are an individual contractor to CUB, from your employer or recruitment agency; and

from third parties (for example, from referees if you apply for a position as an employee or contractor with us).

5. For what purposes do we collect, use and disclose your personal information?

5.1  Broadly speaking, we use the personal information we collect to provide and improve our products and services. Some examples of how we use your personal information includes:

to provide or promote our products and services to you;

to inform you about upcoming events, special promotions or offers which CUB believes may be of interest to you;

to facilitate your entry and participation in a competition or promotion, or to enable you to use our mobile applications;

to contact you to obtain your feedback, to find out your level of satisfaction with our products and services and for other market research activities; and

to consider you for a job at CUB (whether as an employee or contractor) or other relationships with us.

5.2  CUB will take reasonable steps to inform you why we are collecting your personal information, how we intend to use that information and to whom we intend to disclose it at the time we collect your personal information.

5.3  In addition to the purposes listed above, CUB may use your personal information for other purposes which will be made clear to you at the time CUB collects that information, or for other purposes permitted by law.

5.4  Where CUB uses your personal information to promote or market products or services directly to you (including by way of email, telephone, SMS, MMS and mobile push notifications) we will provide you with an opportunity to unsubscribe from any future direct marketing correspondence. You can also contact us directly on the details below if you wish to unsubscribe from our direct marketing.

6. What happens if you don’t provide personal information?

6.1  Generally, you have no obligation to provide any personal information requested by us. However, if you choose not to provide certain personal information we may not be able to provide you with the products and services that you require.

7. To whom do we disclose personal information?

7.1  We may disclose your personal information to third parties in connection with the purposes described above. We may also disclose your personal information where we are required or authorised to do so by law.

7.2  This may include disclosing your personal information to the following types of third parties:

our related companies;

our contractors and other third parties that provide goods and services to us (including marketing and promotions agencies, website and data hosting providers, and HR-related service providers);

companies that may use your personal information in order to tailor electronic advertising to you (e.g. on a webpage) in relation to our products and services;

if you are an individual contractor to CUB, to your employer or agency.

7.3  We take reasonable steps to ensure that these third parties are bound by confidentiality and privacy obligations in relation to the protection of your personal information. Importantly, CUB will never sell your personal information to a third party.

7.4  If you post information to public parts of our websites or social media pages (including through our mobile applications), you acknowledge that such information (including your personal information) may be available to be viewed by the public. You should use discretion in deciding what information you upload to such sites.

8. Does personal information leave Australia?

8.1  Some of the third parties to whom we disclose personal information may be located outside Australia.  Where this is the case, we take reasonable steps to ensure that your personal information will not be held, used or disclosed by such third party in a way that is inconsistent with the principles contained in the Privacy Act.

8.2  These overseas third parties (which are often related companies of CUB) typically provide data-storage related services, and are located in countries such as the United States of America, the United Kingdom, India and Germany.

9  How do we protect personal information?

9.1  CUB takes reasonable steps to ensure that the personal information we collect from you is held securely and protected from misuse and unauthorised access or disclosure.

9.2  Unfortunately, we cannot and do not guarantee that unauthorised access to your personal information will not occur. Accordingly, where consistent with applicable legislation, any personal information you provide to CUB will be at your own risk (even if we are negligent). If you do become aware of a breach of security in relation to your personal information, please contact us.

10. Links, cookies and use of CUB websites and applications

10.1  CUB websites may contain links to other sites. This Privacy Policy applies to our websites and not any linked sites which are not operated or controlled by CUB. We encourage you to read the privacy policies of each website that collects your personal information.

10.2  CUB uses “cookies” and similar technology on its websites and in other technology applications. The use of such technologies is an industry standard, and helps us monitor the effectiveness of our advertising and how visitors use our websites/applications.  We use such technologies to generate statistics, measure your activity, improve the usefulness of our communications and to enhance the “user” experience.

10.3  If you prefer not to receive cookies you can adjust your Internet browser to refuse cookies or to warn you when cookies are being used. However, our websites may not function properly or optimally if cookies have been turned off.

10.4  Each time you access one of our websites, we may deliver certain customised information, including ads and marketing campaigns, to you based on the data stored in your cookie. Third party vendors may show our ads and marketing campaigns on sites on the Internet and serve these ads and marketing campaigns based on a user’s prior visits to our website and other Internet activity. CUB may also use analytics data supplied by third party vendors to inform and optimise our ad and marketing campaigns.

11. How can you access and correct personal information we hold about you?

11.1  You have a right to access your personal information that we hold, subject to some exceptions allowed by law. If you would like to access that personal information, please contact us. We may require that the person requesting access provide suitable identification and, in certain circumstances, we may charge a fee for searching for and providing access to your personal information.

11.2  We try to maintain your personal information as accurately as reasonably possible. We rely on the accuracy of personal information as provided to us both directly (from you) and indirectly. We encourage you to contact us if the personal information we hold about you is incorrect or to notify us of a change in your personal information.

12.1  If you have any questions, comments or complaints about our collection, use or disclosure of personal information, or if you believe that we have not complied with this Privacy Policy or the Privacy Act, please contact us.
