1. Secure Parking is the promoter (Promoter) of various marketing campaigns providing offers to existing
and new Club Secure Members as part of its Share the Offer Program (or STO Program).
2. Each Share the Offer Campaign is subject to these General Terms and Conditions and the terms and
conditions applicable to the relevant STO Campaign.
3. To be eligible to participate in a STO Campaign, Recipients must be a resident of Australia (18 years of
age or over).
4. If for any reason:
a. any aspect of a STO Campaign (including but not limited to Original Offers and Inviter
Rewards) is not able to be fulfilled/completed; or
b. the Recipient’s membership of Club Secure is terminated or rescinded,
the Recipient will not be entitled to receive the benefit of the relevant Original Offer or STO Reward (if any).
5. To receive the benefit of an Original Offer, a Recipient must:
a. complete the online Original Offer Acceptance Form (if an existing Club Secure Member); or
b. complete the online Offer Acceptance Form and be accepted as a Club Secure Member (if not
a member at the time an Original Offer is received).
6. Where an STO Campaign provides for Inviter Rewards, an Inviter and where an Invitee completes the
online Offer Acceptance Form and Original Offer Invite Form, an Invitee, will both be eligible for Inviter
Rewards promotions subject to the terms and conditions of the relevant STO Campaign and STO
Reward promotions available on the Secure Parking website.
7. In respect of any Invitation for the Original Offer submitted by the Inviter pursuant to an STO Campaign,
the Inviter represents, warrants and confirms that:
a. the Inviter has provided its consent, via an online invitation, to receive an Original Offer from
the Promoter;
b. the use of personal data by the Promoter is consistent with the consent which the Inviter has
provided;
c. the data provided by the Inviter is correct and up-to-date;
d. it acknowledges and agrees that any sharing of the Original Offer to a Invitee is an invitation
by the Inviter and not the Promoter ; and
e. the Inviter shall indemnify the Promoter for any loss, damage or liability suffered or incurred by
the Promoter arising from or in relation to the breach of any of this clause by the Inviter.
8. Without limiting any other provision of these General Terms and Conditions or the terms and conditions
of an STO Campaign or STO Rewards promotion, Inviters will only be eligible to receive a STO Reward
applicable to a STO Campaign:
a. if the Invitee submitted by the Inviter is not an existin
14. The Promoter reserves the right, at its sole discretion, to vary or cancel, terminate or suspend the STO
Program, any STO Campaign or any STO Reward or other benefit or promotion in connection with the
STO Program at any time without prior notice. Should any dispute arise, the decision of the Promoter
shall be final.
15. Employees of the Promoter, its related entities or consultants as well as their Immediate Families and
friends, are ineligible to participant in this Campaign.
16. To the extent permitted by law the Promoter and its employees and agents will not be liable for:
a. personal injury, death, damage to or loss of property, financial loss, lost profit, or loss of
opportunity or other economic loss arising from the act or omission of any person in the
delivery, supply or use of the Original Offer or STO Reward and whether the act or omission is
deliberate, reckless, negligent or otherwise constitutes a tort, breaches any statutory duty or
any contract;
b. any failure by any third party (including any sponsor or the supplier of any Original Offer or
STO Reward) to provide an Original Offer or STO Reward or to provide it as promised as a
result of bankruptcy or entry into any other form of administration in insolvency;
c. any defect in any Original Offer or STO Reward;
d. the consequences of late or misdirected mail, including but not limited to the consequence that
you may not actually receive notice that you have received an Original Offer or STO Reward;
e. the consequences of any fraud or cheating of any entrant or third person;
f. loss of any kind caused by any event outside our reasonable control of, including but not
limited to strikes and other industrial action, wars, acts of terrorism, natural disaster, inclement
weather and acts of God; or
g. any tax liability incurred as a result of receiving an Offer, STO Reward or other benefit as a
result of participating in the STO Program or a STO Campaign. You must obtain independent
tax and financial advice.
17. By participating in an STO Campaign and providing their Personal Information each Invitee and Inviter
consents to receiving electronic newsletters from the Promoter and materials about the Promoter’s
services.
18. The Promoter offers the STO Campaigns and all Offers, STO Rewards and benefits in connection with
the STO Program as trustee for the Secure Kings Unit Trust and in no other capacity. Any liability of the
Promoter arising under or in connection with this Campaign is limited to the amount the Promoter is
entitled to and actually receives in the exercise of its right of indemnity from the property of the Trust.
19. The Promoter may not be sued in any capacity other than as trustee for the Trust, including seeking the
appointment of a receiver (except in relation to the property of the Trust), a liquidator, an administrator
or any similar person to the Promoter or provide in any liquidation, administration or arrangement of or
affecting the Promoter (except in relation to the property of the Trust).
20. If a participant in an STO Campaign tampers with, or subverts, the processes relating to participation in
the STO Campaign, or may benefit from such tampering or subversion by any other person, the
Promoter reserves the right in its sole discretion to disqualify that participant.
21. Nothing in these conditions varies any terms or conditions applicable to the supply of goods or services
by us.
22. All entries of participants in an STO Campaign become the property of the Promoter. The Promoter’s
decision is final and no correspondence will be entered into.
23. Details from all entries will be collected and used for the purposes of conducting the STO Program
(which may include disclosure to third parties for the purpose of processing and conducting the STO
Program) and for publicity purposes surrounding the STO Program promotion. By entering any STO
Campaign participants consent to receive future marketing material from Secure Parking Pty Ltd,
including an email confirmation.
24. All participants in an STO Campaign will automatically be entered into Club Secure database. A
member can opt-out of the program at any time by email by clicking the unsubscribe link included in any
Club Secure email. By entering an STO Campaign participants agree to all the terms and conditions of
membership for Club Secure. A full set of membership terms and conditions of Club Secure
membership is available at
www.secureparking.com.au. Participants may also be subscribed to receive
offers from Secure Parking partners.
25. In these Terms and Conditions, The following words and expressions will have the meaning attributed to
them (unless the context otherwise requires):
a. “Club Secure” means Secure Parking’s customer database.
b. “Club Secure Member” means a customer that has an active record (with email address as
identifier) on the Club Secure database.
c. “GST” means the tax imposed or assessed by the GST Act and its related legislation and
includes any similar or substitute impost introduced in the future and, where used in the context
of GST, the phrases ‘consideration’, ‘input tax credit’ and ‘taxable supply’ have the respective
meanings given to those terms by the GST Act.
d. “Immediate Family” means spouse, de-facto spouse, parent, natural or adopted child or
sibling and whether living in the same household or otherwise.
e. “Invitee” means an individual that has received an Invitation for the Original Offer from an
Inviter.
f. “Invitee Registration Page” is the page specific to an STO Campaign where an Invitee
completes the Offer Acceptance Form.
g. “Inviter Registration Page” is the page specific to an STO Campaign where an Inviter
completes the Offer Acceptance Form.
h. “Inviter” means an individual that has sent an Invitation for the Original Offer to an Invitee.
i. “Invitation for the Original Offer” means an invitation to obtain the Original Offer that is
automatically generated when an Inviter submits Invitee details using the Original Offer Invite
Form.
j. “Inviter Rewards” mean the reward and/or benefit that is available to an Inviter when one of
their Invitees is successfully added to Secure Parking’s Club Secure database. An Inviter will
not be eligible to receive Inviter Rewards if an Invitee that is an existing Club Secure Members
completes the Original Offer Acceptance Form. The specific terms and conditions for the STO
Reward for each STO Campaign is available on the Secure Parking Website.
k. “IP Address” means a logical numeric address that is assigned to every single computer,
printer, switch, router or any other device that is part of a TCP/IP-based network
l. “Offer Acceptance Form” means the online form on the Invitee Registration Page that is
specific to an STO Campaign that an Invitee must complete in order to receive the Original
Offer. As part of the process of completing the Offer Acceptance Form, the Invitee must
consent to agree to receive future marketing activity.
m. “Original Offer” means an offer or benefit that can be obtained by an Inviter or Invitee as part
of an STO Campaign.
n. “Original Offer Acceptance Form” means the online form on the Inviter Registration Page
that is specific to an STO Program that an Inviter must complete in order to receive the Original
Offer.
o. “Original Offer Invite Form” means the form that an Inviter uses to enter and submit Invitee
details for the purposes of issuing an Invitation for the Original Offer to an Invitee from the
Inviter.
p. “Personal Information” means first name, email address and state of residence.
q. “Recipient” means the recipient of an Original Offer or Invitation for the Original Offer.
“Secure Parking” means Secure Parking Pty Ltd as Trustee for Secure Kings Unit Trust (ABN
31 669 236 037).
r. Secure Parking Website – means the Secure Parking website available online at
http://www.secureparking.com.au.
s. “Share the Offer Program” or “STO Program” means the overall program for the facilitation of
Member get Member Campaigns (STO Campaigns).
t. “Share the Offer Campaign” or “STO Campaign” means an individual STO Campaign in
which the terms and conditions which are unique to a specific STO Campaign may differ from
other STO Campaigns.
u. “STO Rewards” has the meaning given in the STO Rewards terms and conditions associated
with the relevant STO Campaign.
