TERMS AND CONDITIONS
1. The following definitions apply to these Terms and Conditions:
a) “Closing Date” means 11.59hrs on 24th October 2018
b) “Commencement Date” means 00.01hrs on 10th October 2018
c) “Determination Date” means 10:00hrs on 25th October 2018
d) “Entrant” means a person who enters the Promotion.
f) “Prize” means a prize offered in the Promotion.
g) “Promoter” means Discount Drug Stores Pty Ltd ABN 54067616826, of 56-58 Jephson St, Toowong, QLD 4066.
h) “Promotion” means this competition.
i) “Promotion Period” means the period between the Commencement Date and the Closing Date.
l) “Website” means the Discount Drug Store website,
www.discountdrugstores.com.au.
m) “Winner/s” means the Entrant who wins the Prize.
n) “Unclaimed Prize Determination” has the meaning set out in clause 21.
o) “Unclaimed Prize Determination Date” means 29th October 2018
2. All times and dates are times and dates in Brisbane, which is AEST time. All times are stated using the 24-hour clock. 00:00hrs is the start of a day and 24:00hrs is the end of a day.
PARTICIPATION
3. The Promotion is conducted by the Promoter.
4. Entry to the Promotion constitutes acceptance of these Terms and Conditions. By entering the Promotion, Entrants accept and acknowledge full responsibility for their decision to participate in the Promotion and to take the Prize if they are the Winner.
5. All entry instructions and prize information published by the Promoter form part of these Terms and Conditions.
6. An Entrant is eligible to win the Prize if they:
a) Are a permanent resident of Australia; and
b) Are over the age of 18;
And are not:
c) Employees of:
1) The Promoter, Discount Drug Stores;
2) Any of the Relevant Parties; or
3) A spouse, de facto spouse, parent, child or sibling (whether natural or by marriage or adoption) of a person who is an employee of any of the entities listed in paragraph (c) above.
7. Entry to the Promotion commences on the Commencement Date and closes on the Closing Date.
ENTRY
8. To enter the Promotion, an Entrant must, during the Promotion Period:
a) Purchase two or more vitamins at any Discount Drug Store from 10th – 24th October 2018; and
b) Fill out all of the required data entry fields on the website entry form.
9. An Entrant’s entry must not be:
a) late;
b) delayed;
c) incomplete;
d) incomprehensible;
e) unlawful;
f) obscene;
g) defamatory;
h) libellous;
i) threatening;
j) pornographic;
k) harassing;
l) hateful;
m) racially or ethnically offensive;
n) capable of encouraging conduct that would be considered a criminal offence;
o) capable of violating any law; and/or
p) capable of giving rise to civil liability.
10. Entry to the Promotion is limited to 1 entry per customer.
11. Entrants must ensure that their entries are received by the Promoter during the Promotion Period. All entries are deemed to be received at the time of receipt by the Promoter, not the time of transmission by the Entrant. The Promoter takes no responsibility for late or lost entries.
12. Should an Entrant’s contact details change at any time between the date on which they enter the Promotion and the Unclaimed Prize Determination Date, that Entrant must notify the Promoter of their correct contact details immediately.
13. The Promoter may decide in its sole discretion which documents are considered suitable for establishing eligibility to enter or win. In the event that a Winner cannot provide suitable proof of eligibility, the Winner will forfeit their Prize in whole and no substitute or compensation will be offered.
14. Any entry that is made on behalf of an Entrant by a third party, or otherwise by proxy, will be invalid.
15. The Promoter may, at its absolute discretion, declare any or all entries made by an Entrant to be invalid if the Entrant:
a) Fails to establish their entitlement to win the Promotion to the Promoter’s satisfaction; or
b) Appears, to the Promoter, to have tampered with, or benefited from tampering with, the entry process; or
c) Has submitted an entry that is not in accordance with these Terms and Conditions.
WINNERS
16. There will be one winner determined from all entries received during the Promotion Period. The Winner will receive a prize.
17. The Winner will be determined on the Determination Date by the Promoter at 56-58 Jephson Street, Toowong, QLD 4066. The Winner will be the Entrant who, in the sole opinion of the judges, have the most informative, creative and original answer.
18. The Promoter’s decisions are final and no correspondence will be entered into.
19. The Winners will be notified by phone and/or email within 2 business days of the Determination Date.
20. All reasonable attempts will be made to contact the Winners. Subject, where relevant, to any directions given under the legislation regulating the Promotion, if a Prize is:
a) not claimed by the Winner by 11:00hrs on the Unclaimed Prize Determination Date; or
b) forfeited for any reason, the Prize will be awarded to another Entrant in an unclaimed prize determination (the “Unclaimed Prize Determination”), which will take place at 11:00hrs on the Unclaimed Prize Determination Date and will be conducted by the Promoter at 56-58 Jephson St, Toowong, QLD, 4066. The Winner of the Unclaimed Prize Determination will be notified by telephone and/or email within 2 business days of the Unclaimed Prize Determination Date.
PRIZES
21. The prize is valued at a maximum of $3500 and consists of the following:
(i) Two (2) return economy airfares for people over 18 to the Destination, departing from one of Sydney, Brisbane, Melbourne, or Perth (whichever departure city is closest to the Eligible Client’s usual place of residence);
(ii) Twin share accommodation at the Destination
(iii) Ground transfers by hotel shuttle or car between the airport and the accommodation at the Destination; and
(iv) Other inclusions specified in the table below

* Accommodation and other inclusions are indicative only and subject to change. The specified accommodation and inclusions may be substituted by Ignite Travel Pty Ltd for accommodation and other inclusions of a similar quality.
22. The Prize does NOT include:
(i) ground transfers or domestic flights within Australia;
(ii) meals (other than those specified in clause 21 (above);
(iii) hotel incidentals including any room service or telephone charges;
(iv) travel insurance;
(v) any visa or passport related costs;
(vi) excess baggage charges;
(vii) fees resulting from booking changes or cancellations;
(viii) costs resulting from any extension of your holiday in the chosen destination, if permitted by Ignite Travel Pty Ltd or Ignite Holidays Pty Ltd (together “Ignite Travel”);
(ix) surcharges applied by Ignite Travel for travel in school holidays or peak travel periods; and
(x) any other costs or items not specified in clause 2(a) above.
23. The Prize must be taken as stated and cannot be varied. A prize, or any unused portion of the prize:
(i) is non-refundable and non-negotiable; and
(ii) cannot be exchanged, taken or redeemed as cash or sold.
24. Prize trip booking
(a) The Prize is offered through an arrangement with Ignite Travel Pty Ltd (Ignite Travel) and is valid for travel between 01 August 2018 and 01 March 2019.
(b) The winner will be provided with a voucher for the prize, which they will be able to use to arrange the Prize trip with Ignite Travel before the voucher expiry date stated on the voucher (31st October 2018).
(c) Ignite Travel’s terms and conditions apply to all bookings and surcharges may be charged by Ignite Travel in respect of bookings made during school holidays and peak travel periods. Any booking changes or cancellations will incur fees which the Eligible Client will be responsible for.
(d) You acknowledge that Discount Drug Stores does not have any responsibility to assist the winner to arrange the prize trip. Responsibility to book and redeem the prize trip through Ignite Travel before the voucher expiry date lies solely with the Winner.
Exclusion of liability
(a) You acknowledge that:
(i) Discount Drug Stores has made a Win a Trip for 2 to Thailand package Offer to you as one if its valued customers; and
(ii) any supply of a Reward Trip is directly between you and Ignite Travel.
(b) It is your responsibility to ensure that you have a valid passport, any visa you require and sufficient funds to allow you to cover any expenses not listed as inclusions in clause 2(a), including travel insurance if desired.
(c) You acknowledge and agree that to the maximum extent permitted by law, Discount Drug Stores, their related bodies corporate and each of their officers, employees, directors and contractors are not liable for any injury, loss, damage, expense, tax consequence, cost or claim whatsoever (including for any indirect or consequential loss) that arises in connection with you claiming, booking or using the Prize Trip, including without limitation:
(i) in the participation in or use of the Prize Trip;
(ii) as a result of any changes to or lack of availability of the Prize Trip;
(iii) as a result of any act or omission of Ignite Travel or the Winner in relation to the booking of the Prize Trip; and
(iv) as a result of any other act of omission of Ignite Travel.
26. All Prize maximum values are correct as of Tuesday 7th August 2018 and are reflective of the recommended retail price and are in Australian dollars. The Promoter takes no responsibility for any variations in the Prize values.
27. If the Prize is unavailable for any reason, the Promoter will, in its absolute discretion, substitute alternative goods or services of no lesser retail value and/or specification. The Promoter accepts no liability or responsibility for any loss incurred by the Winner or any other party if the Prize (or any part of the Prize) is damaged for any reason.
28. The Prize cannot be refunded or exchanged.
29. Once the Prize has left the Promoter’s/Supplier’s premises, the Promoter and the Relevant Parties will not be responsible for any delay in delivery or loss or damage to the Prize.
30. If the Determination Date or Unclaimed Prize Determination Date is a public holiday, the determination will be conducted on the following business day.
31. The Prize will be awarded to the persons named in the winning entry.
GENERAL
32. The Promoter reserves the right to take any action necessary in its sole discretion at any time, subject to any direction given under State permit regulations.
33. These rules are Terms and Conditions and constitute the entire terms and conditions between the Entrant and the Promoter with respect to the Promotion and cannot be altered, modified, or amended.
34. All entries become the property of the Promoter.
PRIVACY
35. Your privacy is important to us. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. Entrants’ personal information will be collected by or on behalf of the Promoter to enable it to administer the Promotion, publicise its Winners, and send Entrants marketing information where Entrants have consented. Entrants’ personal information may be disclosed to marketing and communications agencies, Prize suppliers and Prize deliverers in order to conduct this Promotion. Personal information about Entrants may also be disclosed to the authorities responsible for the regulation of gaming and lotteries. Winners’ names will be published and retained as required by relevant legislation and as specified in these Terms and Conditions.
