1. These Terms and Conditions apply to the Gift Voucher Promotion (“Promotion” or “Competition”) conducted by Autopia Management Pty Limited ABN 80 111 369 049 (“Autopia” or the “Promoter”).
2. Information on how to enter and information about prizes form part of these Terms and Conditions. By entering, entrants accept these Terms and Conditions.
Method of Entry & Eligibility
3. Entry is open to Australian residents aged 18 years or over who sign up to the “Autopia Deals” mailing list for the first time and are still subscribed at the end of the Promotional Period (defined below). Existing Autopia Deals subscribers are not eligible to enter. The Promoter will verify eligibility for all entrants. The directors, management and employees of the Promoter, and their immediate families, as well as the Promoter’s related companies, agencies and suppliers are not eligible to enter.
4. To enter the eligible individual must, during the Promotional Period, sign up to Autopia Deals mailing list via Autopia’s website

http://novated.autopia.com.au/welcome/ or through Autopia’s Facebook Ads. It is not sufficient to “like” or follow Autopia’s Facebook page to enter the Promotion. Once registered and opted in to the Autopia Deals mailing list, they enter the draw to win.
5. There is only one valid entry per person during the Promotional Period. There is no entry fee and no purchase necessary to enter this Competition.
Promotional Period
6. Promotion opens at 8:00AM AEST on Monday, 16 April 2018 and closes at 11:59 PM AEST on Friday, 29 June 2018, (“Promotional Period”).
Prize Details and Winner Selection
7. There will be 1 (one) winner of the Promotion, who will receive 1 (one) AU$1000 Adrenaline Gift Voucher. Adrenaline Pty Ltd (“Adrenaline”) is not affiliated with the competition. The Adrenaline logo is a registered trademark of Adrenaline.
8. The prize winner will be chosen at random by software provided by
https://www.randompicker.com/ from all entries received and verified by Promoter or its agents. The draw will take place at 404/247 Coward Street, Mascot NSW 2020 (“Autopia’s Headquarters”) on Tuesday, 3 July 2018 at 12:00PM AEST.
9. This is a game of chance. The winner will be selected randomly by a draw from all entries received.
10. The Promoter does not take any responsibility for the cost of, or any other expenses related to participation in this Competition, such as any expenses associated with the entrant’s access to Autopia’s website, microsite or Facebook Ads or Autopia Facebook page, including but not limited to the cost of Internet connection or bandwidth usage.
11. The use by an individual of any agencies or automated software to submit entries will void all entries submitted by that individual. The Promoter will not accept any responsibility for entries not received by the Promoter for whatever reason.
Announcement of Winners and Method of Prize Claim
12. The winner will be announced via the Autopia website and Autopia official Facebook page by Friday, 6 July 2018.
13. The winner will be notified by email within two (2) business days of the draw, using the email address provided by the winner at the time of entry in the Competition. If the winner cannot be contacted or does not claim the prize within 14 days [can we include a date for this and define it as a “Prize Claim Date”?] of notification being sent by the Promoter to the winner’s email address, the Promoter reserves the right to withdraw the prize from the winner and choose a replacement winner.
14. If any prize is unclaimed by the Prize Claim Date, all entrants in the Competition will also be entered into the unclaimed prize draw. The unclaimed prize draw will take place on Monday, 23 July 2018 at Autopia’s Headquarters at 12:00PM AEST, subject to any directions from a regulatory authority. The winner of the unclaimed prize draw will be notified by email within two (2) business days of the draw, using the email address provided by the winner at the time of entry in the Competition. The name of the winner (if awarded in the unclaimed prize draw) will be published on Autopia’s website on Monday, 30 July 2018.
15. The Promoter will send the prize to the winner within 28 days of the initial draw or the unclaimed prize draw, as the case may be.
General Conditions
16. The total value of the prize pool is valued at up to AU$1,000 (including Australian Government GST). The prize or any unused portion of the prize is not transferable or exchangeable and cannot be exchanged or redeemed for cash.
17. Unless expressly stated within these Terms and Conditions, all expenses incurred in connection with participating in this Competition are the responsibility of entrants.
18. The Promoter reserves the right to cancel the Promotion and amend these Terms and Conditions without notice to the entrants in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of the Promoter’s control. Any changes to the Promotion for any other reasons will be notified to entrants as soon as reasonably possible by the Promoter.
19. The Promoter’s decisions in respect of all matters in relation to the Competition will be final, and no correspondence will be entered regarding those decisions.
20. As a condition of accepting a Prize, each winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form (including relating to the use of Adrenaline Gift Voucher).
21. In the event that an Adrenaline Gift Voucher is/are not available, the Promoter reserves the right to substitute it prize in its discretion with a prize of the same and equal recommended retail value and/or specification, subject to any written directions from a regulatory authority or legislation.
22. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:
a. to disqualify any entrant from participating in the Promotion; or
b. subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
23. The Promoter reserves the rights to:
a. in its sole discretion, disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions or engaged in any unlawful or other improper conduct calculated to jeopardise the fair and proper conduct of the Promotion;
b. recover damages or other compensation from such an individual;
c. request winners to provide proof of age, identity and residency at the nominated prize delivery address. Identification considered suitable for verification is at the discretion of the Promoter;
d. conduct security verification checks at its absolute discretion. Prize winners may be required to sign a declaration confirming their eligibility to accept the prize.
24. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010, as well as any other implied warranties under similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”).
25. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including but not limited to:
a. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
b. any theft, unauthorised access or third party interference;
c. any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
d. any variation in prize value to that stated in these Terms and Conditions;
e. any tax liability incurred by a winner or entrant; or
f. use of a Prize.
26. This Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter or any other social network.
Privacy
27. By submitting your entry to the Competition, you consent to the Promoter collecting your personal information ("PI") in order to conduct the Promotion. The Promoter may, for the purpose of conducting the Promotion, disclose such PI to third parties, including but not limited to its related bodies corporate (as defined in the Corporations Act 2001 (Cth)), agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing such PI. Subject to paragraph 28 below, the Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at

In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, unless otherwise requested by the entrant, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages to or telephoning the entrant. The Privacy Policy also contains information about how participants may opt out, access, update or correct their PI and about making privacy complaints All entries become the property of the Promoter.
28. Participants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without compensation to you for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
