Information on how to enter and details of the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Entry is only open to Australian residents aged 18 years or over. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Incomplete, illegible or indecipherable entries will be deemed invalid.
Only one (1) entry permitted per person.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
There will be twelve (12) minor draws conducted for this promotion, with entries closing for each minor draw on the dates outlined below. Entries from each minor draw (excluding minor draw winners) will be rolled over into each subsequent minor draw. There will also be a major prize draw conducted for this promotion, from all from all valid entries received during the Promotional Period (including any minor draw winners). The major draw and minor draws will take place at Anisimoff Legal, Suite 5, Erina Plaza, 210 Central Coast Highway, Erina NSW 2250. The winners will be notified via phone and in writing within two (2) business days of each draw. The winners’ names for the major prize and minor prizes will also be published online at https://www.wineselectors.com.au/competitions/competition-winners from 30/07/2018 for the major prize winner and for the minor prizes as per the dates in the table above. In the event the winner (for the major prize) is from SA, the winner’s name will also be published in The Advertiser on 03/08/2018 (major prize only). Anisimoff Legal, on behalf of the Promoter, may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
The Promoter’s decision is final and no correspondence will be entered into.
MAJOR PRIZE

The first valid entry drawn in the major draw will win the major prize of a trip to Kind Island (Tasmania) valued at up to $6,200, depending on date and point of departure. The major prize includes the following for four (4) adults (unless indicated otherwise):
Return economy flights to King Island, from the winner’s nearest nearest capital city in Australia. If the winner is from King Island,  then the prize does not include flights and this element of the prize will be forfeited;
3 nights’ accommodation (at an Airbnb property selected by the Promoter in its discretion). The accommodation will be in a private house and is subject to standard Airbnb terms;
A full day 4WD experience with King Island Holiday Village, with the driver selected by the prize supplier. This prize also included a tour of the area, morning tea and Lunch/Whitable choth “Padddock to Plate” experience. All meals are on set menu.
$300 Full Loaded pre-paid Visa card toward transfers to and from the relevant airports, awarded to the winner only;
Car hire for the duration of the trip (standard rental terms apply and the driver must be 21 years or over with a full unrestricted licence). Petrol is not included and if the winner cannot take the car hire in line with the applicable rental terms, this element of the prize will be forfeited;
A Day-Pass to Cape Wickham Links. Pass includes Carts, Club Hire & Access to the course. This element of the prize is not available from May to October 2018 and if the winner elects to take the drip during these dates, the winner will forfeit this element of the prize and will not receive cash or any other prize in lieu;
Tasting experience & Cheese & Wine platter at the King Island Dairy Cheese Store;
A dinner at a restaurant on King Island up to the value of $800;
Exclusive tasting experience at King Island Cheese store;
Cheese & wine platter tasting (and take away cheese pack for the winner); and
A cheese prize pack for the winner only (this element of the prize will not be awarded during the trip and will be delivered to the winner’s address at a time specified by the Promoter). Contents of the cheese pack will be determined by the Promoter in its discretion.
If flights are required, the following conditions apply:
-     If the prize winner and companions are from Victoria, they will fly from either Essendon Airport or Moorabbin Airport – winner’s choice;

-    If the prize winner and companions are from Tasmania, they will fly from Burnie Airport or Launceston Airport – winner’s choice;

-     If the prize winner and companions are from South Australia, they will fly from Adelaide Airport or Port Augusta Airport – winner’s choice

-     If the prize winner and companions are from any other state or territory they will fly to Adelaide airport and then to King Island from Adelaide.

Major prize is valid for four (4) adults. All elements of the prize are subject to availability at time of booking. The winner must take the prize within 12 months of the major draw but subject to Island accommodation availabilities.  If for any reason the winner does not take the prize and complete the relevant holiday within 12 months or, once the prize has been booked, take the prize or an element of the prize by the date stipulated, then the prize or that element of the prize will be forfeited without further compensation. All activities must be redeemed at once (i.e. over the course of three (3) nights/days) and the winner may not change the activities of the prize. The winner and his/her companion must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in agreement with the winner but in the event that agreement cannot be reached, the Promoter reserves the right to determine the itinerary.   
All other expenses, not specifically stipulated in the prize description above, remain the responsibility of the prize winner and his/her nominated travel companions as incurred, including but not limited to: any fees payable to airlines or suppliers for booking changes once a booking is confirmed and ticketed; spending money; additional meals (other than those included); taxes (except where otherwise stated); additional travel and transfers; transport to and from departure point, items of a personal nature; in-room charges; gratuities; optional activities and any other ancillary costs, including but not limited to insurance and any applicable insurance excesses. Accommodation partner will require the winner’s credit card details for security purposes and incidentals incurred outside of what is outlined in these Terms And Conditions. The winner and their companions must comply with the Airbnb terms of stay and must not cause any damage to the property. The winner and their companions will be responsible for their own behaviour and will be liable for any damage to the accommodation property and any other travel partner’s property. Such costs will not be covered by the Promoter. All tours are subject to availability and weather conditions permitting. Should the winner not have three (3) guests, the remaining value of the prize will be forfeited and not exchanged for cash or additional prize value.
MINOR PRIZES

The first valid entry drawn in each minor draw will win a minor prize pack valued at $200 consisting of the following:

2 x wine bottles (MOUNT20115 Mountadam 2015 Chardonnay 750ml & BALLA30617 Ballabourneen 2017 Shiraz Pinot 750ml); and
1 x King Island Dairy Cheese Gift Pack containing:
1 x Brie Baker

Elements of the minor prize pack may be dispatched from different suppliers and arrive to the winner’s address at different times. As such, the cheeses, wines and cheese accessories might and will likely all arrive separately to the winner’s nominated Australian address. Winners should ensure that they or someone else is at home at the time prizes are delivered. If a winner is not at home, cheese might be melted due to external temperature and loose quality of texture and change in taste. If the winner or any person the winner provides access to cheese or alcohol has a dairy allergy, any other allergy or alcohol consumption issues, it will be the winner’s responsibility to ensure the cheese and/or alcohol is not consumed and is disposed of in a safe manner. Each winner acknowledges that any such issues are not the responsibility of King Island Dairy and/or the Promoter and King Island Dairy and the Promoter exclude all liability regarding the same.
All cheese products, cheese accessories and wines contained in the minor prize packs will be awarded in two delivery batches, one at the first six (6) week mark, for winners drawn by that date, and one at the twelve (12) week mark, for winners drawn by that date, due to expiry dates of the cheese products in the prizes.
No more than 20 litres of alcohol will be won by New South Wales residents.
GENERAL

Total prize pool value is up to AU$8,600.
All other costs (except for those mentioned as included) associated with a prize or taking of a prize will be the responsibility of the prize winner. Each prize is subject to the standard terms and conditions of individual prize and service providers.
In the event that a prize (or part of a prize) is/are not available, the Promoter and their prize suppliers reserve the right to substitute the prize (or part of the prize) in their discretion to the same and equal recommended retail value and/or specification, subject to any written directions by a regulatory authority.
The Promoter encourages consumers to enjoy alcohol responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines that are available at www.nhmrc.gov.au.
Subject to the unclaimed prize draw clause, if for any reason the winner does not take or claim a prize (or an element of a prize), by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
If a prize (or part of a prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.
The prizes, or any unused portion of the prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
A draw for the major prize, if unclaimed, may take place on 12/11/2018 and draws for the minor prizes, if unclaimed, may take place as mentioned on the table above (clause 9) at the same time and place as the original draws, subject to any directions from a regulatory authority. The winner/s will be notified via phone and in writing within two (2) business days of the draw. The winner/s name/s will also be published online at https://www.wineselectors.com.au/competitions/competition-winners from 14/11/2018. In the event of a winner (major prize only) from SA, their name will also be published in The Advertiser on 16/11/2018.
Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the promotional website or the Internet in relation to this promotion is the entrant’s responsibility and is dependent on the Internet service provider used.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and King Island Dairy (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and King Island Dairy (including their respective officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury, illness or death; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in the prize value to that stated in these Terms and Conditions; (e) if a promotional stand is not present or is relocated for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) taking/use of the prize (or part of a prize) and/or failure to receive delivery of the prize and/or failing to store and use the prize in accordance with directions.
The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.wineselectors.com.au/privacy-policy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian privacy laws or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia.
As a condition of accepting the major prize, the winner and his/her companions must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
