Terms and Conditions

1. Information on how to enter and the prizes form part of these Terms and Conditions. Entry into the Competition is deemed acceptance of these Terms and Conditions.

2. The promoter ("Promoter") is NULIS Nominees (Australia) Limited (ABN 80 008 515 633 AFSL 236465) of PO Box 200, North Sydney, NSW 2059 and GPO Box 63, Melbourne, Victoria, 3001. Telephone 132 652 / 1300 55 7586. NULIS Nominees (Australia) Limited is part of the National Australia Bank Group of Companies. An investment with NULIS Nominees (Australia) Limited is not a deposit or liability of, and is not guaranteed by, NAB.

3. Entry is open only to Australian residents aged 15 years or over who:

a) have either a MLC Super Fund, MLC Superannuation Fund, DPM Retirement Service and PremiumChoice Retirement Service (collectively referred to herein as "Account"). b) have received a communication directly from the Promoter regarding this Competition; and

c) comply with the specific eligibility criteria relevant to the entry mechanic, as outlined below


("Participants").

4. Participants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the Participant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.

5.Employees (and their immediate family) of the Promoter, its related companies, and agencies associated with this Competition, including but not limited to contractors, agencies, retailers and suppliers (e.g. advertising, marketing and promotional agencies) are not eligible to enter the Competition. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

6. Competition commences on 10 July 2017 and ends at 11:59pm on 30 September 2017  ("Competition Period"). All times indicated in these Terms and Conditions are in AEST/AEDST, as applicable.

7. To enter, a Participant must submit an 'Update my details' form during the Competition Period either via their online Account or via telephone with the Account contact centre. Once a Participant has successfully updated their contact details the Participant will receive one (1) automatic entry into the draw.

8. Only one (1) entry is permitted per person.

9. All entries must be submitted in accordance with the entry instructions.

10. Incomplete or indecipherable entries will be deemed invalid.

11. If there is a dispute as to the identity of a Participant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Participant.


Prize Draw

12. All valid entries received during the Competition Period will be entered into the draw. The draw will be conducted at Anisimoff Legal, Suite 5, Erina Plaza, 210 Central Coast Highway, Erina, NSW 2250 at 11am on 10 October 2017. The winners will be determined by way of a random selection from a computer database containing all entries received from eligible Participants during the Competition Period. All winners will be notified by phone and mail within two (2) business days of the draw by a representative at Anisimoff Legal (on the Promoter’s behalf), and winners' names will also be published in The Australian newspaper on 24 October 2017

13. The first twenty-five (25) valid entries drawn will each win a $1,000 Visa Debit gift card. Any ancillary costs associated with redeeming the gift card are not included. Any unused balance of the gift card will not be awarded as cash. Redemption of the gift card is subject to any terms and conditions of the issuer including those specified on the gift card.

14. If any prize remains unclaimed by 10:00am on 10 January 2018 subject to any directions from a regulatory authority, an unclaimed prize draw will be held at 11:00am on 11 January 2018 at the same draw place as the original draw. Winners, if any, will be notified by phone and mail within two (2) business days of the re-draw by a representative at Anisimoff Legal (on the Promoter’s behalf), and winner(s) names will also be published in The Australian newspaper on 25 January 2018.


General

15. The total prize pool value is $25,000.

16. Subject to the unclaimed prize draw clause, if for any reason a winner does not take or claim a prize by the time stipulated by the Promoter, then the prize will be forfeited.

17. Prizes are not transferable, divisible or exchangeable and cannot be taken as cash, unless otherwise specified by the Promoter.

18. The Promoter is part of the National Australia Bank (NAB) Group of companies. The Promoter collects personal information ("PI") in order to conduct this Competition and may, for this purpose, disclose such PI to third parties, including but not limited to other NAB Group Companies and Anisimoff Legal (for the purpose of conducting the Draw and notifying the winners), agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter and NAB will also use and handle PI as set out in their respective Privacy Policies, available at nab.com.au or by calling 13 22 65 (1300 363 647 for hearing impaired individuals with telephone typewriters) (for NAB’s Privacy Policy) and mlc.com.au/mlc/im_considering_mlc/personal/footer_tools/privacy_policy and plum.com.au/content/dam/plum/pdf/PSF_Privacypolicy.pdf (for NULIS’ privacy policy ).  In addition to any use that may be outlined in the Privacy Policies mentioned, the Promoter and NAB may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Participant. The Privacy Policies also contain information about how Participants may opt out, access, update or correct their PI, how Participants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. Should a Participant’s contact details change during the Competition Period, it is the Participant's responsibility to notify the Promoter and NAB. All entries become the property of the Promoter. The Promoter and NAB will not disclose Participant’s personal information to any entity outside of Australia.

19. The Promoter reserves the right to request Participants to provide proof of identity, proof of age, proof of residency at the nominated prize delivery address and/or proof of entry validity in order to claim a prize. Proof of identification, residency, account holder status and entry considered suitable for verification is at the discretion of the Promoter. If a Participant can’t provide suitable proof as reasonably requested by the Promoter, the Participant will forfeit any rights to the prize in whole and no substitute will be offered.

20. The Promoter reserves the right to verify the validity of entries and Participants (including a Participant’s identity, age and place of residence) and to disqualify any Participant who tampers with the entry process, who submits an entry that’s not in accordance with these Terms and Conditions or who has, in the opinion of Promoter, engaged in conduct in entering the Competition which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Competition and/or Promoter. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

21. Entries must be received during the Competition Period. The Promoter has no control over telecommunications networks and accept no responsibility for problems associated with them. Entries deemed received at the time of receipt into the Promoter’s database, not at the time of transmission. Entries submitted using any form of automated entry device or software are ineligible. Entries not fully complying with these Conditions of Entry will be deemed invalid. The Promoter accepts no responsibility for late, lost, incomplete, indecipherable, delayed, corrupted, illegible or misdirected entries whether due to error, omission, alteration, deletion, destruction, transmission interruption, tampering, theft, destruction failure or otherwise. No correspondence will be entered into.

22. Unless expressly stated in these Terms and Conditions, all other expenses become the responsibility of the winner, including any costs associated with accessing the Competition website.

23. By accepting the prize, the winners agree to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned. Participants consent to the Promoter using their name, likeness, image and/or voice in the event they’re a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

24. The Promoter's decision is final and the Promoter will not enter into correspondence regarding the Competition results.

25. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010, as well as any other implied warranties under the Australian Securities and Investments Commission Act 2001 or similar consumer protection laws in the States and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition.

26. Except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry, prize claim or prize delivery that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winner or Participant; or (e) taking and/or use of a prize. Liability for any tax arising out of participation in this Competition (including acceptance of a prize) is the sole responsibility of the Participant. Participants should seek independent financial advice in this regard.

27. If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Competition, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Participant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Competition, as appropriate.

28. Winners may be liable to declare their prize for taxation purposes and will be liable for any tax payable in respect of their prize. Participants should seek independent financial advice in relation to any tax payable on the prize and the potential impact on their personal financial situation prior to entering the Competition.
