Entering:
5.By entering the Competition, Entrants accept the Competition Terms.
6.To receive a conditional Entry/Entries in the prize draw, Entrants must do one or more of the following between 12:01am (AEST) on 1/10/2018 and 11:59pm (AEST) on 31/10/2018 (“Promotional Period”):1.Link your eBay User account and flybuys Member account and receive 5 Entries in the prize draw.

8.The Promoter may disqualify any Entrant who:1.enters the Competition without being eligible (in accordance with paragraph 4 above);
2.tampers with or manipulates the Entry process;
3.submits an Entry that is not in accordance with the Competition Terms; or
4.in entering the Competition, engages in conduct which is fraudulent, misleading, deceptive, collusive, untoward, not made in good faith or damaging to the goodwill or reputation of the Competition, the Promoter or eBay.
Failure by the Promoter to exercise its rights under paragraph 7 or paragraph 8 does not constitute a waiver of the Promoter’s rights under paragraph 7 or paragraph 8. If the Entrant’s contact details change, the Entrant must notify the Promoter.
Drawing winners
9.The Promoter will draw the Winners at random from the pool of valid Entries at 10:00am (AEST) on 7/11/2018 at Focal Promotions, Suite 1, 20 Wangara Rd, Sandringham VIC 3191.
10.The Promoter will notify Winners by email, mail or phone by 14/11/2018 and the Winners’ names and last 3 digits of their flybuys card number will be posted at

11.Subject to the Promoter’s rights under paragraph 7 or paragraph 8, the first valid Entry drawn by the Promoter will win the First Prize*, the next 10 valid Entries drawn by the Promoter will each win a Second Prize**, and the next 100 valid Entries drawn by the Promoter will each win a Third Prize***.
12.The awarding of prizes is restricted to one prize per flybuys account except for SA.
Awarding prizes
13.Each prize will be automatically allocated to the flybuys Account associated with the Winner’s Entry by 28/11/2018.
14.The first drawn Winner will receive the First Prize, the next 10 drawn will receive the Second Prizes and subsequent 100 drawn Winners will receive the Third Prizes.
15.The Promoter may request that the Winners provide proof of identity, proof of age or proof of residency to the Promoter’s reasonable satisfaction before awarding the prize.
16.If the prize is undeliverable or returned to the Promoter by 14/02/2019, or if upon request a Winner does not provide proof of identity, proof of age or proof of residency to the Promoter’s reasonable satisfaction by 14/02/2019, then the relevant Winner will be deemed to have forfeited their entitlement to their prize. In those circumstances the Promoter may redraw the prize in accordance with paragraph 18.
17.In consideration of the Promoter awarding the prize to the Winner, the Winner:1.consents to the Promoter, without royalty or any fees, using his or her name, likeness, image, voice and Entry in any marketing and promotion of the Competition, the Promoter or the Promoter’s business;
2.agrees to use the prize in accordance with the supplier’s specified conditions and requirements; and
3.agrees that the prize is not transferable or exchangeable and cannot be taken as cash.
18.If the prize is unavailable, the Promoter may substitute the prize with a substitute prize, provided that the substitute prize is of the same or similar value or specification as the prize, subject to state authority approval.
Further Draw
19.If for any reason, there are prizes that have not been awarded by 14/02/2019; the Promoter may conduct a further draw from the pool of valid Entries at 10:00am (AEDT) on 15/02/2019 at Focal Promotions, Suite 1, 20 Wangara Rd, Sandringham VIC 3191.
20.The first drawn valid Entry the Promoter draws is the Winner, subject to the Promoter’s rights under paragraph 7 or paragraph 8.
21.The Promoter will notify all further draw Winners by email and/or mail by 22/02/2019 and the Winners names and last 3 digits of their flybuys card number will be posted at

Force majeure
22.If there is a force majeure event which prevents or materially and adversely affects the Promoter’s ability to market, promote and run the Competition in accordance with the Competition Terms, the Promoter may cancel, terminate, modify, suspend or postpone the Competition, subject to State Licensing Authorities approval.
Liability
23.Neither the Promoter, nor eBay is liable for any loss, expense, damage or liability suffered or incurred by Entrants and Winners in connection with the Competition, including without limitation:1.any late, lost, altered, damaged or misdirected Entries or prize acceptance, including delays due to technical disruptions or network congestion;
2.any incorrect or inaccurate information caused by equipment or programming associated with or utilised in the Competition;
3.any technical error, including any omission, interruption, deletion, defect, delay in operation or transmission or communications line, telephone, mobile or satellite network failure; and
4.any theft, destruction, unauthorised access to or alteration of Entries; and
5.any use of the prize or any tax liability incurred by the Winner as a result of accepting the prize.
24.Nothing under paragraph 22 is intended to limit Entrants or Winners’ rights under the Australian Consumer Law (“ACL”).
25.This promotion is in no way sponsored, endorsed or administered by, or associated with any social media platform and no social media platform is liable for any loss, expense, damage or liability suffered or incurred by Entrants and Winners in connection with the Competition.
