Terms and Conditions
1. The “Dine and Win” Promotion (Promotion) commences at 9am Australian Western
Standard Time (AWST) on Thursday 1 February 2018 and concludes at 5pm AWST on
Saturday 31 March 2017, (Promotion Period).
2. The Promotion will take place at Rockingham Centre, 1 Council Ave, 6168 Rockingham
(Rockingham Centre).
3. The Promotion is promoted by Vicinity Centres PM Pty Ltd ACN 101 504 045 as disclosed
agent for the owners of Rockingham Centre, Melbourne Corporate Office, Level 4,
Chadstone Tower One, 1341 Dandenong Road, Chadstone Vic 3148 (Promoter).
4. The Promotion is open to all residents of Western Australia, except employees,
contractors, agents of Rockingham Centre, sponsors of the Promotion and their immediate
families; employees of the Promoter or related body corporate and their immediate
families; tenants in Rockingham Centre and their immediate families; the staff of tenants in
Rockingham Centre and their immediate families; the contractors of tenants in
Rockingham Centre and their immediate families; the proprietors and staff of companies
involved in the production, publishing and administration of the Promotion and their
immediate families. Immediate families means spouse, defacto spouse, parent, child or
sibling (whether natural or by adoption) and grandparents. Tenant means lessees,
licensees and, in the case of a corporation, includes their directors. All participants under
the age of 18 must have prior consent from their parent or guardian before entering the
Promotion and must be able to provide evidence of such consent on request.
5. All entrants (Entrants) will be subject to, and will need to adhere to, the terms and
conditions as set out by the Promoter and any future terms and conditions or alterations to
these terms and conditions. Information about prizes and how to enter forms part of these
terms and conditions.
Prizes
6. The Promotion prize pool has a total value of up to $5000 and consists of:
a. Return Flight tickets around the World ( 3 stops – Perth – Abu Dhabi – Rome – New
York - Perth) for two people ;
b. Accommodation for two people at each destination for 3 nights
7. The Prizes are supplied by Flight Centre ABN (Supplier).
How to Enter
8. To enter the Promotion, Entrants must, during the Promotion Period:
a. spend a total of $25 or more at any one of the Rockingham Centre participating Syren
Street restaurants listed in Schedule 1 (each a Participating Restaurant) in one day
during the Promotion Period (Purchase);
b. retain their store receipt(s) (Receipt) as proof of the Purchase;
c. Fill the Entry Form;
d. Place the entry form in the barrel located at each participating restaurant
9. Entrants must retain and present the receipts evidencing proof of purchase during the
Promotion Period if asked to provide proof of purchase.
10. An entrant may enter this Promotion multiple times throughout the Promotion Period.
11. Entries that are not in accordance with these terms and conditions are invalid.
The Draw
12. The Prize will be randomly drawn from the Barrel at 12:00pm (AWST) on Monday 2nd April
in the Centre Management Office, Rockingham Centre (Draw).
13. The first randomly selected valid Entry From drawn from the Barrel will be deemed the
Winner of the Prize (Winner).
14. The Winner does not need to be present at the Draw and will be notified by telephone or
email.
15. The Winner may be asked to provide proof of purchase.
16. If the Promoter has not had return communication from any initial intended Winner (i.e.
attempts to contact the Winner have met with failure) then that person shall be deemed no
longer eligible for the Prize and the Promoter must announce a replacement Winner
(Replacement Winner).
17. The Winner will need to claim their Prize by 5:00pm (AWST) on Tuesday, 1 May 2018. If
the Prize has not been claimed, as at 5:00pm (AWST) on Tuesday, 1 May 2018, another
Entry Form will be drawn from the Barrel (Replacement Draw). In such a case, the first
valid Entry Form drawn from the Barrel will be entitled to the unclaimed Prize. The
Replacement Winner is then the Winner for the purposes of these terms and conditions.
General
18. If a Prize is unavailable for whatever reason, the Promoter reserves the right to substitute a
Prize for a prize of equal or greater value, subject to any applicable statutory requirements.
19. Proof of identity will be required to claim a Prize. The Promoter may, at any time, require
an individual to produce documentation to establish to the Promoter's satisfaction the
validity of their entries or Prize claim (including documentation establishing their identity,
age, place of residence and place of employment). Failure by the Promoter to enforce any
of its rights at any stage does not waive those rights.
20. Entrants must not:
a. tamper with the entry process;
b. engage in any conduct that may jeopardise the fair and proper conduct of the
Promotion;
c. act in a disruptive, annoying, threatening, abusive or harassing manner;
d. do anything that may diminish the good name or reputation of the Promoter or any of
its related entities or of the agencies or companies associated with this Promotion;
e. breach any law; or
f. behave in a way that is otherwise inappropriate.
21. If this Promotion cannot run as planned for any reason beyond the Promoter's control, for
example due to software, hardware or communications issues, unauthorised intervention,
tampering, fraud or technical failure, the Promoter may end, change, suspend or cancel
the Promotion or disqualify affected entries/entrants, subject to any necessary approval by
the state/territory gaming authorities.
22. The Prize must be taken as offered and is not transferable, refundable or exchangeable for
cash or kind and is subject to these terms and conditions. The prize values are correct as
at the date of preparing these terms and conditions and include any applicable GST. The
Promoter is not responsible for any change in prize value.
23. Any decision made by Centre Management at Rockingham Centre in respect of the
Promotion is final and binding and no correspondence shall be entered into.
Privacy
24. The information you provide will be used by the Promoter for the purpose of conducting
this competition and communicating with you as a member of the Rockingham Centre
Customer Database. The Promoter may collect your personal information (including
through its contractors or agents) or disclose your personal information to its related
companies, contractors and agents to assist in conducting this competition, storing data or
communicating with you. By entering this competition and being a member of the
Rockingham Centre Customer Database, you consent to the storage of your personal
information on the Promoter’s database and the Promoter may use this information for
future competition and marketing purposes regarding its products, including contacting you
via electronic messaging. By entering this competition and being a member of the
Rockingham Centre Customer Database, you consent to receiving SMS or email
messages from the Promoter that do not contain any functional unsubscribe facility. The
Promoter is bound by the Privacy Principles in the Privacy Act 1988 (Cth). The Promoter’s
Privacy Policy, located at
http://www.vicinity.com.au/privacy-policy contains information
about how you can seek access to the personal information the Promoter holds about you
and seek the correction of such information.
Limitation of Liability
25. The Promoter and the agencies and companies associated with this Promotion are not
liable (including in negligence) for any loss (including indirect, special or consequential loss
or loss of profits), expense, damage, personal injury, illness or death suffered in
connection with this Promotion or any prize, except for any liability which under statute
cannot be excluded (in which case that liability is limited to the greatest extent allowed by
law).
26. The warranty on the goods and services obtained as a result of the Promotion remains the
sole responsibility of the manufacturer/supplier of the Prize.
27. The Promoter accepts no responsibility for any tax implications that may arise from the
Prize.
28. No responsibility will be accepted for late, lost, incomplete or misdirected Receipt(s). The
Promoter reserves the right in its sole discretion to disqualify any entrant who the Promoter
has reason to believe has breached any of these conditions, or engaged in unlawful or
other improper misconduct calculated to jeopardise the fair and proper conduct of the
Promotion. The Promoter’s legal rights to recover damages or other compensation from
such a person are reserved.
