This promotion (the “Promotion”) is brought to you by Emirates, a corporation established by Dubai Ruler’s Decree No. 2 of 1985 (as amended) having its principal office at Emirates Group Headquarters, Airport Road, P.O. Box 686, Dubai, United Arab Emirates (“Emirates”) and hosted via the website found at
www.emirates.com/au/win (“Website”).
These terms and conditions together with the general terms and conditions that are applicable to your use of and access to the Website (together the "Terms") govern your use of the Website and set out the rules of participation in the Promotion. By entering the Promotion, you guarantee that you have the authority to accept these Terms and you agree to be bound by the Terms.
In the event of any dispute regarding the Terms or the conduct, results and all other matters relating to the Promotion, Emirates decision will be final and binding and no correspondence or discussion will be entered into.
The Promotion commences at 00.01 AEST on 1 August 2017 and closes at 23.59 AEST on 31 August 2017 (“Promotion Period”)
Qualifying Entrants
You must be at least 18 (eighteen) years of age and a legal resident of Australia in order to be eligible to enter the Promotion (“Qualifying Entrants”).
Employees of Emirates and/or their immediate family and agencies associated with the Promotion are not eligible to enter the Promotion. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
The Promotion is only open to Qualifying Entrants who, on the date of entry, are legal residents of Australia and is void in any other country. Individuals located in a country restricted by applicable controls and sanctions or other laws or regulations as they relate to this Promotion are ineligible to participate in the Promotion. Each entrant must ensure that his or her participation in the Promotion (including the acceptance of any prize awarded) is lawful in accordance with the laws of the country of which he or she is a citizen and/or resides, and/or happens to be at the time the entry is made. Emirates shall not be taken to make any representations, express or implied, as to the lawfulness of any individual’s participation, or as to any other aspect of the Promotion.
Emirates reserve the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, place of residence and employment) and to disqualify any entrant who submits an entry that is not in accordance with these Terms. Errors and omissions may be accepted at Emirates’ discretion. Failure by Emirates to enforce any of its rights at any stage does not constitute a waiver of those rights. If there is a dispute as to the identity of an entrant, Emirates reserves the right, in its sole discretion, to determine the identity of the entrant.
Rules of Entry
The Promotion must be entered as per any instructions set out for the Promotion on the Website, and below. All entries must be received via the Website no later than 23.59 AEST, 31 August 2017 (the “Closing Date”). No entries will be accepted after the Closing Date. Incomplete or indecipherable entries will be deemed invalid and Emirates accept no responsibility for entries which are incomplete, lost or delayed in transit. Any cost associated with accessing the Website is the Qualifying Entrant’s responsibility and is dependent on the Internet service provider used.
To be eligible to enter the Promotion, Qualifying Entrants must, during the Promotion Period, book and pay in full for an Emirates return Economy, Business or First class flight ticket via the Website with point of origin and sale as Australia (the “Qualifying Ticket”). Flight tickets must be purchased for return journeys. 1 (One) way flight tickets will not be eligible for entry into the Promotion. All applications are subject to acceptance by Emirates. The entrant agrees that, to the extent permitted by law, Emirates shall not be liable as a result of any refusal or failure to accept an application and no compensation shall be payable to any person in consequence of such action.
To enter the Promotion, Qualifying Entrants must then register their booking number on the Promotion landing page on the Website and describe, into the entry box provided in 25 words or less, ‘Why they would like to attend the 2017 Toyota AFL Grand Final’ (“Promotional Question”). Only one (1) entry per person is permitted.
This is a game of skill and chance plays no part in determining the Winner. 1 (one) Winner will be chosen from all eligible entries validly submitted (“Winner”). The Winner will be chosen based solely on creative writing merit of their answer to the Promotional Question as determined by the judging panel. The judging will take place at Emirates, Level 17, 1 York Street, SYDNEY NSW 2000 from 12:00 AEST on 6 September 2017.
The decision by Emirates as to the Winner shall be final. The Winner will be notified via email and/or telephone within 5 (five) working days of the judging using the contact details provided at the time of entering the Promotion.
The Prize
The Winner will receive:
2 Reserved tickets (two) to the 2017 Toyota AFL Grand Final on 30 September 2017, including the Crown Grand Final Breakfast. The Winner’s guest must be aged 18 years or over.
Return Economy Class tickets on Qantas, with point of origin as Sydney, Brisbane, Adelaide or Perth, for Winner and 1 (one) guest (“Flight Tickets”). The Winner’s guest must be aged 18 years or over;
The Winner and their guest will be responsible for their own transfers and other activities.
The Prize includes nothing other than that expressly stated to be included as part of the Prize. Proof of age may be required before the Prize can be given. Emirates reserves the right to substitute the prize for another prize of equal or greater value, should the need reasonably arise.
Allocation of Flight Tickets shall be at Emirates sole discretion. The Flight Tickets shall be subject to applicable terms and conditions of the suppliers. The Flight Tickets are non-transferable except as set out in the ticket conditions and cannot be sold, encashed or given away in any circumstances. Prize cannot be used for commercial or promotional purposes.
The Prize is non-transferable and non-exchangeable and booking is subject to availability. If a Winner or guest is unable to utilize the Prize no cash alternative will be provided.
All other expenses associated with redeeming the Prize (including but not limited to food, travel, spending money, passports, visas, vaccination, transport to and from departure point, in-room charges, flights, accommodation other than as provided for under these Terms), travel insurance and any other incidental costs and expenses shall be borne by and are the responsibility of the Winner and guest.
The Winner and their guest must depart from and return to the same departure point and travel together. Itinerary to be determined by Emirates in agreement with the Winner but in the event that agreement cannot be reached, Emirates reserves the right to determine the itinerary. Frequent flyer points will not form part of the prize. The Winner and their guest are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation.
In the event of war, terrorism, state of emergency or disaster, Emirates reserves the right to cancel, terminate, modify or suspend the promotion, or suspend or modify a prize.
To the extent permitted by law, Emirates shall not be liable for any failure to comply with their obligations where such failure is caused by events outside their reasonable control, including but not limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots or any other circumstances amounting to force majeure.
To the extent permitted by law, Emirates accept no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by the Winner or guest as a result of entering or participating in the Promotion or accepting the Prize.
In the event that a Winner cannot be contacted; fails to confirm acceptance of the Prize within 14 (fourteen) working days of receiving notification; or is ineligible for entry into the Promotion then Emirates reserves the right to substitute them with another Qualifying Entrant of its choice, selected in accordance with the judging criteria stated in these Terms. In the event that a Prize is unclaimed, the judging will take place at Emirates, Level 17, 1 York Street, SYDNEY NSW 2000 from 10.00 AEST on 9 September 2017. The Winners will be notified by email within 5 (five) working days of the judging. Emirates take no responsibility for incorrect contact details provided by the Winner. If any Winner fails to take a prize by the time specified by the Emirates, the Prize will be forfeited.
Taxes
Total prize value is up to AUD 6,230 per person, depending on the point of departure. Any valuation of the Prize shall be based on information available to Emirates as at the date of the Promotion and the value of the Prize may be disclosed by Emirates where required by law for tax purposes. The Winner is solely liable for reporting and paying any and all applicable taxes (excluding airline and airport taxes) including but not limited to, personal tax, service tax and other entertainment tax due as a result of the Prize and Emirates accept no responsibility for any tax implications arising as a result of the Prize.
Personal Information
Emirates collect and use the Qualifying Entrant’s personal information (the “Data”) in order to conduct the Promotion and may, for this purpose, disclose or transmit such information to third parties rendering services in relation to the Promotion. By entering the Promotion and providing the Data the Qualifying Entrant authorises Emirates to collect and process the Data in this manner. Entry is conditional on provision of the required data.
In consenting to receive the Emirates Newsletter, the Qualifying Entrant authorises Emirates to retain and use the Data and to transmit the Data to and/or to share it with: Emirates’ offices, authorised agents, Emirates’ other companies and/or brands, anyone to whom Emirates transfers their rights and duties, third party companies offering related services (including, for example, car rental, hotels, limousines, transfers, ancillary services), governments and government agencies, credit card and other payment card companies, and other airlines or providers of such related services.
Emirates may also retain the Data for other direct marketing, but Emirates will obtain the Qualifying Entrant’s authority to do so; and Emirates undertake to collect, process, store, save and transfer the Data in compliance with relevant data protection legislation in force from time to time. In processing the Data Emirates may transfer it to countries, outside of Australia, which may not afford the same level of protection – see the Emirate’s privacy policy at

The Winner agrees to participate in such reasonable publicity as may be requested by Emirates. The Winner agrees to the publication of their name and country in connection with the Promotion.
If the Qualifying Entrant would like to know what Data Emirates are holding about them and/or correct or access the Data that Emirates hold about them they should contact their local Emirates office and/or consult the Emirate’s privacy policy for further details.
Emirates Liability
To the extent permitted by law, Emirates will not be liable to perform any of its obligations under these Terms where it is unable to do so as a result of circumstances beyond its reasonable control including but not limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots or any other circumstances amounting to force majeure. To the extent permitted by law, Emirates accept no liability (and excludes all liability) for any loss of profit, business, contracts, revenues or anticipated savings or for special, direct, indirect or consequential loss of any nature howsoever arising.
To the extent permitted by law, Emirates accept no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by any Qualifying Entrant, the Winner or where applicable the guest as a result of entering or participating in the Promotion or accepting the Prize. This exclusion does not include any liability for death or personal injury caused solely by the negligence of Emirates or any other statutory consumer guarantees or warranties that cannot be lawfully excluded.
Participants enter the Promotion at their own risk and agree to indemnify Emirates against all costs, losses, damages, expenses and liabilities (including for loss of reputation and goodwill and professional advisors' fees) and any claim arising from a participants own actions in any way in connection with the Promotion or a breach of a participants obligations hereunder.
General
Participation in the Promotion does not confer on the entrant any rights in or over any intellectual property arising in connection with the Promotion. Any Terms which are held to be invalid in any jurisdiction shall whenever allowed by the context be deemed to be replaced by such valid and enforceable terms and conditions whose contents are as close as permissible to those of the invalid or unenforceable Terms. Emirates reserve the right to modify or vary the Promotion and/or these Terms at any time.
These Terms shall be governed by and construed in accordance with laws of Dubai, and as applicable the UAE, and the Dubai courts shall have exclusive jurisdiction in relation to any disputes arising.
Qualifying Entrants agree that they are fully responsible for any materials they submit via the promotion including but not limited to comments, recordings and images (“Content”). Emirates shall not be liable in any way for such Content to the full extent permitted by law. Emirates may remove or decline to publish any Content without notice for any reason whatsoever. Entrants warrant and agree that:
they will not submit any Content that is unlawful or fraudulent, or that Emirates may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;
their Content shall not contain viruses or cause injury or harm to any person or entity;
they will obtain prior consent from any person or from the owner(s) of any property that appears in their Content;
The Content is their original work, and the Content does not infringe the rights of any third party;
they consent to any use of the Content which may otherwise infringe the Content creator’s/creators’ moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights; and
they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.
Without limiting any other terms herein, the Qualifying Entrant agrees to indemnify Emirates for any breach of the above terms.
As a condition of entering this promotion, each Qualifying Entrant licenses and grants Emirates, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry (which shall include Content) for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability.
Qualifying Entrants consent to the Emirates using their name, likeness, image and/or voice in the event they are a Winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by Emirates.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of Emirates, including but not limited to technical difficulties, unauthorised intervention or fraud, Emirates reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Qualifying Entrants; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
