Spin2Win Terms and Conditions
The promoter is HAVAL Motors Australia Pty Ltd ABN 68166119795 of Suite 1, 745 Springvale Road, Mulgrave, 3170 (“Promoter”).
Information on how to enter and the Conditional Vouchers (defined below) form part of these Terms and Conditions. Participation in this promotion is deemed as acceptance of these Terms and Conditions.
Entry is only open to NSW, NT, TAS, VIC, WA and QLD residents aged 18 years or over.
Employees (and their immediate families) of the Promoter are ineligible to enter. Immediate family for the purpose of this clause means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, brother, sister, step-brother, step-sister.
Entries into the promotion will only be open from 12pm on 1/08/2017 until 11:59pm AEST on 30/09/2017 (“Promotional Period”). Redemption of Conditional Vouchers (as defined below) will only be valid for selected eligible new vehicles retail delivered between 1/08/2017 and 31/10/2017, whilst stocks last.
This promotion provides eligible individuals with the opportunity to purchase a selected range of new eligible HAVAL SUV vehicle at a discounted price, with a voucher claimed through the promotion (“Conditional Voucher”). Selected HAVAL models where discount vouchers can be applied are H2 Premium and Lux Auto, H6 (Premium and LUX), H8 (Premium and LUX), and H9 (Premium and LUX),
The total prize pool is up to AUD$4,000,000.00 (see Attachment 1).
Every eligible individual that participates in the promotion will be able to claim a Conditional Voucher. The value of a Conditional Voucher will be determined by random selection by an online system used by the Promoter. The voucher can be claimed by each individual following the procedure outlined in clause 10.
Each Conditional Voucher is only valid for the discount amount specified on the Conditional Voucher. The values and number of Conditional Vouchers that are available to be won in the promotion are listed in the table included in Attachment 1. The numbers outlined in Attachment 1 may be subject to change in case of any claimed Conditional Vouchers being returned into the promotion, as specified in these Terms and Conditions.
The Promoter reserves the right in its absolute discretion, to provide additional Conditional Vouchers to the individual if they purchase more than one of the same HAVAL model.
To enter: Eligible individuals (private vehicle buyers only, excludes buyers of demonstrator vehicles, fleet and government buyers) can enter the Promotion and receive a Conditional Voucher in the promotion by following these steps:
Visit havalspin2win.com.au (“Website”) and follow the prompts to the promotion entry page.
The individual will enter their email address and will then receive a link to click on to go through to the game.
They select the HAVAL SUV they are interested in (from the models shown on the Website). Depending on the vehicle chosen, the individual will be presented with a virtual spinning wheel, which will contain a number of segments, with each segment featuring a Conditional Voucher of a certain value. The value of the Conditional Vouchers varies according to the model selected.
Follow the prompts on screen to spin the wheel, find out what segment they land on and therefore what Conditional Voucher they will have an opportunity to claim.
Each game consists of up to 5 spins for the model selected during a single play session.
Conditions applicable to each play session: Each time an individual spins, they decide if they wish to claim the Conditional Voucher that they land on or discard the Conditional Voucher and spin again for a new Conditional Voucher. (i.e. each spin replaces the previous Conditional Voucher with the Conditional Voucher of the new spin). Individuals will have 5 minutes from starting the game until their session times out (for up to 5 spins in a session). If an individual fails to claim a Conditional Voucher during the allocated 5 minute period, their entry and any Conditional Vouchers they land on will be invalidated and forfeited. Individuals can only play one game in any 24 hour period based on a single email address.
Once an individual claims a Conditional Voucher, they will no longer be eligible to participate in any future play sessions or wheel spins for that email address.
Each person is eligible to claim a maximum of 1 (one) Conditional Voucher per HAVAL model. i.e. maximum of 4 during the Campaign Period per email address as there are 4 different HAVAL models.
Transferability: A Conditional Voucher is only transferable to immediate family members only (Immediate family for the purpose of this clause means spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, brother, sister, step-brother, step-sister, grand-parents, step grand-parents). The Conditional Voucher may be used only by the winner of the voucher being the prospective buyer (or immediate family members above) of the new HAVAL model selected, and the information the individual provides must be exactly the same as included in the sales contract or where the individual wishes to transfer the voucher to an immediate family member, the individual must provide a written declaration (of the relationship between the individual and the transferee and agreement to transfer). This declaration will be provided by the HAVAL Dealer and is to be signed prior to the Contract of Sale.
Claiming a Conditional Voucher: If an eligible individual elects to claim a Conditional Voucher that they land on when they spin the wheel, they must accept these Terms and Conditions, enter their given/preferred name, surname, mobile phone number, email and nominate the HAVAL Dealership they plan to use the Conditional Voucher at using a drop down box.
A personalised Conditional Voucher and email (which will contain the Claimant’s name and phone number, unique coupon code, expiry date, the discount amount and the selected HAVAL SUV) will be emailed (as a PDF) to the email address nominated by the individual. To activate and redeem the Conditional Voucher, the individual must follow the instructions in the email (and below) to redeem the Conditional Voucher. The individual can also save a copy of their voucher onto their phone.
Activation of Conditional Vouchers: Once a Conditional Voucher is claimed, it must first be activated before it can be redeemed. To activate a Conditional Voucher, the individual named on the Conditional Voucher must visit a HAVAL Dealer to get the Conditional Voucher activated, within 10 calendar days of submitting their claim. Once the voucher is activated, the discount is valid on the HAVAL model specified to be ordered and delivered prior to 31/10/2017.
If the Claimant on the Conditional Voucher does not activate a Conditional Voucher within 10 calendar days of the claim being submitted, the Conditional Voucher will be made invalid, the discount is forfeited and will be returned to the promotion. In addition, the Promoter reserves the right, but does not have the obligation, in its absolute discretion to extend the number of days during which the Conditional Voucher can be activated before it expires.
Redemption of Conditional Vouchers Once activated, a Conditional Voucher can be used by the person named on the Conditional Voucher (or their immediate family) to obtain a discount on the purchase of the HAVAL SUV specified on the Conditional Voucher from a HAVAL Dealer. To redeem the Conditional Voucher, the person nominated on the Conditional Voucher must present the voucher when placing an order on a new HAVAL vehicle and must take delivery of that vehicle by 31/10/2017. Active Conditional Vouchers must be presented to the dealership before a contact of sale for vehicle purchase is signed by the customer. A Conditional Voucher may only be used for a vehicle purchase where the delivery date of the vehicle is before 31/10/2017.
Only one (1) Conditional Voucher can be used per vehicle purchase, and a Conditional Voucher can only be used for the purchase of the new HAVAL SUV listed on the Conditional Voucher.
Conditional Vouchers cannot be swapped between HAVAL SUV models. Each Conditional Voucher can only be used once. The Conditional Voucher value will be deducted from the price specified by the nominated HAVAL Dealer for the relevant HAVAL SUV, and the bearer of the Conditional Voucher will be responsible for payment/financing of the remaining balance for the vehicle.
If the Claimant cancels the vehicle order for any reason including where the customer is legally entitled to do so under the cooling off rights, the Conditional Voucher will be made invalid and forfeited, and will be re-allocated into the promotion if the promotion period is still current at the time of cancellation.
The Conditional Vouchers listed on the spinning wheel are updated on a live basis. As soon as all Conditional Vouchers of a particular value available to be won in a particular day have been allocated(whether or not they have been redeemed), that value Conditional Voucher will be made unavailable on the spinning wheel The make up of each wheel at any time is at the Promoter’s absolute discretion and the segment that any spin lands on will be determined by a random online system.
Notification: All entrants will be notified of the acceptance of the Conditional Voucher in three instances:
When they claim the conditional voucher, they will receive the voucher via email
When they activate the voucher by visiting a HAVAL Dealership within 10 days of the claim, the Dealer will advise them of the voucher validity
When they purchase the new HAVAL SUV, the Dealer will advise them that the discount voucher will be applied
The Promoter reserves the right, at any time, to verify the validity of entries and entrants including an entrant’s identity, email, phone number and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any, fraudulent, dishonest, unlawful or other improper misconduct that could jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
The Promoter’s decision is final and no correspondence will be entered into.
If for any reason a winner does not take/redeem a Conditional Voucher by the time stipulated by the Promoter, then the Conditional Voucher will be forfeited.
Conditional Vouchers are not transferable (except for clause 11) or exchangeable and cannot be taken as cash.
Unless specifically revoked, entrants consent to the Promoter using their name, likeness, image and/or voice in the event they claim a Conditional Voucher (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting its products and its brand.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the Website is the entrant’s responsibility.
The use of any automated software, mechanical or electronic means that allows an entrant to automatically enter repeatedly or interfere with the Conditional Vouchers on the wheel is prohibited and will render all spins, entries and claims submitted by that entrant null and void.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) redemption of a Conditional Voucher.
The Promoter collects personal information (“PI“) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at

In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or phoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia.
