1. Information on how to enter and the prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. The promoter (“Promoter”) is The Cheesecake Shop Pty. Ltd. (ABN 54 059 134 431) of 2 Lisbon Street VILLAWOOD NSW 2163, telephone 61 2 9723 1011 (Australia) and 7B Canaveral Drive Rosedale Auckland 0632, telephone 64 9 475 9634 (New Zealand).
3. Entry is only open to Australian and New Zealand residents.
4. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.
5. Employees (and their immediate families) of the Promoter, any The Cheesecake Shop store in Australia or New Zealand, and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
6. Promotion commences at 12:00am AEDST on 30 October 2017 and ends for Orders at 5:00pm AEDST (for Australian residents) and 5:00pm NZST (for New Zealand residents) on 21 December 2017 (“Promotional Period”).
7. To enter, individuals must visit
www.cheesecake.com.au (for Australian residents) or
www.thecheesecakeshop.co.nz (for New Zealand residents) and follow the prompts to pre-order and pay for any one (1) or more full size cake product(s) in a single transaction during the Promotional Period (“Order”). Entrants must provide their full name and email address as part of their Order to be considered valid for the purposes of this promotion.
8. Multiple entries permitted, subject to the following:
(a) only one (1) entry permitted per Order/receipt (regardless of the number of full size cake products purchased in that Order in excess of one (1)); and
(b) each entry must be submitted separately and in accordance with entry requirements.
9. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
10. Incomplete or indecipherable transactions will be deemed invalid.
11. Entrants must retain their original purchase receipt(s) for all Orders as proof of purchase. Failure to produce the original purchase receipt(s) for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase as The Cheesecake Shop’s Australian or New Zealand online store, that at least one (1) full size cake product was purchased and collected as required.
12. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
13. There will be eight (
draws conducted for this promotion (each a “Prize Draw”). Subject to the start time and close time indicated in Clause 6, entries into each Prize Draw will open at 12:00am (AEDST for AU residents and NZST for NZ residents) and closes at 11:59pm (AEDST for AU residents and NZST for NZ residents) on the dates specified in the table below. All Prize Draws will take place at The Cheesecake Shop Pty Ltd, 2 Libson Street, Villawood NSW 2163 at 12:00pm AEDST on the dates specified in the table below. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. Entries in each Prize Draw will NOT be entered into any subsequent Prize Draws. Winners will be notified in writing by email within two (2) business days of the relevant Prize Draw. 14. The first ten (10) valid entries drawn in Prize Draws 1-7 and the first thirty (30) valid entries drawn in Prize Draw 8 will each win a $200 The Cheesecake Shop digital Gift Card. All prizes will be awarded by email and in the currency of the winner’s country of residence, being either AUD or NZD. The Cheesecake Shop digital Gift Cards will be redeemable in-stores and online.
15. Any ancillary costs associated with redeeming a The Cheesecake Shop Gift Card are not included. Any unused balance of a The Cheesecake Shop Gift Card will not be awarded as cash. Redemption of a The Cheesecake Shop Gift Card is subject to any terms and conditions of the issuer including those specified on The Cheesecake Shop Gift Card. The Cheesecake Shop Gift Cards will be valid for 12 months from the date of issue.
