“CALTEX MYER ONE ” PROMOTION
TERMS AND CONDITIONS
1. Information on how to enter and the prizes form part of these Terms and Conditions.
Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is open to Australian residents aged 18 years or over with a valid MYER one
Membership or who sign-up to become a MYER one Member prior to making a
qualifying purchase (as detailed below).
3. This promotion is conducted by Caltex Pty Ltd (“Caltex”) (ABN 40 004 201 307) of 24/2
Market Street, Sydney NSW 2000, telephone (02) 9250 5000 (“The Promoter”) with
approval of and in association with Myer Pty Ltd (“Myer”).
4. This Promotion is authorised under NSW Permit No. LTPS/17/15267. ACT Permit No.
TP17/01204. SA Permit No. T17/1150
5. Employees (and their immediate families) of the Promoter, Participating Service
Stations (as defined below), Myer and agencies associated with this promotion who
are directly involved in the management of the promotion are ineligible to enter.
Immediate family means any of the following: spouse, ex-spouse, de-facto spouse,
child or step-child (whether natural or by adoption), parent, step-parent, grandparent,
step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister
or 1st cousin.
6. Promotion commences at 12:01am AEST on 01/08/2017 and final entries close at
11:59pm AEST on 15/09/2017 (“Promotional Period”).
7. A Participating Caltex Service Station will be any Caltex Service Station listed on the
MYER one website at
http://myer.taguchimail.com/media/1/01.Mailout/pdfs/wk18-caltex.pdf (each a “Participating Service Station”).
8. To be eligible to enter and receive an automatic entry into the relevant draw, individuals
must undertake the following steps during the Promotional Period:
a) spend $30 or more in a single transaction, at a Participating Service
Station, on any fuel or shop product/s, excluding tobacco and
cigarettes, (“Eligible Purchase”); and
b) Scan their MYER one card at the time of making their Eligible Purchase.
9. Entry is automatic upon completion of the above steps. Individuals that do not wish to
participate can contact the Promoter directly using the details outlined in clause 3 and
request that their entry/s be removed.
10. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per
transaction associated with an Eligible Purchase; and (b) each entry must be submitted
separately and in accordance with entry requirements. For the avoidance of doubt,
only one (1) entry is permitted in respect of each transaction relating to an Eligible
Purchase, regardless of the amount spent in that transaction in excess of $30.
11. The draw will take place at Anisimoff Legal, Suite 5, Erina Plaza, 210 Central Coast
Highway, Erina NSW 2250 at 10:00am AEST on 29/09/2017. Winners will be notified
within two (2) business days of the draw. Winner’s first initial, surname and postcodes

will be published online at
www.caltex.com.au/myer from 13/10/2017. In the event of
any SA winners their fist initial, surname and postcodes will also be published in The
Advertiser on 13/10/2017.
12. The first valid entry drawn will win the major prize of a shopping trip for two (2) adults
to Los Angeles, California, USA valued at up to AU$30,900 (depending on date and
point of departure). Prize includes:
Two (2) x return business class airfares from winner's nearest Australian capital
city to Los Angeles, California, USA;
Five (5) nights twin share accommodation at Four Seasons Beverly Wilshire with
breakfast included daily (on a set menu);
A USD$100USD credit to use towards either (a) The Spa at Beverly Wilshire and
The Nail Bar (excluding retail products and Lea Journo Salon); or (b) dinner at THE
Blvd or CUT by Wolfgang Puck; and
AUD$5,000 spending money for the winner only.
Additional spending money, additional meals, taxes (excluding airline and airport
taxes), insurance, passports, visas, vaccinations, transport to and from departure
point, transfers, items of a personal nature, in-room charges and all other ancillary
costs are not included. The winner must advise of nominated travel dates no later than
3 months prior to their intended travel. Prize must be redeemed by 11:59pm AEST on
31/08/2018 and is subject to booking and flight availability. Black out periods apply of
17/12/2017 to 05/01/2018. Frequent flyer points will not form part of the prize. Prize is
subject to the standard terms and conditions of individual prize and service providers.
The winner may be required to present their credit card at time of accommodation
check in.
13. The next twenty (20) valid entries drawn will each win a digital $500 Caltex StarCash
Card. Each digital Caltex StarCash Card will be awarded via email and will be valid for
twelve (12) months from the date of issue. Instructions on how to download and use
the digital Caltex StarCash Card will be provided within the email. Each digital
StarCash Card is redeemable at participating locations as instructed within the email.
Any ancillary costs associated with redeeming a Caltex StarCash Card are not
included. Any unused balance of a Caltex StarCash Card will not be awarded as cash.
Redemption of a Caltex StarCash Card is subject to any terms and conditions of the
issuer including those specified on the Caltex StarCash Card.
General
14. A valid entry is any entry that is submitted in accordance with, and is compliant with
these Terms and Conditions.
15. Incomplete entries will be deemed invalid
16. The Promoter reserves the right, at any time, to verify the validity of entries and
entrants (including an entrant’s identity, age, place of residence and MYER one
Membership) and reserves the right, in its sole discretion, to disqualify any individual
who the Promoter has reason to believe has breached any of these Terms and
Conditions, tampered with the entry process or engaged in any unlawful or other
improper misconduct calculated to jeopardise fair and proper conduct of the promotion.
Errors and omissions may be accepted at the Promoter's discretion. Failure by the

Promoter to enforce any of its rights at any stage does not constitute a waiver of those
rights. The Promoter's legal rights to recover damages or other compensation from
such an offender are reserved.
17. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in
its sole discretion, to determine the identity of the entrant.
18. The Promoter’s decision is final and no correspondence will be entered into.
19. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves
the right to cancel, terminate, modify or suspend the promotion or suspend or modify
a prize, subject to any written directions from a relevant regulatory authority.
20. Subject to the unclaimed prize draw clause, if for any reason a winner does not take
and/or redeem a prize (or an element of a prize) at or by the time stipulated by the
Promoter, then the prize (or that element of the prize) will be forfeited and will not be
redeemable for cash.
21. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves
the right to substitute the prize (or that part of the prize) with a prize to the equal value
and/or specification, subject to any written directions from a regulatory authority.
22. Total prize pool value is up to AUD$40,900
23. Prizes, or any unused portion of a prize, are not transferable or exchangeable and
cannot be taken as cash, unless otherwise specified.
24. A draw for any unclaimed prizes may take place on 21/12/2017 at the same time and
place as the original draw, subject to any directions from a regulatory authority.
Winners (if any) will be notified within two (2) business days of the draw. Winner’s fist
initial, surname and postcodes will be published online at
www.caltex.com.au/myerfrom 04/01/2018. In the event of any SA winners their fist initial, surname and
postcodes will also be published in The Advertiser on 04/01/2018.
25. As a condition of accepting a prize, winners consent to the Promoter using their name,
likeness, image and/or voice (including photograph, film and/or recording of the same)
in any media (including but not limited to the Promoter’s social media pages) for an
unlimited period without remuneration for the purpose of promoting this promotion
(including any outcome), and promoting any products manufactured, distributed and/or
supplied by the Promoter.
26. If this promotion is interfered with in any way or is not capable of being conducted as
reasonably anticipated due to any reason beyond the reasonable control of the
Promoter, including but not limited to technical difficulties, unauthorised intervention or
fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent
permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions
from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as
appropriate.
27. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit,
exclude or modify the statutory consumer guarantees as provided under
the Competition and Consumer Act, as well as any other implied warranties under the

ASIC Act or similar consumer protection laws in the States and Territories of Australia
(“Non-Excludable Guarantees”). Except for any liability that cannot by law be
excluded, including the Non-Excludable Guarantees, the Promoter (including its
respective officers, employees and agents) excludes all liability (including negligence),
for any personal injury; or any loss or damage (including loss of opportunity); whether
direct, indirect, special or consequential, arising in any way out of the promotion.
28. Except for any liability that cannot by law be excluded, including the Non-Excludable
Guarantees, the Promoter (including its respective officers, employees and agents) is
not responsible for and excludes all liability (including negligence), for any personal
injury; or any loss or damage (including loss of opportunity); whether direct, indirect,
special or consequential, arising in any way out of: (a) any technical difficulties or
equipment malfunction (whether or not under the Promoter’s control); (b) any theft,
unauthorised access or third party interference; (c) any entry or prize claim that is late,
lost, altered, damaged or misdirected (whether or not after their receipt by the
Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any
variation in prize value to that stated in these Terms and Conditions; (e) any tax liability
incurred by a winner or entrant; or (f) use of a prize and/or taking of a prize.
29. The Promoter collects personal information ("PI") in order to conduct the promotion
and may, for this purpose, disclose such PI to third parties, including but not limited to
related entities, agents, contractors, service providers, prize suppliers and, as
required, to Australian regulatory authorities. Entry is conditional on providing the
requested PI. The Promoter will also use and handle PI as set out in its Privacy Policy,
which can be viewed at
http://www.caltex.com.au/Pages/PrivacyPolicy.aspx. If the
entrant opts in at the time of entry, the Promoter may, for an indefinite period, unless
otherwise advised, use the PI for promotional, marketing, publicity, research and
profiling purposes, including sending electronic messages or telephoning the entrant.
The Privacy Policy also contains information about how entrants may opt out, access,
update or correct their PI, how entrants may complain about a breach of the Australian
Privacy Principles or any other applicable law and how those complaints will be dealt
with. All entries become the property of the Promoter. The Promoter may disclose
