TERMS & CONDITIONS
General terms and conditions
1. Information on how to enter forms part of the terms and conditions of entry. By
submitting an entry, all entrants are deemed to have accepted these terms and
conditions.
2. The “Promoter” is Japan National Tourism Organization (JNTO), Suite 1, Level 4, 56
Clarence Street, Sydney NSW 2000, ABN 74 739 122 404
3. The promotion commences on 9:00AM AEST Monday 17 July 2017 and concludes at
5:00PM AEST Monday 28 August 2017. Entering the promotion constitutes acceptance
of these conditions.
4. The promotion is only open to Eligible Entrants.
5. An "Eligible Entrant" is an individual who is:
a. Not an employee, officer, servant or contractor of the Promoter or any
organisation associated with the Competition or provision of the gift/prize, or their
related corporate bodies or associates or any of their agencies involved with the
promotion;
b. Not a spouse, defacto spouse, parent, child or sibling (whether natural or by
adoption) of such an employee or other person as described in clause 4(a)
above;
c. A permanent resident of Australia; and
d. Aged 18 years or over.
6. All relevant instructions on the Promoters’ website (if any) form part of these conditions.
7. To enter the promotion, participants must complete the following “Entry
Requirements”:
a. Correctly answer questions 1-3 (level easy)
b. Fill in the entry form (compulsory fields: First Name, Last Name, Email Address
and Postcode)
c. Write in 300 characters or less, an original answer to the question: “What emoji
(that doesn't currently exist) do you need in your life & why?” and
d. Tick the ‘I agree to the Terms & Conditions and Privacy Policy’ checkbox
8. Maximum of 1 x entry per person. (Entering more than once does not provide multiple
chances to win)9. This is a game of skill. Chance plays no part in determining the winners. Japan National
Tourism Organization will individually judge each entry on their merits based upon:
creativity, personality and originality.
10. All Eligible Entrants must check the Terms & Conditions check box acknowledging that
they have read and agree to the Competition Terms.
11. By entering the promotion, entrants agree to the website Terms of Use:
https://www.jnto.org.au/terms-of-use/12. All entries become the property of the Promoter.
13. By entering the promotion and claiming the Prize, the winner agrees that the Promoter
may use their name for publicity and competition purposes without compensation, and
agrees that the Promoter will own copyright.
14. There will only be one (1) winner selected. Judging of all entries will take place on
Wednesday 30 August 2017 at Japan National Tourism Organization (JNTO), Suite 1,
Level 4, 56 Clarence Street, Sydney NSW 2000, ABN 74 739 122 404
15. The winner will be notified via email on Thursday 31 August 2017, at 12:00PM EST.
16. Photo identification (e.g. a Driver’s License) will be required to verify the winner is an
Eligible Entrant.
17. The winner has 7 days to claim the Prize. If the winner does not claim his Prize in 7
days, then a new winner will be selected. The Promoter reserves the right to forfeit the
Prize or select a new winner in the event of any Eligible Entrant not claiming the Prize.
The new winner will be notified by email.
18. The Promoter expressly disclaims any responsibility and entrants agree to indemnify and
hold harmless the promotion entities from and against any and all claims, actions,
demands and/or liability for injury, damage or loss whatsoever relating to or arising in
connection with participation in this promotion (regardless of the cause of such injury,
damage or loss) and/or the delivery and/or subsequent use or misuse of any of the
prizes awarded.
19. The Promoter reserves the right, at any time, to verify the validity of entries and entrants
(including an entrant’s identity, age and place of residence) and reserves the right, in its
sole discretion, to disqualify any individual who the Promoter has reason to believe has
breached any of these Terms and Conditions, tampered with the entry process or
engaged in any unlawful or other improper misconduct calculated to jeopardise fair and
proper conduct of the competition. Errors and omissions may be accepted at the
Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage
does not constitute a waiver of those rights. The Promoter's legal rights to recover
damages or other compensation from such an offender are reserved.
20. The Promoter’s decision concerning any aspect of this promotion is final and no
correspondence will be entered into.
21. The Promoter and its related bodies may use entrant’s email addresses for future
promotional and marketing purposes. Entrants may unsubscribe at any time.
22. The Promoter collects information about entrants, including names and contact details
which entrants provide when registering or using our services, as well as information
from data houses, social media services, affiliates and other entities. The Promoter
collects and uses that information to provide you with our goods and services, to
promote and improve our goods and services, to provide opted-in entrants with targeted
advertising, for the purposes described in our Privacy Policy and for any other purposes,
described at the time of collection.
Prize inclusions
27. Eligible Entrants who satisfy the Entry Requirements will be eligible to win the “Prize”:
Flights from Sydney to Tokyo on All Nippon Airways.
a. Two (2) return premium economy flights with All Nippon Airways to Tokyo Haneda
Airport, departing Sydney International Airport, valued at approx. AUD $4,104 as at 5
July 2017 (including taxes).
Prize terms and conditions
28. No extension of validity under any circumstances is allowed.
29. Changes are not permitted, once booking is confirmed.
30. Compliance with any health or other government requirements is the responsibility of
each prize-winner and his or her companion. All Nippon Airways makes no
representation as to the safety, conditions or other issues that may exist at any
destination.
31. Flights are subject to availability at the time of booking and embargo periods, and
blackout periods may apply. Seats are subject to availability at time of booking.
32. Ticket is valid on All Nippon Airways aircraft and not applicable on code-share flights.
33. Ticket must be booked in designated booking class.
34. Ticket is not eligible for mileage accrual & upgrading using mileage is not allowed.
35. Ticket is valid on flights & dates shown on the ticket only. Travel dates and name
changes are not permitted.
36. The prize is not transferable. Ticket is not exchangeable for cash, non-transferable,
non-endorsable, non-reroutable and non-refundable under any circumstances and
cannot be altered in any way and cannot be taken in parts.
37. Japan National Tourism Organization reserves the right to substitute for any reason
whatsoever a prize (or portion thereof) of comparable or greater value, at their sole
discretion. Prize is awarded “as is” without warranty nor guarantee, subject to any written
directions from a regulatory authority.
38. The winners desired travel dates must be communicated to the designated Japan
National Tourism Organization representative within 21 days of winning the Prize.
39. Flights arrangements will be made by a designated Japan National Tourism
Organization representative.
40.
Travel period: 1st October 2017 until 31st March 2018 (All travel to be completed by 31st
March, 2018). No exceptions accepted.
41. Return ticket is valid for one month from date of departure from Sydney.
42. The Prize winner and their companion must depart from and return to Sydney and travel
together on the same dates/times. If the Prize winner (and their travel companion) are
located outside of Sydney, connecting airfares and other travel costs will be at the
winner’s expense.
43. No Prize substitution or cash equivalent of Prize will be awarded for any reason,
including for cancellation of trip due to natural calamities or any other force majeure
event.
44. Once the trip is confirmed, the departure date cannot be changed or winner will forfeit
the Prize.
45. All other costs not included in the Prize are the responsibility of the winner. Travel
insurance is strongly recommended.
46. Picture identification (valid driver’s license, passports, visas or other picture
identification) is the winner’s and their companion’s responsibilities. Australian passport
holders do not require visas to enter Japan.
47. Entire travel must be completed by 31 March 2018 in accordance with fare validity.
48. Any cost associated with accessing the promotion website is the entrant’s responsibility
and is dependent on the Internet service provider used.
49. If the promotion is interfered with in any way or is not capable of being conducted as
reasonably anticipated due to any reason beyond the reasonable control of the
Promoter, including but not limited to technical difficulties, unauthorised intervention or
fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted
by law (a) to disqualify any entrant; or (b) subject to any written directions from a
regulatory authority, to modify, suspend, terminate or cancel the promotion, as
appropriate.
