Lord Mayor's Photographic Awards 2018

Terms and conditions

1. Eligibility

1.1 To be eligible to enter the Lord Mayor's Photographic Awards (the Awards), a person must:

(a) be an Australian resident from the Brisbane Local Government Area (Brisbane LGA) and if requested, be able to provide evidence of such residency;


(b) not be an employee, contracted staff or Councillor of Brisbane City Council (Council); and

(c) fully and legibly complete all details on the official entry form.

1.2 All images must:

(a) have been taken within the Brisbane LGA;

(b) have been taken after 1 January 2018;

(c) be submitted in JPG format. Entrants may submit colour or black and white images;

(d) have a minimum dimension of 612 pixels along both sides of the image. 72dpi is acceptable but 300dpi is preferred; and

(e) be the original work of the entrant. No third party may enter on behalf of another individual unless a parent entering on behalf of a minor.


1.3 Entrants:

(a) are limited to one image per person;

(b) must include a brief artist statement of up to 30 words to describe the submitted image; and

(c) are permitted to use post processing (e.g. Instagram filters, Photoshop and similar software) on images.

1.4 The entrant should have the written, signed and dated permission of any people appearing in the image submitted. 1.5 Council reserves the right to refuse display of any entry deemed unsuitable for public exhibition, or be associated with any social media accounts that are deemed unsuitable. This includes material that contains swearing, nudity, racist, sexist or political comment, political satire, political criticism, smoking, alcohol, unsafe behaviour, destruction and/or vandalism of public property or may otherwise be potentially embarrassing to Council.

2. Categories
2.1 The Categories

(a) There are three categories for the Awards:

(i) the Open category;

(ii) the Student category; and

(iii) The Social Media Hashtag category.


(b) Entrants for all categories (other than the Social Media Hashtag category) must specify on their entry form which category they are entering.

2.2 Additional criteria for the Student category

The Student category is only open to students currently studying at a registered educational institution within the Brisbane LGA, and who are living and residing in the Brisbane LGA. Entrants may be required to provide proof of current student status before being awarded a prize. This may be in the form of a student identification card or number.

2.3 Additional criteria for the Social Media Hashtag category

(a) Only entries submitted via Instagram using the hashtag #LMPA2018 are eligible for entry into the Social Media Hashtag category.

(b) Entries submitted via Instagram are eligible to win the Social Media Hashtag, People’s Choice, Open, or Student prizes, provided they meet the requirements of each category.

(c) Entries using the hashtag (#LMPA2018) via Instagram must be posted using a public account during the Awards’ period (11 July-8 August 2018) and belong to a permanent Australian resident of the Brisbane LGA to be valid entries.
(d) Social Media Hashtag category entries must have been uploaded during the Awards timeframe. Hashtags may not be edited into descriptions or added as a comment on old images. Photographs, photocopied reproductions or any other recreation of images taken before 1 January 2018 will not be accepted.

(e) Social Media Hashtag category entrants will be shortlisted to 20 entries for judging purposes. Shortlisted entrants will be contacted by 5pm on Thursday 9 August 2018 and asked to accept these terms and conditions published on lmpa.brisbane.qld.gov.au. Only those entries who accept the terms and conditions prior to 5pm on Friday 10 August 2018 will progress through to the judging panel round of the Awards.

(f) There will only be one Social Media Hashtag category winner and the winning entry will be determined by a judging panel appointed by Council.

3. How to Enter
3.1 All entrants must complete all sections of the online entry form.

3.2 Entries open at 10am on Wednesday 11 July, and must be submitted online via the Awards’ website or Instagram by 5pm on Wednesday 8 August 2018.

3.3 Late, incomplete, incorrectly submitted, or ineligible entries will not be accepted. Delays or failures in technology will not be considered.

3.4 Only digital files and social media submissions will be accepted as eligible entries. Prints or entries on CD/DVD will not be accepted.

3.5 All files must be named: entrant-name_title-of-work (e.g. John-Smith_my-Brisbane) and be dated excluding those entered via Instagram.

3.6 Entrants may be required to submit their entry via CD/DVD, USB or large file transfer mechanism with a higher resolution version for reproduction/exhibition purposes if requested.

3.7 Personal information provided as part of entry will not be disclosed without your consent for any other purpose unless required by law.

3.8 By submitting an entry, the Entrant agrees to be bound by the terms and conditions outlined in this document.

4. Judging and Prizes
4.1 All entries will be judged by a panel made up of industry professionals and Council representatives. Council reserves the right to make the final decision regarding all winners and allocation of prizes.

4.2 People’s Choice Award finalists will be decided by public popular vote. All other categories will be awarded by the judges. The decision of the judges will be final.

4.3 Every approved entry will be considered for judging.

4.4 Prizes are as stated on the Awards’ website.

(a) Open category winner will receive $5,000 prize money.

(b) Open category first runner-up will receive $2,000 prize money.

(c) Open category second runner-up will receive $1,000 prize money.

(d) Student category winner will receive $3,000 prize money.

(e) People's Choice Award winner will receive $2,000 prize money.

(f) Social Media Hashtag category winner will receive $1,000 prize money.

4.5 Winning entries for the Open and Student categories and finalist entries for the People’s Choice category will be notified by phone, letter or email by Friday 24 August 2018. The Lord Mayor or representative will announce winners by 27 August 2018.

5. Voting
By voting for entries in the People's Choice Award voters agree to be bound by the following terms and conditions:

(a) Online voting for the People's Choice Award opens at 10am on Monday 27 August 2018 and closes at 5pm Monday 24 September 2018;

(b) Eligibility to vote: To be eligible to vote, a person must fully and legibly complete all the details on the voting form;

(c) Based on popular vote, the image with the most public votes will be deemed the overall winner. Only one image will be awarded the People's Choice Award. This winner will be awarded the prize money as set out in clause 4.4(e);

(d) In the event of a tie when judging the People's Choice Award, the judging panel of the Open and Student category will have the final vote to determine one winner; and

(e) Important – Privacy Consent: No information given by voters will be stored on any database. Records of voters’ personal information will not be retained by Council.

6. Copyright and Moral Rights
6.1 Upon submission of an entry to the Awards, you, as the owner of the image grant Council the right to:

(a) maintain a copy of the image for archival purposes;

(b) publish on Council's website and social media platforms (including but not limited to Instagram); and

(c) allow the image to be reproduced and/or exhibited by Council and its subsidiaries and related companies. This consent is perpetual, nonexclusive transferrable and royalty free.

6.2 You warrant that you are the owner of all copyright of the images or have obtained all necessary approvals to permit the submission of the image to the Awards.

6.3 While you retain copyright of the image, you grant permission for the image to be used for promotional and publicity purposes relating to the Awards and Council and for the image to be promoted through social media platforms (including but not limited to Instagram).

6.4 Council will acknowledge the image owner in all publicity of the image as the creator and owner of the image.

6.5 While Council will take care to ensure the quality and integrity of the reproduced artwork, you acknowledge that enlargements and slight variations to the image may result from adapting the original artwork to the large-scale format required for presentation.

6.6 The winning images may be featured on the cover of the Live guide during 2018-19. Live is a publication which promotes Council's arts and cultural events, workshops and activities across Brisbane. No additional financial benefits will be paid to the image owner for this use.

6.7 Any inadvertent failure of Council, or failure of a third party, to accord proper attribution shall not entitle you to withdraw your consents and approvals given in these terms and conditions.

7. General Conditions
7.1 Council reserves the right to modify these terms and conditions at any time and to cancel or amend the Awards and/or the voting process at any time without notice or further recourse to the entrants or to voters.

7.2 Council accepts no responsibility whatsoever for late, misplaced, lost or ineligible entries. Council makes no representations or warranties as to the quality, suitability or merchantability of the prizes. To the extent permitted by law, Council is not liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss which includes but not limited to loss of actual or anticipated profit, loss of goodwill, loss of reputation, loss of opportunity, loss of savings and/or loss of contract) or for any personal injury sustained in connection with the entry into the Awards or acceptance of the prize. This clause 7.2 is not intended to exclude any liability which cannot be excluded under Australian consumer protection laws. Any such liability is limited to the resupply of the prize.

7.3 Force Majeure: If for any reason these Awards is not capable of running as planned (including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of Council), which corrupts or affect the administration, security, fairness, integrity or proper conduct of these Awards, Council reserves the right, in its sole discretion, to take any action that may be available, and to cancel, terminate, modify or suspend the Awards. Council reserves the right in its sole discretion to disqualify all entries from any individual who tampers with, or benefits from tampering with, the entry process which as a result corrupts or affects the administration, security, fairness, integrity or proper conduct of the Awards.

7.4 In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; Council may in its absolute discretion cancel the Awards and recommence it from the start on the same conditions.

7.5 This promotion is powered by Woobox which is based in the United States of America. Woobox does not sponsor, administer or endorse these Awards. Information provided by entrants and voters for the Awards will be transferred to Woodbox’s server in the United States of America. By entering in the Awards or voting for the People’s Choice Awards, entrants and voters agree to the transfer of this information. Entrants and voters must read and agree to Woobox's Terms & Conditions of Use and Privacy Policy before voting or participating in these Awards.

7.6 The Awards is being presented and promoted by Brisbane City Council ABN 72 002 765 795 acting through Connected Communities branch, Lifestyle and Community Services whose principal offices are at Brisbane Square, 266 George Street, Brisbane.

8. Privacy Policy
By entering into the Awards, the entrant acknowledges that their personal information will be collected and stored by Council for the purpose of conducting the Awards. The personal information you provide in your entrant will be protected in accordance with Council’s obligations under the Information Privacy Act 2009 (Qld)
