Terms and Conditions
1. The “Win A Homewares Package” (Promotion) commences at 9am Australian Eastern
Standard Time (AEST) on Monday 30th April 2018 and concludes at 4pm AEST on
Sunday 13th May 2018 (Promotion Period).
2. The Promotion is promoted by Vicinity Custodian Pty Ltd ACN 077 870 243 as trustee for
VCX Property Management Trust ABN 21 969 875 489 (Promoter) of Runaway Bay
Centre,10-12 Lae Drive, Runaway Bay, Queensland 4216 (Runaway bay Centre).
3. All entrants will be subject to, and will need to adhere to, the terms and conditions as set
out by the Promoter and any future terms and conditions or alterations to these terms
and conditions.
Prize
4. The Promotion prize pool has a total value of $3,000 and consists of the following:
a. One (1) Bedroom Package as displayed in centre (First Prize);
How to Enter
5. To enter the Promotion, entrants must, during the Promo
NB - Multiple receipts can be aggregated in order to meet the minimum Purchase
amount to obtain an Entry Form. However, if the aggregate value of multiple
receipts exceeds $60, the residual balance of any receipt cannot be contributed
towards an additional Entry.
6. Clauses 5(a) to (d) constitute one (1) valid entry (Entry).
7. Subject to complying with clauses 5 and 6, an entrant may enter the Promotion multiple
times during the Promotion Period.
8. Entry Forms that are not in accordance with these terms and conditions are invalid.
9. Receipts from any retailers other than those listed in Schedule 1 cannot be used to enter
the Promotion. Receipts for payment of the following goods and/or services are not valid:
a. Receipts for payments of alcohol, cigarettes, phone cards and products, recharge
cards, gift cards, postage, bus and rail tickets, pharmaceutical scripts,
Travel, bill/account payments or gambling products of any form including, but not
limited to, Instant ‘Scratch and Win’ cards and Lotto..
Draw
10. The draw will be conducted by Runaway Bay, centre management staff (Centre
Management) at 10am (AEST) on Monday 14th
May 2018 at the Centre Management
office.
11. The first (1) valid entry drawn from the Draw will be deemed to be the winner who will win
the Prize.
12. The Winners do not need to be present at the Draw and will be notified by email. Centre
Management will arrange a time with the Winners to collect their respective Prizes.
13. If a Winner cannot be contacted within three (3) months of the Draw (i.e. attempts to
contact the Winner have met with failure), that Winner will no longer be entitled to the
Prize and the Promoter may undertake a re-draw at a time and place determined by the
Promoter. In such case, the first valid Entry Form drawn in the re-draw will be entitled to
the Prize (Replacement Winner). The Replacement Winner is then the winner of the
Prize for the purposes of these terms and conditions.
14. If a Prize is not collected by a Winner or Replacement Winner within four weeks of any
communication purporting to accept the Prize, that Winner or Replacement Winner will
forfeit the Prize. Subject to any statutory requirements, the Promoter reserves the right to
award that Prize to another eligible entrant in accordance with the terms and conditions
of the Promotion.
General Terms and Conditions
15. Entry Forms must be originals. No copies or facsimiles of Entry Forms will be accepted.
16. All winning Entry Forms drawn at the Draw must conform to all terms and conditions. No
responsibility will be accepted for late, lost, incomplete or misdirected Entry Forms.
Entry Forms which contain incorrect contact details shall be deemed invalid. The
Promoter reserves the right in its sole discretion to disqualify any entrant who the
Promoter has reason to believe has breached any of these terms and conditions, or
engaged in unlawful or other improper misconduct calculated to jeopardize the fair and
proper conduct of the Promotion. The Promoter’s legal rights to recover damages or
other compensation from such a person are reserved.
17. Any decision made by Centre Management in respect of the Promotion is final and
binding and no correspondence will be entered into.
18. If a Prize is unavailable for whatever reason, the Promoter reserves the right to substitute
that Prize for a prize of equal or greater value, subject to any applicable statutory
requirements.
19. Proof of identity will be required to claim a Prize.
20. All participants under the age of 18 must have prior consent from their parent or guardian
before entering the Promotion and must be able to provide evidence of such consent on
request.
21. If a Winner is under 18 years of age, the Prize will be awarded to the Winner’s nominated
parent/guardian upon presentation of photo identification. The parent/guardian shall be
deemed the Winner for the purposes of these terms and conditions.
22. By entering the Promotion, the entrants hereby give Centre Management and the
Promoter authority to publicly announce their name (should they be a Winner or a
Replacement Winner) at the time of the Draw and at any stage thereafter.
23. The Promotion is open to all residents of Queensland except employees, contractors,
agents of Runaway Bay Centre, sponsors of the Promotion and their immediate families;
employees of Vicinity Limited or related body corporate and their immediate families;
tenants in Runaway Bay Centre and their immediate families; the staff of tenants in
Runaway Bay Centre and their immediate families; the contractors of tenants in
Runaway Bay Centre and their immediate families; the proprietors and staff of
companies involved in the production, publishing and administration of the Promotion
and their immediate families. Immediate families means spouse, defacto spouse, parent,
child or sibling (whether natural or by adoption) and grandparents. Tenant means
lessees, licensees and, in the case of a corporation, includes their directors.
24. By partaking in the Promotion, entrants agree that the Promoter may use information
provided on an Entry Form or in connection with claiming a Prize in accordance with
Vicinity Centres’ Privacy Statement. A copy of Vicinity Centres’ Privacy Statement will be
available for viewing at Centre Management office, Runaway Bay or at
www.vicinity.com.au/privacy-policy25. The Prizes must be taken as offered and are not transferable, refundable or
exchangeable for cash or kind and are subject to these terms and conditions.
26. The warranty on the goods and services obtained as a result of the Promotion remains
the sole responsibility of the manufacturer/Supplier of each Prize.
27. The Promoter (including its related entities) and its respective officers, employees,
contractors and agents shall not be liable for any loss or damage whatsoever which is
suffered (including but not limited to indirect or consequential economic loss) or for
personal injury suffered or sustained, as a result of the Promotion or in connection with a
Prize.
28. The Promoter accepts no responsibility for any tax implications that may arise from a
Prize.
29. The Promotion is not valid in conjunction with any other offer.
30. By participating in the Promotion, each entrant acknowledges and agrees that the
Promoter collects personal information about entrants for the purposes of:
a. including entrants in the Promotion and, where appropriate, awarding Prizes; if
the personal information requested is not provided, the entrant may not
participate in the Promotion; and
b. enabling the Promoter to use the information to assist the Promoter in improving
goods and services and to contact the entrant in the future with information on
special offers or provide entrants with marketing materials via any medium
including mail, telephone and commercial electronic messages (SMS (Short
Message Service), MMS (Multimedia Message Service), IM (Instant Messaging)
and email) or any other form of electronic, emerging, digital or conventional
communications channel whether existing now or in the future. The Promoter
may share information with its Australian related companies or promotional
partners, who may contact the entrant with special offers in this way. By entering
the promotion, an entrant agrees that the Promoter may use the entrant's
personal information in this manner. Entrants may opt out by clicking on the
