TERMS & CONDITIONS
Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
The Promoter is Arnott’s Biscuits Ltd (ABN 44 008 435 729) of 24 George Street, North Strathfield NSW 2137, telephone (02) 8767 7000 (“Promoter”)
Entry is only open to Australian residents aged 18 years or over. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Promotion commences on 01/05/2018 and ends at 11:59pm AEST on 31/07/2018 (“Promotional Period”).
To be eligible to enter individuals must purchase a specially marked packet of Tim Tam biscuits from any retailer nationally, that stocks specially marked packs of Tim Tam, during the Promotional Period (“Eligible Products”). Specially marked packs of Arnott’s Tim Tam will include original 200g, classic dark 200g, chewy caramel 175g and double coat 200g.
There are two elements to this promotion, the instant win component (“Instant Win Component”) and the wish component (“Wish Component”).
Instant Win Component
To participate in the Instant Win Component eligible individuals must purchase an Eligible Product during the Promotional Period and then using their mobile device and the Shazam Application (available to download for free via Apple App Store or Google Play) Shazam the code displayed on Eligible Products. Once the Shazam code has been captured, using the Shazam Application, individuals will be notified instantly if they are a provisional winner of an instant prize or not. Individuals will also receive a Clue (as detailed in the Wish Component below) whether they are an instant winner or not.
Instant winners will be directed to a promotional entry page. Individuals must then input the requested details (including full name, valid email address, residential address and mobile phone number), when prompted, upload a legible copy of their purchase receipt; and then submit the fully completed online entry form.
All non-winners will be given the opportunity to provide their details for the purposes of the 2nd chance draw in the event of any unclaimed prizes.
There will be three (3) prizes available to be won each day of the Promotional Period between 12:00am AEST on 01/05/2018 and 11:59pm AEST on 31/07/2018. There will be a total of two hundred and seventy six (276) prizes. The Promoter will use a computer drawing system to randomly determine three (3) times each day during the Promotional Period (each a “Winning Time”). The first entry, received on or after each Winning Time, will be the provisional winner of that prize. If a prize for a particular day is not won (i.e. there are no entries received on that day on or after a Winning Time), the prize for that day will be allocated to the 2nd chance draw.
If an entrant is deemed a provisional winner in accordance with Clause 10 above, they will receive an instant notification upon submitting their entry (“Provisional Winner”). All Provisional Winners’ names will be published fortnightly (within 14 days) online at
www.arnotts.com, with the first publication date commencing from 15/05/2018. Provisional Winners will only be confirmed as verified winners upon authentication of their entry.
Instant Prizes: Each instant win prize is a one (1) year supply of Tim Tam (which equates to 52 packets) valued at RRP$190.00. Exact variants of Tim Tam packs awarded will be determined by the Promoter in its absolute discretion. Due to the shelf life of Tim Tam packs, the prize will be awarded in two (2) installments.
Wish Component
For the purposes of the Wish Component, there will be a total of three (3) specially marked packets of Tim Tam that will contain a golden ticket inside the pack (each a “Golden Tim Tam Pack”). Each Golden Tim Tam Pack will be secretly planted by the Promoter at locations that have been previously determined by random selection during the Promotional Period. For clarity, the Golden Tim Tam Packs will not be available to be found at the start of the Promotional Period, they will be released at times that coincide with the clues that will be provided throughout the Promotional Period.
Throughout the Promotional Period, individuals can obtain clues as to the eventual location of a Golden Tim Tam Pack (each a “Clue”). To obtain Clues, eligible individuals must submit an entry in accordance with clause 7 above. In addition, the Promoter may in its absolute discretion release Clues on its social media platforms after they have been available to consumers for at least seven (7) days.
Individuals that find a genuine Golden Tim Tam Pack during the Promotional Period, will each win the Wish Prize (defined below). Individuals must retain the golden ticket inside their Golden Tim Tam Pack and follow the instructions provided to claim their prize, this will include sending the golden ticket to the Promoter for verification. Wish Prizes must be claimed by no later than 11:59pm AEST on 14/08/2018.
Each wish prize consists of up to $100,000 towards fulfilling the winner’s wish or wishes (“Wish Prize”). There will be three Wish Prizes in total. The Promoter will work together with each winner to organise fulfilment of the winner’s wish or wishes. The Promoter will fulfil up to three (3) wishes for each winner of a Wish Prize up to the total value of $100,000. In the event fulfilment of the winner’s wish/s will cost less than $100,000, any remaining value will be forfeited by the winner and will not be redeemable for cash. In the event fulfilment of the winner’s wish/s will cost more than $100,000, the winner may select to pay the difference in cost to have their wish/s fulfilled. In the event there is a disagreement between the winner and the Promoter regarding the fulfilment of a wish, the Promoter’s decision will be final. In the event the Promoter is unable to organise fulfilment of the winner’s wish/s, the Promoter will award the winner $100,000 in the form of a cheque made out in the winner’s name. The Promoter will only fulfil wishes that are lawful and consistent with community standards.

General
In addition to uploading a receipt for the purposes of claiming an Instant Prize, entrants must retain their original purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Promotional Period but prior to entry.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
Incomplete or indecipherable entries will be deemed invalid.
Multiple entries permitted, subject to the following: (a) only one (1) entry is permitted per Eligible Product purchased; (b) each entry must be submitted separately and in accordance with entry requirements; and (c) a maximum of three (3) entries per person per device per day is permitted.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
The Promoter’s decision is final and no correspondence will be entered into.
Subject to the unclaimed prize draw provisions in clause 27, if for any reason the winner does not take or redeem a prize (or an element of the prize) at or by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Total prize pool value is up to $352,440. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
A draw for any unclaimed Wish Prize or Instant Prizes may take place at 10:00am AEDST on 14/11/2018 at Anisimoff Legal, Suite 5, Erina Plaza 210 Central Coast Highway Erina NSW 2250, subject to any directions from a regulatory authority. Winners (if any) will be notified in writing within two (2) business days of the draw and their names will be announced online at
www.arnotts.com on 22/11/2018.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost (including data costs) associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
Printing and other quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured. Any unclaimed instant win prizes that are part of the advertised total prize pool will be awarded in the unclaimed prize draw. Instant win game materials void if stolen, forged, mutilated or tampered with in any way.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act (Cth), as well as any other implied warranties under the ASIC Act (Cth) or similar consumer protection laws in the States and Territories of Australia (“ Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the NonExcludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
As a condition of accepting a prize, the winner must sign any legal documentation as and in the form reasonably required by the Promoter and/or prize suppliers.
The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at
www.arnotts.com. The Privacy Policy also contains information about how entrants may access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter.
