1. Following Terms & Conditions of use together with our privacy policy (collectively, Terms) form the agreement between You and Us in relation to Your use and access of this website and the supply of wine ordered by the website.

2. By accessing this website, you acknowledge that you are 18 years or older and have read and understood the terms and that you agree to be bound by the terms. If You do not agree to the terms or have not reached 18 years of age then you must not use this website.

3. We may change these website terms at any time without notice. Please review these website terms regularly to ensure you are aware of any changes made.

4. “Our”, “We”, and “Us” means Mark’s Vineyard Pty Ltd and “You” and “Your” means the customer having an account with us or placing an order with us.

ORDERING
1. To purchase goods via the website you may create an account or check-out as a guest.  In order to create an account you must provide personal details and contact information. Regardless of whether you create an account or check out as a guest, you warrant that the details you provide to us are accurate and correct and you accept the responsibility that fulfilment of your order is predicated on the information you have provided to us is correct at the time of ordering.  If you create an account your details may be updated at any time when you log into your account.

2. By placing an order with us, you are confirming that you are 18 years or older. It is illegal for us to sell alcohol to anyone under the age of 18. If you purchase products from us through the site, you warrant to us that:

2.1 you are over the age of 18 years; and

2.2 any person that you are obtaining the products for, or supply the products to, is over the age of 18 years.

3. When you give us your credit or debit card details you are confirming that you are either the card holder, or that you have permission from the card holder to use the card for the purpose of ordering wine from us.

4. The delivery address supplied by you must be in Australia. We are not permitted to ship product internationally.

5. For retail customers, the full payment for your order will be deducted from your credit card on completion of your order.  Delivery will not commence until payment has been processed/validated.  Full Trade purchase terms and conditions can be viewed here.

6. Mark’s Vineyard accepts payment by Visa and MasterCard.  All credit card details are processed using the Merchant Warrior Level 1 PCI compliant payment gateway.  Credit card data is encrypted using SSL 256 bit encryption.  Credit card data is encrypted and stored by Merchant Warrior and is only accessible by authorised personnel and is not stored by Mark’s Vineyard.

7. We reserve the right to cancel any orders we cannot fulfill for any reason. If your order is cancelled We will contact you to inform You of the cancellation and refund any money you have paid us for that order.

8. Once you submit your order, cancellations of your Order or changes to the goods in your order cannot be made. You should check your order carefully before submitting your order.

9. We only ship in cases containing 12 bottles. We cannot accept any orders for less than 12 bottles and will only ship full case quantities.

10. Upon successful completion of your order you will receive confirmation by email with a tax invoice attached.

11. We collect and use your personal Information in accordance with our Privacy Policy, which can be viewed here.

PRODUCT AVAILABILITY
1. Products offered by us are displayed on our website(s) in ‘real time’.  As we are a specialist boutique vineyard and don’t ‘buy in’ inferior quality grapes from other farmers, we only have a limited quantity of wine available, therefore, any product may be withdrawn from offer without notice at our discretion.

2. If for some reason we are unable to fulfill your exact order, we will put Your order on hold and contact you for further instructions.

3. We reserve the right to limit sales to retail quantities if we reasonably deem that the order is not within a reasonable retail quantity. If you wish to purchase unusually large orders for an event, please call us prior to placing the order so that we can accommodate you.

4. Mark’s Vineyard is 100% committed to your satisfaction.  If you are unhappy with our wines, we offer a full money back guarantee. To receive the full money back guarantee, you must communicate with us via email within 7 days of the date of delivery of the wine to you. We promise to work with you resolve any problems as quickly as possible.  If you would like to return your wine our Return Policy terms can be viewed here.

DELIVERY
1. For ease of delivery and tracking of your wine’s shipping status, you will want to make sure that someone over 18 will be available during normal business hours at Your shipping address to receive the goods.  Where possible please provide an address where you will be able to sign for receipt upon delivery.  Please note that as it is an offence to deliver wine to people under 18 our courier may require proof of age identification at the time of delivery.

2. Delivery is free to all Mark’s customers across Australia, so you won’t have any extra surprises at the checkout. Currently Mark’s Vineyard uses Australia Post to deliver to all States and Territories, with the exception of South East Queensland which is serviced by First Express and Capital Transport. Please allow 5-7 business days for Australia Post deliveries.  Deliveries to the South East Queensland will only take 1-2 business days.

3. All rural Australia Post deliveries will be left at the local Post Office for pick up.

4. If your order goes missing, or is damaged, between dispatch and delivery, we will send you a replacement order as soon as we can. If we are unable to dispatch replacement goods within 7 days We will offer You a full refund. For these purposes, delivery takes place when products are left at the delivery address specified in your order.

5. If for any reason your order is not able to be delivered to your specified delivery address a Calling Card with a contact number will be left at the specified address.  The goods will then be returned to the carrier depot.  You are responsible for contacting the carrier within 7 days of the date of the Calling Card.  Mark’s Vineyard is not responsible for goods that remain unclaimed as a result of failing to contact the carrier within the specified timeframe.

6. If a carton of wine is deemed undeliverable by the assigned carrier, the Carrier will advise us, who will then attempt to contact you to arrange re-delivery.

7. All deliveries should be inspected by you immediately upon arrival for any deficiencies and/or damages.  Claims (if any) must be lodged at the time of delivery, otherwise any breakages shall be deemed to have occurred thereafter.

8. For Trade Customers Title of the product remains with us until we receive the full price of the product from you in cleared funds. Trade terms and conditions can be viewed here.

RETURN & REFUND POLICY (NON ABN CUSTOMERS
1. Mark’s Vineyard is 100% committed to your satisfaction.  If you are unhappy with our wines, we offer a full money back guarantee. To receive the full money back guarantee, you must communicate with us via email within 7 days of the date of delivery of the wine to you.

2. Upon notification we will contact Yyu to advise the delivery address that the wine can be returned to.  All delivery costs for the return of the wine are at your expense.

3. All goods being returned must be unopened and in good order.

4. Upon receipt and validation of returned goods to Mark’s Vineyard, a credit will be arranged.

SOCIAL MEDIA
1. Mark’s Vineyard enjoys interacting with you on public social media platforms via its company and individual accounts.  If you respond to our brand’s questions, posts or otherwise post content on or via our official presence via these platforms, we may use or republish your posted text, photo, video or other materials (“Content”) as outlined below.  Our official brand presence on social media includes Facebook, Twitter, Instagram, Pinterest, LinkedIn, Google+ and YouTube.

2. If you post a comment on any of our Social Media or Blog pages incorporated within the site your comments will be in the public domain and will be visible to anyone who visits the site. We remind you to be respectful to others when making any statement on social media and be aware that you are personally responsible for all communications which will be published on the internet for anyone to see.  You must not post a comment that is offensive, unlawful, obscene or defamatory.  You are solely responsible for all posts listed using your account, whether the post was authorised or not.  We will look to remove all content that is unlawful, offensive and/or breaches advertising standards.

3. If you post a comment on our website or Social Media accounts, you agree that we can publish the post to promote the wine or Mark’s Vineyard, without the need to reference you when we do so – even though we most likely will.

4. Wine ratings and comments posted by you will be fed through to the relevant wine page, and therefore visible to anyone who visits the site.
