Terms & Conditions for the “Alinta Energy Cricket Australia Giveaway Tickets” Competition (Competition)
Entrants to the Competition are taken to accept and agree to abide by these Terms and Conditions.
The Promoter of the Competition is Alinta Energy Retail Sales Pty Ltd (Alinta Energy) of Level 13, Grosvenor Place, 225 George Street, Sydney, NSW 2000. Phone: 02 9372 2600 (Promoter).
“Cricket Australia” is Cricket Australia (ABN 53 006 089 130) of 60 Jolimont Street, Jolimont, Victoria 3002.
This is a game of chance and skill plays no part in determining the winners.
The Competition commences at 09:00 (AEDT) on Thursday 20 December 2018 and closes at 10:00 (AEDT) on Friday 11 January 2019 (Competition Period).
Subject to clause 5 of these Terms and Conditions, entry into (and winning) this Competition is only open to individuals who are:
a resident of New South Wales;
aged eighteen (18) years or older as at the time of entry into the Competition; and
the account holder of an active residential or small business Alinta Energy electricity and/or gas account as at the date of the Draw,
(Eligible Entrant).
An Eligible Entrant excludes any:
employee or agent of the Promoter;
relative of an employee of the Promoter, being a spouse, parent, step-parent, sibling or child of that employee; or
Alinta Energy customer who has cancelled their Alinta Energy electricity and/or gas account or whose supply of electricity and/or gas has been cancelled by either the customer or Alinta Energy as at the date of the Draw.
To enter the Competition, Eligible Entrants must complete the online entry form and submit it no later than 10:00 (AEDT) on Friday 06 January 2019. Entries received after this time will automatically be deemed as invalid. The time of the entry will be the time the entry form is received by the Promoter’s database. The Promoter accepts no responsibility for late, lost or misdirected entries due to technical disruptions, network congestions or any other reason.
Only one entry is allowed per Eligible Entrant.
Eligible Entrants must provide a valid email address and/ or telephone number.
The draw will take place by random digital selection at 10:01 AEDT on Friday 06 January 2019 and the winners will be notified by email and/or phone as provided in the entry form (Draw).
The first valid eight (
entries drawn will receive a Gold double pass for the third Gillette ODI match between Australia and India at the MCG on 18 January 2019 (valued at $190 and allocated at the Promoter’s absolute discretion)
The next valid five (5) entries will receive a General Admission double pass for the third Gillette ODI match between Australia and India at the MCG on 18 January 2019 (valued at $60 and allocated at the Promoter’s absolute discretion) (Prize).
The total prize pool for this Promotion is valued at a maximum of AUD $1820.
The Prize is not transferrable and cannot be exchanged for cash.
The Promoter reserves the right, at any time, to request proof of the validity of entries and Eligible Entrants (including an entrant’s identity, age, place of residence or relationship to an employee of the Promoter) to claim a Prize and to disqualify any entrant who submits an entry form that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
The Promoter will endeavour to notify the winners by email or telephone within two (2) business days of the Draw. The Promoter accepts no responsibility for failure to notify a winner if that winner is not reasonably contactable. The Prize must be claimed within two (2) business days of the Draw. Any unclaimed Prizes remain the property of the Promoter or the prize supplier.
The Promoter’s decision regarding the Draw, determination of the winner and the conduct of the Competition is final and cannot be contested. No correspondence shall be entered into.
The Competition winners consent to the Promoter and Cricket Australia using their name, suburb, image and/or voice (including photograph, film and/or recording of the same) for publicity purposes without any remuneration.
The winners’ names will be listed on the Alinta Energy website as soon as reasonably practicable after the Draw.
In the case of any force majeure event or circumstance not reasonably within the control of the Promoter and which by the reasonable exercise of due diligence the Promoter is not reasonably able to prevent or overcome, the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion or value or type of Prize, subject to any written direction from a relevant regulatory authority (“Force Majeure Event”). Without limiting the generality of the nature of those events, a Force Majeure Event includes any act of war, terrorism or natural disaster in Australia.
Winners accept all risks, responsibilities and restrictions associated with the acceptance and use of the Prize by themselves and anyone else. To the maximum extent permitted by law, the Promoter, Cricket Australia or any of their respective related bodies corporate or their respective officers, employees, agents or contractors do not accept or otherwise have any responsibility for any loss, damage, accident, death or injury resulting from or arising out of or in any way connected with the Competition. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 of Australia, as well as any other implied warranties or similar consumer protection laws in the States and Territories of Australia.
By entering the Competition, each entrant consents to their personal information (including name, address, telephone number and email address) being used for future marketing purposes in accordance with the terms and conditions of the Promoter’s privacy policy, which is available on Alinta Energy’s website at
www.alintaenergy.com.auCricket Australia reserves the right in its absolute discretion to change or amend the International Cricket fixture without notice. Neither the Promoter nor Cricket Australia accept responsibility for the cancellation or delay of any cricket match connected with this Promotion for any reason beyond the control of the Promoter or Cricket Australia.
By entering this promotion entrants agree to comply, and ensure that each subsequent ticket holder complies, with the ticket conditions which accompany any tickets won in conjunction with the promotion. Entrants also agree to comply, and ensure that each subsequent ticket holder complies, with Cricket Australia’s 2018/19 Ticket and Entry Conditions (available at
www.cricket.com.au/tickets) supplemented by conditions of entry imposed by the venue operator. The Promoter will provide every person attending the match as part of the promotion with a copy of Cricket Australia’s 2018/19 Ticket and Entry Conditions with delivery of the prize tickets.
If you have selected the option to receive information and offers from Cricket Australia, you understand and agree that Cricket Australia also collects your personal information, including on behalf of State or Territory cricket associations, including the Big Bash League teams (together, "Australian Cricket") to communicate with you, and for any of the purposes set out in Australian Cricket's Privacy Policy (available at

privacy@cricket.com.au), and that the personal information you provide will be disclosed to and used by Australian Cricket under the terms of Australian Cricket's Privacy Policy, which contains information about how you may access and seek to correct your personal information or complain about a breach of your privacy, and how Australian Cricket will deal with that complaint. Australian Cricket may disclose your personal information to other parties, including Australian Cricket's third party service providers. From time to time, these third parties may be located (and so your personal information may be disclosed) overseas, including in India, the USA and the UK, and other countries from time to time.
