AU 360 - TERMS AND CONDITIONS

1.   General
RSL Art Union (the “Art Union”) No AU360 (also known as “Draw AU360L”) (the “Art Union”, the “Draw”) is conducted by Returned & Services League (Queensland Branch) (RSL (Queensland Branch)) ABN 79 902 601 713 (“we”, “us” and “our”). The Art Union is conducted for the purposes of funding veteran welfare and support in Australia pursuant to the following permits QLD Licence No. 29819, ACT Permit No. R18/00135, Vic Permit No. 10463/18, NSW Permit No. GOCAU/2053 and SA Permit No. M13551.

These terms and conditions apply to all entries into and/or prizes awarded in the Art Union. The purchase of a ticket in the Art Union is deemed acceptance of these terms and conditions by the person whose name is either completed on the ticket or the person identified as the entrant in the Art Union (“Entrant”, “you” or “your”). Where a ticket in the Art Union is purchased as a gift for and/or on behalf of the Entrant, the purchaser of the ticket is deemed to be acting as an agent for the Entrant and the Entrant is deemed to have accepted these terms and conditions. On entering into and accepting these terms and conditions, you agree that the Art Union is a game of chance. The Entrant is deemed to have accepted the laws of Queensland apply to the conduct of the Art Union.

RSL (Queensland Branch) reserves the right to change these terms and conditions at any time without notice.

2.   Draw Details
RSL Art Union AU360 will be open from 12.01am am Australian Eastern Standard Time (AEST) on 3 October 2018 and will close at 8.00pm AEST on 13 November 2018 unless the maximum saleable quantity of tickets has first been exhausted (Draw period). The Art Union is licensed for 2,750,000 which may include a maximum of 577,500 bonus tickets in draw AU360. Open and close dates are subject to change without notice, please refer to www.rslartunion.com.au for up to date draw details.
The Draw will be conducted on 21 November 2018, at ANZAC House, 283 St Pauls Terrace, Fortitude Valley QLD 4006 at 10:00am by way of approved random number generator. The Draw will commence with the drawing of the major prize, followed by other prizes in descending order of value.

3.   Eligibility
Entry into the Art Union is open to Australian and some overseas residents who are at least 18 years old and are not the following ineligible persons:
a)   A member of the management committee of RSL (Queensland Branch), including the Board and Executive management;
b)   Employees of RSL (Queensland Branch) and its subsidiaries, including Mates4Mates Limited ABN 54 160 646 999;
c)   A family member of a person caught by paragraph (a) and (b) inclusive of spouses, de facto spouses, parents, step parents, siblings, step siblings, adopted siblings, children and adopted children;
(collectively, a), b) and c) are “Ineligible People”).


4.   Entry
(a)   To enter the Art Union, an eligible person must purchase or be gifted one or more tickets into the Art Union. Tickets and/or VIP Memberships be purchased through the following channels by:
i.   visiting the Art Union website;
ii.   visiting an Art Union open prize home;
iii.   contacting the Art Union call centre on 1300 775 847;
iv.   completing a printed mail order form;
v.   visiting an authorised RSL Art Union sales kiosk.

(b)   At the time of ticket purchase, all required details on the ticket order form, online purchase path or as requested by an Art Union sales agent must be correctly completed. To issue a ticket, the Art Union requires the following details:
i.   An individual, legal name (such as the name printed on Government Identification);
ii.   All requested details including, but not limited to, registered postal address, contact email address (where applicable), phone number and confirmation that the Entrant is over the age of 18.

5.   Tickets and Ticket Books
On receipt of payment, a ticket will be issued for inclusion in the Draw. The ticket will be issued in the name of the Entrant as determined by the name on the online Art Union account, the name detailed on the order form or the name of the gift recipient. For the avoidance of doubt, a ticket must include a single, legal name of a natural person. The default method of customer contact is email. Once a ticket is issued, the details associated with that ticket, including but not limited to, the Entrant’s name and address, cannot be amended or updated. When a winning ticket is drawn, the Entrant as named on the ticket will be declared the winner. Tickets cancelled between the Draw open and Draw close date or refunded for other reasons will be ineligible to win.

Tickets are numbered consecutively within the licensed ticket range however tickets within ticket books may not be consecutively numbered.

(a)   The following pricing applies to tickets in the Art Union other than the Golden Treasure:
$5 – 1 entry;
$10 book – 2 entries – one of which may win first prize, plus a $30,000.00 bonus gold bullion;
$20 book – 5 entries – one of which may win first prize, plus a $40,000.00 bonus gold bullion;
$30 book – 8 entries – one of which may win first prize, plus $55,000.00 bonus gold bullion;
$50 book – 13 entries – one of which may win first prize, plus $85,000.00 bonus gold bullion;
$75 book – 19 entries– one of which may win first prize, plus $105,000.00 bonus gold bullion;
$100 book – 25 entries– one of which may win first prize, plus $135,000.00 bonus gold bullion.

The maximum order that can be placed in one transaction is $1,000 consisting of 10 x $100 books.
(b)   The following pricing applies to the Golden Treasure draw:
$10 book – 1 entry;
$30 book - 4 entries – one of which may win first prize, plus a $50,000.00 bonus gold bullion;
$50 book – 7 entries – one of which may win first prize, plus $80000.00 bonus gold bullion;
$80 book – 11 entries – one of which may win first prize, plus $90,000.00 bonus gold bullion;
$100 book – 14 entries– one of which may win first prize, plus $100,000.00 bonus gold bullion;
$150 book – 21 entries– one of which may win first prize, plus $135,000.00 bonus gold bullion;

(c)   Ticket books must be purchased in a single transaction. Where a ticket within a ticket book is determined as the winning entry, the bonus gold is payable on the value of the ticket book purchased which contains the winning ticket. For the avoidance of doubt, where multiple ticket books are purchased, and a winning ticket is drawn from within one of the ticket books, the bonus gold payable is calculated based on the individual ticket book value that contains the winning ticket and not based on the combined total value of the ticket book purchases.

(d)   Tickets cannot be combined to form a book with gift tickets that are purchased in the same transaction. By way of example only, where an order is placed for one $5 ticket and one $5 gift ticket, these are independent transactions and do not form a $10 book of two entries eligible for $30,000 bonus gold bullion.

6.   Gift Tickets
Purchasers may purchase tickets as a gift for eligible individuals. To purchase gift tickets, the purchaser must provide the gift recipient’s first name, last name, registered postal address, phone number and confirm that the gift recipient is over the age of 18. The gift recipient as identified on the ticket, not the purchaser, will be the Entrant in the Draw. Where a ticket book is purchased as a gift, bonus gold is awarded to the gift recipient as the winner in the Draw.

Where a gift ticket purchaser is a VIP or Loyal Supporter, the purchaser will be entered into the subsidiary draws for those categories, not the gift recipient.

7.   Loyal Supporter Draw
Entry into the Loyal Supporter draw is automatically granted to a customer who has valid entries in three (3) or more Art Unions in the last twelve (12) months (one of which must be the current open Art Union, Draw AU360). Eligible customers who, at the time of draw open (3 October 2018), are active VIP members will also get automatic entry into the Loyal Supporter draw, to be drawn on 21 November 2018. Only one (1) entry per eligible customer will be included in this bonus draw. Additional tickets/entries are not available for this exclusive draw.

Two draw prizes consisting of a $5,000 travel voucher and $5,000 gold bullion is available for AU360.

Selling costs and market variations apply when selling gold bullion. Travel is issued in the form of a voucher in the name of the winner, is not transferrable or redeemable for cash and must be booked directly with our selected supplier, subject to our supplier’s terms and conditions available here.


8.   Art Union Account
An individual cannot hold more than one Art Union account. The changing of a customer name on an account is only permitted where sufficient evidence is provided of identity of account holder and authority where applicable. Tickets in the Draw will be issued with the Account holder as the named Entrant. Details associated with an account must be updated or amended by the account holder only, unless valid documentation is provided authorising an individual other than the account holder to do so.

9.   Payment
(a)   Tickets in the Art Union must be purchased in Australian dollars via the following payment methods:
1.   Cheques – make payable to RSL Art Union. All correspondence is to be directed to Locked Bag 4032, Fortitude Valley QLD 4006;
2.   Money orders – make payable to RSL Art Union. All correspondence is to be directed to Locked Bag 4032, Fortitude Valley QLD 4006;
3.   Cash – payable at the sales kiosk in the Prize Home only;
4.   Credit Card and Debit Card - Visa, Mastercard, AMEX and Diners;
5.   Direct Debit;
6.   PayPal.

(b)   Where an order for tickets is placed and payment tendered by cheque or direct debit, payment must be received by us four (4) business days in Brisbane prior to the close of the Draw period, before orders relating to these payment methods are processed. The funds must clear prior to the end of the Draw period. If an order to purchase tickets is received after the end of the Draw period, or the Draw is sold out or valid payment has not cleared in time, the order will be entered into the next Draw. Orders will be processed in Australian dollars and payments for Art Union tickets are not tax deductable. A ticket issued also acts as the payment receipt for an order.

(c)   The Art Union will allow refunds for orders placed in an open draw upon cancellation of tickets purchased. Refunds will be issued via the same method in which payment was originally received, except for cash as cash is banked and stored in a ‘wallet’ upon receipt. To withdraw from a wallet, contact our call centre on 1300 775 888. When a request is made to refund funds from a wallet, the entirety of the balance in the wallet must be withdrawn.

10.   Wallets
Where an order for tickets is placed by cash, a ‘wallet’ will be established that will store that value for future transactions. In circumstances where an amount of cash is received that does not directly correlate to an order value, the funds will be applied to the lower value tickets and the surplus will be stored in a wallet for future use until we are directed to apply these funds to a future order. When a request is made to refund funds from a wallet, the entirety of the balance in the wallet must be withdrawn.

11.   Prizes

The cost of security and maintaining the Prize is the responsibility of the winner from handover of the property to the winner or after 14 Days from day the winner of the Draw is decided, whichever occurs first. If there is a delay in handover beyond the scheduled handover date due to an act of delay by the winner, we will not be liable for costs associated with securing or maintaining the property after this time and we reserve the right to reimbursement from the winner for any additional costs and expenses incurred by us caused by any delay. On handover of the prize, the winner is responsible for the security, maintenance, insurance, electricity, gas, telecommunications, internet, and all other costs and expenses associated with the property.

(b)   Second Prize: $10,000 Gold Bullion.
(c)   Third Prize: $5,000 Gold Bullion.

Selling costs and market variations apply when selling gold bullion. Travel is issued in the form of a voucher in the name of the winner, is not transferrable or redeemable for cash and must be booked directly with our selected supplier, subject to our supplier’s terms and conditions.

12.   Prize Transfer and Handover
(a)   Entry into the Art Union Draw and transfer of the Prize to the winner is conditional on the winner receiving and accepting all prizes in as is, where is condition.
By entering this draw, all Entrants acknowledge that these terms and conditions provide adequate warning of eligibility requirements, alternative prize arrangements and afford a reasonable opportunity for the Entrant to seek their own independent legal advice prior to taking transfer of the prize. Where we are unable to deliver a prize due to natural disaster, fire, theft, destruction or other circumstances beyond its control as may arise from time to time, we may at our discretion offer to a winner a substitute prize of gold bullion to the value of the original prize in Australian Dollars.

(b)   Title Transfer
Prizes are not transferable, and we will only transfer prizes and title in any property to the winner named as the Entrant on the winning ticket. Any cost and expenses associated with the transfer from the prize winner’s name to another person is the sole responsibility of the winner. If a foreign Entrant is declared to be the winner of land in Australia, the Entrant may be required to obtain relevant approvals from the Australian government authority before we can transfer the property to the winner. We will use reasonable endeavours to assist in this request for approval subject to the costs of any necessary application to any Australian government authority being borne by the winner. RSL (Queensland) is not responsible for payments associated with the acquisition of land by a foreign person. The Entrant is required to promptly make such applications to relevant government authorities if required. Where approval is not obtained or not obtained within a reasonable time, as we reasonably determine in our absolute discretion, the Entrant agrees to accept a prize of equivalent value in accordance with legislative requirements for the conduct of the Art Union.

(c)   Unclaimed Prizes
Unclaimed prizes will be dealt in accordance with the combined legislative requirements for the conduct of the Art Union. In the event that a Prize remains unclaimed for one year following the date of Draw AU360, a redraw will be conducted on 22 November 2019 at ANZAC House, 283 St Pauls Terrace, Fortitude Valley 4006 at 10am by way of approved random number generator.

13.   Agents
The Art Union may, from time to time, engage with third party agents to assist with provisioning the sale of tickets and facilitating entries in the Art Union. The following third-party agents are authorised by RSL (Queensland Branch) and may receive the following commission for their contributions:
(a)   Advertiser Contributions – where ticket purchases are made through affiliated online advertisers, up to a maximum of 20% of the total value of the order;
(b)   Traders
i.   AIDA Direct Pty Ltd ABN 31 138 300 482 (www.aidagroup.com.au, (07) 5656 0404) – an estimated 4.7% of total gross proceeds of the appeal;
ii.   Global Interactive Pty Ltd ABN 70 099 460 81 (www.globalinteractive.com.au, (07) 5570 3337) – an estimated 2.3% of total gross proceeds of the appeal;
iii.   Chameleon Customer Contact Pty Ltd ABN 72 404 194 759 (www.chameleoncustoercontact.com.au, 0457 416 714) - an estimated 2.2% of total gross proceeds of the appeal;
iv.   Concentrix Services Pty Ltd CAN 166 171 991 (www.concentrix.com, 1300 288 808) - an estimated 2.6% of total gross proceeds of the appeal.

14.   PRIVACY AND COMMUNICATIONS
Your participation in the Art Union constitutes an invitation to RSL (Queensland Branch) to contact you in relation to, among other things, offering you tickets in future lotteries, matters relating to your ticket purchase and to notify you of the outcome of the Art Union. Please refer to www.rslartunion.com.au/PrivacyPolicy to view our Privacy Policy for information in relation to how we deal with your personal information. To purchase in the Art Union, you must supply at least one method of contact for ticket issuance and service messaging. RSL (Queensland Branch) reserves the right to send service related communications to you subject to our Privacy Policy regardless of your contact preference. These service related communications may include, by way of example only, updates to the rules relating to the Art Union, the delivery of tickets purchased, updates to our privacy policy and anything else required to fulfil your purchase from the Art Union. At any time, you may elect to opt out of marketing communications.

15.   DISCLAIMER
Any and all products, brand names, logos, images and/or trademarks as displayed or referred to on the Art Union website are owned by the respective trademark owners. RSL (Queensland Branch) does not warrant to have an affiliation with any trademark owner referenced on this website. RSL (Queensland Branch) uses all reasonable endeavours to ensure that information on this website is correct but we do not warrant the accuracy or completeness of the information provided and will not be held liable for any inaccuracy, omission, variation or error. Photographs and floor plans are for illustrative purposes only and may not be to scale or depict exact prize detail or size. Art Union themes and prizes do not necessarily reflect the views of RSL (Queensland Branch) or its staff. By purchasing a ticket in the Art Union, the Entrant agrees to the laws of Queensland to the conduct of the Art Union and these terms and conditions.

To the extent permitted by law, including pursuant to schedule 2 of the Competition and Consumer Act 2010 (Cth), being the Australian Consumer Law, RSL (Queensland Branch) shall not be liable for any loss or damage of whatsoever nature however occasioned to any person by, through or in connection with the Art Union (including but not limited to direct, indirect or consequential loss or damage or personal injury). RSL (Queensland Branch) will not be liable to a winner for any financial consequences (including but not limited to any taxation liability or levy that may accrue to the winner, impact upon eligibility for or receipt of any pension, benefit allowance, superannuation or similar entitlement) to the winner as a result of winning the prize.

16.   RSL ART UNION VIP CLUB - TERMS AND CONDITIONS
(a)   Acceptance
By becoming an RSL Art Union VIP member, it is deemed that the terms and conditions applicable to the Art Union and all other terms and conditions, including those for customer segment draws such as the Loyal Supporter draw, are accepted.

(b)   Eligibility
VIP membership is open to those eligible for entry in the Art Union, as outlined in the RSL Art Union Terms and Conditions. As a VIP member, you are automatically entered into each Art Union draw, including the exclusive VIP only Heroes draws, as well as bonus draws.

(c)   Payment
Where you elect to become a VIP member, your nominated account will be automatically debited at the scheduled open of each draw to the value of your nominated subscription amount. This will occur for each of the Art Unions, and the once a year Golden Treasure. Tickets in the Golden Treasure draw are a minimum of $10. In the event that your membership is a $5 multiple, your membership will be rounded to the nearest $10.
You may elect to stop automatic debits and cancel your VIP membership at any time by calling our Customer Service Team on the following numbers: AUS 1300 775 847 (1300 RSL VIP), NZ 0800 450 970, INT +61 7 3088 5878.

(d)   Commencement of VIP membership
VIP membership commences upon enrolling to join the Art Union VIP membership program.

(e)   VIP membership cancellation
Where four consecutive Art Union orders go unfulfilled due to declined payment attempts, we will cancel your VIP membership. To reactivate your membership please contact our Customer Service Team on the following numbers: AUS 1300 775 847 (1300 RSL VIP), NZ 0800 450 970, INT +61 7 3088 5878.

(f)   VIP membership suspension
You are entitled to suspend your VIP membership for up to 12 months. During a suspension period, you will not be classified as a VIP. Separate purchases made during a suspension period do not count as VIP additional purchases and do not count towards eligibility in subsidiary VIP only bonus draws and prizes.

17.   VIP Only Bonus Draw
VIP members who have a valid entry in the current Art Union draw AU360 will be automatically entered into the VIP Only Bonus Draw, to be drawn on 21 November 2018. Only one (1) entry per eligible VIP member will be included in this bonus draw. Additional tickets/entries are not available for this exclusive draw.

Two draw prizes each consisting of $10,000 Gold Bullion. Selling costs and market variations apply when selling gold bullion.

18.   VIP Update Your Details Draw
VIP Members who are recipients of a ‘request to update your details’ communication gain entry into the VIP Update Your Details Draw by updating payment or contact details between the open date of the current RSL Art Union Draw AU360 and the scheduled open date of the following Art Union AU361. Close date may change if the current lottery AU360 sell outs before the scheduled open date of the next lottery. Only one (1) entry per eligible VIP member will be included in this bonus draw. Additional tickets/entries are not available for this exclusive draw.
