“The Cliveden Bar & Dining – Dine and win a VESPA” CompetitionTerms and ConditionsInformation on how to enter the Promotion forms part of these terms and conditions. Entries not made
in accordance with these terms and conditions will be disqualified.
Section 1: Promotion1. Promotion: Being an Accor Plus member, dine at The Cliveden Bar & Dining at the Pullman
Melbourne on the Park for a buffet lunch, buffet dinner, weekend buffet brunch or special
event as noted by the promoter and receive an entry ticket for each diner paid for under the
Accor Plus membership card. The ticket(s) is to be filled out by the Accor Plus members only
with his/her details and handed back to a staff member on the day of dining to get
automatically entered in the draw to win a new Vespa.
** Accor Plus member will get a ticket for each person dining at their table. I.e. the more
people they bring in, the more chances of winning. E.g. Table of 4 under Accor Plus
membership booking will receive 4 entry tickets which the member can fill in with his/her
details.
2. Promoter: Sovereign PCH Melbourne Pty Limited (ABN: 72 560 756 279) of 192 Wellington
Parade Melbourne Victoria 3002, Trading as Pullman Melbourne on the Park and The
Cliveden Bar & Dining.
3. Promotion Period: The Promotion will commence at 6.31pm am on 18 August 2017 and will
close 01.00am on 01 January 2018. All times recorded throughout these terms and
conditions are in Australian Eastern Standard Time.
Section 2: Eligibility4. Eligibility: To be eligible to enter the Promotion, the entrant must:
a. be above 18 years of age; and
b. be an current and valid member of Accor Plus; and
c. be an Australian resident
5. Non-Eligibility: Entrants are not eligible to enter the Promotion or win any Prize if they are a
director or manager, an employee or immediate family member of an employee of the
Promoter, or an employee of their agencies associated with the Promotion.
Section 3: Entry to the Promotion7. When an eligible entrant purchases an eligible meal and fills their details out on the entry
ticket and gives it back to a staff member, the entrant will automatically receive entry to the
Promotion within the Promotion Period as noted in Clause 3. Multiple entries are permitted.
Section 4: Draw8. Draw: A representative of the Promoter will conduct a manual random draw of submitted
entries at 5.00pm on 8 January 2018 at MDSA 15 Grosvenor Street, Neutral Bay NSW
2089. One (1) entrant will be drawn at random from all eligible entries received under these
terms and conditions over the Promotion Period.
9. The entrant drawn will be announced at this time using the details included on their entry
coupon.
The Promoter reserves the right to require the drawn entrants to provide proof of identity
and/or proof of age, and to validate their Accor Plus membership. Identification considered
suitable for verification is at the discretion of the Promoter. If for any reason the winner is
found to be ineligible they will forfeit their chance to win the prize.
Section 5: Prize10. Prize: There is 1 prize to be awarded in this Promotion.
11. Prize Components: The prize will comprise all components listed below:
• 1 x new Vespa Primavera 125 iGet
• Includes 12 months registration, applicable stamp duty, Compulsory Third Party Insurance
(CTP) (if applicable) and dealer delivery charges in winners’ state.
• The Vespa is a new Vespa Primavera 125 iGet, Grigio Seta (Silver). VIN
RP8M82122GV000208. (Vespa on display is the winning prize).
The maximum retail value of the Prize is $6,690.00 (based on VIC Registration)
12. Prize Value: The total value of the Prize to be won during the Promotion is valued at up to
AUD$6,690.00 inclusive of GST (based on VIC Registration).
13. Prize Conditions: Prizes are subject to the following conditions:a. No exchange of Prize: A Prize can be transferred to a person 18 years or over at the
absolute discretion of the Promoter. However, it cannot be exchanged or redeemed for
cash. If for any reason, a Prize Winner cannot take any component of the Prize and
he/she does not wish to transfer the Prize, then the Prize will be forfeited.
b. Ancillary Costs: All insurances, service charges, taxes, transfers and ancillary costs are
not included in a Prize unless specified and are the responsibility of the Prize Winner.
c. Taxes: If a Prize or receipt of it incurs a tax liability, the Prize Winner is liable for payment
of such tax.
d. Prize Availability: All components of the Prize are as is displayed in the promoters venue
at 192 Wellington Parade, East Melbourne, VIC, 3002.
e. Date Prize to be Delivered: Delivery will be to the prize winners’ nearest Vespa Dealer. It
is anticipated that delivery will occur within 2 weeks.
f. Includes all on road costs at time of publication . All ancillary costs or accessories not
expressly provided are the responsibility of the winner. The Prize excludes
comprehensive insurance, operational costs, fuel, personal costs and any other ancillary
or incidental costs related to the Prize or anything else not specifically mentioned, which
is the responsibility of the winner. Delivery or collection of the Prize vehicle (as
applicable) is subject to availability of the vehicle. If the Prize winner is, through any legal
incapacity or otherwise, unable to register the motor vehicle Prize in his or her name then
they may assign the motor vehicle Prize to another person with legal capacity for the
purpose of registration. The Promoter takes no responsibility for any such arrangements
between the Prize winner and an assignee. The Prize will be made available for the
winner to collect from the dealer closest to the winner’s place of residence as stated in
their entry details. All costs associated with travel to and from the dealer is at the winner’s
own cost. The Promoter accepts no responsibility for any mechanical, body or paint
repairs or repairs or maintenance of any kind relating to the Prize after the date and time
of Prize collection by a winner. Any vehicles depicted in any promotional material are not
necessarily the same colour or grade as the Prize vehicle, and are for illustration
purposes only
Section 5: Prize Winner14. Contact: The Promoter will contact the Prize Winner in writing by mail or email and
telephone by 09 January 2018 to confirm his/her eligibility under these terms and
conditions and to confirm whether the Prize Winner wishes to claim his/her Prize. The name
of the Prize Winner will also be published in the Public Notices section of The Australian
newspaper on 15 January 2018
15. Claim of Prize: If the Prize Winner wishes to claim the Prize, the Prize Winner must confirm
this fact and his/her eligibility to win under these terms and conditions by 10.00 am on 09
April 2018. If the Prize Winner fails to do either or both of these things by the deadline, the
Prize Winner will be deemed to have forfeited the Prize.
16. The Promoter reserves the right to conduct another draw in the event of the prize winner
being unable to satisfy these terms and conditions or forfeiting or not claiming a prize. For a
prize that remains unclaimed or is forfeited through ineligibility or otherwise, the Promoter
will conduct a further draw at the same time and place as the original draw from the
remaining coupons on 24 April 2018 subject to permission from the applicable state
authorities. The winner will be notified in writing immediately, and their name will be
published in The Australian newspaper on 1 May 2018.
17. Winner Publicity: In accepting the Prize, the Prize Winner agrees to participate in any
publicity arrangements made by or on the behalf of the Promoter. The Prize Winner further
acknowledges that the Promoter reserves the right to publicise their name, address and
photographs without any payment being made to them in respect of this Promotion.
Section 6: General Conditions18. Lost, Delayed Communication: The Promoter will not be responsible for any delayed, lost or
misdirected mail or any other communication.
19. Release: To the fullest extent permissible by law, each entrant in the Promotion including
without limitation the Prize Winner, releases the Promoter from any claim, loss, damage,
expense (including any claim for legal expenses), cost or charge sustained or in any way
incurred by such entrant in connection with the Prize or their participation in the Promotion.
The Promoter, its related bodies corporate, their officers, employees and agents will not be
liable for any loss, damage or personal injury whatsoever (including but not limited to direct,
indirect, consequential and economic loss) suffered or sustained in connection with this
Promotion, the promotion of this Promotion, or the use of any Prize, except for any liability
which cannot be excluded by law. Further, to the fullest extent permitted by law, the
Promoter excludes liability for any problems or technical malfunction of any telephone
network or lines, computer online systems, servers, or providers, computer equipment,
software, technical problems or traffic congestion on the Internet or any website, or any
unauthorised intervention, or any combination thereof, including any non-delivery or
corruption of entries to the Promoter, injury or damage to participants' or any other person's
computer related to or resulting from participation in or down-loading any materials in this
Promotion. The use of any automated entry software or any other mechanical or electronic
means that allows an entrant to automatically enter repeatedly is prohibited and will render
all entries submitted by that entrant invalid.
20. Force Majeure: Subject to State legislation the Promoter will not be responsible for any act,
omission, failure or delay by the Promoter that is due to an act of God, riots, acts of
terrorism, storms, fire, any labour or industrial dispute, any strike, and other acts, which are
not reasonably within the control of the Promoter.
21. Disputes: In the event of a dispute, the decision of the Promoter is final and binding and no
correspondence will be entered into.
22. Privacy Notice: During the course of the Promotion, the Promoter may collect personal
information in relation to entrants. This may include, but is not limited to, the names, email
addresses, telephone numbers and credit card details of the entrants, provided by the
entrant on the guest registration form or when paying for services provided by the
participating Hotel. The entrants' personal information is collected so the Promoter is able to
conduct the Prize Draw and to contact and award the Prize to the Prize Winner, to publish
the results of the Promotion and to publicise the Promotion.
23. Consent to use of Personal Information for Marketing Purposes: Furthermore, by entering
this Promotion, unless otherwise advised by the entrant, each entrant consents to the
retention and use of the information collected pursuant to Clause 23 by the Promoter, which
trades as The Cliveden Bar & Dining and Pullman Melbourne on the Park, part of the
AccorHotels Group. For details about who we are, how we may use your information and
what your rights are under the new privacy laws, please see our Privacy Policy, which is
available from the Promoter at the address provided in Section 1, Clause 2 or online at
www.accorhotels.com/privacy. Uses may include future promotional, marketing and
publicity purposes without any further reference or payment or other compensation to the
entrant, or distribution of marketing materials for goods or services in the tourism, hospitality
and services industries from the Accor Group or from companies in the tourism and
