TERMS AND CONDITIONS:


On entering this competition you are agreeing to the following terms and conditions:



1. STANDARD TERMS

1.1 Information on how to enter forms part of the terms of entry. Entry into the promotion is deemed acceptance of these conditions of entry.

1.2 This is a game of chance and the winner will be drawn randomly.


2. WHO CAN ENTER?

2.1 Subject to clause 2.2, entry is open only to permanent residents of Australiaover 18 years of age.

2.2 Employees and families of the Promoter or the prize suppliers or any of their agenciesassociated with the Competition or Programare not eligible to enter. This includes a spouse, de-facto spouse, parent, child or sibling (whether full, half, step or by adoption)

3. HOW TO ENTER

3.1 Simply fill out the details on the entry form to go into our draw. One entry per person only.

3.2 The Prize is subject to the standard terms and conditions of the concert venue provider.

3.3 Entry via the Facebook page requires a personal Facebook account.

3.4 Failure to comply with the above conditions or complete all fields required will deem the entry invalid and no correspondence will be entered into.



4. CRITICAL DATES



4.1 The promotion starts 9am Monday 23rd July and concludes at 1pm (AEST) on 9th of September 2018.

4.2 The weekly prize draws will take place at 3pm (AEST) at the Brand Collective office at, 332 Lorimer Street, Port Melbourne, Victoria. 3207

4.3 Winners’ names will be announced weekly on the website www.hushpuppies.com.au and on our Facebook & Instagram.





5. THE PRIZE DETAIL AND CONDITIONS OF WINNING



5.1 There are prizes to be won weekly. The first valid entry drawn will receive two (2) tickets to Australia’s hottest concert. Or Ticketek vouchers to use at their own discretion. The total prize value per week is up to $1000 r.r.p.

5.2 No purchase is required to enter.

5.3 To be eligible to win the winner must be available to attend the concert as per the date and time on the ticket nominated by the promoter.

5.4 Subject to the terms and conditions of the participating prize provider, if for any reason the winner does not, once the prize has been allocated, take the prize (or an element of the prize) at the time stipulated, then the prize will be forfeited and will not be redeemable for cash.

5.4 The prize is not transferable and cannot be redeemed for cash.

5.5 The prize does not include transport to the concert venue or accomodation or any other expenses. Winners and their guest must make their own way via transport to the concert venue and provide their own accomodation, meals and other requirements at their own expense.

5.6 As the prize is provided to the Promoter by a third party, the prize is subject to the terms and conditions of the third party prize supplier and the provision of the prize is the sole responsibility of the third party and not the Promoter. The terms and conditions which apply to the prize at the time it is issued to the winner will prevail over these Conditions of Entry, to the extent of any inconsistency. The Promoter accepts no responsibility or liability for any delay or failure by the third party to deliver the prize, any delay or failure relating to the prize itself or failure by the third party to meet any of its obligations in these Conditions of Entry or otherwise.

5.7 The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence or wilful misconduct) in connection with this Promotion or accepting or using any prize (or recommendation), except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowed by law).

5.8 It is a condition of accepting the prize that a winner and their travel companion may be required to sign a legal release as determined by the Promoter in its absolute discretion, prior to receiving a prize. If a winner or travel companion is under the age of 18, a nominated parent or legal guardian of the winner or travel companion will be required to sign the legal release on the winner or travel companion's behalf.

5.9 Winners of the prize should seek independent financial advice about any tax implications that may arise from the prize winnings.

5.10 The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.

5.11 Entrants' personal information will be collected by the Promoter. Personal information will be stored on the Promoter's database. The Promoter may use this information for future marketing purposes regarding its products, including contacting the entrant electronically. The Promoter is bound by the Australian Privacy Principles in accordance with the Privacy Act 1988 (Cth) and its privacy policy which is located at www.brandcollective.com.au/privacy-policy/. The Promoter's privacy policy contains information about how the entrant may access, update and seek correction of the personal information the Promoter holds about them and how the entrant may complain about any potential breach by the Promoter of the Australian Privacy Principles or any other Australian privacy laws and how such complaints will be dealt with. The Promoter collects personal information about entrants to enable them to participate in this Promotion and may disclose the entrants' personal information to third parties including its contractors and including its contractors and agents, prize suppliers and service providers to assist in conducting this Promotion and to the State and Territory lottery departments as required under the relevant lottery legislation. If the entrant does not provide their personal information as requested, they may be ineligible to enter or claim a prize in the Promotion. Personal information collected from entrants will not be disclosed to any entity located outside of Australia.

5.12 In participating in the competition, the winners agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed, filmed for broadcast and photographed. The winners agree to grant the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winner (and his/her companion) will not be entitled to any fee for such use.

5.13 The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages to the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.

5.14 If a prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority. As a condition of accepting the prize, the winner must sign legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indem

5.15 The Promoter’s decision is final and no correspondence will be entered into.


1.NO LIABILITY



6.1 CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS COMPETITION OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.



6.2 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to government legislation



6.3 The Promoter is not responsible for lost, interrupted communications or unavailable server or other connections, failed telephone, mid-delivery or computer transmissions or other errors of any kind, whether human, mechanical or electronic.



6.4 If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.



6.5 The Promoter reserves the right to verify the validity of entries and to disqualify any entry of any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.



6.6 Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantee, the Promoter (including its respective officers, employees and agents) and Prize Promoter are not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity) ; whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by the winner or entrant; or (f) use of the prize.





6.7 Nothing in these Terms and Conditions limits, excludes or modifies or purports tlimit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (‘Non-Excludable Guarantees’). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
