CONDITIONS
This competition (“Competition”) is conducted by Coca-Cola South Pacific Pty Ltd, ABN 50 003 029 794, of Level 9, 40 Mount St, North Sydney, NSW 2060 (“Promoter”). Phone number 1800 025 123.
Entry into the Competition constitutes acceptance of these conditions. All entry instructions and prize information published by the Promoter form part of these conditions (“Conditions”).
Only open to “Eligible Entrants”. An Eligible Entrant is an individual who is an Australian resident aged 13 years or over as at time of entry, excluding any: (i) employee of the Promoter or any of its related corporations or any of their agencies associated with the Competition; (ii) employee of Coca-Cola Amatil (Aust) Pty Ltd, ABN 68 076 594 119 (iii) spouse, defacto spouse, parent, child or sibling (whether natural or by adoption) of an excluded employee; and (iv) person who the Promoter has previously notified is not permitted to enter the Promoter’s competitions. Eligible Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the Eligible Entrant must read and consent to these Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this Competition.
Competition opens 00:01hrs on 03/06/2018 and ends at 24:00hrs on 15/07/2018 ("Competition Period"). All times and dates are times and dates in Sydney, which will be Australian Eastern Standard Time (“AEST”) during the Competition Period. All times are stated using the 24-hour clock. 00:01 hrs is the start of a day and 24:00 hrs is the end of the day.
To be eligible to enter, Eligible Entrants must undertake the following steps during the Competition Period:
Purchase a specially marked FIFA POWERADE product during the Competition Period (“Eligible Products”) from any retailer that stocks Eligible Products nationally. Eligible Products include specially marked bottles of:

POWERADE ION4 Berry Ice 600ml
POWERADE ION4 Lemon Lime 600ml
POWERADE ION4 Blackcurrant 600ml
POWERADE ION4 Pineapple Storm 600ml
Each Eligible Product will include on the label, a promotional code (“FIFA Code”).
To enter and see if the Eligible Entrant has won an instant prize, Eligible Entrants must undertake the following steps during the Competition Period:

input the requested details including the FIFA Code from the Eligible Product; and
submit the fully completed online entry form.
Each Eligible Entrant will be notified instantly online whether or not they are an instant winner of an instant prize. All valid entries received from non-winners of an instant prize will automatically be placed in the 2nd chance draw for any unclaimed prizes at the end of the Competition Period.
This is a game of chance and skill plays no part in determining the winners.
Eligible Entrants must retain original promotional labels for each Eligible Product used to enter, clearly showing the FIFA Code(s) for all entries as proof of purchase. Failure to produce the original labels for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an Eligible Entrant’s entries and forfeiture of any right to a prize.
Any cost associated with accessing the competition microsite is the Eligible Entrant’s responsibility and is dependent on the internet service provider used.
The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an Eligible Entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Competition. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
Incomplete or indecipherable entries will be deemed invalid.
Multiple entries are permitted, subject to the following: (a) each entry must be submitted separately and in accordance with entry requirements; (b) only one (1) FIFA Code per entry is permitted; (c) the same FIFA Code cannot be used more than once; (d) unrecognised codes will be deemed invalid; and (e) a limit of one (1) entry is permitted per Eligible Entrant per day during the Competition Period
The Promoter will use a computer drawing system to randomly determine one hundred (100) winning times for each day during the Competition Period (the “Winning Times”). The first valid entry that is received on or after each Winning Time, will be deemed an instant winner of that prize.
The instant win prizes available to be won during the Competition:
4,300 x Powerade Soccer Balls valued at $25.00 RRP each.

Winners of an Instant Prize will be notified instantly, in writing, online as to whether or not they are an instant winner (“Instant Winner”). Instant Winners will be published online at
www.Powerade.com.au from 10/08/2018. If an Instant Winner is subsequently found not to be an Eligible Entrant, or their entry is deemed invalid under these Conditions, the Instant Prize will be awarded in the Unclaimed Prize Draw.
If the winner of any Instant Prize is under the age of 18 years, the Instant Prize will be awarded to the winner's nominated parent or guardian on the winner’s behalf.
The Promoter’s decision is final and no correspondence will be entered into.
Total prize pool value is up to AUD$107,500.00.
Instant Prizes are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified. No responsibility will be accepted by the Promoter for late, lost or misdirected prize claims.
A draw for any unclaimed Instant Prizes may take place on 17/10/2018 at Handling Matters, Unit 40 Thew Parade, Cromer, NSW 2099 at 10.00hrs subject to any directions from a regulatory authority. Winners, if any, will be notified in writing within two (2) business days of being drawn and will be published online at
www.Powerade.com.au from 16/11/2018.
Quality control errors will not invalidate an otherwise valid Instant Prize claim. Unless otherwise due to fraud or ineligibility under these Conditions, if a quality control error occurs, all valid Instant Prize claims in excess of the advertised prize pool will be honoured. Instant win notification messages are void if stolen, forged, mutilated or tampered with in any way.
Eligible Entrants consent to the Promoter using the Eligible Entrant's name, likeness, image and/or voice in the event they are an Instant Prize winner (including photograph, film and/or recording of the same) in any media (including social media) for an unlimited period without remuneration for the purpose of promoting this Competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
It is a condition of accepting an Instant Prize that the winner must comply with all the conditions of use of the relevant Instant Prize and the relevant Instant Prize supplier’s requirements.
As a condition of accepting an Instant Prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. In the event a winner is under the age of 18, a nominated parent/legal guardian of such person will be required to sign the legal documentation required under this clause on their behalf.
If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition, subject to the approval of the authorities that have issued permits for its conduct.
The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any Eligible Entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise, (ii) any theft, destruction or unauthorized access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition; (iv) any incorrect or incomplete information which may be communicated in the course of the administering this Competition (whether as a result of one of the foregoing causes or otherwise); (v) any entry or Instant Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (vi) any variation in prize value to that stated in these conditions; (vii) any tax liability incurred by a winner or Eligible Entrant; or (viii) use of a prize. Individuals should obtain independent tax and financial advice.
CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS COMPETITION OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.
If any Instant Prize or any element of an Instant Prize becomes unavailable, the Promoter may substitute an Instant Prize of equal value at the Promoter’s sole discretion, subject to any written directions from the relevant authorities.
To the full extent permitted by law, the Promoter, its related companies (including but not limited to Coca-Cola Amatil (Aust) Pty Ltd ABN 68 076 594 119) and agencies, prize suppliers and all those entities' personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Entrant in connection with the Competition or Instant Prizes, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death. Nothing in these Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia.
Eligible Entrants' personal information will be collected by or on behalf of the Promoter to enable it to administer the Competition and publicise its winner(s). The personal information of each winner may be provided to others assisting in the conduct of the Competition, including the Competition administrator, prize suppliers and deliverers, and to regulatory authorities. Persons may contact the Promoter at
privacyofficerau@coca-cola.com to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If an Eligible Entrant does not provide accurate personal information the Promoter may determine that they are not eligible to win a prize. The Promoter will also use and handle personal information as set out in its Privacy Policy, which can be viewed at
https://www.powerade.com.au/privacy-policy. The Privacy Policy also contains information about how Eligible Entrants may opt out, access, update or correct their personal information, how Eligible Entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. Entrants’ personal information collected will be shared with overseas third parties who provide services to the Promoter in order to conduct the Competition. These overseas locations are noted in the Promoter’s Privacy Policy. By registering for the Competition, Eligible Entrants consent for this to occur. Do not register for the Competition if you do not consent for your personal information to be shared with overseas recipients.
